Project Summary: 
 
1. 
The applicant is seeking to modify conditions of the previously approved zoning on subject parcel 
APN 501-03-006J, which was approved via the Board of Supervisors per MCP2016001 and 
MCP2016006.  The proposed modification will allow for the additional use of portable HVAC unit 
storage and maintenance.  The use would occupy a portion of the existing 48,000 sq. ft. building 
and no additional construction other than interior alterations would occur on site.  The existing 
cold storage uses on site would remain and would occupy a small portion of the existing building.  
Site access remains unchanged will continue to access the site off of a private easement along 
the northern portion of the site that connects to Sarival Ave. to the east.  The narrative states that 
there will be about 75 to 100 portable commercial HVAC units stored within the building, ranging 
in volume from about the size of a suitcase to the size of a large truck.  The units will be stored 
on site, leased on a temporary basis, and then maintained upon their return.  The operation will 
be run by Trane Rental Services.

Prior to the current proposal there is no history on site within the last five years. The initial zoning 
entitlement and construction of the subject property all occurred in 2016.  The applicant applied 
for a Use Consistency and Compatibility Determination, UC2023007, on March 9, 2023 and was 
deemed “compatible” by Luke Air Force Base on April 4, 2023.  The pre-application meeting, 
PA2023101, for the proposed use was held on June 27, 2023 and formal submittal was made on 
July 6, 2023.

Potential Zone of Luke Air Force Base.  Uses should be restricted to those that have been deemed

Public Participation Summary:

Despite the relative minor nature of the request, the applicant went above the minimum citizen 
participation requirements.  Notification letters were sent to all property owners within 600’ of the 
subject site, double the minimum requirement of 300’.  Additionally, the applicant posted the site 
with compliant signage in two locations.  The applicant has not reported any public response as 
a result of the public participation efforts. In addition, staff routed notice of the case to all 
registered areas of interest and municipalities within three miles of the subject site, including the 
City of Glendale.  Staff received no comment from the public.  The only response from the staff 
routing was those from LAFB and ADOT, both of which had no concerns on the proposal.

The subject site is surrounded on three sides by similar, industrial uses.  The remaining residential 
uses east of the subject site are within the MAAMF overlay, and while they are legal-non 
conforming they will likely transition to similar industrial or other LAFB compatible uses in the

future.  The proposed additional use of portable HVAC storage will have minimal impact on the 
surrounding properties as the intensity will be similar to the existing use on site.  Additionally, no 
exterior modifications are proposed, so the additional use will be nearly unnoticeable.   It is 
noteworthy that LAFB has no concern over the proposed use of the property, confirmed both in 
positive comment provided during technical review of this case and as per the positive finding of 
“compatible” via UC2023007.  As such, the proposed use is consistent with both the City of 
Glendale General Plan as well as the White Tank / Grand Avenue Area Plan, both of which 
delineate the subject site for uses compatible with LAFB. 
 
 
Recommendation: 
 
11. 
Staff recommends the Commission adopt a motion recommending that the Board of Supervisors 
approve MCP2023009 subject to the following conditions ‘a’ – ‘e’: 
 
a. 
Development of the site shall be in substantial conformance with the Site Plan entitled 
“White Tank Cooling LLC“, consisting of 1 full-size sheets, dated August 10, 2023, and 
stamped received August 17, 2023, except as modified by the following conditions. 
 
b. 
Development of the site shall be in substantial conformance with the Narrative Report 
entitled “White Tank Cooling”, consisting of 5 pages, dated July 7, 2023 and stamped 
received July 7, 2023, except as modified by the following conditions. 
 
c. 
Uses on site shall be limited to those deemed compatible by Luke Air Force Base via 
UC2015006 and UC2023007. 
 
d. 
The following Planning Engineering conditions shall apply:  
 
1. 
Engineering review of planning and/or zoning cases is for conceptual design only. 
All development and engineering design shall be in conformance with Section 1205 
of the Maricopa County Zoning Ordinance; Drainage Policies and Standards; 
Floodplain Regulations for Maricopa County; MCDOT Roadway Design Manual; and 
current engineering polices, standards and best practices at the time of application 
for construction. 
   
2. 
Based on the conceptual design nature of the information submitted, changes to the 
site layout may be necessitated by the final engineering design of the site’s drainage 
infrastructure.

Detailed Grading and Drainage (site infrastructure) Plans must be submitted with 
the application for Building Permits.

For the firs Building Permit Submittal, move the south driveway gate west to 
provide enough parking space for a truck when the gate is closed. 
 
e. 
The granting of this change in use of the property has been at the request of the applicant, 
with the consent of the landowner.  The granting of this approval allows the property to 
enjoy uses in excess of those permitted by the zoning existing on the date of application, 
subject to conditions.  In the event of the failure to comply with any condition, the property 
shall revert to the zoning that existed on the date of application.  It is, therefore, stipulated 
and agreed that either revocation due to the failure to comply with any conditions, does

not reduce any rights that existed on the date of application to use, divide, sell or possess 
the property and that there would be no diminution in value of the property from the value 
it held on the date of application due to such revocation of the MCP.  The MCP enhances 
the value of the property above its value as of the date the MCP is granted and reverting 
to the prior zoning results in the same value of the property as if the MCP had never been 
granted.

B.  PURPOSE OF REQUEST 
On September 7, 2016, the Maricopa Board of Supervisors unanimously approved Case No. 
MCP2016001 to enable the development of a 48,000 sqft advanced cold storage facility for the 
temporary storage, packaging and distribution of fresh produce and dry storage.  On January 11, 
2017, the Board of Supervisors approved a modification to the MCP per Case No. MCP2016006, 
allowing for a slight increase in building height.  Since those approvals, the Property has been 
fully developed and utilized for cold storage and associated uses.  The purpose of this request is 
simply to allow for a new use; the maintenance, storage and rental of portable HVAC units and 
associated accessory uses.  No other changes from the previously approved case are requested 
with this application. 
 
 
C.  DESCRIPTION OF PROPOSAL 
The Property consists of roughly 11.5 acres located at the northwest corner of Sarival Avenue 
and the Ocotillo Road alignment, near the intersection of Loop 303 and Glendale Avenue, 
Assessor Parcel No. 501-03-006J (the “Property”).  See aerial map attached at TAB A.  Because of 
the proximity to Luke Air Force Base, and per the Maricopa County Zoning Ordinance, a Military 
Compatibility Permit (MCP) is required for development and change of use.  As noted above, an 
MCP and Plan of Development were previously approved in 2017/2017.  Additionally, the 
Applicant has already obtained a Use Compatibility and Consistency Determination (UCCD) 
approval from Luke Air Force base (UCCD No. UC2023007) for the newly proposed use.   
 
The new proposal will utilize the existing building and site configuration for the maintenance, 
storage and rental of portable HVAC units and associated accessory uses.  Specifically, Trane 
Rental Services will be leasing space at this location for commercial HVAC unit maintenance, 
storage and rental.  They anticipate the storage of roughly 75-100 units which come in various 
sizes - some as small as suitcases and others the size of large trucks.  Units come back from a 
rental customer and will be serviced / repaired within the building and then stored on site 
awaiting a future rental.  Maintenance work will require compressed gases and welding.  Similar 
to the existing cold storage use, the HVAC storage anticipates minimal semi-truck traffic (0-10 
per day).  No change to vehicular circulation or parking layout is proposed.  The previously 
approved deviations from the Rural-43 zoning district will remain.   
  
 
D.  RELATIONSHIP TO SURROUNDING PROPERTIES 
The proposal is appropriate for the area which consists primarily of large, industrial and 
distribution-type facilities and businesses.  The majority of the surrounding land has been 
annexed into the City of Glendale and is zoned PAD for industrial and distribution uses.  The 
immediately surrounding conditions include: 
 
• North:  
City of Glendale.  PAD zoning. Industrial/distribution use.  
• South:  
City of Glendale.  PAD zoning. Industrial/distribution use.

E.  LOCATION AND ACCESSIBILITY 
The Property is located near the intersection of Glendale and Sarival Avenues, with convenient 
access to the Loop 303 Freeway located to the west.  Freeway access is provided at Glendale 
Avenue with both on and off ramps.  The Property also lies within the vicinity of Luke Air Force 
Base (within the 75ldn contour).   
 
 
F.  RELATIONSHIP TO STATE STATUTE 
The project complies with ARS 28-8481 as noted in the previous approvals.  The proposed use is 
a highly compatible and appropriate use given the location within the vicinity of Luke Air Force 
Base and the project incorporates sound attenuation measures including using insulated metal 
building wall panels.  The project also complies with Chapter 10, Section 1010 of the Maricopa 
County Zoning Ordinance.  As the proposed use is not specifically identified in the list of uses 
pursuant to Article 1010.6.6 of the Maricopa County Zoning Ordinance, a Use Compatibility and 
Consistency Determination (UCCD) must first be obtained prior to filing for an MCP.  As previously 
noted, a UCCD was received from Luke Air Force Base on April 3, 2023 (UCCD No. UC2023007).   
 
 
G.  CIRCULATION SYSTEM 
To accommodate vehicular ingress and egress, the project has two (2) access points along Sarival 
Avenue.  This frontage has been designed to incorporate a future right-of-way of 65 ft.  Employee 
and visitor vehicles will enter the north drive and park.  Delivery trucks will access the north drive 
and proceed to the appropriate loading / unloading area, with the option to exit at the same 
point, or through the southern drive aisle on Sarival.   
 
A reduction in the required number of parking spaces was approved by the Board of Supervisors, 
and 11 standard parking spaces are provided, 1 ADA space is provided, and 12 truck parking 
spaces are provided.  These spaces will be more than adequate to serve the use.      
 
 
H.  DEVELOPMENT SCHEDULE 
The property is already fully developed.  Some minor interior work is anticipated to allow for 
the new use.

Thank you for the opportunity to provide comments on the proposed modification for the White Tank Cooling MCP 
application.  The site is located on approximately 11.50 acres and is located at the NWC of Sarival and Ocotillo Road in 
unincorporated Maricopa County, AZ.  This proposal is to rent space in the existing facility for portable HVAC rental and 
repair services.  The site is inside of the Luke AFB 1988 70 Ldn, “high noise or accident potential zone” as identified by 
A.R.S. § 28-8461 and is within the “territory in the vicinity of a military airport” also defined by A.R.S. § 28-8461.     
 
This project was previously commented on via “HVAC Unit Storage Repair (UC2023007)” (attached) and current 
information does not affect our previous input.  As described, this project will not negatively impact the flying 
operations at Luke AFB.  Since the site will be located within the “territory in the vicinity of a military airport,” it will be 
subjected to approximately 170 over flights per day.   We recommend you review the sound attenuation requirements 
found in A.R.S. § 28-8482.  In addition, a strong notification program on the part of the applicant is essential to inform 
future tenant(s) about Luke AFB operations.

Thank you for the notice of proposed development.  After a review of your submitted information, we have concurred 
that the proposed project will not have an impact on our highway facilities in this area.  Exceptions to this would be 
traffic control necessary at ADOT facilities. If you are in need of performing traffic control on ADOT facilities said traffic 
control would require a permit.
