Project Summary: 
 
1. 
The applicant, on behalf of the property owner, is requesting a special use permit (SUP) for an 
interim industrial use to accommodate an existing non-conforming recycling collection facility in 
the C-3 zoning district. The current land use is an intense industrial use that would be allowed in 
an industrial zoning district, but not in a commercial zoning district, hence this SUP request. This 
business has been operating on this site for over four years and has a code violation for running 
an industrial business on a site in the C-3 zoning district. The site is located on the northeast 
corner of Apache Tr. and 85th Pl. at the base of the Twin Knowles, which is 840 feet east of the 
northeast corner of Apache Tr. and Hawes Rd. in the Mesa area.  
 
2. 
The recycling facility office is in an existing single-story building with storage and sorting of 
recycled materials in the rear of the site that will be screened with a new eight-foot-tall solid fence; 
however, part of the northwest corner of the site will be screened by an eight-foot-tall accessory 
structure away from adjacent residences. Once the recycled material has been sorted it will be 
sent off to an off-site processing facility that will occur daily. Normal business hours are between 
8:00 a.m. through 9:00 p.m. and typically has 10 to 20 customers per day. Access to the site will 
be directly off Apache Tr. with nine parking spaces; however, portions of the parking area are 
within the 100-foot half-width ADOT right-of-way of Apache Tr. Internal driveways will be in a one-
way configuration with customers entering the rear storage area of the lot near the eastern site 
boundary to access the at-grade scales dropping off materials behind the building and then 
exiting the yard near the western site boundary to park their vehicles in front of the office building. 
Once parked the customer enters the office building to receive payment for their dropped-off 
recyclables. It should be noted that due to the existing location of the site with portions of the 
parking area inside the street right-of-way, the applicant is requesting to eliminate all required 
sight-visibility-triangles in this SUP request.   
 
3. 
Four years ago the property owner purchased the property and started the recycling facility 
business. On November 24, 2021, the code compliance division received a complaint and opened 
a code violation for running an industrial business in a commercial zoning district (V202102261).  
The violation was verified by site inspection on December 20, 2021. On March 8, 2022, a 
compliance agreement was executed with the property owner requiring the owner to resubmit all 
necessary entitlement applications by May 2, 2022, or cease all operations restoring the site by 
July 30, 2022. On May 18, 2022, the applicant submitted this SUP request which was followed by 
a Technical Advisory Committee Meeting on June 21, 2022. The property owner failed to abide 
by the terms of the compliance agreement. An administrative civil hearing was held on May 30, 
2023, where the property owner was judged responsible for the violation and imposed a $500 
initial non-compliance fine with a $50 daily non-compliance fine. Since the applicant is in the 
process of obtaining a SUP, the initial fee was due on this date, but the daily fines were suspended 
and will be dismissed if compliance (cease and desist or approved SUP and completion of 
required construction permitting) is gained no later than December 29, 2023.

Mesa’s General Plan (adopted June 16, 2004): This document designates the site as a 
Neighborhood character area primarily residential areas with supporting parks, schools, 
churches, and small commercial areas. This proposed SUP of an industrial nature is not 
compatible with this land use designation.   
 
Public Participation Summary:

Regarding the minimum requirements of Maricopa County’s citizen review process, the applicant 
did send mailers to property owners within 300 feet of the subject parcel and interested parties 
via first-class mail. The applicant submitted a public participation results report and according to 
the report the applicant received no response from the public.   
 
9. 
Staff received 13 opposition letters and one opposition petition with twelve signatures. Concerns 
center around noise, dust, exposure to possible toxic chemicals, trash and windblown litter, blight, 
risk of fire, and incompatibility with their adjacent residences. Additionally, several residents have 
submitted numerous complaints to the Sherriff’s Office for noise from the site outside normal 
business hours. In contrast, staff received eight support letters mentioning that this facility is a 
reasonable distance from residential homes and that it is a responsibly run business in an area 
with many commercial uses.

Staff Analysis:

Staff does not support this SUP because this request is not compatible with the adjacent 
residential area. The site is zoned for heavy commercial use; however, a recycling center does 
not qualify as a heavy commercial use.  A recycling collection center would be more compatible 
in an industrial area away from residences where noise and other impacts generated from this 
type of operation would not be an issue. the property owner started this business at this site 
without a due diligence check of the site’s zoning and what uses are allowed in the C-3 zoning

district. This demonstrates a disregard for the neighbors. The current layout of the site with 
parking in the existing right-of-way and limited space for outdoor storage are and will continue to 
be issues on this small site. Allowing the non-conforming use to continue will adversely impact 
the adjacent residential neighborhood. The use interferes with the enjoyment of the neighboring 
properties which impacts the area’s public health, safety, welfare, and convenience. Staff received 
opposition from the neighborhood residents stating valid concerns which prompted staff’s 
recommendation that this SUP request be denied.  
 
Recommendation: 
 
12. 
For the reasons outlined in this report, staff recommends the Commission adopt a motion that 
the Board of Supervisors deny Z2022097.  
 
13. 
However, if the Commission chooses to adopt a motion to recommend approval, staff offers the 
following conditions ‘a’ – ‘k’ for Commission consideration: 
 
a. 
Development of the site shall be in substantial conformance with the Site Plan entitled 
“Juniors Recycling“, consisting of one full-size sheet, dated August 15, 2023, and stamped 
received August 16, 2023, except as modified by the following conditions. Staff may 
determine slight refinements to remain in substantial conformance with the approved site 
plan.  Minor and major amendments to the site plan will be determined in accordance with 
Chapter 3 of the Maricopa County Zoning Ordinance. 
 
b. 
Development of the site shall be in substantial conformance with the Narrative Report 
entitled “Juniors Recycling”, consisting of three pages, dated August 8, 2023, and stamped 
received August 9, 2023, except as modified by the following conditions. 
 
c. 
The following Planning Engineering comments shall apply:  
 
1. 
The applicant shall be responsible for coordinating any requirements that may be 
imposed by ADOT for access to Apache Trail (redletter@azdot.gov).  
 
2.  
Any new development shall be in conformance with Section 1205 of the Maricopa 
County Zoning Ordinance; Drainage Policies and Standards, and current 
engineering policies, standards, and best practices at the time of application for 
construction.  
 
d. 
This special use permit shall be valid for ten years and shall expire on November 15, 2033, 
or upon termination of the use for a period of 90 or more days, whichever occurs first. All 
improvements associated with the special use permit shall be removed within 90 days of 
such expiration or termination of use.  
 
e. 
Daily operations of the facility shall only take place during the hours of operation listed in 
the applicant’s narrative report, which are 8:00 a.m. to 9:00 p.m. every day.  
 
f. 
The property owner or applicant must submit as-built building permits for any structure 
that has been built on-site that has a footprint over 200 square feet or a height more than 
ten feet, including fences and any signage, that has been constructed without permits.

g. 
Any stored materials shall be placed behind an eight-foot-tall screening wall, or the eight-
foot-tall existing rear storage shed, and no material stored on site shall exceed the height 
of a screening wall or the existing rear storage shed.  
 
h. 
There shall be no required sight-visibility triangles on this site.  
 
i. 
Any outdoor lighting shall be in conformance with the provisions of Section 1112 of the 
Zoning Ordinance and shall be placed so as to reflect light away from any adjoining rural 
or residential zoning district.  
 
j. 
Noncompliance with any Maricopa County Regulation shall be grounds for initiating a 
revocation of this special use permit as set forth in the Maricopa County Zoning 
Ordinance.  
 
k. 
The granting of this change in use of the property has been at the request of the applicant, 
with the consent of the landowner.  The granting of this approval allows the property to 
enjoy uses in excess of those permitted by the zoning existing on the date of application, 
subject to conditions.  In the event of the failure to comply with any condition, and at the 
time of expiration of the special use permit, the property shall revert to the zoning that 
existed on the date of application.  It is, therefore, stipulated and agreed that either 
revocation due to the failure to comply with any conditions, or the expiration of the special 
use permit, does not reduce any rights that existed on the date of application to use, divide, 
sell or possess the property and that there would be no diminution in value of the property 
from the value it held on the date of application due to such revocation or expiration of 
the special use permit.  The special use permit enhances the value of the property above 
its value as of the date the special use permit is granted and reverting to the prior zoning 
results in the same value of the property as if the special use permit had never been 
granted.

The Maricopa County Environmental Services Department (MCESD) has 
reviewed revised documents received from the Maricopa County Planning and 
Development Department for the above referenced project. SUP non-
conforming existing use  at APN # 218-39-001. Water and sewer services will 
be provided by City of Mesa. MCESD has concerns ATC must be obtained 
prior to construction permit approval. 
Based on the above, MCESD raised no objections to the Planning & 
Development Department in Accela Automation on May 18, 2022. 
It should be noted that this document does not approve the referenced project. 
Comments are provided only as advisory to Maricopa County Planning and 
Development Department to assist staff to prepare a staff report.  Other 
Maricopa County agencies may have additional requirements. Final review and 
approval will be made through Planning and Development Department 
procedures. Applicant may need to submit separate applications to the 
Maricopa County Environmental Services Department for approval of proposed 
facilities regulated by the Department.  Review of any such application will be 
based on regulations in force at the time of application.

The Twin Knolls neighborhood in Mesa AZ opposes the rezoning of current commercial property to 
support a Special Use Permit, which would allow an INDUSTRIAL business interfering with residential 
area.    This rezoning has not, and will not, be a benefit to our local residents.  In addition to the rezoning 
from C-3 to C-3SUP, there are noise, dust and environmental issues, which have been and continue to 
be detrimental to our neighborhood.  The surrounding residential properties belong to homeowners, 
many of whom have retired to this area or have been in the areas for decades, due to the beauty of the 
Twin Knolls formation.   This was a lovely and peaceful view for many until Juniors Recycling (that’s a 
nice name for what is really a scrap yard) opened years ago at a nearby location and has since moved 
and expanded and has been running the business illegally for years.  Several homes have been built in 
the area recently and purchasers did not sign up for 12+ hours of noise, dust, increased traffic, along 
with potentially toxic air and contaminated land.  Approving this permit would be a slap in the face not 
only to those businesses that do follow rules, but to those who came to this area to enjoy the beauty 
and quiet that once existed…pre-Scrap Yard. It would also open the area for more INDUSTRIAL type 
activity, which we vehemently protest, as approving this Permit would set a precedent for the area.   We 
do not want or need an INDUSTRIAL business in the Twin Knolls neighborhood.  
 
A most recent update is that we almost lost the Knolls, and potentially the neighborhood, to fire, which 
we believe was started from a spark from the CAT320C the Scrap Yard owns and runs at the back of the 
Scrap Yard property.  It runs hours a day, to include both before and after posted work hours.   Two 
neighbors took a closer look at the burn area, and we believe the fire was caused by sparks from the 
excavator.  Photos are available.  In research, we found an Expert CAT site on-line stating the following: 
"The sparks you see are caused by hard particles of soot and carbon in the exhaust.  I see this lot.   Over 
time the inside of the exhaust will have a lot of soot and carbon build-up.   Eventually it will slowly break 
loose and when it does, you can see sparks coming from the exhaust."   Here is the link for a drone video

This and additional photos in our possession, show what appears to be a triangular burn pattern that 
points directly at the Scrap Yard.  We do not have an official cause for the fire from Rural Metro.  
 
Thankfully Rural Metro did their job in keeping the fire from expanding to the neighborhood, which 
could have been disastrous to our humble mobile homes.   One stray ember could have resulted in the 
destruction of an entire neighborhood. Thankfully the winds were on the mild side that day but what 
about the next time?   This fire did create a bump in PM on that day, as we have a neighbor about ½ 
mile away monitoring air quality.   
 
Juniors Scrap Yard is applying for a special use permit is under Section 1301.1.22 of the Maricopa Zoning 
Ordinance.    In discussing this section with neighbors, we are unable to reconcile how a Scrap Yard fits 
into the category of "Outdoor storage including wholesale and retail sales of landscape materials, 
storage rental yards, construction yards and similar interim industrial uses for a period not exceeding 
ten years."  We do not see where it fits the specifics items outlined or that it is even a similar INTERIM 
industrial use. It appears that this may be under the NON-CONFORMING USE under 1301.6 which must 
be approved by the BOS.  It appears the application reflects this is indeed a NON-CONFORMING use.

I will be reaching out to the Board of Supervisors, as well as others, to express our displeasure of any 
allowance of a Special Use Permit (SUP), but before this SUP request moves forward, one should focus 
on  Article 1302.1 the intent being  “The uses, buildings and structures permitted in this Section shall be 
established and maintained so as to provide minimum interference with the use and enjoyment of 
neighboring uses, building and structures and to ensure public health, safety and convenience.”   
Approval of this Permit request would not be in compliance with this Article of Maricopa County Zoning 
Rules.    
 
CITIZEN NOTIFICATION ERRORS 
The whole process of application begins with an error in Citizen Notification – “The owner or authorized 
agent shall also post the property (see example in “Sign Specifications”) included in the proposed 
change.”  
Per County Rules - The posting shall be in no less than two places with at least one notice for each 
quarter mile of frontage along perimeter right-of-way so that the notices are visible from the nearest 
public right-of-way. The postings shall remain in place for the entire application period. Each notice shall 
be a minimum of six square feet in area unless combined with the public hearing notices. The posting 
shall include, at a minimum, a brief description of the area of the proposed Zone Change, a general 
explanation of the nature of the proposal, the name of the owner or authorized agent, and……. 
3. The sign shall have a white background with black lettering.  
4. The minimum lettering size shall be 1/2 inch for lowercase and 1 inch for upper case. The words 
“Zoning” and “Public Hearing” shall be a minimum of 2 inches in size.   (Not quite sure how one is to 
read the sign traveling at 45 MPH on Main Street and since it is off property, why would any customer 
be looking to see this?)… 
7. The height of the sign shall be at least 4 ft from finished grade to top of sign and shall not be 
obstructed from view.  
Not only was just one sign posted but it was not even on the applicant’s property, which is even clearly 
noted in their own evidence.   Additionally, the sign was posted so that anyone driving west on Apache 
Trail would have to know the one sign was there, stop, get out of their vehicle and to look behind the 
dumpster that was blocking it in order to even get a glimpse.  In violation of the County guidance noted 
above, the ONE sign was obstructed from view and continues to be on a daily basis.   (Photo evidence is 
available).   
 
Why is the applicant being allowed to not comply with the Special Use Permit procedures to the 
detriment of the neighborhood? An even more important question is why has this business been 
allowed to function illegally for years?   Why has a stop work order not been issued?   
 
VIOLATION CASE V202102261 
Once the neighborhood became aware of the illegality of the Scrap Yard, a complaint was filed and a 
violation issued.  Under this violation there was a hearing held on May 30, 2023, due to the fact that the 
violator  failed to comply with the agreement entered into with the County over a year prior.    
Subsequent to the hearing notice, the violator now is scurrying to follow procedures.  They have finally 
provided additional information based on communication with Jeffrey Brunning, who is assigned the 
violation case, and also it is noted as such on the Accela Citizen Access website.

Under Maricopa County Zoning Ordinance 1302.3.1 (3) “Upon acceptance of a complete application for 
a new Temporary Use Permit, the subject property shall be posted with a "Notice of Application" for a 
ten-day period. If a written letter of opposition is received within the ten-day posting period, the 
request for a Temporary Use Permit shall be placed on the Agenda of the first available Board of 
Adjustment Hearing for Resolution and noticed in accordance with Chapter 3, Section 303., Article 
303.6. If no written letter of opposition is received within the posting period, then a Temporary Use 
Permit may be approved by the zoning inspector.”  
My question is – How do we know when the application is complete?  According to Accela Citizen 
Access the application is under review.   
If it is complete, we presented a protest letter, photos and videos on May 22, 2023 and signatures of 
protest on May 26, 2023, why has no meeting been scheduled by the Board of Adjustment?   This 
submitted protest was made part of the Permit case file on-line.  
PLAN NARRATIVE ERRORS 
We are taking  exception to the Plan Narrative provided by the applicant to the county initially dated 
May 9, 2022 and Revised April 10, 2023 (almost a year where no action was taken by applicant after 
entering into an agreement with the County) outlining and detailing the business.   
 
DESCRIPTION OF PROPOSAL  
Section C- Juniors Recycling has been in business much longer than 4 years.   He previously ran business 
from a location at 15 N. 85th Place where he also failed to have proper permitting.   He leased that 
location and then moved to his current location where he also leased the property and ran his business 
without proper permitting.  He then purchased the land and business in 2021 and still failed to have 
proper permitting.   We question why the County is now rewarding this business by helping to move 
this application forward to permit a NON-CONFORMING, basically illegal business that is detriment to 
the immediate residential area. The permit is for 10 years, when it is very likely Mr. Gonzalez has 
already been running his business illegally for that length of time by flying under the radar of county 
authority and to the detriment of the residential community.  
 
Also in Section C, it is stated that the hours of operation are 8AM-9PM.    The neighborhood strongly 
objects to this for multiple reasons.  First and foremost, INDUSTRY does not belong next to Residential.   
Another reason is NOISE!

As you see from sample list below of other recyclers/scrap yards the hours of operation are those 
posted.    It is unacceptable to the neighborhood to have to listen to the noise from an excavator 
moving/crushing heavy metals and large dumpsters of materials, both of which can be heard and cause 
vibration felt hundreds of feet away.  As an example, on June 23, 2023, a community member was 
parked in a lot across Main Street and to the east and was able to feel the vibration of items being 
moved and could easily hear the excavator.  There is video evidence that these excavators are running

at all hours, well before and well after the posted open hours and the customary hours for any similar 
businesses.  This information was submitted within the 10-day window after the hidden posting of the 
Application, not on the proper property as a protest to the Special Permit Application.  However, no 
agenda item was added to the Board of Adjustments as required by County Ordinance.

The neighborhood is also subject to the cutting/sawing and breakdown of metals, all while loud music is 
playing to include even after posted hours.    This is a violation of P-23 and the Sheriff has been called 
numerous times.    We still do not have a response to the long overdue FOIA request to the Sheriff’s 
department outlining all the calls to them about noise.   There has been NO action taken by the Sheriff 
for the P-23 violations even though multiple, almost daily violations occur.   
 
Maricopa County Noise Ordinance P-23 
Paragraph I. Purpose  
At and above certain levels, noise is detrimental to the health and welfare of Maricopa County citizens. 
Therefore, Maricopa County has determined that it is in the best interest of its citizens to control noise 
in a manner which promotes commerce; the use, value, and enjoyment of property; sleep and repose; 
and environmental quality. Therefore, it is hereby declared to be the policy of Maricopa County to 
prohibit excessive, unnecessary, disruptive, and annoying noises from all sources.   This business not 
only is INDUSTRIAL in a Commercial Zone but blatantly causes excessive, unnecessary, disruptive and 
annoying noises.   
 
Under Paragraph V Public Disturbances 
 A. It shall be unlawful for any person to cause, or for any person in possession of property to allow to 
originate from the property, any noise which disturbs the peace or quiet of any neighborhood if such 
noise can be heard from within closed residential structures located within 500 feet of the boundary of 
the property from which such noise emanates. This subsection shall not apply to noise produced in the 
normal conduct of business provided that such noise occurs within the normal and customary hours 
for the conduct of such business, which is based on the normal and customary hours of operation of 
similar, existing businesses, and the operation is legally conducted within the scope of all ordinances, 
laws, and statutes of Maricopa County and the State of Arizona.  
 
Also under P-23  C. Radios and Sound M Amplification Devices - It shall be unlawful for any person to 
operate any radio, loudspeaker, musical instrument, or other sound producing, sound reproducing, or

sound amplification equipment which emits noise that can be heard from within closed residential 
structures located within 500 feet of the boundary of the property from which such noise emanates. 
Is it the position of the County that everyone must stay in their homes with doors and windows closed 
and hope it stops the noise from being heard?   
 
Section C also claims there are 10-20 customers a day.   This is a very lowball estimate, when in fact it  
the Scrap Yard issues a receipt for scrap received and the dollar amount the customer will receive for 
said scrap.   This receipt is taken to the “office” for payment.   All one needs to do is look through his 
records to see, this is a very low number.   As a visual, a representative from the neighborhood did a 
count of activity at the business on June 23, 2023. There were 5 customers seen from 10:45AM-
11:35AM.     That is probably an off time and also this is summer when many folks are gone so if you 
estimate for the day, there could have been up to 40 customers on that day.   On June 24, 2023, 12 
customers were seen between 9:30-10:30.   I would guess this too might be a bit of a down time as the 
rush would be more at opening time,  when a line of customers can be seen waiting for service and 
there would be increased activity closer to closing time.   We also suggest that if only there were 20 
customers a day, would the business have all of his properties FULL of scrap?  The Plan Narrative is very 
misleading.  
 
Section C also indicates customers enter with their recyclables/scrap to be weighed on scales.  It has 
been confirmed the scales are licensed under Weights and Measures. BMF# 42006.   How can the scales 
be licensed, when the business has not ever been??   The application letter also provides a very nice 
photo of a clean area of the front of the business.   They must have swept up because that is not how it 
normally looks.   (We have photo evidence to this as well.)  There are scrap vehicles parked on the 
residential property to the west, near the Scrap Yard's, sometimes overflowing, dumpster.   The 
dumpster was and has been located to the south east corner of the property which is where the Permit 
Notice was placed…behind the dumpster.  It appears that not only was the Notice placed off of the 
property, as of June 23, 2023,  it was noted that two vehicles and an RV were parked by the Permit 
Notice sign making it basically impossible to see. Even if one was a client dropping off materials, the 
Notice is not is a place where one would notice and especially would not when the dumpster was in its 
usual place.   There are many times bicycles or shopping carts among other items that are to the east of 
the entry where homeless have left the carts after dropping off scrap metal or cans for money.  On June 
23, 2023 and July 2, 2023, we have photo evidence of what appears to be an abandoned vehicle on 85th 
Place, outside of the scrap yard property.  This is NOT what we want in our neighborhood! 
 
RELATIONSHIP TO SURROUNDING AREA 
D.   We take exception to this section, as the narrative fails to accurately describe the surrounding area.   
It appears to be intentionally misleading.  
 
To the immediate east is a commercial business, a car repair business which recently opened. It is 
unclear whether they too are car sales and if so, it is unclear if they have proper licensing.   There is 
signage that indicates they are auto sales, but we have been unable to locate a license for that.    This 
was the prior location of Junior’s Recycling.   This business recently attempted to build a building 
without proper permit and was put under stop work order and they have been operating on Sundays.    
The Plan Narrative talks about property directly to the east; however if one moves to the east and 
slightly north, there are numerous occupied homes.  This is a RESIDENTIAL district.   These homes are 
exposed to the noise from the excavator, metal saws, etc. coming from Scrap Yard at all hours of the day 
and to include most recently on a holiday.    
 
Looking a bit further east, the following are nearby to the scrap yard 
Parcel 218-39-003E; 003N; 003H; 003J; 003K; 003D; 004L; 004M; 004F; 004ER; 004C ; just to mention a 
few, ALL of which are listed as RESIDENTIAL.

To the immediate north is currently unoccupied land that is Zoned R-3 RESIDENTIAL per County Records.   
This land had reclamation plans posted in 2019 to build homes, which requires a residential zoning. (This 
fell through due to termination of planned “mining” in the middle of Residential neighborhood)    Why is 
the county now advising the permit applicant to update their Plan Map to reflect the land directly 
north and west to C-3?   
 
To the immediate west is currently unoccupied land Zoned R-3- RESIDENTIAL.  Same as immediately 
above.  
 
Also to the west one will find Parcel 216-26-016, R1-8; 011A, R-5; 020D, R-5; with a few C-3’s in the area.  
218-26-017 and 015 are C-3 and owned by Mr. Gonzalez for his storage of scrap, which is not a pretty 
sight either.  218-26-034M and 034L are C-3 and in the process of having rental properties built and it is 
unclear how that can be, if it is currently listed as commercial.  218-26-022 is owned by the City of Mesa 
and is C-3.  
 
To the South is Main Street/Apache Trail and across the street are a variety of properties.   
  
Parcel 218-59-028/8449 E Apache Trail (C-3) belongs to Hays Leasing.  This was part of a Mobile Home 
Park that remains in place with Residences now behind the small Leasing Company. 
 
Parcel 218-44-001G/8421 E Main(C-3) and 001F (R-5) belong to Bright Haven MHC LLC, basically a 
mobile home park with RESIDENCES.  
 
Parcel 218-44-003D/8601 E Main (R-5) -028 belong to Sunset Mobile Home and RV Park LLC with 
RESIDENCES.     
 
Section D also notes that this business is appropriate for the area.   It is NOT!   This is an INDUSTRIAL 
business, situated in the middle of many residences/neighborhoods. Juniors Recycling is NOT a 
commercial business as the letter suggests.  Another misleading statement.  It is INDUSTRIAL.    If this 
was in the city of Phoenix, under their municipal codes, this would not be allowed, as their rules state 
for Recycling Industry shall not be located within 1,000 feet of S-1, S-2…..R1-18…….    Here we have 
property that butts to Residential property.  Just because we are a county island does give open season 
for the county to treat us as we have no rights.    
 
We do not see how this INDUSTRIAL business in the middle of neighborhood is positive.   It is a draw for 
those who are unhoused as well as for increased crime.   The community recently had to battle to get 
the Twin Knolls mountain formation cleaned and cleared due to the numerous encampments and trash 
that appeared.  The trash continues to accumulate and another tent was recently found in the bushes.  
We have photos of unhoused climbing fences, walking with shopping carts, etc.   Crime has increased 
too.    Since the Scrap Yard takes copper, bikes, ladders, wiring, batteries, etc., all of these are easy 
pickings for a thief to make some money.   In fact, the Scrap Yard experiences theft as well.   Sort of 
ironic that perhaps someone steals from the Yard and then returns it for money.   It is possible.   
 
Fences around the area surrounding the Scrap Yard have been cut and repaired dozens of times by 
neighbors.   We have a photo from June 26, 2023 of an apparent homeless person is crawling over razor 
wire with a back pack and his bike.   
 
Home values will decrease!  Who wants to live next to a Scrap Yard, let alone one that currently runs 
sometimes more than 12 hours a day?

With increased crime, the constant noise, the dust, the traffic, the toxicity, etc., the Scrap Yard is not an 
improvement for the neighborhood!!   
 
Section D also states the “operation does not create un-do noise, dust or pollution of any kind”.  This 
comment is so far from the truth, it is laughable.   We have already addressed noise.   Dust and 
pollution are an issue as well.   There are two possible entry points- One off of Apache Trail and the 
other is a dirt road, 85th Place, which has now become a “thruway” from the north to the Scrap Yard.   
85th Place is listed as an Unmaintained Road and thus there is no dust abatement by the County.   Due to 
increased traffic because of the Scrap Yard, there is more dust.   This area is already listed as a SERIOUS 
Non-Attainment area for air quality.   Is this increased dust what the Maricopa Air Quality wants?  And 
please do not suggest that the residents pool together to pave the road.  WE did not create this 
situation.     We also have evidence of a huge truck carrying tires from the Scrap Yard Location.   Lots of 
dust caused by this and a discussion of the other business being run out of the Scrap Yard Building will 
be discussed below.  Those traveling this new thruway to get to the Scrap Yard, drop screws, bolts and 
other such metal items resulting in a hazard for the residents on 85th Place.     
 
We can get into a very technical discussion on dust and metal particles as we are in possession of a 
calculator obtained from University of Arizona that shows these particles travel dozens of miles.  And 
just a reminder about the fire.   An ember could have flown with devastating results to the community.    
 With the excavator running pretty much daily stirring up dust and debris, and metal cutting also daily, 
there is concern about the long term safety of the neighborhood with this increase in breathable, 
detrimental particles.   
 
And let’s add to that, the environmental issues.  We will be reaching out to Environmental on this issue 
as well.   
 
Salvage yards are an important source of end-of-life recycling for motor vehicles. However, these yards 
can also be a source of pollution and endanger the health of nearby communities if they are not 
properly maintained and regulated.  There has been no regulation of this Scrap Yard or maintenance of 
this business for years and even with a permit, the dangers for the surrounding area still exist.   
Junkyards contain many hazardous materials including lead batteries, mercury from light switches, anti-
freeze, Freon from cooling systems, Polychlorinated Biphenyls (PCBs), Chlorofluorocarbons (CFCs), 
asbestos found in the brake pads and lining of older cars, motor oil, and heavy other metals.

This business is NOT an improvement for the neighborhood! 
 
LOCATION AND ACCESSIBILITY 
Section E.  States access to the Scrap yard is directly off Apache Trail.  (Main Street)

Although the entrance and exit driveway on the applicant’s map shows in and out is from/to Apache 
Trail, 85th Place also offers a short cut to the entryway and could also be used as an exit.  The Scrap Yard 
has caused 85th Place to become a main thruway.   Customers from the Twin Knolls neighborhood on the 
north side of the Scrap Yard as well as many coming in from University Street area now use 85th Place to 
come to and depart from the Scrap Yard.  To the Scrap Yard, there is easy access by “cutting the corner” 
off 85th Place to enter directly to the driveway without driving out to Main Street and turning in.   
 
This “thruway” has resulted in much traffic on the unmaintained county road.    This is a dirt road that 
the County and State seem to be playing hot potato with.  Nobody is responsible for it.    No one 
maintains it yet the County now wants to contribute to the problem of dumping on the street, dust and 
such by approving a SUP.   This is unacceptable!  Because it is unmaintained, no County entity will pick 
up dumped items that are provided regularly by rude, disrespectful neighbors.   Even in the County 
there is confusion.   The west side of 85th place has a Right of Way for the Maricopa Department of 
Transportation, yet they refuse to provide any service.   But on the other hand they recently felt they 
had a right to clear shrubbery from private property on the northeast corner of Boise and 85th Place and 
place a Stop sign.  This is sadly hilarious as no one pays attention to stop signs on the road and there are 
speeders that fly through there, creating dust on a regular basis while no speed limit signs are posted 
and the Sheriff will take no action. Then it raises the question, if no one takes responsibility for 
maintaining it, why did the MCDOT take action to smooth and area of the road at the north end of 85th 
Place and to place a stop sign?   Why was this done?    
 
The Scrap Yard has created a traffic nightmare for those who live on 85th Place between Boise and 
Apache Trail.  If this SUP is approved and it should not be, we will be demanding that 85th Place be 
closed, just as 86th Street, 86th Place, 87th Place and 87th Street, similar dirt road are closed.   
 
CIRCULATION SYSTEM 
F.  The Circulation System is erroneously listed as turning right in and right out due to a median (not 
medium as was written).  As noted above, there is a “cut the corner” coming in off of 85th Place.   One 
will also see that cars cross directly across the 85th Place break in the median to go left onto Main Street.   
Many cars, trucks, trailers do not exit directly out onto Main Street.   There is a parking area where a 
customer parks to go into the facility to get paid for their dropped off scrap.  Many of those dropping off 
have no room to park their vehicles as they may be too large or be dragging a trailer and thus must park 
off site on the property to the east.   In fact we have photos of cars and an RV that are parked there on 
June 26, 2023 that have been there for several days and is definitely blocking the Notice of Special Use 
Permit application.  Additionally, if the wall at 85th and Main is torn down as it blocks the view of traffic 
going south on 85th as suggested in the TAC2 review,  that opens up more opportunity for customers to 
“cut the corner” rather than enter and exit from Main Street.   
 
We also wonder about the additional heavy truck traffic and track-out that is caused by the movement 
of the scrap materials being moved from this business location.   Are there not some County or State 
rules to monitor this increase usage of Apache Trail/Main Street?   
 
OTHER ISSUES 
 
PARKING AND NO MENTION OF ANOTHER BUSINESS 
We see no mention of the Tire Shop that has been functioning within the Scrap Yard main building but 
recently opened an access door to the building and now has signage.   As last viewed, there are currently 
piles of tires (possibly scrap) in front of a couple of parking spaces and there is a movable canopy set up 
under which customers can have their tires serviced/replaced.   This business now takes up parking 
spaces, so there appears to be no way that the Scrap Yard can comply with the required 18 spaces.    It is 
also distressing that the County offers under the TAC2 review, that the Scrap Yard submit for a variance

on their SUP, which is already a variance, to non-comply with the required spaces, and could possibly be 
approved for just 9 spaces.   Not sure that 9 are feasible either since the tire shop has now taken over 
several and the R/W is 100 feet, not 46’6” as the plan map submitted notes.   
 
And as a side note, I wonder if the Tire Shop has all its required permits, since the business that houses 
it does not and has not.  
 
NOTICE TO CITIZENS 
Also the Notice sent to those who are within 300 feet of the Site, shows a map that is wrong.   The site is 
showing as being east of Glenmar Road.   It is not.   It is west of Glenmar and also west of 85th Place.   
The map also reflects that Hawes Road continues north of Apache Trail and it does not.   
 
I believe it is in the best interest of the community to start this application process over from STEP1 and 
to do in compliance with County processes.   A corrected notice should be provided to those required 
and to add the following to receive all notices on this SUP application activity:

There is a planned 8-foot masonry wall surround this INDUSTRIAL business.  Not sure how an 8-foot wall 
is going to protect our RESIDENTIAL AREA from the noise and view of the excavator that has a boom

There is much to consider before approving what does not belong.   We strongly request that this 
application for Special Use Permit, NOT BE APPROVED.  It is clearly a detriment to the RESIDENTIAL 
NEIGHBORHOOD.  It does not belong and should not have been allowed as long as it has been.

I am forwarding a video with the usual wakeup call (6AM and sometimes earlier) from the 
large, loud excavator that runs before and after usual hours almost daily. The Twin Knolls 
neighborhood has contacted Maricopa Planning and Development and MCSO previously 
regarding this continued violation of P-23 Maricopa County Noise Ordinance by Juniors 
Recycling, located at 8518 East Main Street, Mesa AZ 85207. This business has not only 
been running an industrial business in a commercial zone for years without consequence, 
the community has reported noise from this business in clear violation of P-23, Section V, 
many, many times to MSCO as well as Planning and Development with no change to the 
business behavior. This business does NOT fit into any of the Exemptions outlined in 
Section VI. 
 
It has been our understanding that it is the responsibility of MSCO to enforce P-23. We 
continue to wonder why there has not been any violation issued against this business under 
Section VIII of P-23. The community has not tracked the number of complaint calls to 
MSCO but did issue a FOIA request asking for a listing of received such calls, but it has gone 
unfulfilled. There have been no violations and no fines issued under Section VIII that we 
are aware of and the noise continues. 
 
As we read P-23 more closely, the Administrator of this Ordinance is defined as "the 
Maricopa County Board of Supervisors or their authorized representative from a Maricopa 
County department, including the Maricopa County Sheriff." 
Thus, I am turning to the Board of Supervisors, especially District 2, for assistance in 
determining who is responsible for putting a halt to this continued noise before and after 
business hours to include holidays by Juniors Recycling. 
 
It is unfortunate enough that the neighborhood has had the endure increased illegal trash 
dumping, increased crime, increased dirt and dust and increased traffic as a result of this 
unpermitted business. Having to endure not only before and after hours noise from the 
excavator and also from radios, as an added bonus, we get to experience vibration from the 
excavator when it drops large loads for metal scrap or a dumpster. Who is responsible for 
holding this business responsible? Can we please have the appropriate party(ies) properly 
administer P-23?

Hello, I am writing once again as a representative of our neighborhood group, Save Twin Knoll Advocacy, to 
advise that Junior's Recycling (Scrap Yard) continues to violate County Ordinances, trespasses on neighbor's 
properties and on the State's and County's Right of Ways.   We believe this in itself should result in the 
shutdown of this business. 
As mentioned in a prior letter, we believed this business was responsible for a fire that was started on the small mountain formation known 
as the Twin Knolls, resulting in both Rural Metro and also Arizona Department of Forestry and Fire being called to fight this fire.   A follow‐
up was conducted with Chief Tim Soule of Rural Metro regarding the cause of the June 27, 2023 fire.    I spoke with him personally on July 
19, 2023.   Although there is not an "official" cause of the fire, he did state that Scrap Yard employees were using a torch, and he believed 
that a stray spark did indeed cause this fire.   Chief Soule was present to fight the fire.  
 
So not only is the neighborhood subjected to this INDUSTRY functioning illegally in a commercial zone and 
blatantly violating P-23, now we are being subjected to possible destruction of our neighborhood.  Use of 
torches is not a one-time thing.   Because this scrap yard deals in metal, they regularly use torches and metal 
saws to cut metals.   This has truly crossed the line for us!!   Not only are torches used, but daily, and in clear 
violation of County Ordinance P-23 , they run a noisy excavator that can send sparks flying from its 
exhaust.  Even just metal on metal can cause a spark and one stray ember  from a fire could be devastating to 
our neighborhood that consists mostly of mobile homes or manufactured homes.  
 
The neighborhood of Twin Knolls once again emphasizes their request that the Application for a Special Use 
Permit be DENIED.

I'm writing in reference to zoning violation 2021002061 and SUP case Z2022097. 
 
I strongly oppose the Special Use Permit for this location. 
 
For years this property owner has operated in violation of existing zoning laws. A recent fire on Twin Knolls can be traced 
back to metal cutting activities at this business, an activity that would be prohibited if the business was held to existing 
commercial zoning rules. 
 
Rewarding this owner with a change in zoning to industrial to make his activities legal while giving no thought to the 
existing neighborhood is wrong and the County government should be thinking carefully about this decision. 
 
Changing adjacent property zoning from commercial to industrial can have a significant negative effect on residential 
property. 
In many cities, such a change in zoning has led to the collapse of older neighborhoods resulting in a decrease in 
affordable housing for the community. 
 
In todays economic conditions, and with our current low level of available affordable housing, this decision would be 
unexcusable and would exhibit a detachment from the reality of life in the community. 
 
This is the same careless thought process that led Maricopa County to almost approve a mine towering over 100 feet 
above the center of our neighborhood. 
 
What message are you trying to send the people of Maricopa County? 
 
You must not only deny this SUP, the County should also begin making this business obey the legal requirements of the 
current zoning.

I am writing to express my concern about the special use permit case number Z2022097. 
 
Our neighborhood has been in contact with almost every entity and authority that we can possibly think of, to put an 
end to this illegal business's operation.  
 
We live in a residential area. Junior's Recycling causes us great stress with noise at all hours, excessive traffic causing 
dust and noise, pollution, debris, exposure to chemicals, and even a fire on the Twin Knolls that endangered our entire 
neighborhood on a windy day, that was started by sparks from Junior's business's machinery,  
 
This business has been operating illegally for a very long time, and has not followed the rules laid forth by the county. 
Our requests and pleas for help has been repeatedly ignored. 
 
 We as homeowners pay taxes and follow the rules. We expect that the county would respect that, and do what is right 
for our neighborhood and  to protect us from further upset, emotional distress, and 
devaluation of our property values.. the list goes on. 
 
We request that you deny permit Case Z2022097. 
 
This business is industrial, and is illegally running on a commercially zoned property. 
 
We do not want the zoning changed! Why would a residential neighborhood want industry all around it... feet away 
from where they live? This is not acceptable and we do not want any change to the zoning. We want our rights to be 
respected. 
 
Changing the zoning will only pave way for more industry in our neighborhood, which we do not want. It is unfair to our 
community to even consider such a change. 
 
Please do not reward those who do not follow the rules. 
 This sets a dangerous and unfair precedent in our society for wrongdoers, who feel like they can do whatever they want 
to do, while honest people, who've worked hard their whole lives' rights will be trampled upon...this is unrighteous.

My name is Jesse Recker‐ a long time resident of "Twin Knolls Estates".  I am writing to you in regard to 
Junior's Recycling Special use permit as I will be out of town and unavailable to attend the 10/5/23 Planning 
and Zoning hearing. 
 
Since the early 80's, I grew up in this neighborhood and have been a homeowner here since 2006.  Twin Knolls 
has been a landmark all these years and it is a shame we are battling an issue yet again regarding the misuse 
of the area.  We nearly lost this area to a quarry, had to attend hearings, and even picket on Apache Trail!   
 
Junior's recycling started out as a very small business‐ focusing mainly on aluminum can recycling.  Since 
moving to the current location, the business has increased and with that, noise and traffic have also increased 
(not in a positive way).  All the way from my place, I can hear the rumble and feel the vibration of the 
excavator they utilize.  While I do not directly smell the exhaust, I am certain is does waft our way‐ causing 
unseen pollution.  Recently (June/July, I believe), a fire was started on the mountain due to a spark caused by 
this business. 
 
Most concerning to me, is the increased amount of vagrant traffic.  I have caught and called the Sherrif 
multiple times, vagrants and "tweakers", for the lack of better term", wandering down our alley, even peering 
into backyards searching for scrap to sell.  This business attracts these people who then, target our homes.  
 
We (at least on 86th St.), are trying to revitalize our neighborhood and make it a pleasant place to live.  The 
business draws unsavory people, and the continuous noise is a nuisance to the neighboring homes.   
 
As a licensed real estate agent, 20+ year professional property manager, and homeowner, I am expressing my 
opinion and saying NO to allowing the Special Use Permit to be granted by the Planning and Zoning 
Commission.

Really loud noises from Juniors Recycling on Main/85th pl
Hi there, my name is Colton Teacher and I live at 128 N 86th St which is like... 100 yards away from this place on Main st 
and 85th place called Juniors Recycling? and I just recently found out that they've been doing this illegally for a long time 
now and I'm wondering why anyone allowed this to happen for so long? For a residential area, this is like, REALLY loud. If 
I were to produce this much noise, especially for how long it has been going on, I would have had the cops called on me 
dozens of times by now and probably thrown in jail or landed up in a court for this.  
 
So we found out that after having operated illegally for X amount of months/years, they're trying to finally apply for a 
permit that allows them to do this, even though they've been doing it non‐stop without penalty or any repercussions. To 
simply put it, this shouldn't be allowed by even a thought, it is RIGHT next to a residential area on the North, South, and 
East side of this extremely loud industrial recycling plant. You can feel the noises they make through the ground, let 
alone hear it through the walls. 
 
Having this illegal business continuing to go on would drive down the values of all properties in the vicinity within at 
least 1/2 mile. It would incentivize the homeless people around here on Main street and University and everywhere in 
between to continue stealing peoples items and trying to cash them in; wires, copper, random scrap, tools, etc etc. 
 
So I would ask you, as a 1st time home buyer, please help and put an end to this egregious facility that is polluting the air 
with insanely loud noises. They shouldn't be doing it in the first place and legal action should be taken to the businesses 
name and the owners.

To whom this may concern. I live at 113 N 86th st mesa on county island. I brought this huge problem to Charles Hart 2 
years ago next month. I had called Chip to complain about the ongoing noise from this recycling center that use to be a 
landscape supply company.  I explained to Chip that whatever juniors is doing is literally shaking my house I've even had 
pictures fall of my walls twice!! This is  constantly throughout the day starting early in the morning. My dog constantly 
thinks something is out front of my house because of all the pounding and noise from this place. Anytime I'm outside 
doing work to my house, yards or getting my rv ready for a trip I literally get anxiety from the constant pounding and 
crushing of metal from juniors. My house is 2 streets away too. 2 years ago Chip assured me this place would be shut 
down because it's industrial business in a commercial zoned area and does NOT have permits or proper sewer system or 
anything to be allowed. There is no other business in the area for probably 10 miles away that has a huge earth moving 
piece of equipment being used to crush cars, load semis full of metal and everything else that goes on. Neighbors that 
live behind me on next street over didn't know where all the noise was coming from either until we talked one day and 
they asked me about it.  
 This illegally run business does not belong in a neighborhood. This brings nothing but constant noise basically 7 days a 
week, theft from homeless stealing and turning into scrap and this place needs to be shut down immediately.  I have 
called/complained about the disturbing noise for 2 years now and I'm so sick of it. I can only imagine if I lived closer to it 
I wouldn't want to even go home. What if we wanted to sell our homes and buyers are hearing all this disturbing noise 
of crushing metal and shaking of our houses. I sure wouldn't want to buy a home with that. Please turn down this SUP 
THIS DOES NOT BELONG IN A NEIGHBORHOOD.

     Dear sir, I am emailing to you my support for Junior's Recycling. I have been using Junior's Recycling for many years. 
He provides I much needed service to those of us that live in East Mesa, as he recycles many kinds of recyclable 
materials. Recycling is a very much needed industry. The aluminum can manufacturers are begging people to recycle 
their aluminum cans, as there is a shortage of aluminum to make cans.    
     I live in a 55+ community, and we collect aluminum cans from our residents, and we then take them to Juniors to 
recycle them. The money we receive from recycling funds some of the activity groups in our senior center. There are no 
other recycle centers that are located near our community, and if Junior's is closed down it will make it much harder to 
recycle our cans.  
     I have seen the posts on social media about how Junior's is an eyesore and noisy and dirty. That's a given for the type 
of business it is, but for people to say that Junior's is especially bad is false. If you take in the whole area where Junior's is 
located, it's all some form of industrial/business type of usage. That whole area is stuck in the 1950's. He only operates 
his business during normal daylight working hours, he isn't disturbing the peace of the pretty run down neighborhood he's 
currently next to except for during the day.  
     If anyone was to drive up and down Main St, or the Apache Trail, or old highway 60 as it's also known as, they will 
clearly see that Junior's recycling is just not that much different than any other structures along that stretch of the road.  
     As I said, Junior's recycling provides a much needed service to the residents of East Mesa, and it would be a damn 
shame to let 1 or 2 disgruntled neighbors shut it down, and then we have no place within reasonable distance to recycle 
cans and whatever else we might find the need to recycle.

1. Junior's has been in violation of zoning laws for years and recycling is basically a misnomer.   It is a scrap 
yard, not a recycling center. It's a junkyard of tires all over the property.  
2. Crime, dumping, dust, increased traffic, noise, pollution has increased as this business has expanded, still in 
non-compliance 
3.  Concerns for fire as per Rural Metro, after conversing with owner,  June fire was likely the result of scrap 
activity. Could be devastating to the community. 
4.  Homes will be impossible to sell with the noise that continues to not be is not addressed. Home values will 
plummet.  Who wants to live near a business that runs a 18ft boom excavator starting a 6AM during the 
week?     
5.  Recycling is great but it does not belong in the middle of a neighborhood, just as mining a couple of years 
back did not either.   The overflow scrap from this business is visible along Main Street.   Let's clean up this 
area, not add more problems to the neighborhood.   This is not what a neighborhood should look like!   
6.  A scrap yard is great, but not in the middle of a neighborhood that we are trying to revitalize.  This will 
destroy any efforts we are trying to make to upgrade our area to a quiet, family friendly community. The owners 
of this dump yard pays homeless people cash to steal from the the yards of the local residents.  
 
We adamantly request denial of this permit.

As a representative of a neighborhood group named Save Twin Knolls, I would like to bring to 
the attention of the court the concerns we have regarding Mr. Gonzalez’s, industrial business 
that is operating on property that is zoned commercial and which butts up to property 
(Parcel 218-39-005) that is zoned residential (R-3) and is also within feet of neighborhood 
housing.

There was a county compliance inspection conducted March 15,2023.  The property 
owner had applied for a Special Use Permit (Z2022097); however no required action per the 
Compliance Agreement of March 8, 2022 has been completed.   The deadline for completion 
was February 24, 2023 to obtain zoning entitlements.  The Agreement is stated as void on the 
Accela Citizen Access system and a civil hearing is scheduled for May 30, 2023 at 
9:00am.  However, I was recently informed by Mr. Charles Hart, Maricopa County Planning 
and Development (P&D), that Mr. Gonzalez has submitted a plan to P&D on April 23, 
2023.  Please note this is after failing to comply with requirements where he was given a 
year in which to comply.    
It is incomprehensible and bewildering to the community how the county can even offer a 
Special Use Permit for any such industrial business and for an unbelievable period of time of 
ten years, when the current zoning is and has been Commercial (C-3) and 
surrounding properties are zoned Residential. 
The business continues to run contrary to the legal requirements and should have been 
put to a halt years ago.  
Mr. Gonzalez originally had a recycling business in a nearby location, 15 N. 85th Place, just east 
of his currently location.   He moved to 8518 East Main a number of years ago and expanded 
his business to a scrap yard, which is clearly an Industrial activity. He was leasing the 
property at that time.    In 2021, he purchased the property, and it was then that the 
community realized Mr. Gonzalez was and had been in business without proper authority 
and it was reported it to the County.  He hasalso purchased additional property nearby for 
storing much of the scrap before it is sold.  These properties are Parcel 218-26-017 and 218-
26-015B with an address of 8336 E Main Street, Mesa AZ  85207 and these are also zoned 
Commercial.  These properties used to be a landscape/brick sales business. As his business 
expanded, the neighborhood has begun to decline.    
There is increase in crime.  Numerous unhoused individuals are now in the area and look for 
items to steal to take to the scrap yard for income.  Neighbors have had batteries stolen.   A 
battery is of value at the scrap yard and is a source of income to the unhoused, or for anyone in 
need money for that matter.  The scrap yard has also created a steady stream of stolen shopping 
carts filled with the pickings of the unhoused.  These are pushed down the county unmaintained 
road to the scrap yard for money.   This is NOT a parade any neighborhood should have to view 
for any reason from their homes, yet for years families have.    Bicycles are regularly stolen and 
bicycles have been noted as taken into scrap.  If one looks at the Lexis Nexis Crime Map over 
time, one can see there is increased crime in the area.   
There area is also now a draw for people to dump not only on the Knolls area behind the 
scrap yard (218-39-005, 218-26-013, 218-26-008H, 218-26-008G and several others) but on 
85thPlace, an unmaintained county road next to the scrap yard. On April 24, 2023, someone 
dropped a burned out RV on 85th Place since the scrap yard would not take it.   The individuals 
just dropped it and took off in their truck.   
The scrap yard takes in and weighs most metals and pays by the weight.  It has been observed 
that there are no stickers on the scales, indicating they have been properly inspected and 
approved.   Weight Scales are now inspected or monitored by State Weights & Measurements

Division due to the fact operation has no permit.  This incredible when you think that this has 
been allowed for years!!  
There is also a tire business that works out of this facility.  It is unknown if it is his business or 
one that is run by someone else.  The names are different.  We are also unsure if there are 
required permits for this business.  On April 4 at 6:47 AM the community experienced a truck 
laden with at least 100 tires driving down the unmaintained 85th Place, disturbing neighbors 
with noise and dust.    
There are major concerns about the unsightliness and noise from the business.  There is 
no appropriate fencing, which makes the activity visible from the east side 
neighborhood.   There is alsonoise from diesel powered shovels moving heavy scrap with the 
yard and loading into large containers,  not only during their business hours which are posted 
as 8:00AM to 4:00PM weekdays and 8:30AM to 1:00PM on Saturday but many hoursafter that 
to include on weekends.  There is almost constantnoise from metals saws, grinders, moving of 
dumpsters, etc.  Several videos are available.   In addition to the fact, this industrial business 
is a noise and visual disturbance, there are concerns what is being released into the air with 
housing so close.  
Numerous calls have been made to the Sheriff’s department about the noise, as they are 
responsible for enforcing Maricopa County Noise Ordinance P-23, yet the activity 
continues. We made a Freedom of Information Act public records request on April 13, 2023 
for the number of calls made regarding the reporting of noise from the facility, as we know 
there are many, but it has yet to be fulfilled. There are penalties to be applied for each 
violation of noise, yet we have not seen any court cases established, and the noise continues.   
The yard also draws additional traffic on an unmaintained road resulting in speeding above 
the 15 MPH limit, raising dust, harming air quality.  It creates a dangerous situation for the 
neighborhood with drivers failing to drive in accordance with the law.   
  
In summary – 
The business is industrial and does not belong in a residential neighborhood and should 
not be                                   functioning in C-3 zoning or butting up to R-3 properties        
The business has been functioning without proper permits or licensing for years 
The business has failed to comply with an agreement with the County to the point it is listed 
as void 
The business is a nuisance to the neighborhood bringing increased crime 
The business potentially creates harm to the neighborhood with air quality contamination 
The business has created additional traffic on an unmaintained county dirt road where 
there is no    county enforcement available for a 15 mph speed limit, resulting in dust and 
danger  
The business operates outside of business hours resulting in failure to comply with P-23 
  
  
There seems to be disregard for numerous legal requirements bythis business.  It has 
functioned for years without proper licensing or permits.   We are all for a business to be 
successful, but when it functions illegally for years, to include within a wrong business zoning 
causing harm to the neighborhood, we respectfully ask that this business NOT be issued a

Special Use Permit.  Issuing such a permit would set a precedent for other industrial business 
to come to this area.   It would be a shame if the county fails to protect its residents in favor of 
an industrial business clearly detrimental to the area.

The constant noise of equipment, metal banging and the smells should not be next 
to a residenƟal neighborhood. This is a residenƟal rental and we constantly get complaints 
from our tenant about the early morning noise of the equipment operaƟng as early as 
5:00 am.  Also, our tenant complains of the shady customers that frequent the recycling 
yard.  They line up early on foot with their shopping carts full of items to recycle. 
Neighbors can’t leave anything outside their homes as it will disappear.  Our tenant 
had to start parking his vehicle behind a locked gate.  On more than one occasion he 
has come out in the morning to leave for work to find these customers in his yard. 
This type of business should not be next to residenƟal properƟes but needs to be in an

Greetings Mr. Martell, 
 
I am writing this letter on behalf of the owners of Junior’s Recycling Center, LLC in the C-3 zoning district located 
840 feet east of the NEC of Main Street and Hawes Road in the Mesa area. I ask the Committee to strongly 
consider voting “yes,” in the request for Special Use Permit Z2022097.  
As a small business owner myself, I utilize the services provided at Junior’s Recycling on a regular basis. I could 
draft an extensive report on the benefits to recycling but will simply summarize by stating that the worth to 
reducing landfill waste and the conservation of natural resources speak for themselves. My business replaces a 
great deal of electronic equipment and needs to dispose of measurable metal scrap monthly. Junior’s is the only 
reputable provider in the area for proper processing of that waste. 
The area where this business is located is perfectly situated within our community. This property is a reasonable 
distance away from any residential structures and does not impede the access to or peace of surrounding 
dwellings. Majority of the land in the vicinity is occupied by commercial businesses, none of which can be 
considered a great contrast to Junior’s Recycling Center.  
I would also like to address the slanderous and frankly, malicious claims the opposition to this permit have been 
circulating throughout the surrounding communities. A statement has been made implying that a fire this past June 
on the upper hillside behind the property was caused by fault of operations at Junior’s Recycling Center. It was 
directly reported by the distinguished members of the Mesa area Fire Department who responded to the incident, 
that the probable cause, (which was not in the proximity of the property in discussion), was a stray piece of glass 
resulting in solar ignition. The owners of this establishment have complied with all ordinances and requests to

I and many members of the community use the services supplied by Junior's Recycling Center frequently. We appreciate 
the convenience of the location and the excellent customer service provided. The staff is always willing to go above and 
beyond to provide the best possible experience for thier customers.  
 
Junior's Recycling center is an asset to Mesa and the surrounding area. I would hate to have to travel to a less desirable 
area in Phoenix or beyond to find a location for responsibly disposing of recyclable waste. Please approve the Special 
Use Permit for the benefit of the entire community.   
 
Without a place like this located near me I will put recyclables in the trash, and they will end up in the landfills that the 
city has to pay for. Not Cans, paper or cardboard, but things that Mesa Blue Bin Recycling won't accept. Things like water 
heaters, batteries, metals, appliances, A/C units, motors, wire, car rims, and so much more. I have taken all this to 
Junior's and have had it recycled instead of put into the ground. I will continue to do so but not if it's inconvenient. Keep 
a responsible recycler open and available. I want to do my part, please do yours.
