CITY OF TEMPE Meeting Date: 6/25/2026 REQUEST FOR COUNCIL ACTION Agenda Item: 8C5 ACTION: PUBLIC HEARING ITEM Hold the second and final public hearing to adopt an ordinance amending Tempe City Code, Chapter 14A-11 "Violations". The applicant is the City of Tempe. The first public hearing was held on June 4, 2026. (Ordinance No. O2026.28) FISCAL IMPACT: None RECOMMENDATION: Adopt Ordinance No. O2026.28. BACKGROUND INFORMATION: Staff requests that Council adopt proposed amendments to Chapter 14A-11 of City Code, which pertain to violations of the Historic Preservation Ordinance's requirements for historical and archaeological properties. Under the proposed amendments, a judge may impose penalties under Section 1-7 of City Code for "construction, alteration, neglect, demolition, or removal of a designated property or portion thereof in violation of the provisions of [Ch. 14A]" and for "defacing, damaging, or engaging in unauthorized excavation in an area classified as 'archaeologically sensitive' (as defined in Sec. 14A-2) while performing work as a contractor or subcontractor on a City of Tempe project, on a project on City of Tempe-owned property, or on a private project subject to archaeological mitigation requirements imposed by Tempe City Council. On May 13, 2025, the Historic Preservation Commission voted 6-0 to recommend adoption of the proposed ordinance. Between the first and second City Council hearings, the City Attorney approved minor modifications to the language of the ordinance made for the sake of clarity. ATTACHMENTS: 1.
