ACTION:  QUASI-JUDICIAL ITEM / PUBLIC HEARING ITEM Hold a public hearing for an Appeal of 
the Development Review Commission's decision to approve a Use Permit to allow a massage 
establishment for MASSAGE ACES, located at 1761 East Warner Road. The appellant is Matt Smith. 
The original applicant is Yinyu Shi, LLC.
FISCAL IMPACT:  None
RECOMMENDATION:  None
 
BACKGROUND INFORMATION:  On December 9, 2025, the Development Review Commission 
approved a Use Permit for MASSAGE ACES (PL250382) to allow a Massage Establishment. The 
request included the following: ZUP250108 Use Permit to allow a Massage Establishment in the PCC-
1 zoning district.
In December 23, 2025, a petition was filed by Matt Smith to appeal the decision of the Development 
Review Commission. The appellant's submitted letter of explanation, a petition signed by neighbors, 
and original case documentation is provided for reference to this appeal. This request includes the 
following: 
ZUPA250005 Appeal of the Development Review Commission’s decision to approve a Use Permit 
(ZUP250108) for a massage establishment in the PCC-1 zoning district.
