Project Summary: 
 
1. 
The applicant, Annmarie Beckett of Clear Blue Services, is requesting a special use permit (SUP) 
to accommodate a proposed wireless communication facility (WCF) on Parcel 401-38-006A. The 
subject parcel is currently vacant and comprises approximately 2.1 acres. The property is located 
at the northwest corner of Old US Highway 80 and the Cactus Rose Road alignment in the 
Arlington area. 
 
2. 
The legal description provided by the applicant identifies a site that is approximately 10,170 
square feet. This includes the main 2,500-square foot lease area (a 50’ x 50’ area bounded by an 
8’ CMU wall, within which the WCF will be located), as well as a proposed 20’-wide access/utility 
easement, a 5’-wide telco/fiber electrical easement, and an electrical transformer pad beside the 
access easement. The subject site would be leased to Vertical Bridge for telecommunications 
infrastructure and will be part of the larger 2.1-acre parcel.  
 
3. 
The subject WCF would be a maximum height of 199’ and have an antenna array diameter of 12’-
5”. The facility would remain unmanned with an occasional visit by one employee to oversee site 
maintenance as needed. Access to the WCF would be via 20’ wide easement from Old US 
Highway 80. One parking spot will be provided for the maintenance technician.

The subject property is zoned Rural-43. The applicable development standards for this district, as

The applicant is requesting to establish standards for height, setbacks from rural/residential 
zoning on adjacent parcels, antenna array diameter, pole base diameter, access road surfacing, 
and sight visibility triangles (SVT) that differ from the base development standards for WCFs in 
the Rural-43 zoning district. Whereas Section 1202.3 of the MCZO allows monopoles to a 
maximum height of 80’, the applicant is proposing to construct the monopole to a maximum 
height of 199’. (The tower itself will reach 195’, while the lightning rod and aircraft warning light 
will extend the total height to 199’. It is staff’s understanding this is the maximum height without 
triggering requirement for FAA safety lighting at the top of the structure, although one has been 
requested by Luke Air Force Base.) As there are no existing WCFs nearby, a tall monopole height 
was deemed necessary to maximize the reach of reliable service. When complete, the tower 
would serve a very remote area that is currently underserved by wireless service.

Likewise, the applicant is proposing to allow a maximum antenna array diameter of 13’, greater 
than the eight feet allowed per MCZO Section 1202.3. According to the applicant, this is due to 
the size of modern 5G antennas, which require sufficient separation beyond what the base 
development standards allow. Staff notes that the actual proposed antenna array diameter, as 
depicted in the site plan and attached elevations, is actually 12’-5”. Establishing a standard 
diameter of 13’ would give the applicant leeway if at a later date minor adjustments needed to be 
made to the antenna array that would slightly increase its diameter. In this scenario, only a minor 
amendment to the special use permit would be required, as opposed to a major amendment or a 
modification of conditions. 
 
7. 
Additionally, due to the taller height of the monopole and the desire to eventually accommodate 
multiple carriers (and their respective equipment), the applicant is proposing to allow a maximum 
tower diameter of 5’-9”, greater than the 2’-6” allowed by right. Such would ensure greater stability 
for the tower at its proposed height. 
 
8. 
The monopole would be located toward the center of the subject property. Even so, due to the 
proposed height of the tower and the limited dimensions of the property, meeting the required 
setback of two feet from each property line for each one foot in height was impossible. Therefore, 
the applicant is requesting to reduce the setback requirements to the extent necessary to support 
the tower in the approximate center of the property. Measured from the antenna array 
circumference line, as required, the tower would be located approximately 118’-9” from the north 
lot line, 135’-9” from the south lot line, 148’-10” from the east lot line, and 167’-2” from the west 
lot line. In the event the antenna array diameter is increased from 12’-5” to the maximum proposed 
standard of 13’, the proposed setback regulations are 118’-6” from the north lot line, 135’-6” from 
the south lot line, 148’-7” from the east lot line, and 166’-8” from the west lot line. 
 
9. 
Finally, due to the very limited number of trips that would be generated by the WCF (currently the 
only proposed use of the property), the applicant is proposing to modify the MCZO standards for 
access road surfacing and SVTs. Specifically, most of the access easement would not be paved, 
but would be surfaced with stabilized decomposed granite (DG). However, some portions – 
specifically that portion of the driveway within the Old US Highway 80 right-of-way and those 
portions of the easement that cross washes – will be paved with concrete as required or 
necessary. Due to the curvature of the proposed easement and the proximity of the driveway to 
the north property line, the required 25’ x 25’ SVTs will not be feasible. As such, the applicant is 
requesting that the SVT requirement be waived. Because generally no more than one 
maintenance vehicle will be accessing the site at a given time (and even then, generally no more 
than once a month), the applicant believes that the SVTs will not be needed to ensure the safety 
of said vehicles entering from and exiting the property onto Old US Highway 80. The low traffic 
volume along this route, the open and rural nature of the surrounding area, and the lack of nearby 
buildings, walls, and other visual obstructions, would further ensure the safety of entering and 
exiting vehicles.

Old US Highway 80 Area Plan (adopted May 2007): This plan identifies the subject parcel as a 
Large Lot Residential (1 – 2 d.u. / acre) land use. The Large Lot Residential category denotes 
areas where single-family residential development is desirable and urban services such as sewer, 
water, schools, parks, and fire and police protection may be only partially available or required as 
an improvement district. 
 
Public Participation Summary:

The applicant complied with the requirements of the citizen review process with the required 
posting of the site and notification by first class mail to interested parties and adjacent property 
owners within 300’ of the subject parcel. Two signs were posted onsite in accordance with 
applicable regulations. Staff received no letters in support or opposition to the request. 
 
15. 
Although the site is not located within the City of Buckeye Municipal Planning Area, Buckeye 
expressed no objections citing that there were no planned residential uses in proximity to the 
subject site. Nonetheless, the site is near the Buckeye Municipal Planning Area, which identifies 
the future land uses in the area as Agriculture and Open Space (including the Buckeye Hills 
Recreation Area). As such, Buckeye has requested that the tower be designed for co-location by 
multiple carriers to prevent need for a larger number of towers in the “natural, scenic area” 
surrounding the subject site. The applicant’s narrative confirms that the tower has been designed 
for co-location. 
 
16. 
Luke Air Force Base also sent comments regarding the request. Although the site is not located 
within the designated “territory in the vicinity of a military airport,” Luke’s Community Initiatives 
Team did acknowledge that the site is located within a low-level flying corridor between Luke 
itself and the Gila Bend Auxiliary Airfield. The results of an FAA Obstruction Evaluation/Airport

Airspace and Spectrum Analysis (OE/AAA) concluded that the WCF will not negatively impact the 
flying and base operations of Luke AFB. Nonetheless, due to the tower’s planned height and 
location, Luke has requested the installation of an aviation obstruction light (AOL) or aircraft 
warning light (ACWL) for operational awareness. Pursuant to this request, the top of the 
monopole was modified during the review to include such a light. 
 
Outstanding Concerns from Reviewing Agencies:

None except as noted above where Luke AFB has requested an ACWL. 
 
Staff Analysis: 
 
18. 
Staff supports the applicant’s request for a special use permit. The proposed WCF promises to 
provide needed wireless service in a remote area where such service is currently minimal or 
nonexistent. Even with low traffic volumes along the adjacent stretch of Old US Highway 80 
unlikely to increase significantly in the foreseeable future, adding a new cell tower in the proposed 
location would provide a useful and desirable service for drivers along this route, especially in the 
event of a roadside emergency. 
 
19. 
Staff likewise finds the requested development standards to be justified for the reasons provided 
in the applicant’s narrative and discussed in the project summary of this report. Allowing a 199’ 
co-locatable monopole (where a maximum height of 80’ is allowed by right) would enable a wider 
service area along the remote stretch of Old US Highway 80, which in turn would reduce the need 
for more cell towers in the vicinity. The very low population density of the surrounding area also 
reduces the visual impact of the tower. 
 
Recommendation: 
 
20. 
Staff recommends the Commission adopt a motion recommending that the Board of Supervisors 
approve Z2023046 subject to the following conditions ‘a’ – ‘j’: 
 
a. 
Development of the site shall be in substantial conformance with the site plan entitled 
“US-AZ-5151 GILA RIVER”, consisting of 18 full-size sheets, dated October 9, 2023, and 
stamped received October 9, 2023, except as modified by the following conditions. Staff 
may determine slight refinements to remain in substantial conformance with the approved 
site plan.  Minor and major amendments to the site plan will be determined in accordance 
with Chapter 3 of the Maricopa County Zoning Ordinance. 
 
b. 
Development of the site shall be in substantial conformance with the narrative report 
entitled “Project Narrative”, consisting of seven pages, dated October 5, 2023, and 
stamped received October 6, 2023, except as modified by the following conditions. 
 
c. 
The following Planning Engineering conditions shall apply: 
 
1. 
At the time of application for permit, the monopole foundation design shall 
address potential scour given existing topographic conditions and the pole’s 
proximity to a wash. 
 
2. 
The portion of the driveway access within the County right-of-way must be paved 
or concrete; and conform to MCDOT requirements. The driveway culvert must be 
constructed with headwalls or flared end sections at its up and downstream ends.

3. 
The gated driveway access must be designed with an onsite turnaround area so 
vehicles will not back out onto Old Hwy 80. 
 
4. 
The applicant may be required to execute a Wireless Agreement with the County 
(via the MCDOT Utility Branch – dotwirelesspermits@maricopa.gov) for all 
equipment, conduit, fiber optic lines and other work that will be within the MCDOT 
R/W. If required, the agreement must be effectuated prior to issuance of any 
building permit(s). Otherwise, written confirmation from the County that an 
Agreement is not required must be submitted with the building permit submittal. 
 
5. 
A 15’ wide right-of-way preservation area along Old US 80 must be maintained. 
 
6. 
Engineering review of Special Use Permit cases is conceptual in nature. All 
development and engineering design shall be in conformance with Section 1205 
of the Maricopa County Zoning Ordinance; Drainage Policies and Standards; 
Floodplain Regulations for Maricopa County; MCDOT Roadway Design Manual; 
and current engineering policies, standards and best practices at the time of 
application for construction. 
 
d. 
The maximum height of the wireless communication facility shall be limited to 199’. 
 
e. 
Future requests to co-locate carriers on the wireless communication facility shall comply 
with Maricopa County and federal requirements. 
 
f. 
This special use permit is valid for a period of 30 years and shall expire on January 24, 
2054, or upon termination of the use for a period of 90 or more days, whichever occurs 
first. All site improvements associated with the special use permit shall be removed within 
90 days of such expiration or termination of use. 
 
g. 
The following SUP standards shall apply:

Noncompliance with any Maricopa County Regulation shall be grounds for initiating a 
revocation of this special use permit as set forth in the Maricopa County Zoning 
Ordinance. 
 
i. 
The granting of this change in use of the property has been at the request of the applicant, 
with the consent of the landowner.  The granting of this approval allows the property to 
enjoy uses in excess of those permitted by the zoning existing on the date of application, 
subject to conditions.  In the event of the failure to comply with any condition, and at the 
time of expiration of the special use permit, the property shall revert to the zoning that 
existed on the date of application.  It is, therefore, stipulated and agreed that either 
revocation due to the failure to comply with any conditions, or the expiration of the special 
use permit, does not reduce any rights that existed on the date of application to use, divide, 
sell or possess the property and that there would be no diminution in value of the property 
from the value it held on the date of application due to such revocation or expiration of 
the special use permit.  The special use permit enhances the value of the property above 
its value as of the date the special use permit is granted and reverting to the prior zoning 
results in the same value of the property as if the special use permit had never been 
granted. 
 
j. 
An Aviation Obstruction Light (AOL) or Aircraft Warning Light (ACWL) shall be installed 
near the top of the structure/attachments in accordance with Luke Air Force Base 
operational awareness requirements.

Purpose of Request: Vertical Bridge is requesting a Special Use Permit Review for a New Wireless 
Communications Facility. Per Maricopa County Zoning Ordinance Chapter 12 Development Regulations: Wireless 
communications facilities are permitted in all zoning districts subject to the provisions and standards outlined in 
Section 1202. Any proposed wireless communication facility that cannot meet the standards outlined in Article 
1202.3 of the Ordinance shall be required to obtain a Special Use Permit approval by the Board of Supervisors.

Description of Proposal: This SUP request is for a new 195’ monopole (collocatable) to be located in the 
approximate center of Parcel 401-38-006A. This parcel, zoned Rural-43, is currently vacant and located at the 
northwest corner of Old US Highway 80 and Cactus Rose Road in the Arlington area. 
 
Vertical Bridge has chosen this location for a new cell tower due to the lack of existing reliable cellular service in 
the surrounding area. As such, there are no other cell towers within 1,000’ of the proposed site. 
 
Vertical Bridge is proposing to install an antenna array toward the top of the monopole, with the center of the array 
mounted at 193’. This antenna array will measure 8’ from top to bottom and 12’-5” in diameter. A 4’ lightning rod 
will bring the total height of the WCF to 199’. All ground-mounted equipment, including a backup diesel generator, 
will be constructed on cement slabs and screened by an 8’ CMU wall measuring 50’ x 50’. All facilities, including 
the monopole and the CMU wall, will be painted, textured, and constructed to minimize visual impacts. Both the 
monopole and the wall will be painted in non-reflective, earth-tone light tan colors, generally matching the 
surrounding desert. Lighting will be in compliance with Section 1112 of the MCZO, will be limited to facing the 
compound maintenance area, and will only be used when the cellular technician is onsite. At the request of Luke 
Air Force Base, an Aviation Obstruction Light (AOL) or Aircraft Warning Light (ACWL) will be installed for 
operational awareness. The WCF will not negatively impact the flying and base operations at Luke. 
 
 
Relationship to Surrounding Properties: Both the site and the surrounding properties are currently vacant. The 
adjacent property to the west is owned by the Arizona State Land Department, while the property to the north is 
private land. Adjacent to the east and south of the site are MCDOT-maintained rights-of-way (Old US Highway 80 
to the east and Cactus Rose Road to the south). Across these rights-of-way are additional privately-owned 
properties. 
 
The site and surrounding properties are mostly open desert, with some farmland just beyond the Arlington Canal 
to the east of Old US Highway 80. The site is located within a very rural and sparsely populated area. The use of 
the site for a wireless communications facility will not cause any adverse impact on adjacent or nearby properties. 
As this will be an unmanned facility, maintenance will generally visit the site once a month, only visiting more often 
in case of emergency. As such, there will be minimal vehicular traffic (none on most days) and no pedestrian 
traffic generated by the site. Likewise, there will be no increase in emissions, dust, gas, noise, vibration, smoke, 
heat, or glare at a level exceeding ambient conditions. 
 
 
Location, Accessibility, and Circulation System: The site is located at the northwest corner of Old US Highway 
80 and Cactus Rose Road in the Arlington Area, approximately 15 miles west of Downtown Buckeye and 
approximately 50 miles west of Downtown Phoenix. Construction and maintenance personnel will access the site 
via Old US Highway 80. Vertical Bridge will construct a 20’ wide access easement that will meet Highway 80 at the 
northeast corner of the lot, crossing the eastern half of the parcel and terminating at the WCF equipment 
compound near the center of parcel. A single 15’ wide parking space will be provided at the end of the easement, 
adjacent to the compound, for maintenance personnel, which will visit the site generally no more than once a 
month, and only more often in case of emergency. 
 
Stabilized decomposed granite (gravel) will be proposed for this SUP. Since the technician will be visiting the site 
only once a month, the access path can be stabilized decomposed granite, although a concrete slab will be used 
where the access path crosses an existing wash.

Due to the access driveway’s proximity to the north property line, as well as the curvature of the proposed 
easement, the required 25’ x 25’ sight visibility triangle on either side of the driveway will not be feasible. 
Therefore, Vertical Bridge is requesting that the SVT requirement be waived with the Special Use Permit. Because 
generally no more than one maintenance vehicle will be accessing the site at a given time, and will only occur 
generally once a month, Vertical Bridge believes that the SVTs will not be needed to ensure the safety of said 
vehicles entering from and exiting the property onto Old US Highway 80. Additionally, the low traffic volume along 
Old US Highway 80, the open and rural nature of the surrounding area, and the lack of nearby buildings, walls, 
and other obstructions, will further ensure the safety of maintenance vehicles accessing and leaving the site. 
 
Development Schedule: Once the Special Use Permit has been approved and the required building permit(s) 
have been approved by Maricopa County Planning & Development, construction of the site (including the 
monopole, ground-mounted equipment, 8’ CMU wall, and access easement) is anticipated to take approximately 
60 days. 
 
Community Facilities and Services: The site is located within the Arlington Elementary School District, as well 
as the Buckeye Union High School District. The site is located 3.92 miles SE of Arlington Elementary School and 
2.82 miles NW of Powers Butte Wildlife Area. 
 
Public Utilities and Services: The telecommunications facility will not require water or sewer services onsite. 
Police protection will be provided by the Maricopa County Sherriff’s Office. Fire protection will be provided by the 
Buckeye Valley Fire District. 
 
SUP Comparison Chart: To accommodate the telecommunications facility proposed onsite, Vertical Bridge is 
requesting to modify some of the development standards of the Maricopa County Zoning Ordinance. Whereas 
Section 1202.3 of the MCZO allows monopoles to a max. height of 80’ in the Rural-43 zoning district, it was 
necessary to extend the height of the proposed monopole to 199’. When complete, the tower will serve a very 
remote area along a major arterial (Old US Highway 80) that is currently underserved by wireless service. As there 
are no existing wireless communication facilities nearby, a tall monopole height is necessary to maximize the 
reach of reliable service. Due to the coverage objectives of this site, as a 3-carrier pole, additional height is 
required. That is why it is necessary to build the monopole to a max. height of 199, instead of the 80’ allowed per 
Section 1202.3. The array is larger due to the size of the new 5G antennas to have the necessary separation 
between the antennas so it is necessary for the antenna array to have a diameter of 13’, instead of the max. 8’ 
allowed per the code. Due to the height of the monopole and the design to accommodate at least 3 carriers, the 
diameter of the pole needed to be increased to 5’ 8” as opposed to the Standard 2’ 6”, to safely accommodate 
multiple carriers this additional diameter is required.  
 
To maximize the facility’s setbacks from the property boundaries, it will be placed toward the center of the site. 
However, due to the dimensions of the property, meeting the requirement of having the facility setback at least 2’ 
from all property lines for each 1’ in height was infeasible. With a proposed height of 199’, the base regulations 
would require the facility to be setback at least 398’ from all property lines. Instead, the facility will be setback at 
least 118’-6” from the north lot line, 148’-10” from the east lot line (or 133’-10” from the ultimate right-of-way line 
for Old US Highway 80), 135’-9” from the south lot line, and 167’-2” from the west lot line. These setback 
standards are measured from the circumference line of the antenna array, and are based on the proposed 
standard of 13’ as the maximum antenna array diameter. The proposed modifications to the MCZO development 
standards are summarized in the table below:

The following is supplemental information required to be submitted and addressed in the narrative report for the 
Special Use Permit. 
 
1. What is the height of the proposed WCF?    199 feet   
 
2. Provide a map showing all the existing WCFs within a 1,000 feet radius for sites within Rural, Single-
Family Residential or Multiple-Family zoning districts (Regardless of provider). 
 
There are no existing towers within a 1000’ radius of the proposed site. Vertical Bridge needs this site location 
to improve local wireless service, as there are many blocked/dropped calls due to the weak signal in the 
surrounding area. The existing right-of-way power poles, light standards, and stop light pole have been 
thoroughly investigated by the major carrier Radio Frequency Engineers within the search ring area and do 
not work for the RF objectives in this area. 
 
3. Provide a list with locations and approximate height of all existing vertical structures (of a height 
approximately equal or greater than the requested tower) within the WCF’s search area. This includes 
church spires and steeples, light standards, water towers, transmission lines, buildings, or other 
similar structures. 
 
There are no other towers or vertical structures approaching or surpassing this height in the area. This will be 
a multi-carrier site designed to cover a wide, underserved area. 
 
4. Provide a map showing the service areas which the proposed facility will serve. 
 
 
 
5. Explain any attempts or possibilities that have been investigated relating to co-location with another 
provider or existing facility. 
 
As stated above, there are no existing towers of this height to offer coverage in the design area.

6. Explain how this request can facilitate co-location with other users. 
 
The overall height of the tower is designed to accommodate a minimum of three carriers to improve coverage 
in this area. 
 
7. Will the request involve the removal of mature trees or cacti? If so, discuss plans for relocation of 
such vegetation. 
 
No mature trees or cacti will need to be relocated for this project.

PND Engineering Plan Review (DPR, FCD and PND Transportation) has reviewed the 
2nd submittal of the Special Use Permit application routed for review on September 5, 
2023, and has no objections subject to the following conditions: 
 
1. At the time of application for permit, the monopole foundation design shall 
address potential scour given existing topographic conditions and the pole’s 
proximity to a wash. 
 
2. The portion of the driveway access within the County right-of-way must be paved 
or concrete; and conform to MCDOT requirements. The driveway culvert must be 
constructed with headwalls or flared end sections at its up and downstream ends. 
 
3. The gated driveway access must be designed with an onsite  turnaround area so 
vehicles will not back out onto Old Hwy 80. 
 
4. The applicant may be required to execute a Wireless Agreement with the County 
(via the MCDOT Utility Branch – dotwirelesspermits@maricopa.gov) for all 
equipment, conduit, fiber optic lines and other work that will be within the MCDOT 
R/W. If required, the agreement must be effectuated prior to issuance of any 
building permit(s). Otherwise, written confirmation from the County that an 
Agreement is not required must be submitted with the building permit submittal. 
 
5. A 15’ wide right-of-way preservation area along Old US 80 must be maintained.

6. Engineering review of Special Use Permit cases is conceptual in nature. All 
development and engineering design shall be in conformance with Section 1205 
of the Maricopa County Zoning Ordinance; Drainage Policies and Standards; 
Floodplain Regulations for Maricopa County; MCDOT Roadway Design Manual; 
and current engineering policies, standards and best practices at the time of 
application for construction.

The proposed 199’ cell tower is located west of Highway 80, just west of Buckeye’s Planning Area. The future land uses 
identified in the Buckeye General Plan for the surrounding area are Agriculture and Open Space (Buckeye Hills 
Recreation Area). Since there are no planned residential uses in near proximity to the tower site, the City doesn’t object 
to the proposal, though we would strongly recommend ensuring that the tower is designed for co-location by multiple 
carriers to prevent need for a larger number of towers in this natural, scenic area.  
 
I don’t believe we will need to attend the TAC meeting if you can pass along this suggestion.
