CITY OF TEMPE Meeting Date: 4/16/2026 REQUEST FOR COUNCIL ACTION Agenda Item: 8C1 ACTION: APPLICANT HAS REQUESTED TO CONTINUE TO THE JUNE 4, 2026 REGULAR COUNCIL MEETING – PUBLIC HEARING ITEM Hold the second and final public hearing to adopt an ordinance for a Zoning Map Amendment from R-4 and CSS to MU-4, a Planned Area Development Overlay to establish development standards, and a Development Plan Review for a new seven-story mixed-use development consisting of 105 dwelling units on 0.88 acres for THE MARSHALL ON SPENCE, located at 1026 East Spence Avenue. The applicant is CHA Consulting. The first public hearing was held on June 5, 2025. At the request of the applicant, the second and final public hearing was continued from the July 1, 2025 Regular Council Meeting (RCM) to the August 28, 2025 RCM, then further continued to the October 16, 2025 RCM, then to the December 11, 2025 RCM, then to the April 16, 2026 RCM, and is now requested to be continued to the June 4, 2026 RCM. (Ordinance No. O2026.xx; previously assigned Ordinance No. O2025.22 for initial hearing—now retired) FISCAL IMPACT: While this ordinance change does not directly impact revenue, the planned development will result in collection of the standard development fees, calculated according to the approved fee structure at the time of permit issuance. RECOMMENDATION: Adopt Ordinance No. O2026.xx. Approve Development Plan Review, subject to conditions Development Review Commission – Approve (6-0 vote), subject to modified conditions BACKGROUND INFORMATION: (PL240473) THE MARSHALL ON SPENCE. The applicant is requesting the City Council take action on the following: DPR240152 - Development Plan Review including site plan, building elevations, and landscape plan ZON240015 - Zoning Map Amendment from R-4, Multi-Family Residential General, and CSS, Commercial Shopping and Services, to MU-4, Mixed-Use, High Density. PAD240018 - Planned Area Development Overlay to modify the development standards to establish an allowable density of 120 dwelling units per acre, allow for an increase in the maximum building height to 90 feet, an increase in lot coverage to 76%, reduce the required landscaping to 20%, and establish front, side, and rear setbacks.
