RESOLUTION NO. R2026.31
A RESOLUTION OF THE MAYOR AND CITY COUNCIL 
OF THE CITY OF TEMPE, ARIZONA, REPEALING 
RESOLUTION NO. R2026.16 AND AUTHORIZING THE 
CITY MANAGER TO EXECUTE THE CITY OF TEMPE-
ARIZONA STATE HISTORIC PRESERVATION OFFICE 
PROGRAMMATIC 
AGREEMENT 
REGARDING 
DEPARTMENT 
OF 
HOUSING 
AND 
URBAN 
DEVELOPMENT-FUNDED PROJECTS.
WHEREAS, the City of Tempe (City) receives Federal funding administered by the U.S. 
Department of Housing and Urban Development (HUD) (e.g., Community Development Block 
Grant (CDBG), CHOICE Neighborhood, HOME funds, and Public Housing Authority Operating 
and Capital Funds, etc.) that are used for various programs and program activities (“Programs” or 
“Program Activities”; and 
WHEREAS, the HUD-funded Programs and Program Activities qualify as a federal 
undertaking subject to the provisions of Section 106 of the National Historic Preservation Act 
(NHPA), 54 U.S.C. § 306108, and a Programmatic Agreement will provide a program alternative 
for HUD to fulfill its Section 106 responsibilities through the City’s consultation with the Arizona 
State Historic Preservation Officer (SHPO), and serves as the vehicle for resolving adverse effects 
to historic properties that may result from the implementation of these Federal Programs; and
WHEREAS, a programmatic agreement with the State Historic Preservation Office will 
assist the City in carrying out historic preservation for projects receiving federal funding;
WHEREAS, on February 5, 2026, Resolution No. R2026.16 authorized the City Manager 
to sign a prior version of the Programmatic Agreement for which the SHPO requested additional 
revisions; and
WHEREAS, it is in the best interests of the City to approve the revised Programmatic 
Agreement containing mutually agreeable changes;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF 
TEMPE, ARIZONA, as follows:
Section 1: Resolution No. R2026.16 is hereby repealed.
Section 2:  The City Manager is authorized to execute the revised City of Tempe-State 
Historic Preservation Office Programmatic Agreement regarding Department of Housing and 
Urban Development-funded projects.

Section 3:  The City Manager or designee is authorized to execute such further documents 
and take such further actions as are necessary to carry out the purposes of this Resolution.

ARIZONA, this 26th day of March, 2026.
