O2026.24 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TEMPE, ARIZONA RELATING TO THE HEALTH AND SAFETY OF CONSTRUCTION AND RELATED ACTIVITIES IN THE CITY ANDREPEALING CHAPTER 8, TEMPE CITY CODE, RELATING TO BUILDINGS AND BUILDING REGULATIONS, AND ADOPTING THE TEMPE ADMINISTRATIVE CODE, THE 2024 INTERNATIONAL BUILDING CODE, THE 2024 INTERNATIONAL RESIDENTIAL CODE, THE 2024 INTERNATIONAL EXISTING BUILDING CODE, THE 2024 INTERNATIONAL MECHANICAL CODE, THE 2024 INTERNATIONAL PLUMBING CODE, THE 2024 INTERNATIONAL FUEL GAS CODE, THE 2024 INTERNATIONAL ENERGY CONSERVATION CODE, THE 2024 INTERNATIONAL SWIMMING POOL AND SPA CODE, AND THE 2023 NATIONAL ELECTRICAL CODE AND AMENDMENTS THERETO; AND REPEALING SECTION 14-16 AND REPLACING WITH THE 2024 INTERNATIONAL FIRE CODE. *********************************************** WHEREAS, nationally and internationally recognized building and fire codes have been newly adopted; and WHEREAS, the City Council finds that it is in the best interests of the City to adopt and recognize updated building and fire codes; and WHEREAS, the City Council finds that certain modifications to the newly adopted codes will provide the best manner of implementation for the City; and WHEREAS, the City Council finds that it is the best interest to have a transition period to assure a reasonable process for implementation of newly updated codes; BE IT ORDAINED BY THE COUNCIL OF THE CITY OF TEMPE, ARIZONA as follows: Page 2 of 4 Ordinance No. O2026.24 SECTION 1. Articles I, II, III, IV, V, VI, VII, VIII, IX, X, and XI of the Tempe City Code Chapter 8 Building and Building Regulations and Article II of Tempe Fire Prevention and Protection Chapter 14, are hereby repealed in their entirety. SECTION 2. The following new codes are hereby adopted in their entirety, subject to amendments by the City referenced below, which are attached to this Ordinance (with deletions struck through and additions underlined) and incorporated herein by reference; with one electronic and one paper copy of each code to be filed with the City Clerk and marked, known, and designated as a separate document of the Construction Code of the City of Tempe under Chapter 8, Article 1, Section 8 and the International Fire Code under Chapter 14, Article 2 of the City Code: • International Building Code (IBC), including Appendices I, J, N; • 2024 International Residential Code (IRC), including Appendices BB, BF, BG, BO, CA, CB, CD, CE, CF, and NB; • 2024 International Existing Building Code (IEBC); • 2024 International Mechanical Code (IMC); • 2024 International Plumbing Code (IPC), including Appendices B, C and E; • 2024 International Fuel Gas Code (IFGC); • 2023 National Electrical Code (NEC); • 2024 International Energy Conservation Code (IECC); • 2024 International Swimming Pool and Spa Code (ISPSC); • 2024 International Green Construction Code (lgCC) (optional) • 2024 International Fire Code (IFC), including Appendices B, C, H, I, K, O and J; SECTION 3. That the 2024 International Building Code (IBC), including Appendices I, J and N, as adopted above is hereby amended as set forth in Exhibit A to this Ordinance. SECTION 4. That the 2024 International Residential Code (IRC), including Appendices, BB, BF, BG, BO, CA, CB, CD, CE, CF, and NB, as adopted above is hereby amended as set forth in Exhibit A to this Ordinance. SECTION 5. That the 2024 International Existing Building Code (IEBC) as adopted above is hereby amended as set forth in Exhibit A to this Ordinance. SECTION 6. That the 2024 International Mechanical Code (IMC) as adopted above is hereby amended as set forth in Exhibit A to this Ordinance. Page 3 of 4 Ordinance No. O2026.24 SECTION 7. That the 2024 International Plumbing Code (IPC), including Appendices B, C, and E, as adopted above is hereby amended as set forth in Exhibit A to this Ordinance. SECTION 8. That the 2024 International Fuel Gas Code (IFGC) as adopted above is hereby amended as set forth in Exhibit A to this Ordinance. SECTION 9. That the 2023 National Electrical Code (NEC) as adopted above is hereby amended as set forth in Exhibit A to this Ordinance. SECTION 10. That the 2024 International Energy Conservation Code (IECC) as adopted above is hereby amended as set forth in Exhibit A to this Ordinance. SECTION 11. That the 2024 International Swimming Pool and Spa Code (ISPSC) as adopted above is hereby amended as set forth in Exhibit A to this Ordinance. SECTION 12. That the 2024 International Green Construction Code (lgCC) as adopted above (as an optional code) is hereby amended as set forth in Exhibit A to this Ordinance. SECTION 13. That the 2024 International Fire Code (IFC) including Appendices B, C, H, I, K, O and J, as adopted above is hereby amended as set forth in Exhibit B to this Ordinance. SECTION 14. That a new Tempe Administrative Code is hereby adopted as set forth in Exhibit C to this Ordinance. SECTION 15. Subject to the provisions set forth below in relation to optional delayed implementation, the new codes and amendments set forth herein shall become retroactively effective on July 1, 2026. SECTION 16. After the effective date of this Ordinance, any person who has already substantially completed the design work on any project may request that the Building Safety Deputy Director / Building Official allow completion of the design using the preceding Construction Codes of the City of Tempe. In such event, the Community Development Director or designee may allow permitting under the preceding codes so long as a substantially completed application is submitted to the City no later than December 31, 2026. SECTION 17. That after the effective date of this Ordinance, any standard plans, as defined by this adopted Construction Code of the City of Tempe, that were approved under the preceding Construction Code of the City of Tempe shall remain in effect and permits may be issued from these plans until June 30, 2027. SECTION 18. The City Clerk is hereby authorized to make such ministerial corrections and enter such numbering in the official version of the Tempe City Code as necessary to provide clarity and direction. Notes and comments contained in Exhibits are intended for convenience only and not intended for adoption as part of the City Code unless the context requires otherwise. SECTION 19. The provisions of this ordinance shall be severable and in the event that any provision of this ordinance should be determined to be invalid, the remaining provisions shall remain in full force and effect.
