Project Summary:
1.
This application is a request to rezone a 16.8-acre site at the southwest corner of Rio Verde Dr.
and 174th St. in the Rio Verde Foothills area from Rural-43 to C-2 CUPD. The parcel is currently
vacant and has no history of development. The request will functionally allow for the development
of a commercial shopping complex to serve the immediate area.

The application was submitted on December 29, 2022 with an engineered site plan and the
request for approval with an accompanying commercial plan of development. A Technical
Advisory Committee (TAC) meeting was held on February 7, 2023 to review the technical details
and requirements of the proposal. The second submission, received March 23, 2023, was
amended to only to include the rezoning request, removing the POD to be approved
administratively at a later time. A subsequent and final submission was submitted May 1, 2023.

The rezoning request includes a CUPD overlay to limit entitled commercial uses on the parcel as
well as to alter development standards with an increase the minimum screen wall height
requirement from 6-feet to 8-feet.

Rio Verde Foothills Area Plan (adopted July 6, 2005): The parcel is within the boundaries of the
Rio Verde Foothills Area Plan and is categorized as Rural Residential or Agriculture and suitable
for 0-1 dwelling units per acre. Plan approval did not include any commercial land uses or
employment centers on the future land uses map. A scenic corridor was proposed in the plan
along Rio Verde Drive, though it was not implemented in the final approval of the plan.
Public Participation Summary:

The applicant has notified local residents of the proposed zone change utilizing two required on-
site notification signs. Letters of intent were sent out to all local landowners within 300’ of the
subject parcel. The applicant has also conducted a door-to-door messaging campaign to raise
awareness of the proposed zone change and to obtain letters of support for the proposal.
9.
Staff has received numerous instances of public outreach both supporting and opposing the
proposed zone change. As of this printing Staff has received 42 items of opposition, and 100
items of support in total for this application.
Outstanding Concerns from Reviewing Agencies:

The City of Scottsdale & Fort McDowell Yavapai Nation have not provided comment on this
application.
Staff Analysis:

The Rio Verde foothills area is a remote community that is comprised of two distinct lifestyle
groups - master-planned residential communities mixing with rural 1+ acre parcels. Development
in the area began during 1890s as homesteading, ultimately becoming the ‘Box Bar Ranch’ and
eventually sold to the Page Land & Cattle Company. In 1970 the land was sold to Rio Verde
Development Inc. which in 1973 began to develop the master-planned community with a second
phase in 1981. The area has had additional master-planned communities gain approval since the
initial Rio Verde creation including Tonto Verde & Trilogy (f.k.a. Vista Verde). The latter did not
begin majorly developing with homes until 2017. An additional master -planned community, West
Thirty-Six, is an approved Development Master Plan in the area (located to the east of the subject
parcel), and is currently processing a DMP amendment along with a rezoning to increase density.
These master-planned communities currently total approximately 3,294 approved units. There is
no commercial development within the master-planned communities other than their respective
golf course clubhouse complexes.

The remainder of the Rio Verde Foothills area is continuing to develop largely via unregulated lot-
splits and remains large acre-plus rural lots with a focus on equine uses, and vast areas of natural

open space on federal lands to the north and east as well as the county regional mountain park
to the south. There are few paved roadways (outside of the master-planned communities) in this
immediate area with other than Rio Verde Dr. The majority of the development in the larger lot
area has been since 2000 with a large influx of new homes in the last few years. Due to the rural
nature of these lots, the vast majority are served via individual on-site septic systems for
wastewater disposal and domestic wells or hauled water options for their water source. Due to a
mixture of circumstances, including having large areas lack water and sewer infrastructure, the
area is generally attributed as having water scarcity issues.

Commercial development has been traditionally discouraged in the area due to limited utility
infrastructure as well as the area plan discouraging commercial uses. The recent and planned
mass influx of population in the area has shifted the needs of the community. Staff recognizes
the impact allowing commercial uses in this area will bring to existing residences. Water and
sewer infrastructure has been expanded west along Rio Verde Dr. The parcel has obtained ‘will
serve’ letter from EPCOR for utility service. Any future surrounding development (residential or
commercial) will be able to utilize a closer utility connection that will be created on the subject
parcel.

As the current request is only for a rezoning, any future plan of development on the site will need
to include roadway improvements along Rio Verde Dr. and 174th St. Traffic and safety is cited as
a concern in many public comments on both opposition and support sides. There is a general
consensus that improvements need to be made to Rio Verde Dr. MCDOT’s future roadway
classification lists Rio Verde Dr. as a Minor Arterial, which is described as 4-lane road. The subject
location is opposite of the entrance to Trilogy and presents potential for a future signalized
intersection.
15.
Staff has had significant internal discussion on appropriate uses and locations for commercial
zoning in this vicinity. Staff supports the proposed application of the CUPD Overlay to prohibit
certain uses such as billboards and adult businesses that would normally be entitled with C-2
zoning. The remaining permitted uses would appear to more compatible given the semi-rural
nature of the area. The CUPD requirement for additional wall height will foster a more effective
buffer and will help reduce any immediate impact to direct neighbors.

The remote and rural nature of the Rio Verde foothills area allows for magnificent nighttime
astronomical viewing. To protect this valuable resource, staff has included provisions for
nighttime light mitigating requirements such as fully shielded fixtures facing downward at a
minimum 20-degree angle below the horizontal plane of the bottom of the light fixture as well as
prohibiting backlit commercial signage for outdoor use.

As in any unique or specific area, the area plan and the language therein must be considered. The
Rio Verde Foothills Area Plan was amended to its current state in 2006. The plan clearly indicates
that commercial and subdivision uses are discouraged. The plan also addresses its future self in
its own conclusion:
“It is important to note that the Rio Verde Foothills Area Plan is not a document that represents
ultimate buildout as many municipal general plans typically do. Rather, it prepares for and
accommodates growth over the next ten to fifteen years, but will be reexamined and updated
periodically to reflect current conditions and changes. While not a complete solution, the Rio Verde
Foothills Area Plan helps address the effects of growth and development by enhancing cooperation
between government agencies, citizens, and other affected interests, and by considering regional
implications”

For all intents and purposes, the area plan has been a success and has lived its natural course.
The area has and continues to experience residential growth but without any corresponding
commercial services. A neighborhood commercial node to service the immediate area is
appropriate.
Recommendation:
18.
Staff recommends the Commission adopt a motion recommending that the Board of Supervisors
approve Z2022221 subject to the following conditions ‘a’ – ‘i’:
a.
Development of the site shall be in substantial conformance with the Zoning Exhibit
entitled “Zoning Map“, consisting of 1 full-size sheet, and stamped “Received 5-1-2023”,
except as modified by the following conditions;
b.
Development of the site shall be in substantial conformance with the Narrative Report
entitled “Shops At Rio Verde”, consisting of 7 pages, dated April 24, 2023, except as
modified by the following conditions;
c.
Development of the site shall include nighttime light mitigating measures which shall
include but not limited to fully shielded, downward facing, side shielded under canopy
fixtures facing downward at a minimum 20-degree angle below the horizontal plane of the
bottom of the light fixture as well as prohibiting backlit commercial signage for outdoor
use. Future site plan of developments shall include a site photometric lighting plan to
ensure conformance to this condition;
d.
The following C-2 CUPD standard shall apply:

Without the submittal of a precise plan of development, no development approval
is inferred by this review, including, but not limited to number of proposed
buildings, drainage design, access and roadway alignments. These items will be
addressed as development plans progress and are submitted to the County for
further review and/or entitlement.
2.
A traffic impact study must be submitted with future entitlement (POD)
application(s).
3.
Engineering review of planning and/or zoning cases is for conceptual design
only. All development and engineering design shall be in conformance with
Section 1205 of the Maricopa County Zoning Ordinance; Drainage Policies and
Standards; Floodplain Regulations for Maricopa County; MCDOT Roadway Design
Manual; and current engineering policies, standards and best practices at the
time of application for construction.
g.
Administrative approval of a Plan of Development will be required prior to approval and
issuance of construction permits to develop and establish use of the site. Prior to
issuance of a building permit, written confirmation will be required from the emergency
fire protection jurisdiction having authority that the facility has been designed in
accordance with their regulations and requirements, and that emergency fire protection
service will be provided to the facility. Prior to issuance of the certificate of occupancy,
local fire protection jurisdiction review and approval will be required;
h.
The property owner/s and their successors waive claim for diminution in value if the
County takes action to rescind approval due to noncompliance with conditions.
i.
The granting of this change in use of the property has been at the request of the applicant,
with the consent of the landowner. The granting of this approval allows the property to
enjoy uses in excess of those permitted by the zoning existing on the date of application,
subject to conditions. In the event of the failure to comply with any condition, the property
shall revert to the zoning that existed on the date of application. It is, therefore, stipulated
and agreed that either revocation due to the failure to comply with any conditions, does
not reduce any rights that existed on the date of application to use, divide, sell or possess
the property and that there would be no diminution in value of the property from the value
it held on the date of application due to such revocation of the Zone Change. The Zone
Change enhances the value of the property above its value as of the date the Zone Change
is granted and reverting to the prior zoning results in the same value of the property as if
the Zone Change had never been granted.

A. REQUEST
The purpose of this request is for approval of a Zone Change with Overlay from RU-43 (Rural-43
– One Acre Per Dwelling Unit) to C-2 CUPD (Intermediate Commercial, Commercial Unit Plan
of Development) on approximately 18.97 gross acres (16.84 net acres) located at the southeast
corner of 174th Street and Rio Verde Drive, in Rio Verde, AZ, 85263 (the “Site”). The Site is a
portion of Maricopa County Assessor’s Parcel Number 219-38-046A. The approval of a Zone
Change with Overlay will allow the Site to operate as a planned shopping center with a variety of
commercial uses.

B. DESCRIPTION OF PROPOSAL
The Site is currently undeveloped desert land. This is a request for a Zone Change with Overlay
to allow the Site to develop as a planned shopping center. The proposal includes a variety of
conceptual commercial uses such as, but not limited to, a grocery store, hardware/tack and feed
store, drive-through restaurants,
full-service restaurants, bank,
automotive uses for tire and
battery repair, coffee shop, gas
station,
convenience
store,
assorted retail services, and
medical and office users. The
shopping
center
will
be
comprised of a several buildings
as depicted on the site plan
below. A larger commercial
building is proposed with several
smaller pad buildings ranging in
size. Each building will be made
up
of
masonry
block
construction
with
a
stucco
exterior and is proposed to be
painted in a manner consistent
with the palette of the native
desert colors in the surrounding
area.
The design of the proposed development seeks to create a community-oriented market and
service center. The architectural design will complement the natural beauty of the surrounding
area through the use of a neutral, soft color palette and naturalistic material choices. The use of
harsh or bright colors will be limited.
The conceptual aesthetic of the development will consist of a modern, rural style. The materials
palette will be considerate of the land that the proposed planning shopping center occupies. The
development will incorporate materials and colors found within the desert southwest
environment. Stone or River Rock veneers will be utilized over block materials. In choosing
colors, paler earth tones with soft accents will be used. Conceptual materials for the proposed
development include, but are not limited to:
o Board and Batton siding
o Standing Seam Metal Roofs
o Split face Block
o Smooth finish stucco or efis
o River Rock style veneer pillars
Signage for the shopping center will be in conformance with a comprehensive sign package to be
submitted and approved by Maricopa County.
Screen walls will be constructed along the perimeter of the shopping center.
Landscaping will be provided throughout the Site to create an aesthetic that is sensitive to the
surrounding rural environment. Shade trees will be provided throughout the surface parking area
to increase pedestrian comfort. As shown below, conceptual landscaping consists of a variety of
drought resistant, desert trees, shrubs, cacti, and flowers.
C. HYDROLOGY & DRAINAGE
Offsite
The subject property is impacted by offsite drainage (approximately 273 cfs) originating from
the west which reaches the site via sheet flow and minor washes. These flows will be intercepted
along the western boundary of the project at historic locations and channelized and routed to the
eastern boundary via engineered channels where a detention facility will hold and release these
flows at historic locations and peak discharges.
The northern portion of the site is inundated by FEMA flood zone AE. According to the Rio
Verde Area Drainage Master Plan (ADMP) approximately 90 cfs reaches the northwest corner of
the site and continues east. The cumulative flow reaching the northeast corner is approximately
100 cfs. Currently, flood waters tend to pond at the northwest corner of the site. An engineered
channel will be designed to replace the existing graded ditch located along the south side of Rio
Verde Drive. This new channel will serve to contain and convey flows east where they will be
released and allowed to continue upon historic flow patterns.
Onsite
Onsite storm flows will be intercepted by scuppers and/or catch basins and conveyed via storm
pipes to either surface retention basins and/or underground storage tanks.
D. RELATIONSHIP TO SURROUNDING PROPERTIES
The Site is undeveloped desert land zoned Rural-43 (“RU-43”), allowing for one dwelling unit per
acre. East, west, and south of the site is also undeveloped land zoned RU-43. To the southwest,
across 174th Street, are a few large lot homes zoned RU-43. North, across Rio Verde Drive, is the
Trilogy gated subdivision zoned R1-10 RUPD (10,000 Square Feet Per Dwelling Unit, Residential
Unit Plan of Development). The Site is located within the Board of Supervisors District 2 (Thomas
Galvin).
Additionally, the Site is located within the planning area of the Rio Verde Foothills Area Plan (the
“Area Plan”). The Area Plan advances policy objectives that promotes a healthy community,
encourages growth, develops an efficient transportation system, maintains a healthy environment,
and creates a diverse economy. The proposed development conforms with the overall goals of the
Area Plan. A discussion of how the proposed development complies with specific policy goals is
outlined below:
Goal L1: Promote efficient land development that is consistent with adjacent land uses, is well
integrated with the transportation system, and is sensitive to the natural environment.
Response: The Site is an ideal location for the proposed development. As mentioned
above, the Site is surrounded largely by residential uses. The addition of the shopping
center will help diversify uses, while also providing commercial, retail, and medical
services that are needed in the existing community. The design of the proposed
development will utilize soft, earth tones and natural finishes to blend in with the
surrounding desert landscape and be sensitive to the surrounding residential context.
Goal ED1: Promote a growing, balanced, efficient, and diversified economy, consistent with
available resources, that enhances quality employment opportunities, improves quality of life, and
is sensitive to the natural and cultural environment.
Response: The proposed development will stimulate economic development by providing
commercial, medical, and retail uses in a largely residential area, thereby providing necessary
services to residents within their own community. The addition of a shopping center in the area
will also increase job availability.
E. LOCATION AND ACESSIBILITY
The Site is located at the southeast corner of 174th Street and Rio Verde Drive in Rio Verde, AZ,
in the jurisdiction of Maricopa County. The subject Site a gateway to the Trilogy, Rio Verde, Tonto
Verde and the Rio Verde Foothills communities. The intent is to provide four access points to the
Site, two on 174th Street and two on Rio Verde Drive.
F. CIRCULATION SYSTEM
Again, the Site will be accessed via two main drives on each street, 174th Street and Rio Verde
Drive. Acceleration and deceleration lanes will be provided on Rio Verde Drive for each entrance
and exit. All four of these ingress/egress points will connect to internal drives within the project
for traffic circulation to and from various parking lot areas or pad users. A stop sign is proposed
at four egress points to help control the flow of traffic leaving the shopping center. Two speed
limit signs, one facing each direction of travel, are also proposed on Rio Verde Drive to control
the speed of vehicles traveling along the northern boundary of the Site.
A Traffic Impact Analysis report (TIA) was prepared by Southwest Traffic Engineering, LLC on
November 28, 2022, and will be provided to the County with a future Plan of Development (POD)
application.
G. COMMUNITY FACILITIES AND SERVICES
Currently, educational needs are being served by the Fountain Hills or Cave Creek school
districts. The Site is also near the McDowell Mountain Regional Park.
H. PUBLIC UTILITIES AND SERVICES
The Site will be served by the EPCOR Water Company for sewer and water service, and electric
power service through SRP. Refuse and trash collection is handled through contracts with private
collection companies. Police services are provided by Maricopa County Sheriff’s Office and fire
services by Rio Verde Fire District.
I. CONCLUSION
We respectfully request that the Zone Change with Overlay from RU-43 to C-2 CUPD be
considered for approval. With Maricopa County’s population rapidly growing and the general
demand for housing, it is critical to have a commercial center in the area for existing and future
residents to purchase goods and services.

My husband and I are residents of Rio Verde Foothills, and we
are opposed to the new shopping center near 174th St. and
Rio Verde Road. Rio Verde Road is already too busy with
traffic, it is a 2 lane not well maintained road. There have been
many incidents or Rio Verde Road, close call accidents, almost
head on crashes, people pulling out and driving well over the
speed limit. By adding a new shopping center, this will only
increase the chances of more accidents because of the
increased volume of traffic. Also, why do you keep approving
permits for any building out here when there is a water
shortage in this area and in Arizona. It is not right... Please do
not approve this.

I have been a resident of Rio Verde Foothills for 12 years and
my family will be directly affected by commercial rezoning on
174th street as I live on this street. First of all, we do NOT have
the infrastructure to support retail commerce in this immediate
area. This is directly on a main road that is only 1 lane in each
direction and not at an intersection (4 way) where ingress and
egress traffic would be most supported. This would result in
traffic congestion for the immediate residents and create a
hardship attempting to gain access to our homes while fighting
traffic. We do NOT want our roads paved, nor do we want the
light pollution, noise or smells of fast food restaurants (grease
traps) that are proposed as well as the noise of large delivery
trucks throughout early morning hours. Of important note is the
fact that this area is very seasonal in residency with Trilogy
directly across the street and Tonto neighborhood nearby.
There have been restaurants at Alma School and Dynamite
that continually go out of business because there isn't enough
steady business to support them. I'm concerned that this too
will end in a vacant/retail strip mall. There is also concern about
the nearby school bus stop that would be not only
inconvenienced by traffic but pose a safety hazard to the
children who have to cross the road in this area from the
elementary and high school buses. There is plenty of
commerce within 15 minutes of this area which is easily

accessible by main roads and doesn't produce traffic safety
hazards such as this. The master plan for the Rio Verde
Foothills area has always been focused on residential zoning
only, preservation of the desert landscape and wildlife in the
area. Please do NOT grant the rezoning of this property.

Hello, My name is Cody Reim, I live in the Rio Verde Foothills
community. This is in regards to the new proposed
Retail/Commercial development on the SE corner of 174th St
and Rio Verde Dr. Although I am one who is for property rights
and individual liberties, I am in opposition to this development
for multiple reasons. First, allowing this type of re-zoning in our
area will set a precedence for future re-zoning requests and will
have unintended negative consequences for our community.
Where would the line be drawn? Would only commercial
rezoning be allowed along Rio Verde Dr or would commercial
rezoning be allowed in the interior streets of the community
such at Lone Mountain or Peak View? Second, the traffic this
type of a development would create would be outrageously
burdensome to those entering and exiting adjacent roadways
onto or off of Rio Verde Dr, there is a School Bus stop nearby,
this could create dangerous traffic incidents for the students &
parents. Second, our dark skies are already being diminished
by the developments happening in Scottsdale and Phoenix,
allowing this development to occur would seal the deal on
never seeing the stars from our homes again. Our area is
already facing overdevelopment and the wildlife population is
facing most of the challenges of that, this development would
only increase those challenges to our unique habitat and
wildlife environment we have in Rio Verde and the Foothills.
Another item I failed to get mention is the potential increase in

crime, it is fact that in the majority of cases where a
retail/commercial development is built that invites more and
more consumers, there is the inherent risk of also inviting those
that seek to do harm or to commit crimes such as theft or
worse. Please do not set the precedence of commercial or
retail development in our very special and unique community,
we have enough retail just a short 15 minute drive away, let’s
keep it at that safe buffered distance from our homes.

Hello,
I am a resident that lives on 174th in the unicorporated
Maricopa County community of Rio Verde. I recently noticed a
“zone change” public notice for Case Number “Z2022221.”
I have some concerns that the project does not address some
drastic changes to the health, safety and welfare of the
established residential area. I am completely supportive of
responsible development and believe owners should be able to
use real property to their desire, yet I also feel personal
responsibility should also be considered. For instance, the
property owner purchased the property knowing full and well
the area was zoned as rural residential. The proposed change
that includes a possible gas station and approximately 700
parking spaces seems unreasonable and frankly irresponsible.
This planned zone change appears to me in direct conflict of
what the County’s own plan elements for the Rio Verde
community.
I am respectfully requesting to meet with the planning authority
to gather further information about what exactly the
development plans are for this area as soon as possible. I
know there is a general sense of support for some type of

infrastructure in the area, yet I don’t think the initial vibe of
support factors in several concerns of how this will effect the
rural environment most residence enjoy.
I am specifically requesting details on:
1) Retail/ lot access on 174th.
2) Any traffic revisions to the access points on Rio Verde/
174th.
3) Economic model to sustain/ support the proposed
infrastructure.
4) Building configuration, size and speculative business
information.
5) Environment impacts to water shed if a gas station is
proposed.
6) Landscaping.
7) Setbacks from residential lots.
8) Flood areas and proposed easements.
9) Lights.
10) Public safety support (i.e. what law enforcement agency
covers this area?).
11) Are any proposed businesses going to sell alcohol?

I moved to Rio Verde after living 20 years on 7th St in Phoenix. It was my goal to get away from stores, traffic and
noise. Bottom line I am not a fan of a shopping center in Rio Verde. We already have too many stores, too many empty
stores and not enough cactus. Development only lines the pockets of developers. They don’t live here. I have no issue
driving 20‐30 minutes to the store. I knew that when I bought my home here in Trilogy. Can there be somewhere
where there is peace and quiet?

Good morning, Andrew!
I’m a resident of Trilogy at Verde River and would like to voice my support for the rezoning at 174th and the shopping
plaza.
In my mind, with more homes being proposed by Shea and Toll Brothers out here, a shopping center here would lessen
the amount of traffic on Rio Verde Road. There is so much traffic already and more homes would bring in even more
traffic.
Also, should Epcor put in a stand pipe out here for the Rio Verde foothills, that is a huge increase of trucks daily servicing
that area.
Please give us a reason not to have to drive Rio Verde Road as much as we do now. We love living here and bought
because we are rural here. It sure would be nice, though, to have a grocery store nearby!

Please don’t bring this retail out here. Our roads cannot handle the construction traffic or the additional traffic after you
build. It’s already dangerous and slow and we all moved out here to get away from retail. We are happy to drive to it

Mr Lorentzen, as a resident of RVF, I am amazed that the county is approving a shopping center to be built in our area.
Does anyone from the county know anything about this area? People have moved to this location for years to get away
from shopping centers.
Have you seen the access on Rio Verde Drive? It’s a two lane 50 mph roadway. The access to this area is one way in and
one way out. We are surrounded by desert shrubs and trees. There are animals living in this area. Is your plan to
relocate those animals? Wildlife in our area is already pushed so far that they are running out of space.
Back to the access. This road cannot support the amount of vehicles that will be servicing these shops. Local traffic is bad
enough and with the building of this center, no one will be able to leave their own streets! We don’t have the roadway
to accommodate more cars and trucks.
As I noted, there is only one way in and one way out. Either you take the access through fountain hills or westbound to
Scottsdale. There is not enough access for local traffic to travel. More people—more cars on a road that can’t support
what’s out here now. We don’t have another east‐west road to travel. Any plans to make another east‐west road out of
here?
And what about fire danger? This area would be in ruins if a wildfire broke out. We can’t all get out now because of the
limited access road. Putting another unnecessary shopping village will only create more traffic. And where will they get
their water? Water for restrooms, irrigation and probably a fountain! This area does not need nor want a shopping
center. We don’t have water for the homes that are located in this area and you want to approve more building! Do you
even visit the areas you approve for building? Maybe you should and maybe you should meet the residents who are
against this disaster. People live in this area to be away from shopping. We all know how to drive to Scottsdale. And if
there are some who moved out here and wanted shopping, they should have stayed in the city! Why should some
people dictate adding more commercial building when there’s plenty of areas in Scottsdale where they can shop—or
live.
It is so disappointing that Maricopa County continues to build and build and build—especially in an area that can’t
handle more building. THERES NO WATER IN CASE YOU HAD NOT HEARD! Why does the county continue to issue
permits in an area that is suffering? Homeowners don’t want this shopping area—they want a water supply to live in
their homes!
Over build and over build. One of the more horrible examples of this is Camelback Mountain. Homes keep creeping up
the mountain. It’s disgusting that permits are allowed to build homes higher and higher. But we all know—money
talks—and if you have it you get what you want. It’s disgraceful that there is no conservation efforts within Maricopa
County. Camelback and Rio Verde Foothills are prime examples. We are so tired of the building in areas that don’t need
it or don’t want it. In RVF we are just the red headed stepchild—we can’t vote on any of these measures and have to
deal with the outcome while you and the others sit in your cozy offices and rubber stamp anything that’s beneficial to
you.

Do us all a favor—make a visit out here and meet with residents. We aren’t bad people. We love our desert, our homes
our quiet. We don’t want more traffic on an already heavily traveled road—we don’t want more truck traffic tearing up
the roadway. We have to drive this commute every day. Can’t we have a safe and peaceful travel route without our
vehicles being exposed to potholes and uneven pavement? We don’t ask for much—just a quiet place to raise our
families, open spaces for our horses and a beautiful desert for wildlife. We’re not city dwellers like you because we
chose that lifestyle. People who want city conveniences should stay in town. There’s a reason we live out here—peace
and quiet and no HOAs. You will be responsible for more traffic, more destruction of beauty and another worthless
shopping center.
I’m sure I won’t get any reply to my email, but at least I’ve voiced my opinion. Things have got to change with Maricopa
County. Overbuilding is killing everyone and one day there won’t be anywhere to escape the madness.

I oppose the change of zoning to allow for the construction of a shopping center on 174th and Rio Verde Drive.
With the rampant development already occurring in this area, with much of it being high density communities (such as
Trilogy and the now proposed subdivision also in the vicinity of Rio Verde Dr. and 174th St), the water supply is already
taxed ‐ which was admitted by EPCOR in the ACC hearings (at maximum capacity I believe was EPCOR's description)
during the petition for rate increase and proposed merger.
In addition, the road network cannot support the increased population and traffic in the event of an emergency ‐ such as
a wildfire. There are only two escape routes out of this area ‐ Rio Verde Dr. towards Scottsdale and Forest Road to
McDowell Mountain Road toward Fountain Hills. Both are two lane roads that are deteriorating rapidly due to the
consistent heavy truck traffic foisted on this "scenic byway" fostered by the greed of developers who have no intention
of improving the area ‐ just destroying it in their pursuit of profit. MCDOT continues to study the issue, but there is no
plan in the foreseeable future and no funding.
There is also no real solution to the Rio Verde Foothills water access, yet Maricopa County continues to allow wildcat
development by issuing building permits for homes without water security. One only needs to go on Redfin to see the
abundance of new listings for new build homes on hauled water.
There is plenty of shopping nearby. We live in the Rio Verde Community and can get to a Safeway or Basha's store in
approximately 15 minutes (Fountain Hills). There is plenty of retail in the Fountain Hills area to support the residents of
this area, including walk‐in clinics. There are plenty more retail and medical options in either Cave Creek or in Scottsdale
in the Pima Rd. / Pinnacle Peak area. Fuel is available at a maximum of 15 minutes in either direction from the midpoint
of this area.
This proposal is for nothing more than a glorified "quickie mart" with services that provide little to no value to
residents. There is no need for a hardware store. There's a :Lowe's, a Home Depot, and several Ace Hardware stores all
located within 20 minutes. There is no need for casual dining as evidenced by the number of restaurants that have
failed at the existing plaza at Rio Verde Dr. and Alma School Rd ‐ where the population is higher. Medical offices won't
be able to survive as the full time population is insufficient to support them. It will become a magnet for trouble.
In my opinion, the proposed shopping center is destined to become a nuisance by attracting more people to Needle
Rock and surrounding areas with their off‐road vehicles ‐ those people are already causing severe damage to the
ecosystem of the Tonto National Forest. They cut fences, allowing the wild horses who make their home there, to
potentially wander onto the roads. There is no police presence out here, other than the occasional transient MCSO
officer.
This is someone's solution in search of a problem and should be denied.

On a side note, I did attend the developer's open house. When asked about issues such as water, roads, security,
resident safety, the representatives' responses gave the impression that they were doing nothing more than the
minimum required to get permits... leaving everyone else with the mess they created.
You have to power to stop the rape of this land.

My name is Holly Kaylene Lasley, I am the reigning Miss Arizona Role Model 2023 (State Title based on community
service & volunteering) and a resident of Rio Verde Foothills in close proximity to the proposed commercial zoning
change by Trilogy for a shopping center.
I am strictly opposed to the rezoning for many reasons:
1. First and foremost, I worked two jobs for 17 years to build my dream home in Rio Verde; away from the city,
away from the crowds, development and to surround myself with the natural beauty and peacefulness of the
Sonoran Desert. I strongly believe if you want city amenities, purchase a home in the city.
2. The appropriate infrastructure needed for commercial plaza is nonexistent.
3. Tonto Verde Country Club, Rio Verde Country Club and Trilogy are all severely understaffed and all have been
unsuccessful in maintaining a full‐time staff required to run their establishments. Who do you think is going to
be employed at a new commercial shopping center when these clubs have failed to maintain employees for
decades?
4. Trilogy already has their own marketplace inside their establishment. Why can Trilogy not expand or change
their products to better serve the needs of their residents?
5. Rio Verde Country Club had their own marketplace for residents and it closed since they could not staff it
properly and it was not cost effective. Why is it not possible for the residents of Rio Verde CC to re‐open their
previous market space and provide for their residents? After all, Troon Golf Management just spent millions of
dollars remodeling their clubhouse and bar.
6. We are in the middle of a water crisis in litigation with no resolution in sight.
7. A commercial plaza does not suit the quiet, peacefulness and character of our small ranching community.

I am writing to express my opposition to the shopping center wanted by the Rio Verde residents.
First and foremost this is a rural area. There are strict rules on light pollution. I suspect a shopping center would want
parking lot lights. Secondly, the people who want this center are only part time residents of the area (snowbirds that
come to AZ). With that, the need for such a center will only be desired half of the year. On top of that, it is difficult, if
not impossible, to find any employees who will drive to this community.
There are grocery stores within 15 minutes of this location. There are also hardware stores. I am truly amazed that
people that move to Rio Verde or Trilogy, knowing there are no conveniences across the street, do so and then expect to
bring their city wants to this rural community.
The residents who have been here,
Full time, do not want the shopping center. We do not need the shopping center. We desire the dark and quiet
environment at night. We don’t need a facility that will become empty store fronts due to the lack of customers and
inability to obtain/retain employees.
What’s more is that a shopping center like this will add to the overly congested Rio Verde Road/Dynamite. It will bring
truck traffic delivering goods at all hours. It will invite crime to the area.
All in all, there are a select few who want a Sun City where golf carts are the main form of transportation and the
conveniences are 5 minutes from their front door step. The overwhelming majority of residents do not want and have
committed to boycotting anything that is located in this center.
This center is completely unnecessary and will fail. Please make a sensible decision for the rural equine and livestock
area.

Dear Mr. Lorentzen:
My wife and I are full time residents in the Tonto Verde community and are in full support of the zoning changes relating
to the proposed shopping plaza at 174th and Rio Verde Drive. I won't make a business case analysis for the shopping
plaza as I'm sure several general contractors can provide those details/arguments. However, this entire corridor is being
developed thereby necessitating the need for a shopping plaza. Of course infrastructure concerns need to be
addressed, e.g., water source, street enhancements, etc., but I'm sure that will be addressed during zoning change
discussions with the affected communities and builders.
In closing, we live in a retirement community and making this a reality would greatly enhance our quality of life‐‐not
having to drive on busy streets.

shopping. It is our opinion that most people would welcome an upscale shopping center after discussions with our
neighbors in Tonto and Trilogy…with restrictions. We are not in favor of a strip mall with fast food and gas station
serving the transient building trades but a tasteful mall with groceries, drug store, family eateries, hair salon, gift shop,
and unique retail shops.
> We think an upscale mall would be beneficial to our property values and that we are projected to have the local
population numbers to easily support a major grocery store, drug store, restaurants, misc retail. Certainly it would draw
from the immediate area but also draw from Troon North and all the new subdivisions east of Alma School and
Dynamite and those near the Scottsdale National Golf Club.
> A strip mall with fast food and a major gas stop for the current building trades would be detrimental to the visual and
experiential appeal of our communities. There is already one such retail center at Alma School and Dynamite heavily
frequented by the building and service trades.
Again, we are in favor of the rezoning. We believe it is only a matter of time before this geographic area completely
transitions to family focused, planned subdivisions and active adult communities and away from the rural lifestyle.
Currently, the foothills area is experiencing water challenges which have been highly publicized. Sadly, many of those
dry‐lot homeowners seek only those solutions that will discourage expanded development.

We are sending support for the rezoning to commercial of open property for a shopping mall along Dynamite Road and
174th Street, across from the Trilogy development. We have lived in the foothills area and in the community of Rio

I am emailing you to today to express my support of the zoning change to allow the development of the Shopping Plaza
at 174th/Rio Verde Drive.
My husband and I live in the Trilogy Community directly across the street from this proposed development and we,
along with many of our friends and neighbors, are in full support of this shopping plaza. I believe it would be a great
addition to the community and would provide retail options very close to our homes. We currently have to drive quite a
distance for any shopping and with gas at $5.00 per gallon, this is an expensive predicament. With the convenience of
‘close‐by’ shopping, I believe there will be less traffic on Rio Verde/Dynamite. Less traffic means less noise, less
pollution, etc.
With so many homes in our community as well as the nearby neighborhoods in Verde River, plus the many properties
along Rio Verde Drive, I believe the retailers within the proposed shopping plaza will be met with great success.
I hope Maricopa County will approve this zoning change as there are lots of positives with this. Thank you for your time

Andrew – I am a Rio Verde Foothills resident living on 174th St (South Side directly across from Trilogy)
where the shopping center is planned to be located. I am writing in opposition of this shopping
center. As you know the foothills is going through a dire water situation and from the ACC hearings
and hearing feedback (via verbally at the ACC and per the ACC docket for our case) one of their
biggest issues is our water hauling trucks so I find it very odd that they are in support of this shopping
center which would bring in delivery trucks equal to the size of our water hauling trucks. Another
concern of theirs is us using their water supply/well but they don’t seem concerned about the fact
that this shopping center will be utilizing their water supply. Such a contradiction wouldn’t you say?
It is quite unbelievable that there is a community of over 500 homes that are in a dire water situation
and do not have access to secure and affordable water yet here you are approving and planning a
shopping center. Sure doesn’t look very good – people literally will not have water this summer
because either they can’t afford it or our water haulers can’t keep up with the demand since they
are traveling much further to get the water. But putting up a shopping center makes complete sense
– apparently, only because it makes the county money so you sacrifice people having the basic
human need of water in order to put up a shopping center for people that don’t want us to have
water either. Quite inhumane I would say and I am going to share this with the news outlets as well
because they need to know not only does the wildcat developing continue but now you are
commercially developing in this rural area while people don’t have access to affordable and secure
water.
This is not a commercial area – we moved out here to be in the rural area, not to have a shopping
center on the corner of my street. How many of the Trilogy and the Verdes reside here full time? If
you build it we will end up with empty store fronts because there won’t be enough business year
round because RVF won’t be supporting any of those businesses. Imagine all the crime that will bring
in addition to the traffic, noise and light pollution.

I understand you are the planner for Maricopa County Planning & Development. My husband and I live at 13911 E Quail
Track Rd, Scottsdale AZ 85262 in the Rio Verde Foothills. We moved to this amazing state full time 3 1/2 years ago to
enjoy its beauty and peacefulness.
I urge you to NOT rezone this area and allow a strip center to be built.
We are minutes from Walgreens, restaurants and gas at Alma School Rd and Dynamite. Maybe 20 minutes from a lot of
other retail shopping and restaurants. We do not need additional retail close to us.
I know some of our neighboring developments; Trilogy in particular are in favor of this strip center. Many of the
residents I have met from Trilogy are only here in the winter and they want the conveniences. I say, move in town if you
are not willing to drive a short distance for things. We moved out here to get out of the city.
My concern is that the businesses will not be able to find workers and even stay afloat and the increased traffic on our
roads.
We live in an area that is on hauled water and we knew that going into it. I would rather have Maricopa County use its
resources to make sure the Rio Verde Foothills had accessible drinking water, than build more commercial retail. We
have a lot in my opinion‐ to the north I can go to Target, Safeway, restaurants, gas, boutiques. And into town ‐ only 15 to
20 minutes I can be at scottsdale rd and pinnacle peak, DC ranch market area or a little further to Desert Ridge shopping.
Please, please do not rezone this area! Rio Verde Foothills residents, some of whom have been out here 20‐30 years, do
not want further development. Cave Creek and Carefree are also minutes away!
We have so many options, more retail will hurt the existing businesses, some of which are struggling to survive as it is.
Andrew, thank you for your time. I really appreciate it and know these are difficult decisions you are making.
I would gladly pay more Maricopa County taxes to not be burden with more retail.
The people near the purposed site at 174th are plentiful but are they really able to support this type of strip center? I do
not think so.
They say they want it for convenience but they are the same people that complain about our water hauler trucks and
increase traffic on the roads. I know growth is inevitable but we did not move out here to have the amenities follow us.
We love the green spaces and open desert. There is nothing quite like it!

Hi Andrew ‐ I read your comments on Facebook and I must say I’m one of those folks up the hill in the foothills but I’m
not necessarily opposed to shopping at 174th because even for us it’s 11 to 12 miles to the nearest grocery store. So we
could use a bit of shopping closer as well as our neighbors in Trilogy.
The most complaints I’ve heard come from the horse people who want to keep this area like it was 30 years ago. We
both know that’s not gonna happen because more and more people are moving to this area to get away from the
crowded city.
I represent the Rio Verde precinct within legislative district 3 as a precinct committeeman. I’m concerned about our
water issues as well as traffic along Rio Verde Drive. This area was not designed for the number of cars & trucks and
people that are now congesting it, and the high density of trilogy has made things even worse. I’m very concerned about
the number of building permits that are being issued in the Rio Verde foothills area. We both know this is putting stress
on not only water, but power and traffic and other social services. That will eventually mean need for additional schools
as more and more families with children move here.
Considering the high volume of traffic going through the Rio Verde foothills area out past trilogy I believe the road needs
to be a four‐lane divided like it is in the Troon area along Dynamite Boulevard.
I would not be opposed to a small shopping area at 174th St. that would include the businesses that are most critical to
the local residents. Hopefully it would be tastefully done to blend in with the local community. Of course, no one wants
to see it become a big box area like is happening in Cave Creek along Carefree Highway.
Not all of us in the foothills are bombarding negativity but we are hoping to see things done according to what the
community really needs and in a way that keeps this area a beautiful place to call home.

Dear Andrew : I am writing to you to provide support in the construction of a much needed
shopping center near 174th and Rio Verde Drive, Rio Verde. . We have lived in Rio Verde for 4
plus years and each shopping trip for grocery and pharmacy items has been over 30 minutes
away. We are over 70 years old, and there are emergency situations, not to mention
inconvenience, where pharmacy and grocery stores are not currently available . We are
essentially in a food desert.
There are so many other positive environmental benefits such as decreased vehicle use,/gas
consumption, decreased wear and tear of road surfaces , and decreased traffic etc. It will also
bring employment and financial input to the Rio Verde community.
I appreciate your attention to this matter and take action to support construction of this
shopping center. As Arizona is anticipating an influx of people from out of states, the shopping
center can be another example of how the County is preparing for growth in the community,
both current and incoming residents.

I am writing in response to the approval of the shopping center at 174th and Rio Verde Drive. We have lived in the Shea
Trilogy development for approximately the last four and one half years. When ever we need to go shopping for groceries,
gas or other supplies, it takes us over thirty minutes round trip to complete this event. My wife and I are over seventy
years old, and trips like this are stressful. Approval of the shopping center would be very beneficial for us as well as the
people in Tonto Verde, who are just around the corner.
Other advantages of the approval would be decreased vehicle, less gasoline consumption, and less pollution to the
environment. Also, it would decrease wear and tear on the roads due to less travel for the Trilogy residents.
It would also create job opportunities and provide financial input for the community.
We appreciate your attention to this new opportunity for the betterment of the community. Since Arizona is anticipating
new housing developments in this area, this shopping center would be a great example of how the County is preparing for
future in this area.

I have just posted a comment on the above case regarding the Shops at Rio Verde. I am not certain that it went through.
Here is what I wrote in my comment:
I am writing to express my strong support for the proposed Shops at Verde River project. I am a
resident of Trilogy at Verde River. Currently, a simple trip to the grocery store is over an hour
roundtrip, much longer if there is a traffic/construction issue. And there is always a traffic/construction
issue.Having the ability to make a quick, local stop to pick up some milk or eggs, or grab a quick bite
will be a huge convenience for me and my husband. We are seniors, as are many of the residents in
our community, and the opportunity to run a fast errand nearby, as opposed to fighting traffic and
crowds, will definitely enhance our daily lives. We love being in Rio Verde and its remote beauty is
one of the things which originally attracted us to the area, but the reality of living there and the
inconvenience inherent in that remoteness now leads me to enthusiastically support the prospect of
nearby shops.

Please include my name in opposition to the shopping center at the intersection of 174th and Rio Verde dr. The
development would be out of character with the area, increase noise, lights and traffic, and cause even more problems
than Trilogy with low availability of MCSO support. Adequate services are 10 minutes away in either direction making it
unnecessary. This area is under AMA as well and would be another example of county BoS developing in areas that
were designed to be low infrastructure and equestrian focused. Please have businesses like this focus on areas already
set up to handle them.

I oppose the development for a strip mall in Rio Verde. The noise and traffic have increased since the extensive
nonsensical building began in Rio Verde. We live in Troon North on Dynamite. Our quality of life has been reduced
because of traffic noise from water trucks, construction and unnecessary growth of Rio Verde. We no longer can make a
left turn from Troon North Club Dynamite Grill area without fearing of accident.

Hi,
I am sending this email in opposition of this shopping center. We moved out to this area to have rural country living and
we do not want business in this area. We knew when we moved out here we would be commuting to any groceries or
other items and so did everyone else. This is just going to cause more issues and problems for our community that are
not needed. I think a vote should be taken by the Rio Verde Foothills community since it is being put in our
neighborhood. Please help us stop this development.

Nice to meet you Sir.
I live in Rio Verde (the new Trilogy development) for 9 months a year. In our local Facebook Trilogy group, there are
some Rio Verde Foothills people (the ones without water) that are pretending they are neighbors. Anyways, they are
vocal about not having the new proposed shopping center. They are the ones who put your email address out in several
forums begging for people to complain.
Rest assured; the VAST amount of Trilogy neighbors (1000 houses strong and 400 more about to be completed) would
LOVE a grocery store nearby (no maƩer how small it is). I’m thinking it is around 90 % for, and 10% against. And the
people who are against it are worried about “light polluƟon”. I’m sure the smart developer can minimize that. স

Without quesƟon, that will save me 20 minutes of driving every Ɵme I need some items. The net result is the traffic will
be lower on Dynamite.

Dear Mr. Lorentzen,
I am writing in opposition to the proposed shopping center in my community. A shopping center does not
belong in a residential community. Besides being a blight to the area, there will not be sufficient patronage to
sustain its viability. ie, Trilogy, Rio Verde, Tonto Verde are snow bird communities--who will support the
business the other 6-8 months of the year? It will close and my community will be stuck with the ugliest of
eyesores. Please do not move forward with this proposal. Thank you.

Good Morning, I hope you had an enjoyable Memorial Day weekend. My wife and I do not support the rezoning to
the land at 174 St & Rio Verde Drive, we live in the area south of 174 St & Rio Verde Drive and have live here for a long
time. We choose to live out in the rural SW desert to enjoy the open desert and having to travel to go into town. Please
don’t approve the rezoning so the town can come out to us. I’ve never understood the thought process of individuals
that move away from something and then choose to change the area into what they moved away from . They have
chosen to move out here in there master planned communities and now what to build a commercial complex to serves
them. We moved out here to get away from the city and now they want to build that out where we have chosen to live
before they move out here. If they want that then why did they move out here, what give them the right to impose what
they what upon those that live out here to be away from the city. What happened to becoming part of the community
you move into, no they want to change it into what they want. There is a lot of traffic out here already, adding to that by
building a commercial development, and then they’ll approve another master planned communities, more people that
want their city life and all it’s convenances out here and then the rural SW desert life style will be gone. Because it was
turned into a city.

As a community member living near the proposed shopping center on 174th I urge you to please do not rezone for this
purpose. We are struggling already with massive traffic on 2 lane roads, and we don't need shopping when Troon and
Fountain Hills already have the proper infrastructure and just a short drive. We chose to move here for the quiet and dark
sky and if we want shopping, we would have bought property that was urban. This is a rural area and I truly believe we
need to keep it that way and it's extremely dangerous to residents already struggling with traffic issues.

We are adamantly opposed to the rezoning at 174th and Rio Verde Drive.
First, we STILL do not have affordable water out here!! Could we please fix that BEFORE we we discuss rezoning to
continue more development out here, more buildings that need more water? It is infuriating that there is even
discussion of more development when there are hundreds of homes in this neighborhood that have been paying water
bills the equivalent of a mortgage payment since January and the bill to fix it was just vetoed. The county has water for a
strip mall but not families??
Second, we are a rural neighborhood that wants to stay that way. We do not want strip malls that bring in more cars,
traffic, etc. We are all perfectly happy to drive to the stores in Fountain Hills.
Please stop. Let’s fix what needs to be fixed here before you start adding to the problems.
We need affordable water and we need it now. We do not need more development that needs our water.

My name is Beth Taylor. My husband And I moved here to the Rio Verde Foothills in early 2017. Prior to that we lived
in the Tule Springs area (at the base of the mountains), NW of Las Vegas. When we moved there it was rural and
wonderful like the Foothills are here. It pains us to have people; based on a plea for convenience, hope to get Retail
zoned into our pristine and quiet area. Unfortunately we have shared this scenario in Las Vegas and before that in
Boise Idaho. People are under the misconception that a little bit of retail would be great, not realizing that, as you and I
know, once approval starts it opens the door for continued build out. Many of the horse people in this area fought to
keep this area as an exclusive horse and recreational area. Unfortunately they were lulled into agreeing with a small
development of Trilogy, which has since boomed to much larger than they imagined.These Trilogy folks joined us out
here for the same reasons we moved here. Tranquility and a quiet beautiful life. All the while knowing that amenities
were a bit of a drive. Now, today, many of these people are anxious to have convenience without a small
drive. Evidently they have not experienced what we have. A boom of retail around them once they opened the
door. Our place in Nevada and Idaho both became a nightmare surrounded by retail and people that demanded that
those "damn" horse people move out if they didn't like it and by the way,, turn off your arena lights, stop breeding
horses, and stop the flies.. Please think long and hard about this zoning change. We are adamantly opposed. We are
tired of trying to outrun development and treasure our quiet life. Alma School and Dynamite, Pima and Dynamite all
