ACTION:  PUBLIC HEARING ITEM Hold the second and final public hearing to adopt an ordinance 
amending the Tempe City Code, Chapter 19, relating to Motorized and Electric Mobility Devices in 
Sections 19-1 (b), 19-183, 19-184 (a)(b), 19-212 (d)(e), 19-213 (a), and 19-214 (c)(f)(i). The first public 
hearing was held on June 11, 2026. (Ordinance No. O2026.33)
FISCAL IMPACT:  No impact on City funds.
RECOMMENDATION:  Adopt Ordinance No. O2026.33.
 
BACKGROUND INFORMATION:  The use of electric bicycles, electric scooters, motorized 
skateboards, and other personal mobility devices has increased significantly throughout Arizona, 
providing affordable and accessible transportation options while creating new challenges related to 
safety, enforcement, device classification, and integration with existing transportation infrastructure.
In response to increasing community concerns and emerging safety issues, the City Council 
Subcommittee on Electric and Motorized Mobility Devices was established to evaluate the operation of 
electric bicycles, electric scooters, motorized skateboards, and similar devices within the City of Tempe. 
The subcommittee's work included collaboration among several Internal Departments including: the 
Tempe Police Department, Transportation and Sustainability Department, Tempe Fire Medical Rescue, 
the City Attorney's Office, as well as several community stakeholder groups.
During meetings held on January 7, 2026, February 18, 2026, and April 22, 2026, the subcommittee 
reviewed its goals and objectives, updates to state and federal legislation, the City's existing ordinance, 
local incident and injury data, transportation survey results, and community feedback. Presentations 
were provided by the Tempe Police Department regarding enforcement and education efforts, Tempe 
Fire Medical Rescue regarding incident trends, and City staff regarding the Shared Active Transportation 
Vehicle (SATV) program and public education initiatives. The subcommittee also received input from 
shared mobility providers Bird and Lime concerning industry trends, rider education, operational 
practices, and opportunities to improve safety and compliance.
Based on these discussions, stakeholder input, operational experience, and available data, the 
subcommittee recommended amendments to Chapter 19 to clarify device classifications, strengthen 
safety requirements, and improve enforcement of regulations governing electric and motorized mobility 
devices. 
The Council Subcommittee has completed its review and development of the proposed amendments 
and recommends adoption of the ordinance revisions for consideration by the City Council.
