Project Summary:
1.
The applicant is seeking entitlement on the property for a garage-style condominium facility. The
proposed facility would be considered a high-end manifestation of a self-storage type use. Rather
than renting storage units on a monthly or annual basis, the units at this facility would be available
to be purchased outright. The applicant has indicated that owners would then be able to
customize their garage units as they wish. The applicant’s narrative describes the garages being
used similarly as a residential accessory shop where the owners would store/work on vintage
cars, setup hobbyist wood working equipment, etc. The narrative states the uses would be limited
to personal hobby type activities; business activity out of the garage units would be prohibited.
Additionally, the narrative states a willingness to reduce maximum allowed height to 30’ to match
the surrounding Rural-43 height standards. The narrative states there may be up to 56 garage
units, although notes that owners may opt to purchase multiple units and combine them into one.
The facility would offer a central clubhouse which would hold restroom facilities. The narrative
states that all design guidelines of the Carefree Highway Scenic Corridor will be followed. The
proposed zoning overlay will limit the site to just to self-storage and related ancillary uses which
includes a central clubhouse. Staff notes that if the applicant follows through with developing
the site with for-sale garage units the next phase of entitlement will be to submit a final plat for
the garage condo complex, in lieu of a plan of development.

The subject parcel has no previous history prior to the applicant’s pursuit of the current proposal.
The proposal was included in the pre-application meeting PA2022222 which was held on January
24, 2023. Staff notes that the subject parcel had not yet been created and was included as the
parent parcel, APN 211-24-137. That meeting included several proposals on the subject parcel as
well as adjacent parcels, many of which staff indicated may be too intense without urban services.
Following the pre-application meeting, and in accordance with staff recommendation, the parent
parcel was split creating the subject parcel, APN 211-24-137A. Formal submittal of the subject
request occurred on July 19, 2023. The technical advisory committee meeting was held on
August 15.

Public Participation Summary:

The applicant conducted robust public participation that included the minimum required
notification of all property owners within 300’ of the subject site as well as two site postings. In
addition, the applicant conducted a neighborhood meeting that was relatively well attended.
Meeting minutes were provided to staff and while it appears there was a fair amount of concern
from attendees of the meeting, none of the meeting attendees have provided opposition to county
staff. It seemed one point of confusion that was discussed extensively was over the proposed
concept itself, as many people thought it would include residential units. Staff received a number
of phone calls from people similarly confused, however it seems concern wanes once there is a
more full understanding of the intensity of the proposed use.
Outstanding Concerns from Reviewing Agencies:

The City of Phoenix has provided robust comments on the use. They have expressed some
general concerns, mostly over the fact that the proposed use does not match their future land use
designation for the site. The city also conveyed concern that the zone change request does not
include a precise site plan and stated they are unable to support any requests on the site without
a precise plan of development. However, the city did provide several preferred conditions to be
included if the proposal should be approved. Working with the applicant, they have expressed a
willingness to include all applicable conditions requested by the city. The city proposed
conditions that include a ten-foot-wide multi-use trail to be constructed along Carefree Highway,

compliance with all Carefree Highway Scenic Corridor design guidelines, a minimum 10 foot
landscape buffer along all interior lot lines, solid site screening along all boundaries with
residential zoning districts, and that all lighting is directed away from residential properties.
Staff Analysis:

Staff has been cautiously skeptical of the proposed zone change with overlay since the initial pre-
application for the site. The applicant has worked extensively with staff and has been active with
surround property owners to craft a proposal that fits their needs while also respecting
neighboring property owners as well as all applicable land use plans. The proposal for luxury
garage condos, which staff have interpreted to be considered mini-storage, requires C-2 zoning.
Staff was concerned about the addition of more C-2 zoning along Carefree Highway, and as such
recommended an overlay to limit uses to only self-storage and ancillary uses, which is what the
applicant requested.

The subject site is located within the New River/Daisy Mountain area plan. With the recent update
to the area plan the land adjacent to Carefree Highway was designated for commercial uses that
cater to local residents and support the rural community. As such, staff commends the efforts
made by the applicant to accept standards, conditions, and use restrictions that will ensure a low
intensity commercial site that will be designed in a way to not loom over surrounding residential
properties, nor detract from the scenic nature of the surrounding area. To highlight this
commitment, the applicant has requested the site be limited to a 30’ building height, which is
consistent to the surrounding rural properties. Additionally, the applicant is proposing for the lone
allowed use to be self-storage and ancillary uses. Staff notes that this will create a unique
situation where even if the applicant’s development plans fail to come to fruition, the end result
on site will be locked into a similar type of facility unless additional entitlement is approved by
the Board of Supervisors.

The narrative discusses a commitment to adhere to all design guidelines in both the New River
Area Plan as well as the Carefree Highway Scenic Corridor. This includes the aforementioned
height restriction of 30’. Other such guidelines include undulating setbacks to deter linear
development, limited lighting to reduce light pollution, landscape buffers, and a rural
southwestern architectural theme. Given the applicant’s willingness to adhere to these guidelines,
staff suggests memorializing them in the conditions of approval.

The applicant impressed with a citizen outreach that went above and beyond. The applicant
exceeded minimum requirements by holding a neighborhood meeting, providing staff with a full
transcript of that meeting which had several attendees. The summary of that meeting showed
that neighbors where initially unsure of what the proposed zoning would allow, thinking it might
be for a multi-family condominium project. However, most attendees seemed to have concerns
quelled when informed the project is more akin to a self-storage type facility. This mirrors some
questions staff have received from the public. Staff fielded several phone calls from neighbors
thinking this was for a high-density multi-family condo project. Concerned callers all seemed to
be relieved when informed the proposed zoning would not allow for residential and would limit
the site to self-storage uses only. Staff did receive one email of opposition with the main concern
being that further commercial development would disrupt scenic views along Carefree Highway.
Staff feels this concern is not unwarranted, but it is for that very reason that adherence to the
scenic corridor guidelines is encouraged to be memorized in the conditions of approval.

In addition to the lone email of opposition staff did receive comment from the City of Phoenix, as
the proposal is within the city’s municipal planning boundary. City staff conveyed concern over
the project as it does not meet the city’s future land use designation for the site (although it does
match the recently updated county area plan). The City was also concerned that there was no
precise plan of development included with the application. In their comment, they provided a
number of conditions that they wish to be included if the proposal is to be approved. The
applicant has agreed to comply with all conditions requested by the City of Phoenix. As such,
staff recommends the addition of the City’s requested conditions to the conditions of approval.

The applicant has been extremely receptive to staff feedback at all levels of this proposal and has
been able to craft a proposal that makes every reasonable attempt to maintain the integrity of the
Carefree Highway Scenic Corridor and the Daisy Mountain / New River Area Plan, as well as
respecting the comments received from City of Phoenix. Staff feels that the proposal is in line
with future land use guidelines and will provide a quality buffer between the Carefree Highway
and adjacent residential uses.

Staff recommends the Commission adopt a motion recommending that the Board of Supervisors
approve Z2023089 subject to the following conditions ‘a’ – ‘i’.
a.
Development of the site shall be in substantial conformance with the Zoning Exhibit
entitled “Carefree Condos“, consisting of 1 full-size sheet, dated July 14, 2023, and
stamped received July 19, 2023, except as modified by the following conditions. Staff may
determine slight refinements to remain in substantial conformance with the approved site
plan. Minor and major amendments to the site plan will be determined in accordance with
Chapter 3 of the Maricopa County Zoning Ordinance.
b.
Development of the site shall be in substantial conformance with the narrative report
entitled “Carefree Garage Condominiums Rezoning”, consisting of 17 pages, dated August
28, 2023 and stamped received August 28, 2023, except as modified by the following
conditions.
c.
The following planning engineering conditions apply:
1. Any new site improvements will require a plan of development and traffic impact
study.
2. Without the submittal of a plan of development, no development approval will be
inferred by the engineering review, including, but not limited to drainage design, site
access and roadway alignments. These items will be addressed as development plans
progress and are submitted to the county for further review and/or entitlement.
3. Engineering review of planning and/or zoning cases is for conceptual design only. All
development and engineering design shall be in conformance with Section 12056 of
the Maricopa County Zoning Ordinance; Drainage Policies and Standards; Floodplain
Regulations for the Maricopa County; MCDOT Roadway Design Manual; and current
engineering policies, standards and best practices at the time of application for
construction.
d.
The following CUPD standards apply:
1. Maximum height 30’
2. Allowed uses shall be limited to self-storage and uses ancillary to self-storage.
e.
All development shall be consistent with the Carefree Highway Scenic Corridor design
guidelines.
f.
Administrative approval of a Plan of Development will be required prior to approval and
issuance of construction permits to develop and establish use of the site. Prior to
issuance of a building permit, written confirmation will be required from the emergency
fire protection jurisdiction having authority that the facility has been designed in
accordance with their regulations and requirements, and that emergency fire protection
service will be provided to the facility. Prior to issuance of the certificate of occupancy,
local fire protection jurisdiction review and approval will be required.

1. A 120’ landscape setback from the centerline of Carefree Highway.
2. The applicant is to construct a 10 foot wide multi-use trail within an easement for
public use along the entire length of the property fronting Carefree Highway.
3. All buildings and parking areas shall maintain a minimum 10 foot landscape setback
from all interior lot lines.
4. All lighting shall face away from rural or residential zoning districts.
h.
The granting of this change in use of the property has been at the request of the applicant,
with the consent of the landowner. The granting of this approval allows the property to
enjoy uses in excess of those permitted by the zoning existing on the date of application,
subject to conditions. In the event of the failure to comply with any condition, the property
shall revert to the zoning that existed on the date of application. It is, therefore, stipulated
and agreed that either revocation due to the failure to comply with any conditions, does
not reduce any rights that existed on the date of application to use, divide, sell or possess
the property and that there would be no diminution in value of the property from the value
it held on the date of application due to such revocation of the zone change. The zone
change enhances the value of the property above its value as of the date the zone change
is granted and reverting to the prior zoning results in the same value of the property as if
the zone change had never been granted.

The Maricopa County Environmental Services Department (MCESD) has completed review
for the Carefree Garage Condominiums rezoning planning case(s). Please note the following
MCESD requirements for site development:
Drinking Water –
Per the Safe Drinking Water Act, any water system that supplies more than 25 people or 15
service connections per day for at least 60 days per year is classified as a Public Water
System (PWS).
•
A Public Water System application and a New Source Approval application are
required and must be submitted to the MCESD’s Drinking Water Program. A water
quality analysis report will be required with submittal and is good within one-year of
testing.

Onsite Wastewater –
A Notice of Intent to Discharge application for an onsite wastewater treatment (septic)
system is required for any construction. Application must be submitted to the MCESD

Wastewater is not permitted to discharge to an adjacent parcel’s septic system.

Environmental Health –
For any food service operations occurring on site, where food is offered, sold, or prepared

Engineering Review has reviewed the first plan and report routed for review on
08/11/2023, for the subject application and has No Objections subject to the following
conditions:
1.
Any new site improvements will require a Plan of Development and Traffic
Impact Study.
2.
Without the submittal of a plan of development, no development approval will
be inferred by the engineering review, including, but not limited to drainage
design, site access and roadway alignments. These items will be addressed

3.
Engineering review of planning and/or zoning cases is for conceptual design

Carefree Hwy Rezoning
Hi, I’m a resident in the area. I live at 36839 N 20th St Phoenix AZ 85086.
My husband and I both moved here from different states. Minnesota and Washington respectively. We get quite a few
visitor from out of state as we both have a lot of friends and family who live out of state. Multiple multiple visitor have
mentioned how amazing driving on Carefree Hwy is where it’s open desert and they are always surprised there are so
many houses tucked back in once you get off Carefree Highway. Changing the zoning to allow these storage places and
allowing height variances and whatever other businesses have been proposed will change the feeling of historic Carefree
Highway both for residents who have chosen to purchase homes in the area and for visitors come to the area.
