Project Summary: 
 
1. 
The applicant, Annmarie Beckett of Vertical Bridge, is request a SUP for a wireless communication 
facility (WCF) on a leased portion of APN 506-05-006F in the Rural-43 zoning district on US 
Highway 60 in the Aguila area. The WCF will feature a 110’ monopole within an 8’ CMU walled 
compound. 
 
2. 
The site is located between US Highway 60 to the south and an existing railway line to the north, 
just east of the denser part of the Aguila townsite. The existing use of the site is unclear, but 
records indicate two prior zoning cases in 1985 under Z85-184 which would have rezoned the site 
to IND-3 and later in 2003 under an unnumbered case. Staff research was unable to find approved 
entitlements or resolutions for either of these cases. Planning and Zoning Commission meeting 
notes regarding Z85-184 indicate that the case was to be held in abeyance to consider a IUPD 
zoning overlay as compared to straight IND-3 zoning. It was noted that the existing industrial use 
of the site at the time of hearing was legally non-conforming and that the rezone was not 
necessary to continue the existing mining usage. The discovery of the 2003 case was based upon 
a search of the parcel through the County’s PlanNet database. Further research was not able to 
uncover the outcome of this proposal and whether it was ultimately heard. However, the database 
records show the proposal as having been withdrawn and the site retains Rural-43 zoning. 
Historic site aerials indicate all current buildings having been in place by and since 1999. This 
WCF proposal would not appear to have an effect on the site usage.

Public Participation Summary:

The applicant complied with the Maricopa County public participation process with the required 
posting of the property and the notification to the adjacent property owners within 300’ of the 
subject site. Staff has not received any notice of opposition or support to the request. 
 
Outstanding Concerns from Reviewing Agencies:

Staff received comments from the Arizona Department of Transportation (ADOT) regarding an 
active encroachment permit for the existing turnout access to the property off US60. ADOT has 
requested that Maricopa County not issue any approvals until this process is approved. To that 
end, staff has included a condition that would require the applicant to provide proof of ADOT 
approval prior to any construction permit being issued. 
 
Staff Analysis:

Staff supports the proposed cell tower given the necessity of improving cellular services for the 
benefit of emergency responders and the public. The tower will be set several hundred feet away 
from neighboring residences. Staff believes that the requested deviations from the required Rural-
43 development standards are appropriate given the low impact of the cell tower use and lack of 
traffic generated. 
 
Recommendation: 
 
11. 
Staff recommends the Commission adopt a motion recommending that the Board of Supervisors 
approve Z2023067 subject to the following conditions ‘a’ – ‘h’: 
 
a. 
Development of the site shall be in substantial conformance with the narrative report 
entitled “US-AZ-5163 Wickenburg (AGUILA)” consisting of 9 pages, received October 16, 
2023, except as modified by the following conditions. Staff may determine slight 
refinements to remain in substantial conformance with the approved narrative report. 
 
b. 
Development of the site shall be in substantial conformance with the site plan entitled 
“US-AZ-5163 Wickenburg” consisting of 7 full-size sheets, received October 16, 2023, 
except as modified by the following conditions. Staff may determine slight refinements to 
remain in substantial conformance with the approved site plan. Minor and major 
amendments to the site plan will be determined in accordance with Chapter 3 of the 
Maricopa County Zoning Ordinance. 
 
c. 
Applicant must provide the necessary encroachment permit approval form from the 
Arizona Department of Transportation at the time of the initial construction permit 
application for the cell tower construction. 
 
d. 
This SUP is valid for a period of twenty-five (25) years and shall expire on January 24, 
2049, or upon termination of the use for a period of 90 or more consecutive days, 
whichever occurs first. All site improvements associated with the SUP shall be removed 
within 90 days of such expiration or termination of use.

e. 
The following engineering conditions shall apply: 
 
 
1. Owner/applicant responsible for coordinating with ADOT for required studies, 
permitting and access requirements for work in US 60 R/W. 
 
2. The entire site is within a regulated floodplain (FEMA Zone AO). Ground 
equipment/cabinets and electric panels must be elevated to the regulatory flood 
elevations (2 feet above highest adjacent grade). 
 
3. Development in the floodplain will require a floodplain use permit issued concurrent 
with the building permit(s) required for site development. 
 
4. All development and engineering design shall be in conformance with Section 1205 of 
the Maricopa County Zoning Ordinance; Drainage Policies and Standards; Floodplain 
Regulations for Maricopa County; MCDOT Roadway Design Manual; and current 
engineering policies, standards and best practices at the time of application for 
construction. 
 
5. Engineering review of planning and/or zoning cases is for conceptual design only and 
does not represent final design approval nor shall it entitle applicants to future designs 
that are not in conformance with Section 1205 of the Maricopa County Zoning 
Ordinance and Drainage Policies and Standards; Floodplain Regulations for Maricopa 
County; and the MCDOT Roadway Design Manual. 
 
f. 
The following Special use Permit standards shall apply:

g. 
Noncompliance with any Maricopa County regulation shall be grounds for initiating a 
revocation of this SUP as set forth in the Maricopa County Zoning Ordinance. 
 
h. 
The granting of this change in use of the property has been at the request of the applicant, 
with the consent of the landowner. The granting of this approval allows the property to 
enjoy uses in excess of those permitted by the zoning existing on the date of application, 
subject to conditions. In the event of the failure to comply with any condition, and at the 
time of expiration of the SUP, the property shall revert to the zoning that existed on the 
date of application. It is, therefore, stipulated and agreed that either revocation due to the 
failure to comply with any conditions, or the expiration of the SUP, does not reduce any 
rights that existed on the date of application to use, divide, sell or possess the property 
and that there would be no diminution in value of the property from the value it held on the 
date of application due to such revocation or expiration of the SUP. The SUP enhances 
the value of the property above its value as of the date the SUP is granted and reverting to 
the prior zoning results in the same value of the property as if the SUP had never been 
granted.

Purpose of Request: Vertical Bridge is requesting a Special Use Permit for a Vertical Bridge Wireless 
Communications Facility approval on a New Wireless Communications Facility. Per Ordinance Chapter 12 
Development Regulations: Wireless communications facilities are permitted in all zoning districts subject to the 
provisions and standards outlined in Section 1202. Any proposed wireless communication facility that cannot meet 
the standards outlined in Article 1202.3 of the Ordinance shall be required to obtain a Special Use Permit approval 
by the Board of Supervisors. 
 
This SUP for (Z2023067) is for a new 110’ Monopole (Collocatable) site build located in the Center of the 
existing parcel with the Vertical Bridge 8’ antennas to be placed at the top of the Monopole at (110’ top of 
antennas), and equipment within an 8’ CMU walled in compound 40’ x 40’ painted and textured to match 
the existing light tan desert area. The equipment compound behind the walled-in compound will be on 
cement slabs, including a backup generator Model # RD48 Model 7960-0 3.3L External Fill Tank-diesel. 
which complies with the Wireless Communications Facilities Ordinance which mandates the County 
Regulations and requirements for a site located at APN# 506-05-006F 51018 W US HIGHWAY 60 Aguila 
AZ 85320 (Maricopa County).

2. 
Description of Proposal: This SUP request is for a new 110’ monopole (collocatable) to be located in the 
approximate center of Parcel 401-38-006A. This parcel, zoned Rural-43, is currently vacant and located at 51018

W US HIGHWAY 60 Aguila AZ 85320  
 
Vertical Bridge has chosen this location for a new cell tower due to the lack of existing reliable cellular service in 
the surrounding area. As such, there are no other cell towers within 1,000’ of the proposed site. 
 
Vertical Bridge is proposing to install an antenna array toward the top of the monopole, with the center of the array 
mounted at 106’. This antenna array will measure 8’ from top to bottom and 13’ in diameter. A 4’ lightning rod will 
bring the total height of the WCF to 110. All ground-mounted equipment, including a backup diesel generator, will 
be constructed on cement slabs and screened by an 8’ CMU wall measuring 50’ x 50’. All facilities, including the 
monopole and the CMU wall, will be painted, textured, and constructed to minimize visual impacts. Both the 
monopole and the wall will be painted in non-reflective, earth-tone light tan colors, generally matching the 
surrounding desert. Lighting will be in compliance with Section 1112 of the MCZO, will be limited to facing the 
compound maintenance area, and will only be used when the cellular technician is onsite.  
 
3. 
Relationship to Surrounding Properties: Both the site and the properties to the North and East are zoned 
RU-43. The parcels to the West are zoned R-4 and the parcels to the South are zoned C-2.  
 
The site is located within a very rural and sparsely populated area. The use of the site for a wireless 
communications facility will not cause any adverse impact on adjacent or nearby properties. As this will be an 
unmanned facility, maintenance will generally visit the site once a month, only visiting more often in case of 
emergency. As such, there will be minimal vehicular traffic (none on most days) and no pedestrian traffic 
generated by the site. Likewise, there will be no increase in emissions, dust, gas, noise, vibration, smoke, heat, or 
glare at a level exceeding ambient conditions. 
 
 
4. 
Location, Accessibility, and Circulation System: The site is located at the northern portion of 51018 W US 
HIGHWAY 60 Aguila AZ 85320, approximately 23 miles west of Downtown Wickenburg and approximately 77.50 
miles North-West of Downtown Phoenix. Construction and maintenance personnel will access the site via ADOT 
approved access road to 51018 W US HIGHWAY 60 Aguila AZ 85320. Vertical Bridge will construct a 20’ wide 
access easement that will meet Highway 60 at the north terminating at the WCF equipment compound near the 
North central section of parcel. A single 15’ wide parking space will be provided at the end of the easement, 
adjacent to the compound, for maintenance personnel, which will visit the site generally no more than once a 
month, and only more often in case of emergency. 
 
Stabilized decomposed granite (gravel) will be proposed for this SUP. Since the technician will be visiting the site 
only once a month, the access path can be stabilized decomposed granite. 
 
Due to the access driveway’s proximity to the north property line, as well as the curvature of the proposed 
easement, the required 25’ x 25’ sight visibility triangle on either side of the driveway will not be feasible. 
Therefore, Vertical Bridge is requesting that the SVT requirement be waived with the Special Use Permit. Because 
generally no more than one maintenance vehicle will be accessing the site at a given time, and will only occur 
generally once a month, Vertical Bridge believes that the SVTs will not be needed to ensure the safety of said 
vehicles entering from and exiting the property onto US 60. Additionally, the low traffic volume along this section of 
US 60, the open and rural nature of the surrounding area, and the lack of nearby buildings, walls, and other 
obstructions, will further ensure the safety of maintenance vehicles accessing and leaving the site.   
 
5. 
Development Schedule: Once the Special Use Permit has been approved and the required building 
permit(s) have been approved by Maricopa County Planning & Development, construction of the site (including the 
monopole, ground-mounted equipment, 8’ CMU wall, and access easement) is anticipated to take approximately 
60 days.

Community Facilities and Services: The site is located within the Wickenburg United District and the 
Aquila Elementary School District. The site is located  1.77 miles NE from Aquila Elementary School District #63 
and 22.52 miles W from Wickenburg HS, and 21.10 miles W from Sunset Park area.

SUP Comparison Chart: To accommodate the telecommunications facility proposed onsite, Vertical 
Bridge is requesting to modify some of the development standards of the Maricopa County Zoning Ordinance. 
(Use this section to briefly justify why it is necessary to modify these development standards. For example, why is 
it necessary to build the monopole to a max. height of 110, instead of the 80’ allowed per Section 1202.3? Why is 
it necessary for the antenna array to have a diameter of 13’, instead of the max. 8’ allowed by-right?) To maximize 
the monopole’s setbacks from the property boundaries, it will be placed toward the center of the site. However, 
due to the dimensions of the property, meeting the requirement of having the monopole setback at least 2’ from all 
property lines for each 1’ in height was infeasible. With a proposed height of 110, the base regulations would 
require the monopole to be setback at least 398’ from all property lines. Instead, the monopole will be setback 
55.75’ from the north lot line, 603.66’ from the south lot line, 630’ from the ultimate right-of-way line for US 
Highway 60, and 488.66’ from the west lot line and 330’ from the East property line. All setbacks are measured 
from the antenna array circumference line. The proposed modifications to the MCZO development standards are

There are no other towers in the 1000’’ area; Per Section: 1202.3.1.(k)., and due to the major carrier mature 
system build Vertical Bridge needs this proposed site location to improve the services as there are many 
blocked/dropped calls due to the weak signal in the surrounding area, The existing right of way power 
poles, light standards and stop light pole have been thoroughly investigated by the major carrier Radio 
Frequency Engineers within the search ring area which do not work for the RF objectives in this area. 
  
 
3.         Provide a list with locations and approximate height of all existing vertical structures (of a height 
approximately equal or greater than the requested tower) within the WCF’s search area. This includes church 
spires and steeples, light standards, water towers, transmission lines, buildings, or other similar structures.  
 
There are no towers of this height in the area, this is a multi-carrier site designed to cover a wide, 
underserved area.

General 
ADOT has no objections with the pre-app zoning for a special use permit 
application for the installation of a cell tower on parcel # 506-05-006F 
located along US-60 at approximate milepost 84.74 in Aguila, AZ.  
However, ADOT does have concerns of the existing access and the 
potential impacts that the construction of the cell tower may have within 
the ADOT Right of Way along this highway corridor.

TIS
ADOT would require a Traffic Impact Statement (TIS) for review to 
determine potenial impacts and potential improvements to the existing 
access on US-60 from the construction of the cell towers.  The TIS would 
be according to ADOT's Traffic Engineering Guidelines and Processes 
(TEGP), Section 240.  Traffic Engineering Guidelines and Processes (TEGP)  
Traffic Engineering Guidelines & Processes. The owner of the cell tower 
site would need to provide the following: Construction duration, Total 
number of trucks anticipated and size of trucks and largest size of trucks 
expected for delivery of equipment and componets, number of 
employees at peak construction, which direction will construction traffic 
be coming from and hours of operation.  Also, provide vehicle turning 
movement templates for the vehicles that are anticipated to be used 
during construction for the following design vehicles:  largest 
construction vehicle used at this site...WB44 or 50 minimum and up to 
WB67 etc. to demonstrate that the existing driveway has adequate width 
to provide for these vehicles to stay within the curb lane width on US-60 
and 1/2 of the site access driveway. This will help determine what type of 
improvements to the existing access will be required.  Suggest a virtual

Site Plan
Provide a better detailed site plan that shows and calls out the ADOT 
Right of Way from Construction Centerline (C/L) to the property line. 
Include the width and radius of the existing access turnout. Include all 
features within the ADOT Right of Way along the property limits for 
example drainage culverts etc.

General 
It appears that the existing access is a 20' to 23' foot access driveway. This 
does not meet current ADOT Standards for the commercial access. Due to 
the change of use, the current access driveway to Parcel #506-06-006F off 
of US-60 at milepost 84.74 will need to be upgraded to current ADOT 
Standards with a commercial access for the length within ADOT Right of 
way according to ADOT Standard C-6.10. In addition to upgrading the 
current access to current ADOT Standards the driveway access would 
have to be paved within the ADOT Right of Way to the property line 
according to ADOT Standards and Specifications and District wide 
Standard of 5" in. AC over at a minimum 12" AB. The width and radius 
would be determined by the TIS that is required for the construction of 
the cell tower which  would require it to be constructed under an 
encroachment permit.

It also appears that according to ADOT records, the current existing 
access does not have a permit for access to US-60. An encroachment 
permit would be required to bring the existing access for Parcel #506-06-
006F off of US-60 milepost 84.74 into the current owner's name 
according to Arizona Administrative Code R17-3-502(D).

If the TIS finds that impacts from this project affect US-60 at milepost 
84.74, any improvements would require an encroachment permit to be 
submitted to the Northwest District Permits office prior to construction.

General 
If any improvements within the ADOT is determined then any and all 
work within the ADOT Right of Way shall be constructed according to 
ADOT Standards and Specifications. The current owner Millennium 
Milling Inc. or Vertical Bridge Clear Blue Services shall submit an 
encroachment permit with all supporting documentation to ADOT 
Northwest Permits to Northwestpermit@azdot.gov for processing, review 
and approval. The encroachment permit would also be for the change of 
ownership and bring the existing access into the current owner's name 
according to Arizona Administrative Code R17-3-502(D). If the Cell Tower 
permit does not move forward an encroachment permit would still be 
required for the ownership of the existing access into current owners 
Millennium Milling Inc. name. All construction plans shall be signed, 
sealed and dated by a professional engineer. Be prepared to provide on 
and off site plans and include the grading and drainage plans for review.

 ADOT's comments may not be all inclusive. ADOT reserves the right to 
comment further if Parcel #506-05-006F moves forward with the planned 
cell tower project to review the on and off site plans and to comment on 
any other future meetings regarding Parcel #506-05-006F. Please contact

concerns.
