Project Summary:

1.
The applicant is proposing a 134’ high wireless communications facility (WCF) with associated
ground equipment, and an 8’ tall CMU screen wall in a 40’ by 40’ lease area. The applicant is
proposing several standards on the site including overall WCF height of 134’, maximum diameter
of antenna array of 14’ 7”, maximum diameter of support structure of 36”, setback to the western
lot line of 43’ 4” and a setback to the northern lot line of 201’ 8”. The proposed WCF will be able
to facilitate multiple co-located antenna arrays and will serve both emergency 911 purposes as
well as provide private cell services.

2.
The subject parcel had no permit or case history in the previous five years prior to the current
proposal. The pre-application meeting associated with the case, PA2022206, was held on
December 13, 2022. The UCCD associated with the case, UC2022023, was filed on October 20th,
2022 and LAFB determined the proposed use as compatible on November 14, 2022.
Subsequently, the subject case was formally applied for on January 18, 2023 and the Technical
Advisory Committee meeting was held on February 21, 2023.

Adopted Plans:

6.
White Tank / Grand Ave Area Plan – Military Compatible (adopted December 6, 2000): This land
use designation is reserved for parcels within the state-statute defined High Noise or Accident
Potential Zone of Luke Air Force Base. Uses should be restricted to those that have been deemed
consistent and compatible with the Air Force base.

7.
Surprise General Plan 2035: Foundation for the Future – Employment (Adopted December 19,
2015): This land use designation is areas is for large scale industrial space, corporate campuses,
research parks, and the like. The land use designation is intended to protect LAFB operations.

Public Participation Summary:

8.
The applicant met minimum requirements by mailing notice of application to all property owners
within 300’ of the subject property and posting the site with two signs. The applicant reported
that a few inquiries were made about the proposal specifics, but no concerns were conveyed.
Staff did not receive any comment as a result of the public participation.

Outstanding Concerns from Reviewing Agencies:

9.
N/A

Staff Analysis:

10.
The proposed 134’ WCF matches the land use that LAFB deemed as compatible for the site via
UC2022023 and thus matches the future land use designations. This WCF height requires a 268’
setback from all lot lines at a 2:1 setback (measured to the monopole or to the plane of any
protruding attachments if closer to the lot line). Staff was initially concerned over the proposed
setback reductions, as the applicant is requesting a considerable setback reduction to just 43’4”
from the western lot line as well as a 201’8” from the northern lot line. However, given the fact
that the parcels to the west are also within the LDN 65 noise contour, and that the properties are
currently vacant, no residential uses will develop. This alleviates staff’s concerns over the
potential proximity to residential homes. Additionally the setback reductions are largely requested
due to existing floodplain and floodway that covers much of the property, making the proposed

MCP2023001
location the most practical spot on the parcel. The proposed height increase of 54’ over the typical
80’ allowed height is similarly of little concern given adjacent properties are either separated by
an arterial road to the north or are within the LDN 65 noise contour and will not contain residential
uses. The increased height, along with the proposed increase in antenna array, will allow the WCF
to better serve an area with low cell service coverage, bolster E911 emergency coverage, and
allow for several colocations which will reduce the overall number of towers in the area.

Recommendation:

11.
Staff recommends the Commission adopt a motion recommending that the Board of Supervisors
approve MCP2023001 subject to the following conditions ‘a’ – ‘e’:

a.
Development of the site shall be in substantial conformance with the Site Plan entitled
“Vertical Bridge US-AZ-7062“, consisting of 7 full-size sheets, dated March 23, 2023, and
stamped received March 24, 2023 except as modified by the following conditions.

b.
Development of the site shall be in substantial conformance with the Narrative Report
entitled “Narrative Report US-AZ-7062”, consisting of 8 pages, dated March 17, 2023 and
stamped received March 24, 2023, except as modified by the following conditions.

c.
The following Rural – 43 MCP standards shall apply:

1. Maximum WCF Height: 134’

2. Setback to Western Lot Line: 43’ 4”

3. Setback to Northern Lot Line: 201’ 8”

4. Maximum Diameter of Antenna Array: 14’ 7”

5. Maximum Diameter of Support Structure: 36”

d.
The following Planning Engineering conditions shall apply:

1. Engineering review of planning and/or zoning cases is for conceptual design only. All
development and engineering design shall be in conformance with Section 1205 of the
Maricopa County Zoning Ordinance; Drainage Policies and Standards; Floodplain
Regulations for Maricopa County; MCDOT Roadway Design Manual; and current
engineering policies, standards and best practices at the time of application for
construction.

2. Based on the conceptual design nature of the information submitted, changes to the
site layout may be necessitated by the final engineering design of the site’s drainage
infrastructure.

3. Detailed Grading and Drainage (Site Infrastructure) Plans must be submitted with the
application for Building Permits

4. Disturbance within the R/W will require a MCDOT permit concurrent with building
permits.

5. MCDOT Right-of-Way dedication to the full half width of 65-ft must be completed.

MCP2023001

6. The Fence on the property has been permitted with DC20040157 (FA20040060) and
B200800760 (FA20080052). Removal of the fence is not required.

e.
The granting of this change in use of the property has been at the request of the applicant,
with the consent of the landowner. The granting of this approval allows the property to
enjoy uses in excess of those permitted by the zoning existing on the date of application,
subject to conditions. Failure to comply with conditions after a reasonable opportunity to
bring the property into compliance may result in the initiation of revocation at a public
hearing. It is, therefore, stipulated and agreed that revocation due to the failure to comply
with any conditions, does not reduce any rights that existed on the date of application to
use, divide, sell or possess the property and that there would be no diminution in value of
the property from the value it held on the date of application due to such revocation of the
MCP. The MCP enhances the value of the property above its value as of the date the MCP
is granted and reverting to the prior zoning results in the same value of the property as if
the MCP had never been granted.

application on behalf of Vertical Bridge. Vertical Bridge proposes to install a new 134’
Monopole, in a 40' x 40’ area, with associated equipment in an 8' high CMU wall compound.
This wireless facility will provide cellular phone communications and E911 emergency coverage
to all wireless users in the area. Construction will take approximately 6 weeks. The wireless cell
tower will operate year-round, seven (7) days per week 24 hours a day. Maintenance crew will
service cell tower as needed. This property is ideal for its location as there is a dire need for
improved coverage in the area and sufficient space available without infringing on the owner.
This cell tower would be in a prime location in a developing and growing area. The surrounding
properties to this parcel are RU-43 (Rural Zoning). Easily accessible from Wittmann Road. The
tower is easily accessible from the main street, which is a public right of way. Surrounding the
tower are residential homes and small businesses that would benefit from the increased
coverage. Emergency services are 2.5 miles East and schools are 3 miles Northeast of the
proposed cell tower. These facilities would also greatly benefit from the increased coverage in
the area.
This project complies with ARS 28-8481 and Chapter 10, Section 1010 of the Maricopa County
Zoning Ordinance. Shawn Sanchez, as the applicant, will file the MCP packet in its entirety and
will ensure that all required documents are provided. The telecommunications facility will have
no conflict with the Military field or Military airport.

BASE ZONING DISTRICT
REGULATIONS (Rural - 43)
PROPOSED ZONING
REGULATIONS (Rural – 43
MCP)
WCF height
MCZO 1202.3.1.1.a
stipulates the maximum
height, inclusive of all
antennas, rods, or other
appendices shall be
limited to 80’ from natural
adjacent grade.
134'
Maximum diameter of
antenna array
 MCZO 1202.3.1.1.h
dictates the diameter of
antenna arrays must not
exceed 8’. The diameter
must be measured
through the center of the
supporting structure
(monopole) and account
for the outermost
extension of all
components.
14'-7"
Maximum diameter of

MCZO1202.3.1.1.c
dictates the maximum
width of a support
structure may not exceed
30” in diameter.
36”
Setback
Western Lot Line
MCZO1202.3.1.1 dictates
the WCF must be setback
a minimum 2’ per every 1’
of height from all lot lines.

Setback
Northern Lot Line
MCZO1202.3.1.1 dictates
the WCF must be setback
a minimum 2’ per every 1’
of height from all lot lines.
209'-1"

1)
A. The increased height of the proposed WCF is needed to provide coverage to a vast, rural area.
B.
The antenna array exceeds 8' in diameter as we are proposing a platform mount. Platform mounts
provide a safety component for future modifications of the tower equipment. Additionally, a wider
antenna array is required for the technology that will be installed by the future tenant to ensure
maximum coverage objectives.
C.
Due to the height of the monopole, the diameter of 36” is required to ensure that the pole can
structurally support future tenant's tower equipment.
D.
Per the Grading & Drainage report the majority of the parcel is in a flood plain/flood zone area. This
restricts us to the western portion of the parcel where the lease area sits. Additionally, the parcel to the
West (RU-43) is within the 65 LDN noise contour. Thus, it cannot be developed as residential.
Our lease area is placed further north on the parcel as there is a large flood zone to the south requiring
the reduced setback to the north. The eastern portion of the parcel is a floodway, restricting us to the
western portion of the parcel where the lease area sits.
2) Generator serves as emergency backup power in the event that the site loses power. The generator
will cycle once per week and will run for a total of 15 minutes.
3) There will be no mature cacti or trees removed for this WCF.
4) No existing WCF within 1000’ of the proposed WCF. Please see image below:

5) We filed the Use Compatibility and Consistency Determination (UC2022023) application with Luke
Air Force Base. Maricopa reached out to Luke AFB and they provided approval for the tower via email.
The WCF will have no conflict with the Military field or Military airport. Please see attached document
below.
6) The proposed height and area for this WCF allows for multiple carriers to collocate at the site. No
initial plans to expand the compound or increase the height of the tower. In the future should the WCF
require height or size expansion, the WCF will fit within the immediate area and will not pose any safety
issues or have a negative impact on area residents.

Re: MCP2023001; Monopole for E911 Services (APN: 503-34-016U)

Dear Mr. Holm

Thank you for the opportunity to provide comments on the Military Compatibility Permit
Application for the Monopole for E911 Services Project. The site is approximately 4 acres and is located
at 22551 W. Patton Rd in unincorporated Maricopa County, AZ. The developer is proposing a 130 ft
monopole which will provide coverage for emergency 911 services. The parcel in the application is
partially located within the Luke AFB Auxiliary Field #1, 2004 JLUS 65 DNL and is within the “territory
in the vicinity of a military airport” defined by A.R.S. § 28-8461.

Subject to the results of an FAA Obstruction Evaluation/Airport Airspace Analysis (OE/AAA),
this request, as described in the narrative, will not negatively impact the flying and base operations at
Luke AFB. We do however request the installation of an Aviation Obstruction Light (AOL) or Aircraft
Warning Light (ACWL) due to its height and location.

Since the site will be located within the “territory in the vicinity of a military airport,” it will be
subjected to approximately 170 over flights per day. We recommend you review the sound attenuation
requirements found in A.R.S. §28-8482. We also encourage an aggressive notification program on the
part of the county to inform potential developers about Luke AFB operations.

If you have any questions, please contact my Deputy Director, Mr. Mark James at
(623) 856-6175.

            Sincerely
