          ORDINANCE NO. O2026.10
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TEMPE, 
ARIZONA, AMENDING THE CITY OF TEMPE ZONING MAP, PURSUANT 
TO THE PROVISIONS OF THE TEMPE ZONING AND DEVELOPMENT 
CODE PART 2, CHAPTER 1, SECTION 2-106 AND 2-107, RELATING TO 
THE LOCATION AND BOUNDARIES OF DISTRICTS; AND AMENDING 
THE TEMPE ZONING AND DEVELOPMENT CODE, PART 5 – OVERLAY 
ZONING DISTRICTS, CHAPTER 7 – ASU ATHLETIC FACILITIES 
DISTRICT PLANNING (AFDPA) OVERLAY, SECTIONS 5-701, 5-702 
AND 5-706, ADDING APPROXIMATELY 5.5 ACRES TO THE OVERLAY.
WHEREAS, the City of Tempe has received an application for a change to the zoning map 
amendment and a code text amendment in relation to approximately 5 ½ acres of property located 
at the northwest corner of Rio Salado Parkway and Rural Road; and
WHEREAS, the Community Development Director has reviewed the application and 
determined it to be administratively complete; and
WHEREAS, the Council has received a recommendation of approval from the Joint  
Review Committee; and
WHEREAS, the Council finds that:
1) The proposed zoning map amendment is in the public interest;
2) The proposed zoning map amendment conforms with the general plan land use and 
residential density map, and implements certain goals and objectives of the general plan;
3) The proposed zoning map amendment and incorporation of the ASU Athletic Facilities 
District Planning Overlay is compatible with the surrounding land uses, zoning designations and 
development standards; and 
4) The proposed zoning map amendment and overlay code text amendment mitigates 
impacts on land use, water infrastructure, utilities or transportation.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY 
OF TEMPE, ARIZONA, as follows:
SECTION 1.  That the City of Tempe Zoning Map is hereby amended, pursuant to the 
provisions of Zoning and Development Code, Part 2, Chapter 1, Sections 2-106 and 2-107,

by removing the existing Planned Area Development (PAD) Overlay from the below described 
property located in the MU-Ed District and within the RSOD (Rio Salado Overlay District), and 
adding the AFDPA (Athletic Facilities District Planning Area) Overlay and designating it as 
MU-Ed (RSOD)(AFDPA) on 5.498 acres.
LEGAL DESCRIPTION
Lot 2, “MARINA HEIGHTS”, according to the plat of record in the Office of the County 
Recorder, Maricopa County, Arizona, as recorded in Book 1324 of maps, Page 1.
 
TOTAL AREA IS 5.498 GROSS ACRES.
SECTION 2.  Further, those conditions of approval set forth in Community 
Development Case # PL50449 are hereby expressly incorporated into and adopted as part 
of this ordinance as follows:
1.
The property owner(s) shall sign a waiver of rights and remedies form.  By signing the 
form, the Owner(s) voluntarily waive(s) any right to claim compensation for diminution of 
Property value under A.R.S. §12-1134 that may now or in the future exist, as a result of 
the City’s approval of this Application, including any conditions, stipulations and/or 
modifications imposed as a condition of approval.  The signed form shall be submitted to 
the Community Development Department no later than 30 days from the date of City 
Council approval, or the Zoning Map Amendment and General Plan Map Amendment 
approval shall be null and void.
SECTION 3. That Subsection A of Section 5-701 of the Tempe Zoning and 
Development Code is hereby amended as follows:
A.
Purpose and Applicability. The general purpose of the AFDPA is to 
encourage appropriate development and redevelopment for transforming an 
approximate 281.5 276 acre land area generally located between ASU and 
Tempe Town Lake into a mixed-use urban community with athletic fields and 
facilities. 
SECTION 4. That Section 5-702 of the Tempe Zoning and Development Code is 
hereby amended to read as follows:
1.
The location and boundaries of the AFDPA are established as shown on the map titled 
“Zoning map, City of Tempe” dated [December 20, 2018, Ordinance No. O2018.74] 
"ZONING AND OVERLAY DISTRICTS MAP".

SECTION 5. That Figure 5-706A. and Table 5-706B. of Section 5-706 of the 
Tempe Zoning and Development Code is hereby amended to read as follows:
Section 5-706 Development Standards.
The development of AFDPA commercial uses, AFDPA residential uses, and mixed uses 
within the AFDPA shall be in conformance with the land use parameters specified within 
Table 5-706B and the development standards specified by Table 5-706C.

SECTION 6.  Pursuant to A.R.S. § 9-462.01(J), the City Council has considered 
a housing impact statement regarding the impact of the zoning ordinance text 
amendment.
SECTION 7.  All ordinances and parts of ordinances in conflict with the provisions 
of the Code adopted herein are hereby repealed.
SECTION 8.  If any section, subsection, sentence, clause, phrase or portion of this 
ordinance or any part of the Code adopted herein by reference is for any reason held to 
be invalid or unconstitutional, such decision shall not affect the validity of the remaining 
portions thereof.
SECTION 9.  The City Clerk is hereby authorized to correct clerical and 
grammatical errors, if any, related to this ordinance, and to make formatting changes 
appropriate for purposes of clarity, form, or consistency with the Tempe City Code.
SECTION 10.  The various City officers and employees are hereby authorized and 
directed to perform all acts necessary to give effect to this ordinance.
SECTION 11. Pursuant to City Charter, Section 2.12, ordinances are effective 
thirty (30) days after adoption.
