Tempe EXHIBIT 2 PL260107 LETTER OF EXPLANATION Use Permit Application – Rear Setback Adjustment for Accessory Building Property Address: 1038 E Buena Vista Dr, Tempe, AZ 85284 Zoning: AG – Agricultural District Applicant: Jeremy Magoon Date: 4/29/2026 Project Overview and Objectives The purpose of this request is to obtain two Use Permit Standard to allow a reduction of approximately 7 feet from the required thirty-five (35) foot rear setback and 4 feet from the 20 foot side setback to permit construction of a detached accessory building (garage/shop) on the subject property. The proposed structure will be approximately fourteen (14) feet in height and will remain fully within the enclosed rear yard area of the property. The primary objective of the project is to construct a modest accessory building that is consistent with the residential agricultural use of the property and compatible with surrounding development, while accommodating existing site constraints, including septic system separation requirements regulated by Maricopa County Environmental Services. Description of Use and Operation The proposed structure will function solely as a private workshop and storage area serving the residential use of the property. It will not be used for commercial purposes, business operations, or public access. There will be no employees, customer visits, or commercial traffic associated with the use. The structure will be used intermittently by the owner for residential workshop activities typical of AG-zoned residential properties. The accessory building will not generate additional traffic beyond normal residential use patterns and will not introduce any operational impacts to the surrounding area. Reason for Setback Adjustment Request The requested setback adjustment is necessary due to site-specific constraints beyond the control of the property owner, including: • The subject property is approximately 32,417 square feet, which is significantly smaller than the typical one-acre parcel commonly associated with the AG zoning district. • The property has a pie-shaped configuration, which narrows toward the rear property line and substantially limits the available buildable area. EXHIBIT 3 • The existing onsite septic system, which was installed approximately forty (40) years ago, is regulated by Maricopa County Environmental Services. During building permit review, it was determined that required separation distances between the proposed accessory building and the existing septic seepage pit must be maintained. There is no issue with adding a bathroom to this system. • Relocation of the seepage pit is not feasible because current County regulations no longer permit like-for-like replacement of seepage pits. Relocation would require complete redesign and reconstruction of the septic system under modern standards, creating substantial and disproportionate hardship. As a result, shifting the accessory building approximately 7 feet toward the rear property line and 4 feet towards side property line is the only reasonable and proportional solution to maintain required septic separation while allowing reasonable use of the property. Even with the requested adjustment, the structure will maintain approximately 28 feet of rear yard setback and 16 feet of side yard setback, which provides substantial separation and buffering. Impact on Adjacent Properties and Neighborhood The requested setback adjustment will not negatively impact adjacent properties or the surrounding neighborhood for the following reasons: • The rear of the property abuts a utility easement, not an adjacent residential yard, providing an additional buffer and separation. • The accessory building will remain fully enclosed within a six-foot block wall that will surround the property, limiting visibility and minimizing visual impact. • The structure height of approximately fourteen (14) feet is modest and consistent with accessory buildings commonly found on AG-zoned residential properties. • The structure will not block views, sunlight, or air circulation to adjacent properties. • The proposed use is residential and consistent with the character of the neighborhood. Compliance with Use Permit Criteria – Section 6-308(E) a. Vehicular and Pedestrian Traffic The accessory building will not generate significant additional vehicular or pedestrian traffic. Use will be limited to normal residential access by the property owner. No commercial activity or increased public access will occur. This garage is used for workshop purposes not vehicle storage. EXHIBIT 4 b. Nuisance Conditions The proposed accessory building will not create nuisance conditions such as odor, dust, gas, noise, vibration, smoke, heat, or glare beyond normal residential levels. Activities will be consistent with typical residential garage and workshop use. With it being air conditioned doors will be closed during use. c. Neighborhood Character and Property Values The project will not contribute to deterioration of the neighborhood or reduction in property values. Accessory buildings are common and expected within AG zoning districts. The structure will improve the functionality and usability of the property while maintaining compatibility with surrounding properties. The request supports reasonable use of the property consistent with the intent of the AG zoning designation. d. Compatibility with Surrounding Structures and Uses The proposed accessory building is compatible in scale, design, and use with surrounding residential agricultural properties. Similar accessory buildings exist throughout the area. The structure will remain subordinate to the primary residence and consistent with the overall residential agricultural character of the neighborhood. e. Control of Disruptive Behavior The accessory building will be used solely for private residential purposes. No commercial activity, public access, or disruptive uses are proposed. As such, no disruptive behavior impacting the surrounding area is anticipated. Summary and Conclusion The requested Use Permit Standards to allow a 7 foot rear setback and 4 foot side yard adjustment is reasonable, necessary, and appropriate due to the combination of the property’s smaller-than-typical AG lot size, pie-shaped configuration, and existing septic system separation requirements regulated by Maricopa County. The proposed accessory building: • Will not negatively impact adjacent properties or the neighborhood • Will not create nuisance conditions • Will not increase traffic or public activity • Is consistent with surrounding development patterns • Maintains substantial rear yard separation and buffering EXHIBIT 5 The requested adjustment allows reasonable use of the property while preserving public health, safety, and welfare.
