ACTION:  Adopt a resolution authorizing the City Manager to sign the City of Tempe-Arizona State 
Historic Preservation Office Programmatic Agreement regarding Department of Housing and Urban 
Development-funded projects. (Resolution No. R2026.31)

BACKGROUND INFORMATION:  In collaboration with the Arizona State Historic Preservation Office 
(SHPO), the City of Tempe (City) Historic Preservation Office (HPO) has drafted a programmatic 
agreement (PA) pertaining to program activities funded by the U.S. Department of Housing and Urban 
Development (HUD). The purpose of the PA is to assist in identifying, facilitating, and streamlining 
consultations associated with Section 106 of the National Historic Preservation Act of 1966 required for 
HUD-funded programs and program activities that qualify as federal undertakings. This PA shall be 
especially useful, since HUD has typically called upon the City to act as Responsible Entity (RE) for 
programs and program activities within Tempe for which HUD has provided federal funding, including 
Community Development Block Grant (CDBG), CHOICE Neighborhood, HOME funds, and Public 
Housing Authority Operating and Capital Funds. The City HPO and SHPO have reviewed the draft PA 
and find this document to be adequate and in compliance with federal and state guidelines and 
standards.
The HPO initiated a 30-day consultation period on December 1, 2025, with Affiliated Tribes, SHPO, and 
Arizona State Museum, requesting feedback on the draft PA. The HPO received five responses and 
incorporated input, when possible, into a revised draft PA. 
Tempe City Council approved an earlier version of the PA via Resolution No. R2026.16 on February 5, 
2026. SHPO subsequently identified some errors in the PA upon a third review that, according to the 
Tempe City Attorney, will require the Council to pass another resolution authorizing the City Manager to 
sign the revised agreement. If and when the City Council passes the resolution adopting the revised PA, 
the HPO will initiate a final round of required Section 106 consultation to secure the signatures of Tribes 
and agencies who wish to be included as concurring parties to the PA. Agencies and Tribes that do not 
sign onto the PA will still receive consultation mandated under the PA unless they request otherwise.
Once the 30-day consultation period concludes, the HPO will forward the signed PA to the Advisory 
Council on Historic Preservation, a federal agency in Washington, DC, to “execute” the PA, which will 
put the PA into effect.
