O2026.09 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TEMPE, ARIZONA, AMENDING CHAPTER 2, TEMPE CITY CODE, RELATING TO ADMINISTRATION, BY AMENDING ARTICLE V, RELATING TO BOARDS; COMMISSIONS, ETC., BY AMENDING DIVISION 10, RELATING TO THE COMMISSION ON DISABILITY CONCERNS, BY AMENDING SECTION 2-265 RELATING TO ESTABLISHED; COMPOSITION TO AMEND THE MAKEUP OF THE COMMISSION ON DISABILITY CONCERNS TO ADD YOUTH MEMBERS. WHEREAS, the Tempe City Council created the Commission on Disability Concerns to, among other things, advise and make recommendations to the Mayor and City Council, and to assist City departments and the City manager, in the establishment of policies, rules and regulations relating to compliance with federal and state disabilities legislation or regulations and on other disabilities concerns and issues as needed; and WHEREAS, the Tempe City Code currently sets the number of members on the Commission at nine (9) members; and WHEREAS, the current Commission believes that it is important to have youth members on the Commission who might be able to provide a different perspective from adult members and, therefore, voted to recommend to the City Council to amend the membership structure for the Commission to add such youth members; and WHEREAS, the Tempe City Council agrees that it is important to have on the Commission representation from members of the community who are under the age of eighteen on the commission; and WHEREAS, deleted text is noted in strikethrough and added text is noted in ALL CAPS. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF TEMPE, ARIZONA, as follows: Section 1. That Chapter 2, Article V, Division 10 of the Tempe City Code is hereby amended to read as follows: DIVISION 10. – COMMISSION ON DISABILITY CONCERNS Sec. 2-265. - Established; composition; YOUTH MEMBERS. (a) There is hereby established a Commission on Disability Concerns to be composed of nine (9) ADULT members AND UP TO TWO (2) YOUTH MEMBERS. Ordinance No. O2026.09 (b) TO SERVE AS A YOUTH MEMBER, THE YOUTH MUST BE A RESIDENT OF THE CITY AND BE BETWEEN FOURTEEN (14) AND EIGHTEEN (18) YEARS OLD AT THE TIME OF APPOINTMENT OR REAPPOINTMENT. THE TERM FOR YOUTH MEMBERS SHALL BEGIN ON SEPTEMBER 1ST OF EACH YEAR AND SHALL END ON MAY 31ST OF THE FOLLOWING YEAR. YOUTH MEMBERS MAY SERVE UP TO TWO (2) FULL ONE-YEAR TERMS. (b) (c)The City Manager or HER OR his designee shall designate a City staff representative to serve as IN AN advisory capacity for the Commission on Disability Concerns. . . . . Section 2. If any section, subsection, sentence clause, phrase, or portion of this ordinance or any part of the code adopted herein is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions thereof. Section 3. All ordinances and parts of ordinances in conflict with the provisions of the Code adopted herein are hereby repealed. Section 4. The City Clerk is hereby authorized to correct clerical and grammatical errors, if any, related to this ordinance, and to make formatting changes appropriate for purposes of clarity, form, or consistency with the Tempe City Code. Section 5. The various city officers and employees are hereby authorized and directed to perform all acts necessary to give effect to this ordinance. Section 6. Pursuant to City Charter, Section 2.12, ordinances are effective thirty (30) days after adoption.
