Project Summary: 
 
1. 
The Applicant, Shannon McCrea, DW Tower, LLC., on behalf of the property owner, Lonnie Ranft, 
is requesting a Special Use Permit (SUP) for a new 197’ self-supporting Wireless Communication 
Facility lattice tower with associated equipment in a 134’ x 140’ compound surrounded by a 6’ 
high chain link fence in the Rural-43 zoning district. The subject property is parcel 219-05-003P, 
located approx. 906’ from the NEC of SR-87 & Sunflower Rd. in the Sunflower area. The subject 
property is rectangular, generally flat and comprises approximately 1.3 acres. The subject 
property is accessed from a private ingress easement, Sunflower Rd, with similarly zoned Rural-
43 parcels to the north, and adjacent to C-2 zoned parcels to the east and west. To the south is 
Tonto National Forest zoned Rural-190.  The subject property and the properties to the immediate 
north and east are minimally improved vacant parcels. The property to the west is an apparent 
towing yard.

The WCF at its base will measure 19’ by 19’ and is proposed at a height of 197 ft. The tower is a 
steel lattice design setback approximately 31 ft. from the northern (front) property line, 
approximately 80 ft. from the western property line, 71.5 ft. from the eastern property line and 
138.9 ft. from the southern property line. The tower will be enclosed by 6’ high chain link fence 
measuring approximately 134 ft. x 140 ft. The compound itself is setback 32.5’ feet from the 
western property line, which is intended to serve as an access easement to the rest of the site 
further south outside of the fenced in compound where the lattice tower is proposed. The 
proposed placement of the tower and compound wall would require several development 
standard modifications, which can be part of the SUP approval (MCZO Art. 1301.5). The height of 
the tower exceeds the maximum height allowed of 80 feet. (MCZO Art 1202.3.1.1.a) The tower 
does not meet the 2 ft. setback from property lines for each 1 ft. in height required in rural and 
residential zones because it is closer than 197 ft. to all property lines (MCZO Art. 1202.3.1.1.g). 
Additionally, the proposed tower location will encroach 9 feet into the 40-foot required front yard 
setback measured from the northern property line. (MCZO Art. 503.4.1.a). All other requirements 
will be met.

The site is accessed through a series of easements that comprise Sunflower Road. Sunflower 
Road has not been accepted by the County; and is therefore not maintained by the County.

outside of designated Area Plans as being within the Rural Development Area (0-1 d.u./ac) 
Appropriate for rural land uses and rural zoning. 
 
Public Participation Summary:

Per the applicant’s Final Citizen Participation Results Report, the public has been given ample 
opportunity to relay any questions, issues, or concerns regarding the application by contacting 
the authorized agent stated on the notification letters that were send out via email and direct mail. 
The public has not reached out or raised any concerns to the authorized agent, however, Tonto 
National Forest did have concerns regarding scenic preservation. Tonto National Forest currently 
has high scenic integrity and the applicant’s team was asked to take this into consideration when 
building. Because construction will take place on private property, there are no restrictions or 
requirements regarding this concern.

Staff Analysis:

Staff believes the Special Use Permit request is reasonable and necessary to maintain and 
expand cell phone and E-911 service in this area, especially for the traveling public along the 
nearby SR-87. The subject WCF tower will not be located anywhere near a residential use, 
however, the tower is only setback 31 feet from a Rural-43 zoned parcel to the north, which may 
impact future residential uses on this particular parcel in the future. The WCF compound bounds

the nearest, apparent public ingress/egress easement (Sunflower Rd.) with the tower lying 32 ft. 
from the southern edge of this easement per the Applicant’s site plan. The tower may present a 
fall hazard for the adjacent parcels and the easement for Sunflower Rd.; however, Staff considers 
the possibility of tower collapse to be extremely remote as it will be subject to commercial 
construction permitting which includes plan review against all codes and engineering best 
practices and then construction safety inspections in the field to ensure improvements are 
consistent with the approved plans. Sunflower Rd. appears to provide access to only one 
commercial property, and therefore it likely comprises low traffic volumes and speeds making 
the request reasonable and unlikely to cause significant traffic issues. In the project narrative, the 
Applicant states that the tower design will prevent the necessity for additional towers in the area 
as the structure can support multiple co-locations, commonly used by modern WCF facilities. 
Finally, in order to preserve scenic integrity as expressed by Tonto National Forest and to enhance 
the rural character of the area, staff recommends non-reflective material be implemented in the 
tower design. The applicant has proposed that exposed portions of the tower will be non-
reflective, and the color of the tower shall be compatible with the surrounding environment. Staff 
suggests an aged or rusted steel/copper color similarly used by guard rails for the nearby SR-87, 
as shown below. 
 
 
 
Recommendation: 
 
11. 
Staff recommends the Commission adopt a motion recommending that the Board of Supervisors 
approve Z2023008 subject to the following conditions ‘a’ – ‘g’:

a. 
Development of the site shall be in substantial conformance with the Site Plan entitled 
“BUSHNELL“, consisting of 7 full-size sheets, dated March 15, 2023, and stamped received 
March 22, 2023, except as modified by the following conditions. Staff may determine 
slight refinements to remain in substantial conformance with the approved site 
plan.  Minor and major amendments to the site plan will be determined in accordance with 
Chapter 3 of the Maricopa County Zoning Ordinance. 
 
b. 
Development of the site shall be in substantial conformance with the Narrative Report 
entitled “DW Tower, LLC. Site”, consisting of 5 pages, dated March 20, 2023, stamped 
received March 22, 2023, except as modified by the following conditions. 
 
c. 
The following Planning Engineering conditions shall apply: 
 
1. 
Provide the required retention volume for the 100 year, 2 hour storm event with 
one (1) foot of freeboard for the SUP area. 
2. 
Provide a runoff coefficient based on Table 6.3 of the Maricopa County Drainage 
Policies and Standards. Use 0.95 for commercial/industrial areas and 0.5 for 
retention basin areas. Revise the drainage calculations to use the County’s 
required runoff coefficients.  
3. 
Basins one (1) foot or less in depth need not provide freeboard. Provide 
documentation that the retention basin(s) will drain within 36 hours. (MCZO 
1205.7.6-2.a & c) 
4. 
The Red Letter process has been started by the applicant; applicant to notify ADOT 
of proposal through the Red Letter Process, RedLetter@azdot.gov, due to 
proximity to State Route 87. 
5. 
The above comment does not include identification of utilities or underground 
facilities within or adjacent to the required right-of-way that may have prior rights 
and/or require relocation. 
6. 
Engineering review of planning and/or zoning cases is for conceptual design only. 
All development and engineering design shall be in conformance with Section 
1205 of the Maricopa County Zoning Ordinance; Drainage Policies and Standards; 
Floodplain Regulations for Maricopa County; MCDOT Roadway Design Manual; 
and current engineering policies, standards and best practices at the time of 
application for construction.  
7. 
Based on the conceptual design nature of the information submitted, changes to 
the site layout may be necessitated by the final engineering design of the site’s 
drainage infrastructure.  
8. 
Detailed Grading and Drainage (Site Infrastructure) Plans must be submitted with 
the application for Building Permits  
 
d. 
This special use permit is valid for a period of 20 and shall expire on June 14, 2043, or 
upon termination of the use for a period of 90 or more days, whichever occurs first. All 
site improvements associated with the special use permit shall be removed within 90 days 
of such expiration or termination of use. 
 
e. 
Prior to issuance of a building permit, written confirmation will be required from the 
emergency fire protection jurisdiction having authority that the facility has been designed 
in accordance with their regulations and requirements, and that emergency fire protection 
service will be provided to the facility.

f. 
Noncompliance with any Maricopa County Regulation shall be grounds for initiating a 
revocation of this Special Use Permit as set forth in the Maricopa County Zoning 
Ordinance.  
 
g. 
The granting of this change in use of the property has been at the request of the applicant, 
with the consent of the landowner.  The granting of this approval allows the property to 
enjoy uses in excess of those permitted by the zoning existing on the date of application, 
subject to conditions.  In the event of the failure to comply with any condition, and at the 
time of expiration of the Special Use Permit, the property shall revert to the zoning that 
existed on the date of application.  It is, therefore, stipulated and agreed that either 
revocation due to the failure to comply with any conditions, or the expiration of the Special 
Use Permit, does not reduce any rights that existed on the date of application to use, 
divide, sell or possess the property and that there would be no diminution in value of the 
property from the value it held on the date of application due to such revocation or 
expiration of the Special Use Permit.  The Special Use Permit enhances the value of the 
property above its value as of the date the Special Use Permit is granted and reverting to 
the prior zoning results in the same value of the property as if the Special Use Permit had 
never been granted.

Purpose of Request: 
DW Tower, LLC is committed to improving coverage and expanding telecommunications 
network capacity to meet customer demand throughout Maricopa County. SUP application is 
for the purpose of DW Tower, LLC proposing to install a new 197' Self Support Tower with 
associated equipment, in a leased 134’ x 140’ area, on Parcel 219-05-003P. The tower is within 
this parcel, and will be located at 33° 51' 50.701" N, -111° 28' 08.487" W on the Northwest end 
of the parcel. The owners of the parcel, Sunflower Towing and Recovery LLC, have approved 
the installation of the new cell tower. Shannon McCrea, as the applicant, will be submitting all 
required documents on behalf of DW Tower, LLC. 
Description of Proposal: 
This will be a new Wireless Telecommunications Facility. DW Tower, LLC proposes to install a 
new 197' Self Support Tower with associated equipment, in a 134’ x 140’ area, surrounded by a 
6' high Chain Link Fence compound, with utility and access easements as seen in the attached 
drawings.  The tower is within this parcel, and will be located at 33° 51' 50.701" N, -111° 28' 
08.487" W on the Northwest end of the parcel. 
Relationship to Surrounding Properties: 
This wireless facility will provide residents, visitors, and businesses with high quality reliable 
wireless service for both personal and business purposes but also most importantly enhances 
emergency services, which is vital to the safety of the surrounding community. 
Location and Accessibility: 
To access site location at 33° 51' 50.701" N, -111° 28' 08.487" W, take a left turn from N 
Beeline HWY onto Sunflower Frontage Rd at mile-marker 218 onto a private ingress easement. 
Continue down unpaved Sunflower Frontage Rd for approximately 939.33 ft. and make slight 
right turn to arrive at destination. There is adequate access for technicians and parking is 
available on gravel at site location.

Circulation System: 
Sunflower Frontage Rd and site location at 33° 51' 50.701" N, -111° 28' 08.487" W is on a 
unpaved, gravel private ingress easement. There are no paved parking spaces for 
technicians, however, parking is available on existing gravel easement. There are no plans 
for any driveway improvements or pavement installation. The private ingress easement 
does not provide access to other nearby site, is not dedicated, and no patent easements 
surround the property. 
Development Schedule: 
The wireless cell tower will operate year-round, seven (7) days per week 24 hours a day. 
Occupancy type is unmanned. Maintenance crew will service cell tower as needed. N/A 
for parking spaces or ADA parking. There are no paved parking spaces for technicians, 
however, parking is available on existing gravel easement. The estimated construction and 
site improvements timeline for this site once all zoning and permits are approved is 120 
days. Building permits will be requested once zoning and permits have been approved. 
Building permits will be required for DW Tower, LLC installation of a new 197' Self Support 
Tower with associated equipment, in a leased 134’ x 140’ area. This wireless facility will be 
upgraded periodically as network needs change often.

5. There are no viable options for collocation since there is a severe coverage gap in area.
6. Tower can facilitate co-location with other carriers and may have up to 6 tenants.

8. Compatibility Issues:
a. Setbacks from residential and all property lines include Wireless Communication Facilities shall be 
setback 2 feet from all property lines for each 1 foot in height (including tower and antenna 
attachments but not to include architectural features for stealth design), unless co-locating on a 
building/structure (other than a wireless communication facility tower). Structures that are no 
greater in height than the maximum permitted building height for the respective zoning district 
may be permitted at a minimum 3 foot setback but shall not be located within a required front 
yard.
b. There are no setbacks from uses/structures on adjacent property.
c. Setbacks from public and private streets or access easements include roadways and all related 
hillside disturbance shall be contained within dedicated rights-of-way, subdivision private street 
tracts, or easements. Roadways within easements are included in the maximum gross lot 
disturbance (sq. ft.).
d. There are no future additional appurtenances or expansion plans at this time.
e. This is new 197' Self Support Tower with associated equipment, in a 134’ x 140’ area, surrounded 
by a 6' high Chain Link Fence compound, with utility and access easements as seen in the attached 
drawings. The color of a wireless communication facility shall be compatible with the surrounding 
environment. Exposed portions of the tower structure shall be non-reflective.
f. There are no surrounding non-residential uses.
9. A stealth design is not necessary and is not being proposed for the following reasons:
a. There is not a stealth design that would blend in with surrounding vegetation/landscaping.
b. Site is in a rural area, not surrounded by residential properties and won't affect surrounding 
property value.
c. A lattice tower design will be utilized to allow for multiple carriers to collocate which will reduce 
the need for other new towers in the area

Thank you for taking my call at the end of the day.  As we discussed, the Tonto National Forest is the 
neighbor to your project site in nearly all directions.  Its natural beauty contributes to quality of life in 
the State, as well as those who live, travel, and recreate along State Highway 87, including the 
Sunflower area.   High levels of recreational use occur in the vicintiy of this project site, including 
motorized recreation on roads and trails as well as non-motorized recreation along the 
congressionally designated Arizona National Scenic Trail.  We recently revised our Scenery

Management System for the landscapes we manage, consistent with current revisions to our forest’s 
land management plan.  We anticipate that plan being final in the next 12 months.   
 
As we discussed, the scenic integrity of these public lands in this area are moderate to high.

High (Appears Unaltered) scenic integrity refers to landscapes where the valued scenic character 
“appears” intact. Deviations may be present but must repeat the form, line, color, texture, and pattern 
common to the scenic character so completely and at such scale that they are not evident (USDA 
Forest Service 1995).  
 
Page 33- Moderate Existing Scenic Integrity  
Moderate (Slightly Altered) scenic integrity refers to landscapes where the valued scenic character 
“appears slightly altered.” Noticeable deviations must remain visually subordinate to the scenic 
character being viewed (USDA Forest Service 1995). 
 
The very high, high, and moderate scenic integrity objectives result in a relatively natural-appearing 
landscape. It is important for National Forests to manage scenery at this level. “Research has shown 
that high-quality scenery, especially that related to natural-appearing forests, enhances people's lives 
and benefits society” (USDA Forest Service 1995, 17). It should also be noted that according to 
“Floyd Newby’s findings that “people expect to see natural or natural-appearing scenery,”” (quoted in 
USDA Forest Service 1995, 2-3). Furthermore, “research shows that there is a high degree of public 
agreement regarding scenic preferences. This research indicates that people value most highly the 
more visually attractive and natural-appearing landscapes” (USDA Forest Service 1995, 30).

Page 9 Highway Expansion  
The Tonto NF’s partnership with Arizona Department of Transportation since mid- to late 1980s has 
enhanced scenic quality on highway expansion construction since mitigation measures have assured 
changes to the land-scape sufficiently blend with the surrounding natural landscape. Evidence of the 
successful partnership and bene-fits to the quality of scenery are the two expansion projects that 
have been awarded for their beauty a segment of State Route 87 on the Mesa Ranger District and a 
segment of US Highway 60 leading through Gonzales Pass out-side of Superior on the Globe Ranger 
District (USDA Forest Service 2017). 
 
Page 42- State Route 87 is a main highway providing views of Mount Ord, Mazatzal Wilderness, 
Diamond Mountain, Crabtree Butte, Sycamore Creek, and Red Mountain. Two portions of highway 
that had lane widening improvements won awards for aesthetics.
