Fence Variance 
 
The property located at 106 E Broadway Ln is zoned R-2. 
We are requesting a variance to allow a 7-foot-high 
corrugated steel fence within the front yard building 
setback, where a maximum height of four feet is permitted, 
to remain standing. The fence was built in 2018. 
Zoning and Development Code Criteria Section 6-309(D) 
a) The Traffic on Broadway is horrendous. 
b) The noise from 30,000 cars a day on Broadway 
prompted the city of Tempe to build a an 9’4” wall in 
front of all the other houses on our block from Mill 
to College on Broadway Lane.  
c) The height of the wall does not impact traffic or 
visibility, and the wall does not provide any hiding 
places or nuisances for the general public. The wall 
height is in character with the neighborhood, as 
other houses have walls/fences along Broadway 
Lane. There are other walls in the area with 
comparable material, and both match their 
prospective houses in size and finish.  
d) The city did not install 9’4” high walls in front of our 
property on the West end of the block because of 
the site visibility triangle at Encanto Drive i.e. this is 
not a self-imposed hardship.

Dear City of Tempe Permits: 
 
The facade design enhancements to the homes at 100 and 106 E Broadway Lane (PL250189 & 
PL250190) are nice enhancements thus blending in with the overall neighborhood.   In addition 
the landscaping at these homes aligns with the facade enhancements where the homes  have a 
great aesthetic look . 
 
In the surrounding Tempe area near ASU in and beyond the University Park area, many home 
owners have updated or rebuilt their homes like the Tonnesen’s have, where there are homes 
with similar updates at different levels.   One example is 130 E Encancto where this home has 
lined their entire front yard with India Column trees. 
 
Traffic and Business noises in this Tempe area 
 
The vehicle traffic along Broadway road, factory noise from the Milk plant and other businesses 
in the Tempe Industrial park is constant.   At my home at 
,  the vehicle traffic and the 
factory noise from the Milk plant can be heard  24 hours a day.   
 
The updated design of the homes at 100 & 106 E Broadway lane is a major plus to help reduce 
the noise and blending the home design with the neighborhood
