RESOLUTION NO. R2026.50
A RESOLUTION OF THE CITY COUNCIL OF THE CITY 
OF TEMPE, ARIZONA, AUTHORIZING THE MAYOR TO 
SIGN AN INTERGOVERNMENTAL AGREEMENT WITH 
THE STATE OF ARIZONA, ACTING BY AND THROUGH 
ITS 
DEPARTMENT 
OF 
TRANSPORTATION, 
FOR 
PAVEMENT IMPROVEMENTS ON BROADWAY ROAD 
FROM 55TH STREET TO MILL AVENUE IN TEMPE.
WHEREAS, the City of Tempe desires to improve the pavement condition along 
Broadway Road from 55th Street to Mill Avenue, including sidewalk expansion, 
pedestrian ramp improvements, lighting and signal improvements; and,
WHEREAS, the interest of the State in this project is the acquisition of federal 
funds for the use and benefit of the local agency and authorization of such federal funds 
for the project pursuant to federal law and regulations; and,
WHEREAS, the State shall be the designated agent for the City for the project, if 
the project is approved by Federal Highway Administration (FHWA), and funds for the 
project are available; and,
WHEREAS, the City and the State desire to enter into an Intergovernmental 
Agreement (“IGA”) to outline the obligations and responsibilities of the respective 
parties; and, 
WHEREAS, the State is empowered by Arizona Revised Statutes (“A.R.S.”) § 
28-401 to enter into this IGA; and, 
WHEREAS, Tempe is empowered by A.R.S. § 48-572 to enter into this IGA; and, 
WHEREAS, the project cost is estimated at $925,000, which includes federal aid and 
the City’s match; and, 
WHEREAS, the State will administer design, and the City will administer the utility 
relocation and right-of-way acquisition with eligible utility reimbursement not to exceed 
$266,000 and eligible right-of-way reimbursement not to exceed $31,500.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE 
CITY OF TEMPE, ARIZONA as follows:

That the Mayor is authorized to sign an Intergovernmental Agreement between 
the City of Tempe and the State of Arizona, acting by and through its Department 
of Transportation, for pavement improvements on Broadway Road from 55th 
Street to Mill Avenue in Tempe.

That the City Manager (or designee) or the Transportation and Sustainability 
Director (or designee) is authorized to take such further action and execute such 
additional documents, including amendments, as are necessary to implement the 
intent of the IGA and this Resolution.
