REQUEST FOR COUNCIL ACTION

ACTION:  PUBLIC HEARING ITEM  Introduce and hold the first public hearing to adopt an ordinance 
amending Tempe City Code, Chapter 14A-11 "Violations". The applicant is the City of Tempe. The 
second and final public hearing is scheduled for June 25, 2026. (Ordinance No. O2026.28)
FISCAL IMPACT:  None
RECOMMENDATION:  Adopt Ordinance No. O2026.28.
 
BACKGROUND INFORMATION:  Staff requests that Council adopts proposed amendments to 
Chapter 14A-11 of City Code, which pertain to violations of the Historic Preservation Ordinance's 
requirements for historical and archaeological properties. Under the proposed amendments, a judge 
may impose penalties under Section 1-7 of City Code against "any person who constructs, alters, 
neglects, demolishes or removes a designated property or portion thereof in violation of the provisions 
of [Chapter 14A]" and against "any person who excavates, defaces, or damages areas classified as 
'archaeologically sensitive' (as defined in Sec. 14A-2) while performing work as a contractor or 
subcontractor on a City of Tempe project, on a project on City of Tempe-owned property, or on a private 
project subject to archaeological mitigation requirements imposed by Tempe City Council."
On May 13, 2025, the Historic Preservation Commission voted 6-0 to recommend adoption of the 
proposed ordinance.
