312.1 General.
Buildings and structures of an accessory character and miscellaneous structures not classified in any specific 
occupancy shall be constructed, equipped and maintained to conform to the requirements of this code 
commensurate with the fire and life hazard incidental to their occupancy. Group U shall include, but not be 
limited to, the following:


403.3 Automatic sprinkler system. 
Buildings and structures shall be equipped throughout with an automatic sprinkler system in accordance 
with Section 903.3.1.1 and a secondary water supply where required by Section 403.3.3.
Exception: An automatic sprinkler system shall not be required in spaces or areas of telecommunications 
equipment buildings used exclusively for telecommunications equipment, associated electrical power distribution 
equipment, batteries and standby engines, provided that those spaces or areas are equipped throughout with 
an automatic fire detection system in accordance with Section 907.2 and are separated from the remainder of 
the building by not less than 1-hour fire barriers constructed in accordance with Section 707 or not less than 2-
hour horizontal assemblies constructed in accordance with Section 711, or both.

402.5 Automatic sprinkler system.
Covered and open mall buildings and buildings connected shall be equipped throughout with an automatic 
sprinkler system in accordance with Section 903.3.1.1, which shall comply with all of the following:
1.
The automatic sprinkler system shall be complete and operative throughout occupied space in the mall 
building prior to occupancy of any of the tenant spaces. Unoccupied tenant spaces shall be similarly 
protected unless provided with approved alternative protection.
2.
Sprinkler protection for the mall of a covered mall building shall be independent from that provided for 
tenant spaces or anchor buildings.
3.
Sprinkler protection for the tenant spaces of an open mall building shall be independent from that 
provided for anchor buildings.
4.
Sprinkler protection shall be provided beneath exterior circulation balconies located adjacent to an open 
mall.
5.
Where tenant spaces are supplied by the same system, they shall be independently controlled.
Exception: An automatic sprinkler system shall not be required in spaces or areas of open parking 
garages separated from the covered or open mall building in accordance with Section 402.4.2.3 and constructed 
in accordance with Section 406.5.

Other than where preempted by the Arizona Revised Statutes, Group R occupancies shall be equipped throughout 
with an automatic sprinkler system in accordance with Section 903.2.8. Group I-1 occupancies shall be equipped 
throughout with an automatic sprinkler system in accordance with Section 903.2.6. Quick-response or 
residential automatic sprinklers shall be installed in accordance with Section 903.3.2.

502.1 Address identification. New buildings shall be provided with approved address identification in 
accordance with the Tempe Zoning and Development Code, Section 4-903 A and Tempe Administrative Code, 
Section 117. Existing buildings shall be provided with approved address identification as required when 
originally constructed. Where original approvals do not exist, existing buildings shall be provided with numbers 
where each character shall be a minimum of 4 inches (102 mm) high and a minimum stroke width of 1/2 inch 
(12.7 mm). They shall be installed on a contrasting background and be plainly visible from the street or road 
fronting the property. Address numbers shall be maintained.
New and existing buildings shall be provided with approved address identification. The address identification 
shall be legible and placed in a position that is visible from the street or road fronting the property. Address 
identification characters shall contrast with their background. Address numbers shall be Arabic numbers or 
alphabetical letters. Numbers shall not be spelled out. Each character shall be a minimum of 4 inches (102 mm) 
high with a minimum stroke width of 1/2 inch (12.7 mm). Where required by the fire code official, address 
identification shall be provided in additional approved locations to facilitate emergency response. Where access is 
by means of a private road and the building address cannot be viewed from the public way, a monument, pole or 
other approved sign or means shall be used to identify the structure. Address identification shall be maintained.

Exception: Other than in buildings or facilities containing or serving Type B units, 
an accessible route shall not be required between site arrival points and 
the building or facility entrance if the only means of access between them is a vehicular way 
not providing for pedestrian access.

1203.1 Equipment and systems.
Interior spaces intended for human occupancy shall be provided with active or passive space heating and cooling 
systems capable of maintaining an indoor temperature of not less than 68° between 70oF (2021°C) and 82°F 
(28°C) (if cooled by air conditioning, and 88°F (30°C) if cooled by evaporative cooling), measured at a point 3 
feet (914mm) above the floor in the center of the room., on the design heating day. The installation of portable 
space heaters or coolers shall not be used to achieve compliance with this section.
Exception: Space heating and cooling systems are not required for:
1. Interior spaces where the primary purpose of the space is not associated with human 
comfort.
2. Group F, H, S or U occupancies.

1603.1.10 Floor design live loads posted.
Where the live loads for which each floor or portion thereof of a commercial or industrial building is or has been 
designed to exceed 50 psf (2.40 kN/m2), such design live loads shall be conspicuously posted by the owner in 
that part of each story in which they apply, using durable signs. It shall be unlawful to remove or deface such 
notices. The construction documents shall show the proposed sign location and the maximum floor loads.
1603.1.11 Issuance of certificate of occupancy.
A certificate of occupancy required by Section 107 shall not be issued until the floor load signs, required by 
Section 1603.1.10 of this code, have been installed.
1603.1.12 Restrictions on loading.
It shall be unlawful to place, or cause or permit to be placed, on any floor or roof of a building, structure or 
portion thereof, a load greater than is permitted by this code.

1612.3 Establishment of flood hazard areas. 
To establish flood hazard areas, the applicable governing authority shall adopt a flood hazard map and supporting 
data. The flood hazard map shall include, at a minimum, areas of special flood hazard as identified by the Federal 
Emergency Management Agency in an engineering report entitled “The Flood Insurance Study for [INSERT 
NAME OF JURISDICTION]Maricopa County, Arizona and Incorporated Areas” dated [insert date of 
issuance]July 19, 2001, as amended or revised with the accompanying Flood Insurance Rate Map (FIRM) and 
Flood Boundary and Floodway Map (FBFM) and related supporting data along with any revisions thereto. The 
adopted flood hazard map and supporting data are hereby adopted by reference and declared to be part of this 
section.

than the contractor, shall employ one or more approved agencies to provide special inspections and tests during 
construction on the types of work specified in Section 1705 and identify the approved agencies to the building 
official. These special inspections and tests are in addition to the inspections by the building official that are 
identified in Section 110 of the Tempe Administrative Code.
Prior to the issuance of a permit, the registered design professional responsible for the observations shall provide 
a partially completed, parts A, B and C, Special Inspection Certificate (city form) to the building official.
The registered design professional responsible for the observations or the designated special inspector, shall 
periodically visit the site during the course of construction requiring the observations as set forth in the 
statement of special inspections.
Upon completion of the work requiring observations, a completed Special Inspection Certificate (city form) 
shall be provided to the building official under the seal and signature of the registered design professional 
responsible for the observations. A final inspection will not be approved or a Certificate of Occupancy will not 
be issued until the special inspection certificate is received by the building official.
Exceptions:
1.
Special inspections and tests are not required for construction of a minor nature or as warranted by 
conditions in the jurisdiction as approved by the building official.
2.
Unless otherwise required by the building official, special inspections and tests are not required for 
Group U occupancies that are accessory to a residential occupancy including, but not limited to, those 
listed in Section 312.1.
3.
Special inspections and tests are not required for portions of structures designed and constructed in 
accordance with the cold-formed steel light-frame construction provisions of Section 2206.1.2 or 
the conventional light-frame construction provisions of Section 2308.
4.
The contractor is permitted to employ the approved agencies where the contractor is also the owner.
1704.2.1 Special inspector qualifications.  Prior to the start of the construction, the approved agencies shall 
provide written documentation to the building official demonstrating the competence and relevant experience or 
training of the special inspectors who will perform the special inspections and tests during construction or 
provide evidence of approval in another authority having jurisdiction within Maricopa County by being listed on 
their approved published list. Experience or training shall be considered to be relevant where the documented 
experience or training is related in complexity to the same type of special inspection or testing activities for 
projects of similar complexity and material qualities. These qualifications are in addition to qualifications 
specified in other sections of this code.
The registered design professional in responsible charge and engineers of record involved in the design of the 
project are permitted to act as an approved agency and their personnel are permitted to act as special 
inspectors for the work designed by them, provided they qualify as special inspectors.

open mall, such distance shall not exceed 300 feet (91 m).

 Where weathering requires a higher strength concrete or grade of masonry than necessary to satisfy the 
structural requirements of this code, the frost line depth strength required for weathering shall govern. 
The weathering column shall be filled in with the weathering index, “negligible,” “moderate” or 
“severe” for concrete as determined from Figure R301.2(1). The grade of masonry units shall be 
determined from ASTM C34, ASTM C55, ASTM C62, ASTM C73, ASTM C90, ASTM C129, ASTM

Where the winter design temperature in Table R301.2 is below 60°F (16°C), every dwelling unit shall be provided with heating 
facilities capable of maintaining a room temperature of not less than 68°F (20°C) at a point 3 feet (914 mm) above the floor and 2 
feet (610 mm) from exterior walls in habitable rooms at the design temperature. The installation of one or more portable space 
heaters shall not be used to achieve compliance with this section.
Interior spaces intended for human occupancy shall be provided with active or passive space-heating and cooling systems capable 
of maintaining an indoor temperature of not less than 68°F (20°C) between 70°F (21°C) and 82°F (28°C) (if cooled by air 
conditioning, and 88°F (30°C) if cooled by evaporative cooling), measured at a point 3 feet (914mm) above the floor in the center 
of the room. on the design heating day. The installation of portable space heaters or coolers shall not be used to achieve 
compliance with this section.
Exceptions:
1.
Space heating and cooling systems are not required for interior spaces where the primary purpose is not associated
with human comfort.

R1007.1 Clean Burning Fireplaces.
The purpose of this standard is to regulate fireplaces, woodstoves, or other solid-fuel burning devices to reduce the 
amount of air pollution caused by particulate matter and carbon monoxide.
The effective date of the regulations and prohibitions set forth in this standard took effect on December 31, 1998.
  Definitions: For purposes of this standard, the following words and terms shall be defined as follows:
    FIREPLACE means a built-in place masonry hearth and fire chamber or a factory-built appliance, designed to 
burn solid fuel or to accommodate gas or electric log insert or similar device, and which is intended for occasional 
recreational or aesthetic use, not for cooking, heating, or industrial processes.
    SOLID FUEL includes but is not limited to wood, coal, or other nongaseous or non-liquid fuels, including 
those fuels defined by the Maricopa County Air Pollution Control Officer as inappropriate fuel to burn in 
residential wood-burning devices.
    WOODSTOVE means a solid-fuel burning heating appliance including a pellet stove, which is either 
freestanding or designed to be inserted into a fireplace.
R1007.2 Installation restrictions.
On or after the effective date, no person, firm or corporation shall construct or install a fireplace or a woodstove, 
and the building official shall not approve or issue a permit to construct or install a fireplace or a woodstove, 
unless the fireplace or woodstove complied with one of the following:
1.
A fireplace which has a permanently installed gas or electric log insert.
2.
A fireplace, woodstove, or other solid-fuel burning appliance which has been certified by the United 
States Environmental Protection Agency as conforming to 40 Code of Federal Regulations Part 60, 
Subpart AAA as in effect on July 1, 1990.
3.
A fireplace, woodstove or other solid-fuel burning appliance which has been tested and listed by a 
nationally recognized testing agency to meet performance standards equivalent to those adopted by 40 
Code of Federal Regulations Part 60, Subpart AAA as in effect on July 1, 1990.
4.
A fireplace, woodstove or other solid-fuel burning appliance which has been determined by the Maricopa 
County Air Pollution Control Officer to meet performance standards equivalent to those adopted by 40 
Code of Federal Regulations Part 60, Subpart AAA as in effect on July 1, 1990.
5.
A fireplace which has a permanently installed woodstove insert which complies with subparagraphs 2, 3, 
or 4 above.
R1007.3
The following installations are not regulated by this standard and are not prohibited by this standard:
1.
Furnace, boilers, incinerators, kilns, and other similar space heating or industrial process equipment.
2.
Cook-stoves, barbecue grills, and similar appliances designed primarily for cooking.
3.
Fire pits, barbecue grills, and other outdoor fireplaces.

burning appliance in any manner that would void its certification or operational compliance with the provisions of 
this standard.
R1007.5 Permits Required.
In addition to the provisions and restrictions of this standard, construction, installation or alteration of all 
fireplaces, woodstoves and other gas, electric or solid-fuel burning appliances and equipment shall be done in 
compliance with provisions of this Code and shall be subject to the permits and inspections.

306.7.12 Toilet rooms.
Where it is technically infeasible to alter existing toilet rooms to be accessible, one accessible single-user toilet room or one 
accessible family or assisted-use toilet room constructed in accordance with Section 1110.2.1 of the International Building Code 
is permitted. This toilet room shall be located on the same floor and in the same area as the existing toilet rooms. At the 
inaccessible toilet rooms, directional signs indicating the location of the nearest such toilet room shall be provided. These 
directional signs shall include the International Symbol of Accessibility, and sign characters shall meet the visual character 
requirements in accordance with ICC A 117.1. One of two or more fixtures (water closets and/or urinals) may be removed to 
create space for one wheelchair accessible toilet compartment in each existing toilet room. The resulting reduction in water closets 
is permitted to create a conforming wheelchair accessible toilet compartment in each existing toilet room. Alterations under this 
section shall not reduce other accessibility requirements including, but not limited to, required clear floor spaces and 
clearances.

313.1 Mechanical special inspections and observations. The owner or the owner’s authorized agent, other than 
the contractor, shall employ the registered design professional responsible for the mechanical design or one or 
more approved agencies designated by the registered design professional responsible for the mechanical design to 
perform visual observations of complex mechanical equipment and systems for general conformance to the 
approved plans and specification, including but not limited to, placement and interconnection of equipment and 
shall identify the approved agencies to the building official in accordance with Section 1704.2 of the International 
Building Code as amended. Mechanical observations shall be performed at significant stages of the construction 
when the installation is complete and ready for inspection. Mechanical observations are in addition to and not in 
lieu of inspections required by the Tempe Administrative Code, Section 110, and by Section 1705.12.6 of the 
International Building Code, and shall be provided when one of the following conditions exist: 
1.  Duct smoke detectors for air distribution systems as install in accordance with Section 606 of this code.
2.  Fire, fire/smoke, radiation and smoke damper operation for dampers install in accordance with Section 
607 of this code.
3.  Installation of alternative grease duct enclosure systems including but not limited to grease duct-wrap 
or double wall grease duct systems, install in accordance with Sections 506.3.11.2and 506.3.11.3 of this 
code.
4.  The welding of grease duct joints, seams penetrations, and duct-to-hood joints required by Section 
506.3.2 and 506.3.2.2 of this code.
5.  The required grease duct leakage test required by Section 506.3.2.5 of this code.
6.  Type I hood performance test and the capture and containment test required by Section 507.6 and 
507.6.1 of this code.
7.  Test and Balance report for air balance of ventilation systems installed in ambulatory care and I-2

occupied spaces in the building or adjacent properties. Design of the odor control system shall be based on 
acceptable engineering practices. All equipment and filter media shall be listed and labeled for the application.

502.14 Motor vehicle operation. In areas where motor vehicles operate, mechanical ventilation shall be provided in accordance 
with Section 403 Additionally, areas in which stationary motor vehicles are operated shall be provided with a source capture 
system that connects directly to the motor vehicle exhaust systems. Makeup air for the required exhaust systems in areas where 
motor vehicles operate shall be provided through permanent unobstructed openings to the outdoors, such as louvers and grills. 
Mechanical equipment and louvers used for makeup air purposes shall be electrically interlocked with the exhaust system. Such 
system shall be engineered by a registered design professional or shall be factory-built equipment designed and sized for the 
purpose.
Exceptions:
1.  This section shall not apply where the motor vehicles being operated or repaired are electrically powered.
2.  This section shall not apply to one- and two-family dwellings.
3.  This section shall not apply to motor vehicle service areas where engines are operated inside the building only for the
     duration necessary to move the motor vehicles in and out of the building.

606.2 Where required. Smoke detectors shall be installed where indicated in Sections 606.2.1 through 606.2.3.
Exception: Smoke detectors shall not be required where air distribution systems are incapable of spreading smoke 
beyond the enclosing walls, floors and ceilings of the room or space in which the smoke is generated.
606.2.1 Return air systems. Air distribution systems. Smoke detectors shall be installed in return air systems with air 
distribution systems downstream of the filters and ahead of any branch connections in systems having a design capacity 
greater than 2,000 cfm (0.9 m3/s). in-the return air duct or plenum upstream of any filters, exhaust air connections, 
outdoor air connections, or decontamination equipment and appliances.
Exception: Smoke detectors are not required in the return air system where all portions of the building served 
by the air distribution system are protected by area smoke detectors connected to a fire alarm system in 
accordance with the International Fire Code. The area smoke detection system shall comply with Section 
606.4.

608.1 Balancing. Air distribution, ventilation and exhaust systems shall be provided with means to adjust the 
system to achieve the design airflow rates and shall be balanced by an approved method. Ventilation 
air distribution shall be balanced by an approved method and such balancing shall verify that the air distribution 
system is capable of supplying and exhausting the airflow rates required by Chapter 4. 
The ventilation air distribution system shall be provided with means to adjust the system to achieve not less than 
the minimum ventilation airflow rate as required by sections 403.3 and 403.3.1.2. Ventilation systems shall be 
balanced using a nationally accepted air balancing test method. Such balancing shall verify that the ventilation 
system is capable of supplying and exhausting the airflow rates required by Sections 403.3 and 403.3.1.2. A final 
report shall be provided to the engineer of record and the Tempe Building Inspector.

932.1 General. On or after December 31, 1998, no person, firm, or corporation shall construct or install a 
fireplace or a woodstove, and the city shall not approve or issue a permit to construct or install a fireplace or a 
woodstove, unless the fireplace or woodstove complies with one of the following:
1.
A fireplace which has permanently installed gas or electric log insert;
2.
A fireplace, woodstove, or other solid-fuel-burning appliance which has been certified by the United 
States Environmental Protection Agency as conforming to 40 Code of Federal Regulations Part 60, 
Subpart AAA;
3.
A fireplace, woodstove, or other solid-fuel-burning appliance that has been tested and listed by a 
nationally recognized testing agency to meet performance standards equivalent to those adopted by 40 
Code of Federal Regulations Part 60, Subpart AAA;
4.
A fireplace, woodstove, or other solid-fuel-burning appliance that has been determined by the Maricopa 
County Air Pollution Control Officer to meet performance standards equivalent to those adopted by 40 
Code of Federal Regulations Part 60, Subpart AAA; or
5.
A fireplace that has a permanently installed woodstove insert that complies with paragraphs 2, 3, or 4 
above.
Exception: The following installations are not regulated and are not prohibited by this section:
1.
Furnaces, boilers, incinerators, kilns, and other similar space heating or industrial process 
equipment;
2.
Cook stoves, barbecue grills, and similar appliances designed primarily for cooking; and
3.
Fire pits, barbecue grills, and other outdoor fireplaces. 
Fireplaces constructed or installed on or after December 31, 1998, that contain a gas or electric log insert or a 
woodstove insert, shall not be altered to directly burn wood or any other solid fuel. On or after December 31, 
1998, no person, firm, or corporation shall alter a fireplace, woodstove, or other solid-fuel-burning appliance in 
any manner that would void its certification or operational compliance with the provisions of this section.  
Fireplaces constructed or installed on or after December 31, 1998, shall not be altered without first obtaining a 
permit from the city to ensure compliance with this section.

317.1 Plumbing special inspections and observations. The owner or the owner’s authorized agent, other than 
the contractor, shall employ the registered design professional responsible for the plumbing design or one or more 
approved agencies designated by the registered design professional responsible for the plumbing design to 
perform visual observations of complex plumbing equipment and systems for general conformance to the 
approved plans and specification, including but not limited to, placement and interconnection of equipment and 
shall identify the approved agencies to the building official in accordance with Section 1704.2 of the International 
Building Code as amended. Plumbing observations shall be performed at significant stages of the construction 
and when the installation is complete and ready for inspection. Plumbing observations are in addition to and not 
in lieu of inspections required by the Tempe Administrative Code, Section 110, and Section 1705.12.6 of the 
International Building Code, and shall be provided when one of the following conditions exist:
1.
Alternative engineered design plumbing systems as allowed by Section 316 of this code. 
2.
Computer designed drainage and vacuum drainage systems as allowed Sections 713 and 715 of this 
code.
3.
Medical gas and vacuum systems as allowed by Section 1202 of this code.
4.
Non-medical oxygen systems as allowed by the Section 1203 of this code.
5.
Non-potable water systems as allowed Chapters 13 and 14 of this code.
6.

Residential Swimming Pool (residential pool). A pool intended for use, that is accessory to a residential setting and available 
only to the household and its guests including any structure intended for swimming or recreational bathing that contains water 
over 18 inches (457.2mm) deep. This includes in-ground, above ground and on ground swimming pools, hot tubs, spas, and fixed 
in place wading pools. All Oother pools shall be considered to be public pools for the purpose of this code.
Public Swimming Pool (Public Pool). A pool, other than a residential pool, that is intended to be used for 
swimming or bathing and is operated by an owner, lessee, operator, licensee or concessionaire, regardless of 
whether a fee is charged for use. Public pools shall be further classified and defined as follows:
Class A competition pool. A pool intended for use for accredited competitive aquatic events such as 
Federation International De Natation (FINA), USA Swimming, USA Diving, USA Synchronized 
Swimming, USA Water Polo, National Collegiate Athletic Association (NCAA), or the National 
Federation of State High School Associations (NFHS).
Class B public pool. A pool intended for public recreational use that is not identified in the other 
classifications of public pools.
Class C semi-public pool. A pool operated solely for and in conjunction with lodgings such as hotels, 
motels, apartments or condominiums, townhouse complexes, trailer courts, mobile home parks, or 
similar establishments. A semipublic pool includes a pool that is operated by a neighborhood or 
community association for the residents of the community and their guests and a swimming pool at a 
country club, camp or similar establishment where the primary business of the establishment is not the 
operation of a swimming pool and where the use of the swimming pool is included in the fee for the 
primary use of the establishment. This includes in-ground, aboveground, and on-ground pools; spas and 
fixed in-place wading pools.

301.1.2 Unenclosed pools. It is hereby declared to be a violation of this code and a public nuisance and 
dangerous to the public health, safety, and welfare to maintain an outdoor swimming pool or spa in the city unless 
enclosed by a barrier in accordance with Section 305.2 of this code. It shall be the responsibility of both the 
property owner and the occupant of the premises to install and maintain the fences, locks, latches, alarms, and 
gates that make up the barrier in good condition and proper working order when water is in the pool, either or 
both may be deemed in violation of this code for failure to do so.
301.1.3 Prerequisites to issuance of building permit. A building permit shall not be issued for any swimming 
pool, spa or hot tub unless the plans for such pool provide for barrier requirements as required by this code.
301.1.4 Final inspection and approval. No swimming pool, spa or hot tub shall be filled in whole or in part with 
water unless the pool barrier requirements have been installed in accordance with this code and approved by the 
building official or authorized representative.

305.1 General.  The provisions of this section shall apply to the design of barriers for restricting entry into areas having pools and 
spas. Where spas or hot tubs are equipped with a lockable safety cover complying with ASTM F1346 and swimming pools are 
equipped with a powered safety cover that complies with ASTM F1346, the areas where those spas, hot tubs or pools are located 
shall not be required to comply with Sections 305.2 through 305.7. 
It is the responsibility of the property owner and any other person in responsible charge of a swimming pool to ensure that the 
required swimming pool barrier, including all gates, doors, locks, latches, and other portions of the barrier are maintained safe and 
in good working order at all times. No person shall alter or remove any portion of a swimming pool barrier except to repair, 
reconstruct, or replace the barrier in compliance with the provisions of this section. All barriers shall be installed, inspected, and 
approved prior to plastering or filling with water.

305.2.1 Barrier height and clearances.
Barrier heights and clearances shall be in accordance with all of the following:
1.
The top of the barrier shall be not less than 48 60 inches (1219 1525 mm) above grade where measured 
on the side of the barrier that faces away from the pool or spa. Such height shall exist around the entire 
perimeter of the barrier and for a distance of 3 feet (914 mm) measured horizontally from the outside of 
the required barrier.
2.
The vertical clearance between grade and the bottom of the barrier shall not exceed 2 inches (51 mm) for 
grade surfaces that are not solid, such as grass or gravel, where measured on the side of the barrier that 
faces away from the pool or spa.
3.
The vertical clearance between a surface below the barrier to a solid surface, such as concrete, and the 
bottom of the required barrier shall not exceed 4 inches (102 mm) where measured on the side of the 
required barrier that faces away from the pool or spa.
4.
Where the top of the pool or spa structure is above grade, the barrier shall be installed on grade or shall 
be mounted on top of the pool or spa structure. Where the barrier is mounted on the top of the pool or 
spa, the vertical clearance between the top of the pool or spa and the bottom of the barrier shall not 
exceed 4 inches (102 mm).
5.
The inside of a barrier shall be not closer than 24 inches (610 mm) to the nearest edge of the water of a 
pool or spa measured perpendicular from the fence to the water’s edge.

90.1 Scope. This article covers use and application, arrangement, and enforcement of this Code. It also covers the expression of 
mandatory, permissive, and nonmandatory text, provides guidance on the examination of equipment and on wiring planning, and 
specifies the use and expression of measurements.
90.1.1 Title.  These regulations shall be known as the National Electrical Code as amended by the City of Tempe hereinafter 
referred to as “this code or NEC”. These regulations are one document of the overall City of Tempe Construction Code as defined 
by the adopting ordinance.
90.1.2 Authority.  Where used in this article, the term authority having jurisdiction shall include the building official or other 
individuals designated by the building official. This Code shall be administered and enforced by the authority having jurisdiction 
designated by the governing authority as follows:
1.  The authority having jurisdiction shall be permitted to render interpretations of this Code in order to provide 
clarification to its requirements, as permitted by 90.4.
2.  When the use of any electrical equipment or its installations is found to be dangerous to human life or property, the 
authority having jurisdiction shall be empowered to have the premises disconnected from its source of electric supply. 
When such equipment or installation has been so condemned or disconnected, a notice shall be placed thereon listing 
the causes for the condemnation, the disconnection, or both, and the penalty established by 80.23 for the unlawful use 
thereof. Written notice of such condemnation or disconnection and the causes therefore shall be given within 24 hours 
to the owners, the occupant, or both, of such building, structure, or premises. It shall be unlawful for any person to 
remove said notice, to reconnect the electrical equipment to its source of electric supply, or to use or permit to be used 
electric power in any such electrical equipment until such causes for the condemnation or disconnection have been 
remedied to the satisfaction of the inspection authorities.
3.  The authority having jurisdiction shall be authorized to inspect, at all reasonable times, any building or premises for 
dangerous or hazardous conditions or equipment as set forth in this Code. The authority having jurisdiction shall be 
permitted to order any person(s) to remove or remedy such dangerous or hazardous condition or equipment. Any 
person(s) failing to comply with such order shall be in violation of this Code.
4.  Where the authority having jurisdiction deems that conditions hazardous to life and property exist, he or she shall be 
permitted to require that such hazardous conditions in violation of this Code be corrected.
5.  The authority having jurisdiction shall be permitted to investigate the cause, origin, and circumstances of any fire, 
explosion, or other hazardous condition.
6.  The authority having jurisdiction shall be permitted to require plans and specifications to ensure compliance with this 
Code.
7.  Whenever any installation subject to inspection prior to use is covered or concealed without having first been 
inspected, the authority having jurisdiction shall be permitted to require that such work be exposed for inspection. The 
authority having jurisdiction shall be notified when the installation is ready for inspection and shall conduct the 
inspection.

90.1.3 Inspections and Approvals.  Inspections shall be made throughout the installation process and shall be requested by the 
permit holder.  Work shall not be continued until required inspections has been passed.
1.  Upon the completion of any installation of electrical equipment that has been made under a permit other than an 
annual permit, it shall be the duty of the person, firm, or corporation making the installation to notify the building 
official, who shall cause the work to be inspected.
2.  Underground electrical work shall be inspected and made prior to the concealing any of the work or conduits
3.  Rough Electrical work shall be inspected prior to being covered by other materials and prior to the installation of 
fixtures
4.  Electrical Equipment Inspection. Prior to energizing all wiring within the panel shall be secured and landed.
5.  Other electrical inspections, special inspections, observation and reports as required by the building official.
6.  Final Electrical Inspection.  Electrical shall be energized and all over current protection devices are to be in place and 
all required arc fault, ground fault interruption, fuses, surge protection devices and all other protection devices installed 
in their permanent location.
90.1.4 Connection to Electricity Supply.  Connections to the electric supply shall conform to 80.25(A) through 
(C).
(A) Authorization.  Except where work is done under an annual permit and except as otherwise provided in 
80.25, it shall be unlawful for any person, firm, or corporation to make connection to a supply of electricity 
or to supply electricity to any electrical equipment installation for which a permit is required or that has been 
disconnected or ordered to be disconnected.
(B) Special Consideration.  By special permission of the authority having jurisdiction, temporary power 
shall be permitted to be supplied to the premises for specific needs of the construction project. 
(C) Disconnection.  Where a connection is made to an installation that has not been inspected, as outlined in 
the preceding paragraphs of this section, the supplier of electricity shall immediately report such connection 
to the Building Official.  If, upon subsequent inspection, it is found that the installation is not in conformity 
with the provisions of Article 80, building official shall notify the person, firm, or corporation making the 
installation to rectify the defects immediately without delay or a longer period of time as determined by the 
building official.  If such work is not completed within the period as may be specified, the building official 
shall have the authority to cause the disconnection of that portion of the installation that is not in conformity.

110.2 Approval. The conductors and equipment required or permitted by this Code shall be acceptable only if 
approved.
110.2.1 Electrical special inspections and observation. The owner or the owner’s authorized agent, other than 
the contractor, shall employ the registered design professional responsible for the electrical design or one or more 
approved agencies designated by the registered design professional responsible for the electrical design to 
perform visual observations of complex electrical equipment and systems for general conformance to the 
approved plans and specification, including but not limited to, placement and interconnection of equipment and 
shall identify the approved agencies to the building official in accordance with Section 1704.2 of the International 
Building Code as amended. Electrical observations shall be performed at significant stages of the construction 
when the installation is complete and ready for inspection. Electrical observations are in addition to and not in 
lieu of inspections required by Section 110 of the Tempe Administrative Code and Section 1705.12.6 of the 
International Building Code, and shall be provided when one of the following conditions exist:
1.
Ground-fault protection performance tests for equipment with ground-fault protect.
2.
Switch boards, panelboards, motor control centers and other equipment rated at 1,000 amperes or more or 
over 600 volts.
3.
The installation or alteration of electrical systems over 600V.
4.
Transformers rated 100 kVA or more, single phase or 300 kVA or more three-phase.
5.
Insulation integrity of conductors that supply equipment rated at 1,000 amperes or more, or over 600 volts.
6.
Emergency and standby power systems, including switchboards, panelboards, distribution boards, transfer 
equipment, power source, conductors, fire pumps, exhaust and ventilation fans.
7.
Selective Coordination – This includes verification of the installation in accordance with the required 
selective coordination study. 
8.
The installation or alteration of that portion of a health care facility’s electrical system which fall under the 
scope of Article 517 of this code, including such systems installed in facilities where outpatient surgical 
procedures are performed.
9.
The installation or alteration of electrical systems within locations classified as hazardous by provisions of 
this code, except for gasoline dispensing installations and systems located within storage garages, repair garages 
or lubritorium’s.
10. Special cases – Work which, in the opinion of the building official, involves unusual hazards or conditions.

110.7 Wiring Integrity. Completed wiring installations shall be free from short circuits, ground faults, or any
