Project Summary:
1.
The proposed SUP for recreational open-air facilities will allow the property owners to operate a
small-scale training facility to teach circus skills such as trapeze acrobatics, slackline, juggling,
as well as other acrobatic and flexibility practices. The site will utilize a small existing barn for
equipment storage. There will be a permanently installed trapeze apparatus on site. Lights will
be affixed to the trapeze structure for safety and visibility in the latter hours of operation. The
site will be accessed off 182nd St. and parking will be provided on site and will be covered with
ground asphalt millings bound by a liquid emulsifier. A permanent ADA bathroom will be
provided near the parking lot. The applicant is not proposing any additional site screening aside
from an existing chain-link fence which is surrounded by shrubs, brush, and trees. Operations
are expected to be during the morning (8 am to 12 pm) and the evening (6 pm to 9 pm). The
applicant anticipates three two-hour classes per day, with a maximum attendance of 10
students per class. In addition to regular classes the applicant will offer three to four group
events per week, with group event attendance ranging between ten and twenty people and will
mostly be oriented towards children, with parents also in attendance. Group events will be
limited to two hours and will not include food or catering. The applicant is requesting that a
height of 34’ be allowed for the trapeze structure as the size and height of the structure is not
adjustable.

The property was subject to violation case V202000374, initiated on March 10, 2020, which was
for the alleged operation of a commercial gymnastic operation in the rural-43 zoning district.
While inspection of the site identified the erection of a large acrobatics structure for which no

permits had been obtained, the code enforcement team was not able to verify business
operations had been conducted on site. As such, the violation case was dismissed on September
1, 2020. After the violation was cleared the applicants attended a pre-application meeting to
discuss the potential of a SUP for a small circus training business. Formal submittal of the SUP
application occurred on September 7, 2021 and the technical advisory committee meeting was
held on October 19, 2021.

Public Participation Summary:

The applicants met and exceeded minimum requirements for citizen participation. All property
owners within 300’ of the subject site were notified of the requested SUP via USPS mail and signs
were posted on the subject property per ARS requirements. The applicants also discussed having
face-to-face conversations with most immediate neighbors. The citizen outreach provided no
negative feedback but the applicants did provide three support letters from neighbors as part of
their public participation results. The support letters were all enthusiastic and welcoming of the
proposed trapeze lessons. The support specifically mentioned excitement for groups of all ages,
including children, to be able to partake in the proposed training facility.

Staff Analysis:

Staff has some general concerns over the intensity of the proposed trapeze training facility,
especially with the proposed group events. The applicant has stated that these events will occur
three or four times a week and host up to twenty participants, not including parents/chaperons

as many of them will be focused on child participants. This double the number of participants
than the applicant proposes a typical class size to be. In response to staff expressing concerns
over these events the applicant clarified in the narrative that no food or catering would be provided
at these events and that they would be capped at a two-hour maximum time limit. Staff still has
concerns with the overall intensity of the group events, the true number of attendees, and
generally noise generated from these events from music, activity instruction, and potential for
screams/shouts from participants-especially younger cliental. This concern is quelled slightly by
the support letters submitted by the applicant as most of the immediate neighbors seem to be
looking forward to younger groups practicing on the trapeze equipment.

Another concern is of the trapeze structure itself, which is the main structural feature of the
proposed facility. The structure is currently erected on the parcel as a residential accessory;
however, it does not have the benefit of a building permit. The code compliance officer that
closed V202000374 noted the presence of the structure despite the lack of a building permit.
While noting the structure was not permitted the violation was closed because it was specifically
for an illegal business operation, which the code compliance officer was not able to substantiate.
While there have been no violation complaints on the trapeze structure it was present on the
parcel in the 2021, 2022, and 2023 aerial maps per the Maricopa County Assessor Parcel Viewer.
The structure is 34’ in height, which exceeds the base zoning height maximum by four feet. The
applicant also proposes lighting to be placed on the structure as well as a bull horn affixed to the
top. The applicant has not provided details with how high the light fixtures will be placed, only
that they will be at a 90-degree angle. This highlights concerns staff have of the proposed use
being intrusive on the surrounding residential area. Depending on the height of the lights they
may create light trespass onto neighboring properties, even at a 90-degree angle. Additionally,
the applicant has not provided a purpose for the bull horn at the top of the apparatus. No matter
the function, it poses a potential audible disturbance in the area. Staff recommends stipulation
“c“ to require all existing structures receive building permits within six months of BOS approval.
This includes the trapeze structure as well as the shed. It should be noted that the site plan shows
a new electrical line running to the shed as well as the trapeze structure. Additionally, staff will
recommend another condition to limit use of lighting and sound amplification between the hours
of 8:00 am and 9:00 pm, which coincides with proposed hours of operation.

Despite staff concern, the applicants have made a robust case for their proposal. First, they have
demonstrated that there is an abundant amount of vegetation around the perimeter of the
boundary that will act as both a visual screen for ground activities but will also dampen sound
produced on site to minimize visual and audible impacts to the surrounding area. Additionally,
the applicants have demonstrated that several other businesses operate in the neighborhood and
that it is a place conducive to home-based businesses. While staff is unable to verify any
entitlements in the immediate area, the applicant claims were bolstered by support letters which
described several businesses in the area that seem to fit the parameters of a home occupation.
Staff also notes that perhaps the most visually intrusive component of the proposed use, the
trapeze structure, has been in place for several years, albeit without permit, and has not been the
subject of a complaint (V20200374 was for alleged business use, not the structure itself). These
factors combined with support letters seem to make a strong case that the proposed trapeze
training facility will be a good fit for the neighborhood. Since neighborhoods can evolve over time
staff recommends a ten-year time frame be placed on the use so that it may be re-assed in ten
years to ensure continued compatibility with the adjacent properties.

Recommendation:
12.
Staff recommends the Commission adopt a motion recommending that the Board of Supervisors
approve Z2021104 subject to the following conditions ‘a’ – ‘l’.
a.
Development of the site shall be in substantial conformance with the plan of development
entitled “Phillips Residence Parking” consisting of 1 full-size sheet, dated March 16, 2023,
and stamped received May 25, 2023. The Plan of Development may be amended
administratively under separate application as long as the amendment complies with the
established SUP development standards as approved by the Board of Supervisors. Staff
may determine slight refinements to remain in substantial conformance with the approved
site plan. Minor and major amendments to the site plan will be determined in accordance
with Chapter 3 of the Maricopa County Zoning Ordinance.
b.
Development of the site shall be in substantial conformance with the Narrative Report
entitled “Trapeze Training Facility”, consisting of 5 pages, dated May 25, 2023 and
stamped received May 25, 2023, except as modified by the following conditions.

Building permits for all existing structures shall be obtained within six months of BOS
approval.

d.
Required permanent bathroom facilities are to meet all ADA, building code, and
environmental service requirements.
e.
This special use permit is valid for a period of ten years and shall expire on August 23,
2033, or upon termination of the use for a period of 90 or more days, whichever occurs
first. All site improvements associated with the special use permit shall be removed within
90 days of such expiration or termination of use.
f.
The site shall not open to the public prior to 8:00 am and shall not remain open past 9:00
pm.
g.
Lighting shall be extinguished by 9:00 pm daily.
h.
No amplified music or sound shall eminent from the site prior to 8:00 am or latter than
9:00 pm.
i.
Group events shall have a maximum of 20 participants.
j.
The following SUP standard shall apply:

The following Planning Engineering conditions shall apply:

Prior to the building permit approval, update the Engineered Grading and Drainage
Plans to show the extents of the SUP area (parking, trapeze area, overflow area?,
etc.). Provide the outline (top of slope perimeter) of the retention basin.
2.
Prior to the building permit approval, update the Engineered Grading and Drainage
Plans with proposed contours and spot elevations to show how the SUP area will
drain into the retention basin.
3.
Drainage review of planning and/or zoning cases is for conceptual design only and
does not represent final design approval nor shall it entitle applicants to future
designs that are not in conformance with Section 1205 of the Maricopa County
Zoning Ordinance and the Maricopa County Drainage Policies and Standards.
4.
All development and engineering design shall be in conformance with Section 1205
of the Maricopa County Zoning Ordinance and current engineering policies,
standards and best practices at the time of application for construction.
l.
The granting of this change in use of the property has been at the request of the applicant,
with the consent of the landowner. The granting of this approval allows the property to
enjoy uses in excess of those permitted by the zoning existing on the date of application,
subject to conditions. In the event of the failure to comply with any condition, and at the
time of expiration of the Special Use Permit, the property shall revert to the zoning that
existed on the date of application. It is, therefore, stipulated and agreed that either
revocation due to the failure to comply with any conditions, or the expiration of the Special
Use Permit, does not reduce any rights that existed on the date of application to use,
divide, sell or possess the property and that there would be no diminution in value of the
property from the value it held on the date of application due to such revocation or

expiration of the Special Use Permit. The Special Use Permit enhances the value of the
property above its value as of the date the Special Use Permit is granted and reverting to
the prior zoning results in the same value of the property as if the Special Use Permit had
never been granted.

Purpose of Request
Our purpose in requesting a Special Use Permit is to operate a small outdoor trapeze
and circus training facility from our residence. We are professionally trained gymnasts
and trapeze artists who would like to use the space in our yard to help others learn
similar skills. Since we are not trying to operate a large commercial business, but rather
a small scale training facility, a SUP would be sufficient for running this family business
out of our backyard.
Description of Proposal
The proposed uses are for skills such as flying trapeze, aerial silks, static trapeze, lyra,
tightwire/slackline, juggling, acrobatic classes, conditioning and flexibility. We have
an existing barn where other small equipment, ie juggling balls, mats, slacklines, will be
stored for these various uses. The barn for this storage is located to the north of the
trapeze rig.
Our hours will vary based on the season. We expect our summer operation hours to
be between 8am & 12pm, and also between 6pm and 9pm daily. Expected winter
hours could be between 8am-9pm daily. Three scheduled classes would be held
within those hours of operation. The maximum class duration would be 2 hours. This
varies based on the number of students in attendance. Since some classes will take
place during/after sunset lighting will be necessary to operate the evening class. We
attached 6 150-Watt LED NextGen III on each end of the trapeze (north and south)
21,000 Lumen – 5000K Slip Fit Mount Without Photocell all measuring 34 inches. This
lighting was chosen since it only illuminates the trapeze and will not shine on or disturb
the neighbors’ properties.
Our number of employees is 2. These employees do not reside at this residence. When
non-residence employees are required for operation of a class they will park in the
residences two space-driveway leading to their garage. Residence will park in their
garage as necessary. This provides adequate parking for all with no overflow onto the
street, etc.
We have no building in which we operate. All of our activities will take place outdoors
within our backyard. Our fence and landscaping will remain the same. We have no
need for any additions/changes to the property to operate. The existing fencing is
chain-link. The chain-link fence is lined with trees and bushy shrubs along the south
fence that give privacy to the neighbors to the south. We have no plans to change
the vegetation, only maintain it. The neighbors to the north have no desire to have
their view of the trapeze completely blocked off. They have shown interest in seeing
students train on the trapeze from their property. If this were to change for any reason
in the future, we would gladly plant trees and bushes along the fence line to provide
more privacy. We have included some pictures as requested to show the vegetation
and privacy that even the winter scape along the fence provides. Obstructing the
view for the sake of the flyers is not something that is necessary. People who choose
to attend trapeze classes have a strong desire to have their skills exhibited. By nature
flying trapeze is a performance type activity. Although skills are our goal here, the
exhibition part of blocking off view is not necessary for participants sake.
A full class is 10 students. This would be the typical class size. And we would average
3-4 group events (ie. birthday/corporate/youth group) per week. Groups tend to
have between 10 and 20 people. Most of these people are kids with parents or
chaperones who come together. Group events would typically take place on the
weekends and during the day and last only 2 hours max. No outside catering
included in events.
Relationship to Surrounding Properties
All the surrounding properties are zoned RU-43 and their uses are primarily
residential. Some of these property owners operate businesses including horse
boarding, riding lessons, Team Roping, personal training operations, etc. We feel
that outdoor flying trapeze fits in well with the activities already being conducted
within the vicinity of our property. Having spoken to most of the neighbors
surrounding our parcel all have been supportive of our use of our residential
property for flying trapeze training.

The location is 23228 S 182nd Street Gilbert AZ.
The access is located West from 182nd Street.
Circulation System (on & off-site)
Parking will take place in the existing driveway. Our architect has drawn up the plans
for the spaces available. Cars can easily pull into the spaces provided along the south
side of the driveway. We have made an ADA accessible parking spot at the west end
of the “parking lot.” As requested we added a concrete entrance/exit from 182nd street
that will lead off/on asphalt of 182nd.

Other information that will be helpful in evaluating the request
The highest point of the trapeze structure is 34’ in height. The crane bar of fly and
pedestal are the only two parts with their height above 30’. The other structures are
under 30’. We are requesting a variance to the height restriction. The height of the
crane bar of fly and pedestal is necessary for the safe operation of the trapeze, and we
do not feel the additional few feet are obtrusive for the neighborhood as it is not a
covered structure, nor a building, and there have been no neighbor complaints. The
top bar heights are required for the operation of the correct safety net height as well as
for the upper trapeze to provide clearance of the net. The top point includes bullhorn
and light fixtures to the very top of trapeze pole.

General Project Summary:
The proposed trapeze school and parking area is set on a 2.5-acre parcel
located 955’ north of Chandler Heights Rd. on the west side of 182nd St.
(23228 S. 182nd St.). The proposed site will be served by one existing full
access driveway on 182nd St. The site consists of 10 new parking spaces and
no new driveways are proposed. The school is estimated to generate a total
of 64 trips daily with 16 AM peak hour trips and 16 PM peak hour trips.
General Comments:
Entire site is within the Town of Gilbert, this segment of Chandler Heights Rd
and 182nd St. fall under MCDOT jurisdiction. A copy of this TS must be
submitted to Town of Gilbert for their review and approval. The comments
below pertain to roadways under Maricopa County jurisdiction only.
Review Comments:

As site is estimated to generate fewer than 100 peak hour trips, it is
anticipated to have a negligible impact on the surrounding roadway
infrastructure; therefore, there are no further comments on the traffic

The Maricopa County Environmental Services Department (MCESD) has
reviewed revised documents received from the Maricopa County Planning and
Development Department for the above referenced project. This project is a
Requesting Special Use Permit to operate an outdoor trapeze school at APN #
304-69-057B. Water and sewer services will be provided by Town of Queen
Creek. MCESD has no concerns.
Based on the above, MCESD raised no objections to the Planning &
Development Department in Accela Automation on October 4, 2021.
It should be noted that this document does not approve the referenced project.
Comments are provided only as advisory to Maricopa County Planning and
Development Department to assist staff to prepare a staff report. Other
Maricopa County agencies may have additional requirements. Final review and
approval will be made through Planning and Development Department
procedures. Applicant may need to submit separate applications to the
Maricopa County Environmental Services Department for approval of proposed

P&D Engineering Review has reviewed the plans and report submittal date stamped
05/25/2023 for the subject application and has no objections to this application
provided any approval includes the following stipulations:
1. Prior to the Building Permit approval, update the Engineered Grading and
Drainage Plans to show the extents of the SUP area (parking, trapeze area,
overflow area?, etc.). Provide the outline (top of slope perimeter) of the
retention basin.
2. Prior to the Building Permit approval, update the Engineered Grading and
Drainage Plans with proposed contours and spot elevations to show how the
SUP area will drain into the retention basin.
3. Drainage review of planning and/or zoning cases is for conceptual design only
and does not represent final design approval nor shall it entitle applicants to
future designs that are not in conformance with Section 1205 of the Maricopa
County Zoning Ordinance and the Maricopa County Drainage Policies and
Standards.
4. All development and engineering design shall be in conformance with Section
1205 of the Maricopa County Zoning Ordinance and current engineering
policies, standards and best practices at the time of application for construction.
Following are comments from the Maricopa County Department of Transportation
(MCDOT):
1. Prior to the Building Permit approval, driveway access to 182nd Street
(withing the R/W must be paved and will require a permit from MCDOT
issued concurrent with building permit(s) required for site development.
Drainage flow along the roadway must be maintained. The plans must show
the driveway in the MCDOT R/W. The MAG Standard 250-2 cannot be used
since it is for a road with curb and gutter. Identify the driveway to be 5-inch
think with a 6-ft wide wing.
2. See the Traffic Statement approval for the conditions to the approval.
