RESOLUTION NO. R2026.83
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
TEMPE, ARIZONA, APPROVING THE FIRST AMENDMENT TO
THE INTERGOVERNMENTAL AGREEMENT WITH THE CITY
OF PHOENIX FOR THE PURPOSE OF ACCEPTING CITY OF
TEMPE’S
GREEN
ORGANICS,
RECYCLABLES
AND
MUNICIPAL SOLID WASTE ON AN AS-NEEDED BASIS.
WHEREAS, the City is authorized pursuant to the Tempe City Charter Section 1.03 and Arizona
Revised Statutes (“A.R.S.”) §§ 11-951 et seq. to enter into intergovernmental agreements (“IGAs”) for the
provision of services or for joint cooperative action; and,
WHEREAS, the City of Tempe approved a resolution authorizing the Mayor to execute an
Intergovernmental Agreement between the City of Phoenix and City of Tempe for the purpose of Phoenix
accepting Tempe’s green organics, recyclable material and municipal solid waste on an as-needed basis;
and,
WHEREAS, this IGA authorizes the City of Phoenix to charge its gate fees for green organic
tonnage, recycle processing fees for recycling tonnage and gate fees for municipal solid waste; and,
WHERAS, the one-year term of this IGA began on July 1, 2025, and concludes on June 30, 2026;
and,
WHEREAS, provisions of the IGA include four one-year renewal options to extend the agreement,
this being the first of four one-year renewal options, and it is in the City’s best interests to renew; and,
WHEREAS, this Resolution and its actions are for the benefit of persons living, working, or visiting
in the City of Tempe;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF TEMPE,
ARIZONA, HEREBY:
Section 1. The City Council authorizes, approves, and directs the Mayor to execute, on behalf of
the City, the First Amendment to the Intergovernmental Agreement relating to the City of Phoenix
accepting the City of Tempe’s green organics, recyclables and municipal solid waste on an as-needed basis.
Section 2. That the City Manager or designee is authorized and directed to execute any other
documents and take such other actions as are necessary to carry out the intent of this Resolution. The City
Manager or designee is further authorized to execute amendments to the IGA for purposes of consenting to
any annual rate increases by the City of Phoenix that are consistent with rates offered by the City of Phoenix
to others similarly situated.
