RESOLUTION NO. R2026.39
A RESOLUTION OF THE CITY COUNCIL OF THE 
CITY OF TEMPE, ARIZONA AUTHORIZING THE 
MAYOR TO SIGN AMENDMENT ONE TO AN 
INTERGOVERNMENTAL AGREEMENT BETWEEN 
THE CITY OF TEMPE AND THE TEMPE UNION 
HIGH 
SCHOOL 
DISTRICT 
TO 
JOINTLY 
ADMINISTER 
THE 
YOUTH 
TRANSIT 
PASS 
PROGRAM.
WHEREAS, the Tempe Union High School District (TUHSD) and the city of 
Tempe have authority under A.R.S. § 11-952 to enter into Intergovernmental 
Agreements.
WHEREAS, the City of Tempe is authorized to operate public transit services and 
programs pursuant to Tempe charter, City codes and ordinances; and
WHEREAS, TUHSD is authorized to provide public education for ninth through 
twelfth graders pursuant to Title 15 of the Arizona Revised Statues; and
WHEREAS, the City of Tempe and the Tempe Union High School District wish 
to encourage youth transit ridership by jointly administering the Tempe Youth Transit 
Pass Program at four high schools within the City of Tempe city limits as set forth in the 
original Intergovernmental Agreement; and
WHEREAS, TUHSD has been authorized by its Governing Board and the City of 
Tempe has been authorized by its City Council to enter into this Agreement. 
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE 
CITY OF TEMPE, ARIZONA as follows:
Section 1.  That the Mayor is authorized to sign Amendment One to an 
Intergovernmental Agreement between the City of Tempe and Tempe Union High School 
District to jointly administer the Tempe Youth Transit Pass Program.
Section 2.  That the Transportation and Sustainability Director or designee is 
authorized to execute such further documents and take such further actions as may be 
necessary to carry out the purposes of this Resolution.
