Project Summary:
1.
The proposed Special Use Permit (SUP) is to allow for a 100’ WCF to be located on a parcel within
the Rural-43 zoning district. The subject parcel also currently includes single-family residential
home. WCF’s are an allowed use within the Rural-43 zoning district if they meet all the
requirements laid forth in Section 1202 of the MCZO. The applicant is seeking to increase the
allowed antenna array diameter to 15’-2” where 8’ is the maximum is allowed and a height of 100’
where 80’ is the maximum is allowed. The height of the tower will be 90’ with aa 10’ lighting rod.
While the proposed location of the tower meets the required setbacks for the southern and
northern property lines, the applicant is seeking a setback of 131'-8” to the northern property line
and a setback of 18'-4” to the eastern property line, where 200’ is the minimum required (2’
setback for every 1’ in height).
The subject parcel has recent building permits for the single-family residence and accessory
uses. The proposed WCF has no relation to the single-family residence and is not attached to any
existing building or structure. Aside from these building permits there is no other recent history
on the parcel. The pre-application meeting for the WCF was held on January 10, 2023. Formal
submittal for the SUP was January 30, 2023, and the TAC meeting was held on March 7, 2023.

8. The applicant complied with the Maricopa County Public Participation Process with the required
posting of the property and notification to adjacent property owners within 300’ of the subject
site. Staff has not received any notice of opposition or support to the request.

Staff Analysis:
10. An SUP is necessary to allow a decrease of the required setbacks, an increase in height, and an
increase in antenna array diameter. The proposed monopole will be located on a rural lot currently
occupied by a single-family residence near the South Mountain Park. The proposed monopole
does not appear that it will have a significant impact on the visual aesthetic of the area, and will
blend into the surrounding rural uses. The WCF will be located within the northeast portion of the
site and the ground equipment will be screened by an 8’ CMU wall. The WCF proposal does not
have any plans for adding stealth features to the monopole. Additionally, the monopole will
initially house two carriers with potential for additional collocations in the future.
11. The applicant is requesting two variations to the ordinance with this SUP. The first is to decrease
of the required setback of 200’ to 131’-8” for the northern property line and 18’-4” for the eastern
property line, second variation request is to increase the maximum allowed height from 80’ to
100’, and the third request is to increase the maximum allowed antenna array width from 8’ to 15’-
2". These requests seem consistent with similar WCF requests and staff does not feel the
increase will make any significant visual difference to the site given the large setbacks and buffer
areas from the surrounding single-family residential homes to the west and north of the subject
site.
Recommendation:
12. Staff recommends the Commission adopt a motion recommending that the Board of Supervisors
approve Z2023012, subject to the following conditions ‘a’ — jf:
a. Development of the site shall be in substantial conformance with the site plan entitled
“US-AZ-7072", consisting of 5 full-size sheets, dated March 9, 2023, and stamped received
May 3, 2023, except as modified by the following conditions. Staff may determine slight
refinements to remain in substantial conformance with the approved site plan. Minor and
major amendments to the site plan will be determined in accordance with Chapter 3 of
the Maricopa County Zoning Ordinance.

Development of the site shall be in substantial conformance with the Narrative Report
entitled “US-AZ-7072”, consisting of 8 pages, stamped received May 3, 2023, except as
modified by the following conditions.
Maximum overall height of tower and attachments shall be limited to 90’ except for
additional height to include any future Eligible Facility Request for colocation and up to a
10’ top-mounted lighting rod.
The SUP established the following standards:
1. Maximum antenna array diameter of 15’-2”
2. Minimum setback of 18’-4” to the eastern property line
3. | Minimum setback of 131’-8” to the northern property line
Development and use of the site shall comply with requirements for fire protection
measures as deemed necessary by the applicable fire department. Prior to issuance of
zoning clearance, the applicant shall seek review and comment from the applicable fire
protection agency, and shall provide written confirmation that the site will be developed
in accordance with their requirements.
This Special Use Permit shall expire Twenty-Five (25) years from the date of approval by
the Board of Supervisors, June 14, 2048, or upon termination of the use for a period of 90
days or more, whichever occurs first. All site improvements associated with the SUP shall
be removed within 60 days of such termination or expiration.
Development of the site shall be in conformance with all Federal and State requirements,
including but not limited to, Federal Communications Commission (FCC), Federal Aviation
Administration (FAA), National Environmental Policy Act (NEPA), and State Historical
Preservation Office (SHPO). The applicant shall be responsible for obtaining all necessary
approvals prior to construction, and shall be accountable to those agency requirements,
and penalties.
The following Planning and Development Engineering Stipulations shall apply:
1. Any work within County (MCDOT) Right-of-Way (Galveston Street) for utility
extensions to serve the site will require a MCDOT Right-of-Way Permit
concurrent with required building permits.
2. Access to Galveston Street will require a paved driveway access (within the R/W)
and a MCDOT Right-of-Way Permit to be issued concurrent with the building
permits.
3. Prior to issuance of building permits, the applicant must contact MCDOT to
determine if a Wireless Agreement is required for equipment, conduit, fiber optic
lines and other work within the MCDOT Right-of-Way (W Galveston Street). The
applicant must coordinate with Utility Branch Coordination Manager.
4. All development and engineering design shall be in conformance with Section
1205 of the Maricopa County Zoning Ordinance; Drainage Policies and
Standards; Floodplain Regulations for Maricopa County; MCDOT Roadway

Noncompliance with any Maricopa County Regulation shall be grounds for initiating a
revocation of this Special Use Permit as set forth in the Maricopa County Zoning
Ordinance.
The granting of this change in use of the property has been at the request of the applicant,
with the consent of the landowner. The granting of this approval allows the property to
enjoy uses in excess of those permitted by the zoning existing on the date of application,
subject to conditions. In the event of the failure to comply with any condition, the property
shall be considered for revocation by the Board of Supervisors, upon recommendation by
the Planning and Zoning Commission to change the zoning back to that which existed on
the date of application. It is, therefore, stipulated and agreed that revocation due to the
failure to comply with any conditions, does not reduce any rights that existed on the date
of application to use, divide, sell or possess the property and that there would be no
diminution in value of the property from the value it held on the date of application due to
revocation of the Special Use Permit. The Special Use Permit enhances the value of the
property above its value as of the date the Special Use Permit is granted and reverting to
the prior zoning results in the same value of the property as if the Special Use Permit had
never been granted.

We are working on behalf of Vertical Bridge which intends to install a new multi-carrier cell
tower, with associated equipment, at 4312 W Galveston St Laveen at approximately
(33.312726, -112.151798). The owner of the parcel, Michael Rogers, has approved the
installation of the new cell tower.
Shawn Sanchez, as the applicant will be submitting all required documents associated with this
application on behalf of Vertical Bridge. Vertical Bridge proposes to install a new 100’
Monopole, in a 32' x 50’ area, with associated equipment in an 8' high CMU wall compound.
This wireless facility will provide cellular phone communications and E911 emergency coverage
to all wireless users in the area. The site will be accessed by an access and utility easement as
seen in the site plan ( Z-1 pg. 2). Construction will take approximately 6 weeks. The wireless
cell tower will operate year-round, seven (7) days per week 24 hours a day. Maintenance crew
will service cell tower as needed. This property is ideal for its location as there is a dire need
for improved coverage in the area and sufficient space available without infringing on the
owner.
This cell tower would be in a prime location in a developing and growing area. Surrounding
properties to this parcel are RU-43 (Rural Zoning). Easily accessible from W Gavelston St. The
tower is easily accessible from the main street, which is public right of way. Surrounding the
tower are residential homes and businesses that would benefit from the increased coverage.
Emergency services are 4.5 miles North and schools are 2.9 miles Northwest of the proposed
cell tower. These facilities would also greatly benefit from the increased coverage in the area.
Shawn Sanchez, as the applicant, will file the SUP packet in its entirety and will ensure that all
required documents are provided.

The increased height of the proposed WCF is needed to provide coverage to a vast, rural area.
The antenna array exceeds 8' in diameter as we are proposing a platform mount. Platform mounts
provide a safety component for future modifications of the tower equipment. Additionally, a wider
antenna array is required for the technology that will be installed by the future tenant to ensure
maximum coverage objectives.
Due to the height of the monopole, the diameter of 36” is required to ensure that the pole can
structurally support future tenant's tower equipment.
As shown on the site plan, our lease area is placed on the eastern portion of the parcel as there is an
existing cell tower approximately 1000 ft NW of the proposed tower, requiring the reduced setback to
the east. Additionally, the LL specifically requested this location as he has future plans for development
on other portions of the parcel. Even if we shift the lease area 14' south, which would change the
setback from 202' to 188', we still would not meet the required setbacks to the north.
