REQUEST FOR COUNCIL ACTION

ACTION:  Approve and authorize Deputy City Manager Greg Ruiz to execute the Settlement 
Agreement between the Office of Inspector General (OIG) of the United States Department of Health 
and Human Services and the City of Tempe for the purpose of paying the settlement amount to OIG, 
and a budget appropriation transfer from the Emergency Medical Transportation Fund Contingency to 
the Emergency Medical Transportation Fund Operations budget. (Item/Material Added)
FISCAL IMPACT:  Fiscal Year 2025-26 budget appropriations in the amount of $490,000 will be 
transferred from the Emergency Medical Transportation Fund Contingency (cost center 2998) to the 
Emergency Medical Transportation Fund Operations budget (cost center 2991).  The settlement amount 
of $1,050,629.81 will be paid from the Emergency Medical Transportation Fund Operations budget (cost 
center 2991).
RECOMMENDATION:  Approve and authorize the execution of the Settlement Agreement, the budget 
appropriation transfer from the Emergency Medical Transportation Fund Contingency to the Emergency 
Medical Transportation Fund Operations budget, and payment of the settlement amount.
 
BACKGROUND INFORMATION:  In March of 2026, the Tempe Fire Medical Rescue Department 
(TFMRD) made a submission to OIG pursuant to OIG’s Self Disclosure Protocol regarding claims for 
services provided by TFMRD which produced the Settlement Agreement and associated settlement 
amount to be paid to OIG.
