Since the publishing of the staff report, staff received one letter of support for the request. They 
believe that this recycling center is an asset to the community by providing convenience for their 
recycling needs. The letter is attached.   
 
Additionally, since the publishing of the staff report, staff received four letters of opposition to the 
request. Their concerns are this land use creates excessive noise, dust, fire risk, blight, and 
incompatible industrial nature of this land use. The letters are attached.

Greetings Mr. Martell,
I am writing this letter on behalf of the owners of Junior's Recycling Center, LLC in the C-3
zoning district located 840 feet east of the NEC of Main Street and Hawes Road in the Mesa
area. I ask the Committee to strongly consider voting "yes", in the request for Special Use
Permit Z2022097. 
I and many members of the community use the services supplied by Junior's Recycling Center
frequently. We appreciate the convenience of the location and the excellent customer service
provided. The staff is always willing to go above and beyond to provide the best possible
experience for their customers. 
Junior's Recycling Center is an asset to Mesa and the surrounding area. I would hate to have to
travel to a less desirable area in Phoenix or beyond to find a location for responsibly disposing
of recyclable waste. Please approve the Special Use Permit for the benefit of the entire
community.

Hello, my name is Jenifer Finkbeiner.  I have lived  in Az since 1978. My residence has been on Hawes Rd, foothills of the 
Twin Knolls, since 2007.  
Many people in my community are very concerned about the several violations Junior's Recycling is commiting. Violating 
P‐23. For example (another) brush fire, the loud noise and trash. Which also, invites homeless and more trash.  
We, the community, do not want Junior's to get a Special Use Permit. We work hard to preserve this land, homes and

Case Z2022097 – Junior’s Recycling (Scrap Yard) Industrial

The Twin Knolls neighborhood in Mesa AZ opposes the rezoning of current commercial property to 
support a Special Use Permit, which would allow an INDUSTRIAL business interfering with our residential 
area.    This rezoning has not been, and will not be a benefit to our local residents. Aside from the fact 
there is recycling, this business has done nothing but cause our area to decline in the past three years.  
The area surrounding this business had been pristine once again the neighborhood fought to maintain 
and elevate our area when one of the owners of the historic Twin Knolls Mountain formation,  around 
which our neighborhood grew and thrived,  tried to tear down the Knolls utilizing a loophole in the law 
which allows mining basically anywhere in Arizona.   The neighborhood banned together under our 
umbrella of Save Twin Knolls Advocacy Group to help save our neighborhood and we beg the 
Commission and the Board of Supervisors to see clearly that there are numerous reasons why this 
location is NOT where an Industrial Scrap Yard should be located.  
 
In addition to the rezoning from C-3 to C-3SUP, there are noise, dust, environmental issues and lack of 
ordinance violation consequences, which have been and continue to be detrimental to our 
neighborhood.  The surrounding residential properties belong to homeowners, many of whom have 
retired to this area or have been in the areas for decades, due to the beauty of the Twin Knolls 
formation.   This was a lovely and peaceful view for many until Juniors Recycling (that’s a nice name for 
what is really a scrap yard) opened years ago at a nearby location and has since moved and expanded 
and has been running the business illegally for years.  Several homes have been built in the area recently 
and purchasers did not sign up for 12+ hours of noise, dust, increased traffic, along with potentially toxic 
air and contaminated land.  Approving this permit would be a slap in the face not only to those 
businesses that do follow rules but to those who came to this area to enjoy the beauty and quiet that 
once existed…pre-Scrap Yard.  There are 13 scrap yard/recyclers in an approximate 15-mile radius that 
do follow rules and are properly located, NOT in a neighborhood.  Approving this SUP would set a 
horrible precedent, inviting more INDUSTRIAL type activity to this area.   We do not want or need an 
INDUSTRIAL business in the Twin Knolls neighborhood.  
 
 Sadly, the owner failed to do his due diligence before expanding his business with total disregard for 
county rules and ordinances and well as other laws.   
 
On June 27, 2023, we almost lost the Twin Knolls formation and could have potentially lost our 
neighborhood, to fire, which we surmise from inspection for the fire start point that it could have 
started from a spark from the CAT320C the Scrap Yard owns and runs at the back of the Scrap Yard 
property.  It runs hours a day, to include both before and after posted work hours.   Two neighbors took 
a closer look at the burn area, and we believe the fire could have been caused by sparks from the 
excavator.   In research, we found an Expert CAT site on-line stating the following: "The sparks you see 
are caused by hard particles of soot and carbon in the exhaust.  I see this lot.   Over time the inside of 
the exhaust will have a lot of soot and carbon build-up.   Eventually it will slowly break loose and when it 
does, you can see sparks coming from the exhaust."   Here is the link for a drone video of the Knolls

additional photos in our possession, show what appears to be a triangular burn pattern that points 
directly at the Scrap Yard.  We do not have an official cause for the fire from Rural Metro and they state

they do not usually provide a cause unless it is clear such as a house burn and a can of gasoline is 
outside the home but in conversation with Rural Metro, there was conversation with Junior’s Recycling 
and the owner stated they had been using a torch which may have sparked the fire.  Thankfully Rural 
Metro did an excellent job in keeping the fire from expanding to the neighborhood, which could have 
been disastrous to our humble mobile homes.   One stray ember could have resulted in the destruction 
of an entire neighborhood. Thankfully the winds were on the mild side that day but what about the next 
time?   This fire did create a bump in PM on that day, as we have a neighbor about ½ mile away 
monitoring air quality.   
 
It has become clear that Junior’s Recycling is applying for a special use permit is under Section 1301.1.22 
of the Maricopa Zoning Ordinance as a NON-CONFORMING under 1301.6 which must be approved by 
the BOS.   The neighborhood does not need or want a NON-CONFORMING Industrial Business.  
 
Our interpretation is that an automatic denial should happen just in reading  Article 1302.1, the intent 
being  “The uses, buildings and structures permitted in this Section shall be established and maintained 
so as to provide minimum interference with the use and enjoyment of neighboring uses, building and 
structures and to ensure public health, safety and convenience.”   Any approval of this Permit request 
would not be in compliance with this Article of Maricopa County Zoning Rules.    
 
CITIZEN NOTIFICATION ERRORS 
The whole process of application begins with an error in Citizen Notification – “The owner or authorized 
agent shall also post the property (see example in “Sign Specifications”) included in the proposed 
change.”  
Per County Rules - The posting shall be in no less than two places with at least one notice for each 
quarter mile of frontage along perimeter right-of-way so that the notices are visible from the nearest 
public right-of-way. The postings shall remain in place for the entire application period. Each notice 
shall be a minimum of six square feet in area unless combined with the public hearing notices. The 
posting shall include, at a minimum, a brief description of the area of the proposed Zone Change, a 
general explanation of the nature of the proposal, the name of the owner or authorized agent, and……. 
3. The sign shall have a white background with black lettering.  
4. The minimum lettering size shall be 1/2 inch for lowercase and 1 inch for upper case. The words 
“Zoning” and “Public Hearing” shall be a minimum of 2 inches in size.   (Not quite sure how one is to 
read the sign traveling at 45 MPH on Main Street and since it is off property, why would any customer 
be looking to see this?)… 
7. The height of the sign shall be at least 4 ft from finished grade to top of sign and shall not be 
obstructed from view.  
Not only was just one sign posted, but it was not even on the applicant’s property, which is even 
clearly noted in their own evidence.   Additionally, the sign was posted so that anyone driving west on 
Apache Trail would have to know the one sign was there, stop, get out of their vehicle and to look 
behind the dumpster, RV's, automobiles and whatever else this business parks on a daily basis in order 
to hunt down this sign.  In violation of the County guidance noted above, the ONE sign was obstructed 
from view and continues to be on a daily basis.  This also means that the certification of posting 
submitted to the county is false.   (See ROW-Trespass-Notification Failure folder on thumb drive).

Additionally, when a meeting with the Commission was scheduled, the one sign posted off to the west 
of the property was updated but continues to be blocked.   The second posting to the east finally 
appeared but it too is also partially off property at 85th Place and Main Street.  This posting contains a 
falsehood that it was posted in May.   The second sign was NOT posted in May.   
 
Notice of the meeting was only sent to those who were in the 300-foot radius to the property.   There 
were 16 names submitted as those who oppose approval of the SUP, that are considered interested 
parties under Chapter 3 of the Maricopa Zoning Ordinance and they were not included in meeting 
notification.    
 
VIOLATION CASE V202102261 
Once the neighborhood became aware of the illegality of the Scrap Yard, a complaint was filed and a 
violation issued.  Under this violation there was a hearing held on May 30, 2023, due to the fact that the 
violator  failed to comply with the agreement entered into with the County over a year prior.    
Subsequent to the hearing notice and thus legal action being taken by the County, only then did the 
Permit applicant begin the process in attempts to comply with County requirements  
 
PLAN NARRATIVE ERRORS 
We are taking  exception to the Plan Narrative provided by the applicant to the county initially dated 
May 9, 2022 and Revised April 10, 2023 (almost a year where no action was taken by applicant after 
entering into an agreement with the County).   Please note:   There is NO mention of the tire shop 
business has started working out of Junior’s, Chapo’s Tire Shop, and continues to do so,to include 
working on Sundays.   
 
DESCRIPTION OF PROPOSAL  
Section C- Juniors Recycling has been in business much longer than 4 years.   He previously ran a small 
recycling business from a location at 15 N. 85th Place where he also failed to have proper permitting.   He 
leased that location and then moved to his current location where he also leased the property and ran 
his business without proper permitting.  He then purchased the land and business in 2021 and still failed 
to have proper permitting.   The permit is for 10 years, when it is very likely Mr. Gonzalez has already 
been running his business illegally for that length of time by flying under the radar of county authority 
and to the detriment of the residential community.  Rewarding this behavior does not seem 
appropriate.  
 
Also in Section C, it is stated that the hours of operation are 8AM-9PM.    The neighborhood strongly 
objects to this for multiple reasons.  First and foremost, INDUSTRY does not belong next to Residential 
or in a Commercial zone.   Another reason is NOISE!    
 
Posted hours for the Juniors Recycling are:  
 Monday 8 AM–4 PM;  
Tuesday 8 AM–4 PM;  
Wednesday 8 AM–4 PM; 
Thursday 8 AM–4 PM;  
Friday 8 AM–4 PM;  
Saturday 8:30 AM–1 PM;   
Sunday Closed 
 
A visit to 13 cyclers/scrap yards in a 15-mile radius of the applicant’s business showed they have similar 
posted hours. Four of the businesses had an excavator and NOT ONE advised that they ran their 
excavators outside of posted hours as this business does.  More importantly, NONE of these businesses

were surrounded by homes.   It is unacceptable to the neighborhood to have to listen to the noise from 
an 18-foot boom excavator moving/crushing heavy metals and large dumpsters of materials, both of 
which can be heard and cause vibration felt hundreds of feet away.  As an example, on June 23, 2023, a 
community member was parked in a lot across Main Street and to the east and was able to feel the 
vibration of items being moved and could easily hear the excavator.  There are 52 videos on the thumb 
drive submitted as evidence that the excavator at the scrap yard is running at all hours, well before 
and well after the posted open hours and the customary hours for any similar businesses.   
 
The neighborhood is also subject to noise of cutting/sawing and breakdown of metals, all while loud 
music is playing to include even after posted hours and on Holidays.   This is a violation of P-23 and the 
Sheriff has been called numerous times.  Some are anonymous, as there is fear of retaliation and per 
MSCO, those don’t count.   So no anonymous call counts for anything?    We requested under a Freedom 
of Information Act request asking for all calls made in complaints about Juniors but never received a 
response.   
 
Maricopa County Noise Ordinance P-23 (for your reference) 
Paragraph I. Purpose  
 
At and above certain levels, noise is detrimental to the health and welfare of Maricopa County 
citizens. Therefore, Maricopa County has determined that it is in the best interest of its citizens to 
control noise in a manner which promotes commerce; the use, value, and enjoyment of property; sleep 
and repose; and environmental quality. Therefore, it is hereby declared to be the policy of Maricopa 
County to prohibit excessive, unnecessary, disruptive, and annoying noises from all sources.   This 
business not only is INDUSTRIAL in a Commercial Zone but blatantly causes excessive, unnecessary, 
disruptive and annoying noises.   
 
Under Paragraph V Public Disturbances 
 A. It shall be unlawful for any person to cause, or for any person in possession of property to allow to 
originate from the property, any noise which disturbs the peace or quiet of any neighborhood if such 
noise can be heard from within closed residential structures located within 500 feet of the boundary of 
the property from which such noise emanates. This subsection shall not apply to noise produced in the 
normal conduct of business provided that such noise occurs within the normal and customary hours 
for the conduct of such business, which is based on the normal and customary hours of operation of 
similar, existing businesses, and the operation is legally conducted within the scope of all ordinances, 
laws, and statutes of Maricopa County and the State of Arizona.  
 
Also under P-23  C. Radios and Sound M Amplification Devices - It shall be unlawful for any person to 
operate any radio, loudspeaker, musical instrument, or other sound producing, sound reproducing, or 
sound amplification equipment which emits noise that can be heard from within closed residential 
structures located within 500 feet of the boundary of the property from which such noise emanates. 
Is it the position of the County that everyone must stay in their homes with doors and windows closed 
and hope it stops the noise from being heard?   
 
Even though it is clearly written in Section V (A) of County Ordinance P-23, MCSO has refused to take 
action to violate this business for Noise.  Please see our response and detailed evidence provided to 
MSCO from October 9, 2023 which is attached and is also on the thumb drive.   
 
Section C also claims there are 10-20 customers a day.   This is a very lowball estimate, when in fact the 
Scrap Yard issues a receipt for scrap received and the dollar amount the customer will receive for said 
scrap.   This receipt is taken to the “office” for payment.   All one needs to do is look through his records 
to see, this is a very low number.   As a visual, a representative from the neighborhood did a count of

activity at the business on June 23, 2023. There were 5 customers seen from 10:45AM-11:35AM.     That 
is probably an off time and also this is summer when many folks are gone so if you estimate for the day, 
there could have been up to 40 customers on that day.   On June 24, 2023, 12 customers were seen 
between 9:30-10:30.   I would guess this too might be a bit of a down time as the rush would be more at 
opening time,  when a line of customers can be seen waiting for service and there would be increased 
activity closer to closing time.   We also suggest that if only there were 20 customers a day, would the 
business have all of his properties FULL of scrap?  The Plan Narrative is very misleading.   
 
Section C also indicates customers enter with their recyclables/scrap to be weighed on scales.  It has 
been confirmed the scales are licensed under Weights and Measures. BMF# 42006.   How can the scales 
be licensed, when the business has not ever been??   The application letter also provides a very nice 
photo of a clean area of the front of the business.   They must have swept up because that is not how it 
normally looks.  (Please see thumb drive.)  There are scrap vehicles parked on the residential property to 
the west, near the Scrap Yard's, sometimes overflowing, dumpster.   The dumpster was and has been 
located to the south east corner of the property which is where the Permit Notice was placed…behind 
the dumpster.  It appears that not only was the Notice placed off of the property, as of June 23, 2023,  it 
was noted that two vehicles and an RV were parked by the Permit Notice sign making it basically 
impossible to see. Even if one was a client dropping off materials, the Notice is not is a place where one 
would notice and especially would not when the dumpster was in its usual place.   There are many times 
bicycles or shopping carts among other items that are to the east of the entry where homeless have left 
the carts after dropping off scrap metal or cans for money.  On June 23, 2023 and July 2, 2023, we have 
photo evidence of what appears to be an abandoned vehicle on 85th Place, outside of the scrap yard 
property.  This is NOT what we want in our neighborhood! 
 
Section C also advised that there is a screened/storage area in at the rear of  property.   The sides of the 
main back building recently had the walls removed allowing for full flow of air to distribute dust and 
pollution to the surrounding neighborhood. .   The only screen that is at the back of the property is the 
fence which outlines the property. 
 
RELATIONSHIP TO SURROUNDING AREA 
D.   We take exception to this section, as the narrative fails to accurately describe the surrounding area.   
It appears to be intentionally misleading.  
 
To the immediate east is a commercial business, a car repair business which recently opened. It is 
unclear whether they too are car sales and if so, it is unclear if they have proper licensing.  There also 
appears to be a residence on the property.  There is signage that indicates they are auto sales, but we 
have been unable to locate a license for that.    This was the prior location of Junior’s Recycling.   This 
business recently attempted to build a building without proper permit and was put under stop work 
order and they have been operating on Sundays.    The Plan Narrative talks about property directly to 
the east; however if one moves to the east and slightly north, there are numerous occupied homes.  This 
is a RESIDENTIAL district.   These homes are exposed to the noise from the excavator, metal saws, etc. 
coming from Scrap Yard at all hours of the day and to include most recently on a holiday.    
 
Looking a bit further east, the following are nearby to the scrap yard 
Parcel 218-39-003E; 003N; 003H; 003J; 003K; 003D; 004L; 004M; 004F; 004ER; 004C ; just to mention a 
few, ALL of which are listed as RESIDENTIAL.   
 
To the immediate north is currently unoccupied land that is Zoned R-3 RESIDENTIAL per County Records.   
This land had reclamation plans posted in 2019/2020 to build homes, which requires a residential 
zoning. (This fell through due to termination of planned “mining” in the middle of Residential

neighborhood).  Apparently the county has conflicting information on their web-site regarding the 
zoning and it is C-3 zoning but again, how does one have residential plans in C-3 zoning?  
 
To the immediate west is currently unoccupied land Zoned R-3- RESIDENTIAL.  Same as immediately 
above.  
 
Also to the west one will find Parcel 216-26-016, R1-8; 011A, R-5; 020D, R-5; with a few C-3’s in the area.  
218-26-017 and 015 are C-3 and owned by Mr. Gonzalez for his storage of scrap, which is not a pretty 
sight either.  218-26-034M and 034L are C-3 and in the process of having rental properties built and it is 
unclear how that can be, if it is currently listed as commercial.  218-26-022 is owned by the City of Mesa 
and is C-3.  
 
To the South is Main Street/Apache Trail and across the street are a variety of properties.   
  
Parcel 218-59-028/8449 E Apache Trail (C-3) belongs to Hays Leasing.  This was part of a Mobile Home 
Park that remains in place with Residences now behind the small Leasing Company. 
 
Parcel 218-44-001G/8421 E Main(C-3) and 001F (R-5) belong to Bright Haven MHC LLC, basically a 
mobile home park with RESIDENCES.  
 
Parcel 218-44-003D/8601 E Main (R-5) -028 belong to Sunset Mobile Home and RV Park LLC with 
RESIDENCES.     
 
Section D also notes that this business is appropriate for the area.   It is NOT!   This is an INDUSTRIAL 
business, situated in the middle of many residences/neighborhoods. Juniors Recycling is NOT a 
commercial business as their plan submission suggests.  Another misleading statement.  It is 
INDUSTRIAL.    If this was in the city of Phoenix, under their municipal codes, this would not be allowed, 
as their rules state for Recycling Industry shall not be located within 1,000 feet of S-1, S-2…..R1-18…….    
Here we have property that is surrounded by Residential property. We also have the City of Mesa 
wanting to move marijuana businesses to an Industrial zone.  Yet here, the County may be ok with 
having Industrial in the middle of a neighborhood.   Just because we are a county island does give open 
season for us to treated as we have no rights.   We are certainly feeling like this is the case.  I may be 
time for Maricopa County to revisit their Zoning Ordinance.  
 
We do not see how this INDUSTRIAL business in the middle of neighborhood is positive.   It is a draw for 
those who are unhoused as well as for increased crime.   The community recently had to battle to get 
the Twin Knolls mountain formation cleaned and cleared due to the numerous encampments and trash 
that appeared.  The trash continues to accumulate and squatters come and go on a regular basis.    We 
have photos of unhoused climbing fences, walking with shopping carts, etc.   Crime has increased too.    
Since the Scrap Yard takes copper, bikes, ladders, wiring, batteries, etc., all of these are easy pickings for 
a thief to make some money.   In fact, the Scrap Yard experiences theft as well.   Sort of ironic that 
perhaps someone steals from the Yard and then returns it for money.   It is possible.   (See thumb drive 
for Neighborhood decline evidence).  
 
Fences around the area surrounding the Scrap Yard have been cut and repaired dozens of times by 
neighbors.   We have a photo from June 26, 2023 of an apparent homeless person is crawling over razor 
wire with a back pack and his bike.   
 
Home values will decrease!  Who wants to live next to a Scrap Yard, let alone one that currently runs 
sometimes more than 12 hours a day?

With increased crime, the constant noise, the dust, the traffic, the toxicity, etc., the Scrap Yard is not an 
improvement for the neighborhood!!   
 
Section D also states the “operation does not create un-do noise, dust or pollution of any kind”.  This 
comment is so far from the truth, it is laughable.   We have already addressed noise.   Dust and 
pollution are an issue as well.   There are two possible entry points- One off of Apache Trail and the 
other is a dirt road, 85th Place, which has now become a “thruway” from the north to the Scrap Yard.   
85th Place is listed as an Unmaintained Road and thus there is no dust abatement by the County.   Due to 
increased traffic because of the Scrap Yard, there is more dust.   This area is already listed as a SERIOUS 
Non-Attainment area for air quality.   Is this increased dust what the Maricopa Air Quality wants? On 
the thumb drive, please see the 85th Place Traffic for evidence of trucks carrying tires to and from the 
scrap yard as well as them using the private, unmaintained street as a cut-through. Those traveling this 
new thruway to get to the Scrap Yard, drop screws, bolts and other such metal items resulting in a 
hazard for the residents on 85th Place.  There has also been intentional dumping directly on the road.     
 
We can get into a very technical discussion on dust and metal particles as we are in possession of a 
calculator obtained from University of Arizona that shows these particles travel dozens of miles.  And 
just a reminder about the fire.   An ember could have flown with devastating results to the community.    
With the excavator running pretty much daily stirring up dust and debris, and metal cutting also daily, 
there is concern about the long term safety of the neighborhood with this increase in breathable, 
detrimental particles.   
 
Salvage yards are an important source of end-of-life recycling for motor vehicles. However, these yards 
can also be a source of pollution and endanger the health of nearby communities if they are not 
properly maintained and regulated.  There has been no regulation of this Scrap Yard or maintenance of 
this business for years and even with a permit, the dangers for the surrounding area still exist.   
 
Junkyards contain many hazardous materials including lead batteries, mercury from light switches, 
anti-freeze, Freon from cooling systems, Polychlorinated Biphenyls (PCBs), Chlorofluorocarbons (CFCs), 
asbestos found in the brake pads and lining of older cars, motor oil, and heavy other metals.

This business is NOT an improvement for the neighborhood! 
 
LOCATION AND ACCESSIBILITY 
Section E.  States access to the Scrap yard is directly off Apache Trail.  (Main Street)    
 
Although the entrance and exit driveway on the applicant’s map shows in and out is from/to Apache 
Trail, 85th Place also offers a short cut to the entryway and could also be used as an exit.  The Scrap Yard 
has caused 85th Place to become a main thruway.   Customers from the Twin Knolls neighborhood on the 
north side of the Scrap Yard as well as many coming in from University Street area now use 85th Place to

come to and depart from the Scrap Yard.  To the Scrap Yard, there is easy access by “cutting the corner” 
off 85th Place to enter directly to the driveway without driving out to Main Street and turning in.   
 
This “thruway” has resulted in increased traffic on the unmaintained county road.    No one maintains it 
yet does the county now want to contribute to the problem of dumping on the street, dust and such by 
approving a SUP?   This is unacceptable!  Because it is unmaintained, no County entity will pick up 
dumped items that are provided regularly by rude, disrespectful neighbors 
 
The Scrap Yard has created a traffic nightmare for those who live on 85th Place between Boise and 
Apache Trail.   
 
CIRCULATION SYSTEM 
F.  The Circulation System is erroneously listed as turning right in and right out due to a median (not 
medium as was written).  As noted above, there is a “cut the corner” coming in off of 85th Place.   One 
will also see that cars cross illegally for a short distance driving east on the west bound side of Main to 
reach the median break to then drive west onto west bound Main Street.   Many cars, trucks, trailers do 
not exit directly out onto Main Street.  Additionally, if the wall at 85th and Main is torn down as it blocks 
the view of traffic going south on 85th as suggested in the TAC2 review,  that opens up more opportunity 
for customers to “cut the corner” rather than enter and exit from Main Street.   
 
There is a parking area where a customer parks to go into the facility to get paid for their dropped off 
scrap.  Many of those dropping off have no room to park their vehicles as they may be too large or be 
dragging a trailer and thus must park off site on the property to the west (trespassing) or in the ADOT 
Right of Way.   We have photos of cars and an RV that are parked there on June 26, 2023 that have been 
there for several days and is definitely blocking the Notice of Special Use Permit application.  (See folder 
on thumb drive ROW-Trespass-Notification Failure)  
  
We also wonder about the additional heavy truck traffic and track-out that is caused by the movement 
of the scrap materials being moved from this business location.   Are there not some County or State 
rules to monitor this increase usage of Apache Trail/Main Street?  Where is ADOT on addressing the 
constant Right of Way violation? 
 
OTHER ISSUES 
 
PARKING AND NO MENTION OF ANOTHER BUSINESS 
We see no mention of Chapo’s Tire Shop that has been functioning within the Scrap Yard main building 
but recently opened an access door to the building and now has signage.   There are piles of tires 
(possibly scrap) in front of a couple of parking spaces and there is a movable canopy set up under which 
customers can have their tires serviced/replaced.  This business now takes up parking spaces, so there 
appears to be no way that the Scrap Yard can comply with the required 18 spaces.    It is also distressing 
that the County offers under the TAC2 review, that the Scrap Yard submit for a variance on their SUP, 
which is already a variance, to non-comply with the required spaces, and could possibly be approved for 
just 9 spaces.   Not sure that 9 are feasible either since the tire shop has now taken over several and the 
Right of Way is 100 feet, not 46’6” as the original plan map submitted notes.   
 
And as a side note, I wonder if the Tire Shop has all its required permits, since the business that houses 
it does not and has not.  
 
NOTICE TO CITIZENS 
Also the Notice sent to those who are within 300-feet of the Site, shows a map that is wrong on original 
submission.     The site is showing as being east of Glenmar Road.   It is not.   It is west of Glenmar and

also west of 85th Place.   The map also reflects that Hawes Road continues north of Apache Trail and it 
does not.   
 
 
MASONRY WALL 
There is a planned 8-foot masonry wall surround this INDUSTRIAL business.  Not sure how an 8-foot wall 
is going to protect our RESIDENTIAL AREA from the noise and view of the excavator that has a boom 
reach of over 18- feet.   
 
There is much to consider before approving a PERMIT for a business which what does not belong. We 
are all in favor a a successful business –BUT it needs to be in a proper location.  Junior’s Recycling is 
NOT.   We strongly request that this application for Special Use Permit, BE DENIED.   It is clearly a 
detriment to the RESIDENTIAL NEIGHBORHOOD.  We have tried to maintain our long standing area 
with a historical past, reporting violators for trash, dumping, trespassing and other such violations. 
Any approval of this SUP would create an unattainable effort for this neighborhood.  Please help us to 
keep this neighborhood a neighborhood.   A heavy industrial business does not belong and should not 
have been allowed to function illegally as long as it has been.

A 10-page protest to this Special Use Permit Application is attached and is an updated version to one 
previously filed and is on the County permit site.  For ease, I am trying here to make some bullet points 
with some of the highlights from that protest. .  Please see full Protest  for complete information and 
details along with a thumb drive containing over 200 videos and photos to support these concerns.   
Reasons to Deny –  
• 
MAIN REASON – This is a Commercial zone surrounding by Residential zones.  Heavy Industrial 
does not belong!     
• 
Failed to follow county rules from Day 1 of business. Is this the type of business the County 
want, one that has failed to follow rules for years?   13 Scrap Yards/ Recyclers within about a 15 
mile radius of the business to include Mesa, Tempe, Gilbert and Apache Junction are not 
similarly situated in the middle of a neighborhood.     
• 
Even though in business for years without proper permits, was only violated in 2021  
V20210022061. Failed to correct within one year even though there was an agreement with the 
County and only started to take corrective action when legal action was forthcoming.  
 
• 
Their plan was submitted containing numerous errors and misleading information.  Of huge 
concern is there is no mention on any submission to the county of Chapo’s Tire Shop, which 
currently operates on this property.   How can this Scrap Yard possibly have parking spaces 
when another business blocks almost have of the business front area?   
 
• 
The permit request fails Article 1302.1 “The uses, buildings and structures permitted in this 
Section shall be established and maintained so as to provide minimum interference with the use 
and enjoyment of neighboring uses, building and structures to ensure public health, safety and 
convenience.    
 
• 
This business is of zero benefit to the surrounding neighborhood and Section D of their plan 
indicates they are similar to OTHER commercial business.  They are not commercial, but 
INDUSTRY and this business is a detriment to our area.   It may be handy for some but there are 
numerous other recyclers/scrap yards in the area or move this to a more applicable area.   
 
• 
The county has conflicting zones noted on websites for adjacent properties.   It is unclear how 
218-39-005 and 218-26-013 can be C-3 property when 3 years ago the owner, Twin Knolls Two 
Land LLC, had approved plans to tear down the property (Twin Knolls) with intention to build 
homes?     Allowing an Industrial business at 219-39-001 will certainly deter anyone from 
wanting to build a home or buy a home in the area and those who are their now can’t sell as 
nobody would want to live near this business.   
 
• 
Section C of the plan falsely states their hours of operation are from 8AM to 9PM.   This is 
absurd.   Recordings have been submitted with the excavator running as early as 5AM, most 
days around 6AM.   There is NO other recycling/scrap yards within an approximate 15-mile

radius that operate outside of their posted hours and NONE are in the middle of neighborhood!    
Posted for this business hours are M-F 8-4 and Sat 8-1.   
  
• 
P-23 (Maricopa County Noise Ordinance) is being violated almost daily with no action being 
taken by MCSO when it is clear Section V (A) does not apply. See 2 page letter attached and 
included on thumb drive.  Homes will lose value or even become unsellable due to having 
constant noise from this business that can be heard and vibration felt much farther than 500 
feet mentioned in P-23.  
 
• 
Section C also states there are 10-20 customers a day.    See full protest for further details as 
well as the over head views of the scrap yard.   This estimate is low.    
 
• 
Section C also states there is a screened/storage area in at the year of property.   The sides of 
the main back building recently had the wall removed allowing for full flow of air to distribute 
dust and pollution to the surrounding area.   The only screen that is at the back of the property 
is the fence which outlines the property.  
 
• 
Section D of the plan falsely states they do not cause undo noise, dust or pollution.  We have 
50+ videos/photos of noise, vehicles heading to and from the business stirring up dust, and 
nobody, as far as we know, monitors what oils, freon, etc. are being released into the ground. 
Although hearsay, a neighbor advised when he took a refrigerator to Junior’s, it was crushed 
without evacuating the freon.   
 
• 
Section D falsely states this business is appropriate for the area.   This is an INDUSTRIAL business 
that belongs in an Industrial Zone, not commercial or residential asking for Special Use.  
 
• 
We have a concerned neighbor who opposed to this SUP that lives on Boise that monitors air 
quality and Particulate Matter and he has recorded spikes in air quality to the point of danger.   
As it is, this area is already designated as a SERIOUS Non-Attainment area for air quality.   
 
• 
Junior’s scrap yard is a potential fire hazard.   There was as fire that started on June 27, 2023, 
which Rural Metro said in speaking with the business, it was likely caused by a spark from a 
torch.    We also have articles in the full protest that state that CAT Excavators can also spew 
sparks.  Do we have to be in constant fear that another fire might destroy the neighborhood?   
  
• 
Failed notice to those interested parties whose names were submitted as interested and in 
opposition.  Mobile homes owners/renters at Sunset Resort Mobile Home Park and there are 
renters on 85th Place as well we not informed.   How is it that the actual residents are left in the 
dark on this?

• 
300- foot mailed notification is a seemingly ridiculous small area to notify of a zoning change 
when a noisy, dust and pollution creating INDUSTRIAL business is planning to move into a 
residential area.    (City of Mesa wants a marijuana business to be situation along with other 
Industry.  How can Maricopa County possibly believe is line with intent of Zoning Ordinance to 
have a noisy, polluting, dust creating business within 300-feet of a residence?) 
 
• 
Almost daily, ADOT Right Of Way violations happen. A complaint was filed with ADOT.   Per TAC 
Review 2review, items 8, 9 and 10 indicate where the ROW is and we have submitted at least 2 
dozen photos of violations.   That is only a small number of the daily violations observed.   This 
has been observed and photos taken by Charles Hart, of Planning and Development.   
 
• 
In Section F – Circulation System infers Egress/Ingress is strictly on Main Street.  Individuals can 
and do easily turn into the scrap yard from and exit to 85th Place resulting in increased traffic, 
speeders, dust, trash dumping, etc. on that road.   This is an unmaintained county road, so since 
the opening at the current location of this business, the result has become a free-for-all on this 
street to speed, cut - through and dump.   (Example 08-19-23 11:29AM video)   Any 
egress/ingress that takes place directly off Main Street is to a main highway with a posted 45 
MPH speed limit.  Customers while attempt to exit onto this main highway or cross a main 
highway.  This is just an accident waiting to happen.   
 
• 
The SUP requires there be sufficient parking based on the size of the business.  The idea that 
individuals can park at the back of the business as shown in the plan is not feasible as their own 
plan states this is where they do sorting of their intake.  At the front of the business, the 
undisclosed Chapo’s Tire Shop takes up about ½ the available space on the front side of 
business.   
 
• 
There is constant trespassing by this business on adjacent land to the west with parked scrap 
vehicles and RVs, i.e. there is insufficient space for this large, industrial business.    These 
vehicles have constantly blocked the notification posting that this business was asking for a 
Special Use Permit. (See ROW Trespass Notice Failure Folder)  
 
• 
Tire shop traffic for both removal and delivery drives on 85th place (Example 06-02-23 215PM 
video), not onto Main Street as suggested for egress/ingress.  
 
• 
Since moving business to current location from across the street the neighborhood has declined. 
It is a draw for trespassers/homeless on Knolls walking, camping, parking vehicles, and living out 
of vehicles (See Neighborhood Decline folder on thumb drive.) 
 
• 
The area was pristine when the neighborhood battled the planned mining operation to tear 
down a portion of the Knolls in 2020.

• 
Since there is no adherence to law and there have been no consequences, there are motorbikes 
and ATVs in neighborhood with no tags on constant trespassing on the Knolls.  (See Bikes Folder)  
 
• 
Can somebody please explain how this business was issued a weights and measures permit 
when they are not even functioning legally?

Respectfully, the Twin Knolls Neighborhood disagrees with your response of 
September 11, 2023 and the request for specifically created evidence.   
 
P-23 Paragraph I - At an above certain levels, noise is detrimental to the health 
and welfare of Maricopa County citizens.  Therefore Maricopa County has 
determined that it is the best interest of its citizens to control noise in a manner 
which promotes commerce, the use, value and enjoyment of property; sleep 
and repose, and environmental quality.  Therefore, it is hereby declared to be 
the policy of Maricopa County to prohibit, excessive, unnecessary, disruptive 
and annoying noises from all sources.  
 
This neighborhood is clearly experiencing excessive, unnecessary, disruptive 
and annoying noises from Junior's Recycling.  
 
P-23 Paragraph V - A. It shall be unlawful for any person to cause, or for any 
person in possession of property to allow to originate from the property, any 
noise which disturbs the peace or quiet of any neighborhood if such noise can 
be heard from within closed residential structures located within 500 feet of the 
boundary of the property from which such noise emanates.   This subsection 
shall not apply to noise produced in the normal conduct of such business 
provided that such noise occurs within the normal and customary hours for the 
conduct of such business, which is based on the normal and customary hours of 
operation of similar, existing businesses, and the operation is legally conducted 
within the scope of all ordinances, laws, and statutes of Maricopa County and 
the State of Arizona.  
 
In reading the above carefully the 500-foot boundary for evidence does NOT 
apply as neither requirement for such evidence under P-23 is met.  
 
1) The operation is not legally conducted within the scope of ALL ordinances, 
laws, and statutes of Maricopa County and the State of Arizona.  Not only are 
there no proper permits, but photo and video evidence shows this business 
trespassing on adjacent property.  In addition, there are AZDOT ROW violations, 
which have been reported and Maricopa Planning and Development is following 
up on.  
 
Those facts in themselves should be sufficient to allow MSCO to cite Juniors 
Recycling for P-23 violations.  
 
In addition, even though it matters not since this business is in violation of a 
number of laws, etc., I question the comment you made that a number of 
similar businesses function outside posted business hours.   In attempts to

locate a similar type business, I visited 13 recyclers/scrap yards in the 
surrounding area to include Mesa, Gilbert, Tempe and also Apache Junction and 
NOT ONE is similarly situated in the middle of a neighborhood or is similar in 
nature of all that is recycled/ scrapped at Juniors Recycling.  None advised that 
they work outside posted hours.  Only 4 of the 13 own an excavator, which is 
the machinery that causes the noise/vibration that disturbs our residents, and 
of those 4, all affirmed they do NOT run it outside posted business hours.  None 
of those businesses have homes within a 300- or 500-foot area as we do. All 
stated they have had proper permits to function legally.  All were neat and tidy 
and fully enclosed from the surrounding businesses (not residences), which is 
not the case with the business in question.    
 
Also when questioned, those that knew what their zoning was, stated they were 
Industrial zoned.

excavator.   
 
It seems then that the request for evidence from inside a home with shut 
windows and doors within the 500-foot boundary is not within the scope of this 
Ordinance.   
 
Lt Thomas, there have been numerous phone calls from residents in the area 
over the past at least 12 months, complaining about the noise coming from the 
illegally functioning Junior's Recycling (Scrap Yard), not only during posted 
hours but as early as 5AM and as late as 9PM.   These calls have gone without 
any action.  A request under a Freedom of Information Act was submitted 
months ago asking for this list of calls so we can clearly show that our concerns 
have gone without action.   That request has gone unanswered, in violation of 
law.

As for the disturbance of the neighborhood, might I suggest that someone track 
all the calls that have been made to MCSO regarding the noise issue over that 
past year?   Is there some definition of neighborhood that dictates just how 
many people make up a neighborhood?  There is none in the definition section 
of P-23.   It seems to me that this is a very nebulous term.  On one hand, the 
County deems it only necessary to inform residents within 300-feet when there 
is a zoning change being considered.  The County deems it necessary that 
homeowners with 500-feet lock themselves in their homes to determine if 
business being considered for a zoning change is making sufficient noise to 
violate P-23.  Does that not negate the Ordinance itself in that "Maricopa 
County has determined that it is the best interest of its citizens to control noise 
in a manner which promotes commerce, the use, value and enjoyment of 
property; sleep and repose, and environmental quality."  It appears the County 
is now asking for what seems to be some unknown number of people to report 
excessive, unnecessary, disruptive and annoying noise and to report that with a 
specific modality.  It seems that anyone in direct line of this noise is defined as 
the neighborhood.   
 
The community is providing a thumb drive to MCSO that contains a total of 52 
videos, which is just a small sample of the noise and timing of the disturbance 
to this neighborhood.  This should be more than sufficient to demonstrate, in 
addition to the number of calls to MCSO and observations by same, that this 
noise is excessive, unnecessary, disruptive and annoying, thus in violation of P-
23.  I can provide the information who took these video, but we have concerns 
about retaliation from the business in question.   
 
As noted, your request for evidence from inside a closed up home is not 
applicable.   Even if it were, you are basically asking us to procure special 
recording devices, as most phones are certainly not the best at recording. It 
would also not record the vibration that is felt throughout the neighborhood 
when the offensive excavator drops heavy metal, causing our homes to shake.  
Perhaps someone from the county can tell us who to report foundation damage 
to our homes when that occurs.   It is also questionable why a resident would 
be required to have recording devices ready to record at 6:00AM or earlier when 
awakened by the excavator.  Perhaps the County would like visit and join us in 
being awakened to the tune of an excavator.  MCSO has been called and 
sometimes even responds to hear the problem and no action is taken. Then 
there is the potential issue that you would want our phones because it has the 
evidence on it.  I personally ran into that when pornography was sent to my 
phone.   The deputy wanted my phone as evidence with no idea when it would 
be returned!   This request for evidence as suggested seems unattainable.  
Hopefully the intention of the County is not to make P-23 so complex that 
violators can continue to violate and residents are left to suffer.     
 
The Twin Knolls Neighborhood has suffered from years from this illegally 
functioning business and do not want this industrial business in our residential

area.   It does not belong here!   And sadly the owner should have done his due 
diligence before expanding this nuisance business.   If this is what the County 
wants for us, it is a very sad day for our County citizens.

No SUP beneficial to a Metal Scrapping Operation that been breaking the Law for Years! I didn't move into an Industrial 
Area BUT i sure live in one now! ! Who is the person directly responsible for allowing this illegal activity to continue for 
YEARS! Seriously WHO? And How does the Arizona 'Weights & Measurement's " issue a certificate to operate a weight 
scale to an illegal (!) business? The illegal establishment is an income source for vagrants, homeless and drug users- a 
community of dozens of homeless created a tent city camping illegally in the trees West of Juniors Scrapyard (8518 East 
Main), which prowls at night while citizen's sleep. I've had car batteries stolen OUT OF MY BACKYARD. That's five free 
dollars each a scrapyard less than 300 feet from my home- You like people in your backyard while you sleep? Recently, i 
had 100 feet of 1/2" EMT electrical conduit stolen, again in my back yard, $75 loss for me, sold for (your guess) monies 
to buy drugs or to survive But element that is here because of Scrapyard. My neighbor has Two Bar-B -Q stolen- either 
for scrap value or to cook on in homeless camp. He also had a Boat on Trailer stolen, as Juniors Scrapyard creates a 
endless traffic flow on our road to his place, Thus those that are scrapping, are also looking for anything else of value. 
Over at Hawes & Billings someone set a C -Class Dodge RV on fire. Why do i mention that? Well. A guy & lady in a ford 
pickup thought they could drag burnt carcass to Juniors for scarp value. I saw them go by house on 85th Place towing it 
towards Juniors, like i hear & see dozens of trucks and trailers full of scrap go by all week all month for years. I can't 
decide which is nosier, a full trailer or an empty one on their way back on our unmaintained county dirt road. Anyways 
Junior did not accept the burned-up RV, so the guy pulled it back down 85th place and dumped it in FRONT OF MY 
PLACE! I hollered at him, "You're Not leaving that There!"  He lowered his tailgate in an attempt to obscure his license 
plate. And unhooked RV and sped off in a gravel dusty high speed. . . . I got his license plate and a picture of

Thanks Junior! This is added to the never-ending parade of shopping carts full of scrap metal being pushed down road in 
front of our homes going to Junior's Scrapyard on main Street. I that the sight you want passing where you live?  I've seen 
dozens of shopping carts scattered over the days, weeks, months, years around since Junior offers an income source, 
that adds to the neighborHOOD appeal, don't you agree> ?  It has ruined my recent retirement from SRP, my quality of 
life is crap due to the above, as well as the daily mental grind of hearing metal on metal being moved and emptied from 
one pile to a metal bin. The millions of aluminum cans being processed, sounds like a huge herd of metal mice rushing 
into a roll off bin. I never set an Alarm to wake up, as Junior's Monster Excavator provides the Industrial NOISE to awaken 
me as early as 6 a.m., If a Supervisor lived here, JUNIOR's Ilegal business would have been shut down in 48 hours!   But 
it is a low-income area, 80% Latino's an a unmaintained county dirt road, which has zero law enforcement on speeders, 
Check- No One Traffic Citation in 17 years I've been here. Many off road vehicles without license plates going to off-road 
illegally on Knolls are never stopped or cited or impounded, Taxes we pay, but enforce a C-3 illegal industrial scrapyard 
violating its very existence including P-23 noise that has to use adjacent AzDOT R.O.W. to be able to operate for parking 
its roll-off, scraped trailers and/or Rv's employee parking, customer parking- I'm not kidding- He Has No Room For This 
Business-NONE! But breaking the law is like Junior is Teflon, Nothing Sticks to him, He does wa=whatever he wants and 
Nothing Happens, for Years!!!!  An P&Z want to extend a helping hand by even processing a SUP. Well, of course, you 
were OK with a Gravel Mining Operation loading out 4 trucks an hour Six days a week for 10 to 12 years ACROSS THE 
STREET FROM MY FRONT DOOR, C-# means No Industrial- Please follow the rules. like the rest of us do. Yes, i am 
upset- I Live here. . .If i could Id move BUT who would want to buy next to a Metal Scrapyard- Yes, you've made my home

worthless. . . . But this is My Home and You've taken any Quality of Life I'd ever hoped to have in my last years in 
retirement,  Why? Who personally has allowed this atrocity to continue for days, weeks, month and YEARS!  Who? I really 
want a name. I want a reason. I"ve been here long enough to know the Post-Junior Years living here, when it was 
reasonably quiet, when traffic was modest, when homeless weren't living / trashing the once beautiful Twin Knolls, when I 
could sit outside without carrying personal pertection, when shopping carts were at the store, when i didn't have flat tires 
because of nails, screws bouncing off trailers full of scrap metal, when drug users weren't out walking after dark till early 
morning. when the sound of birds weren't overpowered by Junior's Recycling Center- - Sounds Green doesn't it. An let's 
not forget the recent addition of a Tire Store, That has to service the vehicles in the R.O.W. under a portable metal shade 
on wheels. More traffic - Sigh ! Main Street isn't the Only road used, even Jr's Son uses 85th Place to get there, And there 
are Five Other Paved roads that he could use. Cough - Maricopa Violates Minimum Dust Particulates Daily Cough! But i 
digress i know I live here Cough, and the activities spawned by Jr's very existence has made me mad, angry, upset, sad, 
lost and depressed in my own home , in my own yard, in my retirement years, Please shut him down for myself and my 
neighbors and our neighborhood, Sincerely, Michael Milligan P.S. I am not a typist but it was important to try an convey 
what has been wrought by allowing this to continue way beyond the 48 hours since it started, unbelievable, the legally 
permitted recycling centers that i visited could not believe Jr has been allowed to do this for such a long time without a 
permit and in a C-3 Zone, WHY?    


Super noisy at all hours waking us up early am. Creates increased traffic on 85th place with people taking metal to him 
for money. Very frustrating to have this ruining our neighborhood!
