JOB ORDER CONTRACT 
FOR 
 
GENERAL CONSTRUCTION 
 
ADDENDUM NO. 3 
TO CONTRACT C2024-28 
 
 
This Addendum made and entered into on the 26th day of March 2026, by and between the City of 
Tempe, an Arizona municipal corporation (“City”), and Caliente Construction, Inc., an Arizona corporation 
(“JOC”), amends the original Contract made and entered into by and between the same parties on 
February 1, 2024, (C2024-28); along with that certain Addendum No. 1 entered into on January 22, 2025, 
Amendment No. 1 entered into on September 2, 2025 and Addendum No. 2 on January 7, 2026, 
(collectively “Contract”). 
R E C I T A L S: 
A. 
The parties hereto entered into that Contract for General Construction that has proven to be 
an efficient and cost-effective method for City projects, and City requires ongoing support 
services from JOC. 
B. 
The parties desire to further define their respective rights and obligations with respect to the 
Contract price and Job Order price. 
C. 
The parties intend that the following sections shall be integrated into the Contract in place of 
the former similarly identified section, if any, and that this Addendum be given the full force 
and effect of law as the Contract. 
 
Now therefore, in consideration of the mutual promises and covenants as more particularly set 
forth 
below, 
the 
parties

amend 
the 
Contract 
to 
read 
as 
follows:

1. 
Contract Price.  The maximum Contract Price shall be increased by $10,000,000.00.  The 
contract price shall not exceed $20,000,000.00. 
2. 
Job Order Price.  The maximum for each Job Order under this Contract shall be increased 
by $1,000,000.00.  In no event will any Job Order exceed $3,000,000.00. 
3. 
All other provisions of the original Contract where not inconsistent with this Addendum 
shall remain binding on the parties hereto.
