Project Summary:
1.
This is a staff initiated request to revoke an approved Special Use Permit (SUP) for Cazarez Small
Event Venue, which was approved by the Board of Supervisors on January 13, 2021. The property
consists of two parcels (500-93-011 & -013) on 2.28 acres. There is a verified zoning violation
(V202102065) for non-compliance with the conditions of SUP approval. Multiple area residents
have complained regarding the outdoor use, noise and dust. The facility has been operating and
holding outdoor events without obtaining and/or completing the required site improvement
permits. On May 2, 2022 the Hearing Officer found the owners responsible for non-compliance
with the conditions of SUP approval and directed staff to take the SUP to public hearing for
revocation consideration.
2.
The SUP was approved with a 10-year timeframe, and is limited to 30 events per year with a
maximum of 150 guests per event and operation hours from 10:00 am – 10:00 pm on event days.
There is a condition prohibiting amplified music or speakers. Several conditions require
completion of permits prior to operation of the facility. The owners submitted for 3 permits in
2021 & 2022 which were recently issued in late December 2022 but have not yet been issued
authorizing operation of the small event venue. The facility is also required to chip seal Pioneer
St. and 169th Ave. to Lower Buckeye Rd. and although some road work was done it was done
without benefit of an issued construction permit. Finally, a status report from the property owner
was due last year, January 2022, documenting compliance with the SUP conditions, and a second
status report is due this month, January 2023 - but to date no status report has been submitted.

There are numerous public complaints regarding the extensive use of the outdoor venue in a
rural/residential area that has resulted in a direct impact the rural character of the neighborhood.
Code Compliance has also been receiving numerous calls regarding the use, dust, noise, etc.
MCSO has reported and documented noise complaints for the venue. Shown below is a timeline
associated with the project:
October 1, 2013: Warranty deed recorded for property ownership of 500-93-013 to Brenda
Cazarez.
March 6 2018: Quit Claim Deed recorded for property ownership of 500-93-011 to Yaritza Pina-
Merry and Miguel Cazarez.
January 13, 2021: Board of Supervisors approved Z2019024 – Special Use Permit subject to
conditions ‘a’ – ‘i’ for a 10-year timeframe with a status report to be submitted at the one-year
anniversary and every year thereafter detailing how the SUP conditions are being met with
tracking the number of event dates and number of attendance.
July 22, 2021: Grading plan for an outdoor events venue, new restrooms 8’ x15.7’ with
B202110499 including B202111203 and B202213824. Status was out to customer comments
with comments on 9/27/22. Revisions received on 11/4/22 for the permits.
August 5, 2021: Grading permit B202111203 submitted for outdoor events.
October 27, 2021: Violation submitted to Code Compliance Division (V202102065) for failure to
meet the conditions of Z2019024. Complaint verified on 11/24/21 by Code Officer with notation
that lights must be turned off and that chip seal from Pioneer St. and 169th Ave. to Lower Buckeye
is required, driveway and parking area must be chip sealed before any events can take place.

November 24, 2021: Notice and Order to Comply issued to Respondents.
January 7, 2022: Code Officer conducted another inspection to determine if the site received
grading permit. Officer noted the following: Upon arrival determined no changes made to the
parcel, the violation had not been remedied, checked County database for permits and did not
find any permits. Notation to get case scheduled for Hearing Officer.
January 13, 2022: One year anniversary for SUP approval, records show no status report
submitted detailing operation of the facility as required per condition ‘d’.
April 28, 2022: Code hearing held regarding Code Violation V202102065.
May 2, 2022: Order of Judgement by Hearing Officer with notation, ‘Further action in this matter
will be referred to Maricopa County Planning Commission if compliance is not verified as set forth
below. Respondents must comply with stipulations e.5 and e.6 as set forth in case no. Z2019024
on or before October 1, 2022. If Respondents have not complied with stipulations e.5 and e.6 as
set forth in case no. Z2019024 on or before October 1, 2022, the County will refer this matter to
the Maricopa County Planning and Zoning Commission for further action.
September 26, 2022: Building permit B202213824 submitted for a restroom facility.
October 24, 2022: Planning staff sent e-mail to Brenda Cazarez with notification that the SUP
would be scheduled for public hearings for revocation.
October 26, 2022: Planning staff received e-mails from Brenda Cazarez that stated, ‘Good
morning we did everything County ask for air quality came and check and everything was fine.’
November 1, 2022: Received e-mail from Richard Norris with indication that he was assisting
Cazarez. Staff responded with additional information on the SUP and scheduling case for public
hearings.
November 2, 2022: Staff sent e-mail to Richard Norris and Brenda Cazarez with notification that
the SUP would be scheduled for January hearing to allow the owner time to submit for grading
work and obtain the necessary permits.
November 18, 2022: Code Officer conducted inspection and observed that Pioneer St. from in
front of 16740 W. Pioneer St. to 169th Ave. and 169th Ave. from Pioneer St. to Lower Buckeye Rd.
were both covered with compacted asphalt millings that don't suppress dust.
December 23, 2022: Development Services Division issued the permits for B202110499,
B20211203, B202213824.
December 27, 2022: Sent public hearing timeline via e-mail to Brenda Cazarez with notice the site
would be posted by Friday, December 30, 2022 for revocation of the SUP with public hearing
dates. Code Compliance staff posted the site with the public hearing dates.
December 30, 2022: Received call from Brenda Cazarez wanting to discuss e-mail for public
hearing. Requested meeting with Planning to discuss the issues, a meeting was scheduled for
January 5, 2023.

January 5, 2023: Received e-mail from Brenda Cazarez dated 1/4/23 at 11:08 p.m. with notation
that the meeting would need to be rescheduled, no indication on when to reschedule meeting with
staff.
* January 12, 2023: 801 Drainage status of inspection is listed as ‘Inspection – Denied’. Inspection
occurred on this date with the following note from Inspector on B20210499:
Owner builder, first time with grading project.
Walked site with owners, explained their plans and what needs to happen on site.
Retention basin is supposed to be excavated at southeast corner of parking area, not
excavated at this time. Basin also calls out 3 rip-rap spillways, and 2 drywells, no development
of this completed yet.
-New CMU walls call for drain blocks to be every other block at base course per the detail, not
evident on site.
-ADA parking stalls with curbing and signage need to be developed as well.
-New 24' wide driveway to come off of Pioneer needs to be developed (walls and vegetation
need to be removed)
Certified as-builts need to be submitted prior to scheduling a 970 per the permit conditions.
Owner will speak with Engineer about modifying the plan.
* January 19, 2023: Planning & Development Department received a letter from William Lally with
Tiffany & Bosco P.A. requesting a 60 day continuance of the case to allow the firm to review,
analysis and address concerns raised by the Department.
* January 25, 2023: Petition received from property owner with 20 signatures in support of the SUP.
Notified owner due to their legal counsel requesting continuance of the case, the petition would
be included in the next public hearing staff report.
* January 26, 2023: Per the applicant’s request the case was continued at the January 26, 2023
Planning & Zoning Commission hearing to April 6, 2023 to allow the legal firm time to address
concerns and to work with area residents on concerns.
* March 21, 2023: Received letter from Ray Banker with Tiffany & Bosco, P.A. requesting additional
extension of time to include 6 months or greater along with reducing the number of events within
the next two months - they would like to proceed with 2 events in April and 2 in May (dates not
provided), but will be shutting down during the summer months to focus on tasks to be completed
for the facility.
* March 23, 2023: Staff responded to Mr. Banker via e-mail that Planning & Development does not
support the additional extension in time with the continued operation of the facility that is non-
compliant with the conditions of the SUP. They were advised to cease & desist operations until
such time as they’re able to operate in compliance with the previously approved SUP to an
amended SUP approved by the Board of Supervisors.

4.
Shown below are the Board of Supervisors’ conditions established for SUP and staff analysis of
non-compliance with the conditions:
a.
Development of the site shall be in substantial conformance with the Site Plan entitled
“Cazarez Small Event Venue”, consisting of 1 full-size sheet, dated stamped received
November 9, 2020, except as modified by the following conditions. Within 30-days of
approval, a revised site plan shall be submitted to staff showing the additional screening
(wall) requirements.
Non-compliance: Revised site plan to be submitted 30 days from BOS action on 1/13/21.
Site plan submitted on 6/23/2021, approximately 5 months after required 30-day deadline.
The site has not received completed construction permits and thus the use has been
established for commercial/public assembly occupancy of the site. The facility has been
and continues to operate without obtaining and receiving a final status with require
commercial permits as evidence by neighbor documentation and social media posts.

b.
Development of the site shall be in substantial conformance with the Narrative Report
entitled “Cazarez Small Event Venue”, consisting of 4 pages, dated stamped received
November 9, 2020 except as modified by the following conditions.
Non-compliance: The narrative report states ‘Any improvements the County requires will
be done within 3-4 months of the approved plans. The required permits prior to operation
of the facility have not been completed. There are several sections of the narrative report
that do not comply with the conditions of approval.
c.
The following Engineering conditions shall apply:
1.
All landscaping and construction within right-of-way shall conform to MCDOT
design standards.
2.
Drainage review of planning and/or zoning cases is for conceptual design only and
does not represent final design approval nor shall it entitle applicants to future

designs that are not in conformance with Section 1205 of the Maricopa County
Zoning Ordinance and the Maricopa County Drainage Policies and Standards.
3.
All development and engineering design shall be in conformance with Section
1205 of the Maricopa County Zoning Ordinance and current engineering policies,
standards and best practices at the time of application for construction.
Non-compliance: The facility has not met the requirements for engineering related to
stormwater retention, ADA parking spaces and roadway improvements, and should not be
operational until all permits and conditions of SUP approval have been completed.
d.
This Special Use Permit shall expire on January 13, 2031, or upon termination of the use
for a period of 120 or more days, whichever occurs first. All site improvements associated
with the special use permit shall be removed within 120 days of such expiration or
termination of use. There shall be a status report submitted at the 1-year anniversary of
this SUP and every year following that details how the SUP conditions of approval are
being met including the tracking of special event dates and attendance.
Non-compliance: A status report was not submitted by January 13, 2022 to address
compliance with SUP conditions and tracking the number of special event dates and
attendance. Per condition another status is required January 13, 2023, currently no status
report submitted.
e.
The following SUP requirements shall apply:
1.
Limited to 30 events per year, maximum of 150 guests per event
Non-compliance: A status report was not submitted to the County by January 13, 2022 to
address the number of events or number of guests held per year. The area residents have
indicated the facility operates outside the BOS condition of 30 events per year and
exceeds the established use of a small outdoor event venue and includes uses on
adjacent parcels outside the SUP.
2.
Operation hours shall be from 10:00 a.m. to 10:00 p.m. (open to the public) on
event days
Non-compliance: A status report was not submitted by January 13, 2022 which addressed
number of events and attendance. Public comments indicate uses go beyond the
conditioned timeframe. Area residents have provided public records from MCSO with
incident reports with a total of 34 call types as ‘loud neighbors disturbing’ dated 1/1/19 to
12/30/22. Staff notes the community residents have indicated the use started before
obtaining the requirement for a SUP.
3.
Parking lot lighting and related venue lighting shall be shut off by 10:00 p.m. and
meet Maricopa County Zoning Ordinance requirements.
Non-compliance: Facility has been operational without benefit of completed construction
permits authorizing occupancy of the site for the commercial / public assembly use, and
records from MCSO show the venue operational after the 10:00 pm. conditioned time.

There shall be no amplified music or speakers allowed

Non-compliance: SUP condition prohibits amplified music or speakers. Upon review of
Facebook posts, there are several videos with amplified music and live bands performing.
The approved narrative report stated, ‘the events will include music recorded and live’ and
‘Sound mitigation will include existing vegetation, distance to offsite structures located on
adjacent properties, and volume control. Amplified sound levels will comply with current
County Noise Ordinance P-23. Other methods of sound mitigation could include more
speakers at lower volumes, more dense perimeter vegetation and 6’ tall CMU block noise
walls.’ Staff notes the approved condition of approval does not allow for any amplified
music or speakers. Staff received MCSO records of disturbance calls along with public
comment that demonstrates events with amplified music/speakers are occurring.
Records show that during an inspection on 11/25/22, a MCSO deputy advised the owners
that the SUP prohibits the use of amplified music or speakers. They informed the owner
that they would need to amend the permit to change the end time and use of music. During
that same call, the deputies entered the property for a second time and notated that the
music began playing over the speaker system after the party had ended in violation of
event and lighting to be turned off by 2200 hours.
5.
Pavement for parking spaces and internal driveways shall be used
Non-compliance: Permit recently issued for parking spaces and internal driveways.
Facility should not be utilized until all improvements have been completed and receive
final inspections.
6.
Pioneer St. shall be improved with chip seal in front of the property extending west
to 169th Ave. and north to Lower Buckeye Rd. Otherwise, a dust control plan
acceptable to the Maricopa County Air Quality Department shall be allowed
Non-compliance: A permit has not been submitted to Planning & Development for the chip
seal in front of the property and along Pioneer St. and 169th to Lower Buckeye Rd. Public
comments have indicated there has been material placed along the easements without
property owner authorizations. The owners have not filed for a permit for the required chip
seal.
A permit was filed with Maricopa County Air Quality Department, and an inspection was
completed on 10/20/22 by Alex Torres with a dust control permit issued with F045622
and is valid until 8/2/23. No violations were discovered during the inspection, Mr. Torres
noted that Pioneer St. and 169th Ave. were included as disturbed area in the permit in
addition to the parking area. It was determined to be compliant with stability, opacity,
emission control, and recordkeeping standards at the time. Staff notes the issuance of
the Air Quality Permit does not eliminate the need to submit for permits for the chip seal
requirement as set by the BOS.
7.
A minimum 6’ (h) solid wall shall be constructed along the west, east, and north
property lines.
Non-compliance: The recent permits include construction of a maximum of 8’ high wall.
Staff notes the existing on-site wall would need to be modified with the construction
permit. The existing wall also includes two gates utilizing the 20’ ingress/egress easement
which is over the location for the stormwater retention and additional parking spaces. It
appears upon review of 2022 aerial images the uses have expanded to the adjacent

parcels under same ownership but outside of the approved SUP area. Neighborhood
residents are indicating there are outdoor rodeo events being held outside the boundary
of the SUP.
f.
This Special Use Permit approval does not grant any entitlement to buildings, structures
or fencing that encroaches onto adjacent properties, easements or rights-of-way.
Non-compliance: The existing site conditions in comparison to the approved SUP raises
questions if the use has expanded to adjacent parcels. The original SUP approval included
solid fencing to secure the site. There is no permit submitted for the fencing originally
proposed on the property lines to eliminate overflow and uses on the adjacent lots. If there
are additional outdoor uses that expand, the SUP would need to be amended to account
for this use. Neighbors have provided documentation and evidence that there are uses
that go beyond the SUP boundaries.
g.
Noncompliance with any Maricopa County Regulation shall be grounds for initiating a
revocation of this Special Use Permit as set forth in the Maricopa County Zoning
Ordinance.
Non-compliance: Code violation for non-compliance with the conditions of approval, the
Hearing Officer found the owners responsible and directed staff to take the case back to
public hearing for revocation.
h.
The property owner/s and their successors waive claim for diminution in value if the
County takes action to rescind approval due to noncompliance with conditions.
i.
The granting of this change in use of the property has been at the request of the applicant,
with the consent of the landowner. The granting of this approval allows the property to
enjoy uses in excess of those permitted by the zoning existing on the date of application,
subject to conditions. In the event of the failure to comply with any condition, and at the
time of expiration of the Special Use Permit, the property shall revert to the zoning that
existed on the date of application. It is, therefore, stipulated and agreed that either
revocation due to the failure to comply with any conditions, or the expiration of the Special
Use Permit, does not reduce any rights that existed on the date of application to use,
divide, sell or possess the property and that there would be no diminution in value of the
property from the value it held on the date of application due to such revocation or
expiration of the Special Use Permit. The Special Use Permit enhances the value of the
property above its value as of the date the Special Use Permit is granted and reverting to
the prior zoning results in the same value of the property as if the Special Use Permit had
never been granted.
5.
Staff notes the site has received numerous calls to MCSO for loud neighbors disturbing. The
Noise Ordinance (P-23) was adopted February 15, 2006 and is regulated and enforced by MCSO.
The purpose of P-23 states:
At and above certain levels, noise is detrimental to the health and welfare of Maricopa
County citizens. Therefore, Maricopa County has determined that it is in the best interest of
its citizens to control noise in a manner which promotes commerce; the use, value, and
enjoyment of property; sleep and repose; and environmental quality. Therefore, it is hereby
declared to be the policy of Maricopa County to prohibit excessive, unnecessary, disruptive,

and annoying noises from all sources. The noise ordinance applies to properties within
unincorporated Maricopa County.
Section IV. Noise:
C.
Radios and Sound Amplification Devices
It shall be unlawful for any person to operate any radio, loudspeaker, musical instrument, or
other sound producing, sound reproducing, or sound amplification equipment which emits
noise that can be heard from within closed residential structures located within 500 feet of
the boundary of the property from which such noise emanates.
V. Public Disturbances
A. It shall be unlawful for any person to cause, or for any person in possession of property to
allow to originate from the property, any noise which disturbs the peace or quiet of any
neighborhood if such noise can be heard from within closed residential structures located
within 500 feet of the boundary of the property from which such noise emanates. This
subsection shall not apply to noise produced in the normal conduct of business provided
that such noise occurs within the normal and customary hours for the conduct of such
business, which is based on the normal and customary hours of operation of similar,
existing businesses, and the operation is legally conducted within the scope of all
ordinances, laws, and statutes of Maricopa County and the State of Arizona.
6.
There are numerous homes in the vicinity with a total of 34 parcels located within a 500’ radius
of the site. The original SUP staff report referenced that there were no open violations, however
violation history and neighborhood feedback proves that the site has been used for events prior
to obtaining the SUP, and of most concern that the site has been operating without completed
required permits and is out of compliance with the conditions of SUP approval.

for 2023. Staff was unable to find a direct website for the venue, but receive public input showing
events schedule and occurring after the conditions end time of 10:00 p.m. on Facebook and
another website called The Knot.

Below are aerial images showing modifications to the existing SFR, including an expansion of a
porch and a second level with staircase. Staff notes the house is listed as ‘not part of the SUP’,
and staff was unable to find any permits for the expansion. It appears pulling images Facebook

The proposed venue should be developed with a parking lot (located on the currently vacant
eastern parcel) as well as an outdoor event area for guests, located north of the existing residence
on the western parcel. The parking should include a total of 88 parking spaces (including 5
handicap) and would be paved. There should be a single 24’ wide access driveway to the parking
area from Pioneer St. The site plan shows a pathway from the parking area to the outdoor event
area on the western parcel. The site should have a temporary removable tent for events
(approximately 4,500 sq. ft.), food truck area (max. 2 food trucks), and restrooms. There is
existing pole barn and canopy that are part of the operation, which requires commercial alteration
permits. Staff notes the existing layout of the facility does not match nor has been constructed
to the approved SUP site plan.
12.
The existing SUP entitlement is for 10-years, which allows 150 guests per event with a maximum
of 30 events per year. The hours of operation should be from 10:00 a.m. to 10:00 p.m. on event
days. Events would be staffed by four members of the owner’s family, while all other vendors
would be provided by the client. No permanent signage is proposed, the site has existing 4’ tall
iron 3-rail tube fencing along the side and rear property lines.

Show below and on the next page is an aerial map and zoning map showing the County island
with the City of Goodyear planning area. The aerial displays there is no existing public right-of-
way to the site. Pioneer St. and 169th Ave. alignments are easements and are not part of the
County roadway network. Staff notes the County island comprises a total of 125 Rural-43 zoned
properties with no other SUPs or land use designations for commercial businesses.

With the original SUP approval, a Traffic Impact Study (TIS) was approved by MCDOT stating that
there would be less than 100 peak hour trips which it would have negligible impact on the
surrounding roadway infrastructure. The Traffic Impact Study with the original SUP indicated the
following: ‘Roadway Access – Access to the site is provided from City of Goodyear maintained
roads. From Sarival Ave. on to the east via easements along the Pioneer St. alignment and from
Lower Buckeye Rd. to the north via 169th Ave. and Pioneer St. alignments via easements to the site.’
The traffic summary references the venue will have hours of 10 am – 10 pm on event days and
be limited to no more than 30 events per calendar year. Heavy truck use was listed for 2-3 trips
per month.
15.
Staff notes the 169th Ave., Pioneer St. and 165th Ave. alignments are not County owned or
maintained. There are public comments from area residents reports that the use is not limited to
access only from 169th Ave., traffic is also being filtered down 165th Ave., Pioneer St. from Sarival
Ave. The approved SUP includes a condition to chip seal Pioneer St. and 169th Ave. but the use is
impacting other easements that include Pioneer St. and 165th Ave. which has resulted in an
impact to the existing residents that own and maintain the easements.
16.
The requirement for chip seal is roughly 2,280 linear feet of improvements along many properties
which would be logistically difficult to accomplish due to permission from property owners along
this roadway stretch needed to permit such an endeavor. The proposed chip seal also doesn’t
cover the site access to the east where Pioneer St. eventually ends up at 165th Ave. which can
also access Lower Buckeye Rd. to the north and Pioneer Rd. accesses Sarival Ave. to the east.

Public Comments received on the Use:
24. *
Planning and Code Compliance staff have received numerous phone calls (approx. 15) from
neighbors in the vicinity with concerns about the SUP and the ongoing use. Staff notes that
several property owners have expressed opposition to the use, but were concerned about
providing their names for the record and did not want to provide comments in writing. The
telephone calls received expressed concerns with noise, dust, traffic, and impacts to the rural
community lifestyle. Several owners are indicating the noise can be heard within their homes with
doors and windows shut. Residents have been calling MCSO for noise complaints. Deputies are
dispatched to the site, the music is turned down but then after the deputies leave the music is
turned back up. MCSO has documented this with an incident report dated 11/25/22. The
neighbors indicate that the owners operate the facility with complete disregard for the rural
community.
25.
Included with the staff report are letters/e-mails with photographic evidence received with the
following summarized concerns raised by the neighbors:
•
Operated facility prior to entitlement and now there is an increased number of events,
attendees and traffic. The original SUP did not notify neighbors for the venue for public
comment.
•
Events are being held on Friday, Saturday, Sunday and Tuesday nights. Many residents work
and have to deal with the noise every weekend and during the week.

•
Noise and use is too disrupted to the existing rural community, neighbors reporting they can
hear the noise when doors/windows closed at least ½ mile away. Noise can be heard past
midnight.
•
Claim of drunk patrons using the road and speeding down the rural roads. There have been
instances where vehicles end up in the irrigation ditches. Vehicles fishtailing and donuts in
the streets.
•
Increased crime in the community. Reports of people fighting and arguing outside the venue
in the community.
•
Trash and broken bottles in the streets.
•
Expansion of outdoor venue to the parcels to the west (500-93-018 and 015) – photographic
evidence provided for use.
•
Unauthorized construction and tearing up 169th Ave. alignment without property owner
authorization. The owner utilized material that does not meet condition of chip seal.
Reference that it’s a petroleum product that is extremely dusty. This has resulted in holes in
roadway, wash boarding and issues with drainage not functioning properly since work was
unpermitted.
•
Assumption made that all traffic would use 169th Ave., the traffic also utilizes 165th Ave. and
Sarival. They should also be required to chip seal to 165th Ave. and north to Lower Buckeye
Rd.
•
Residents are reporting increased use and damage to 165th Ave. which is privately owned.
The use has caused a direct impact to the property owners with the owners having to maintain
the roadway at their own expense. The easement is not set for this commercial business use.
•
Roadway work caused damage to owls’ habit.
•
The existing 6’ walls does not help with the outdoor music and noise.
•
Calls to MCSO, advising the public to call the non-emergency line – this is wasting emergency
services.
•
Owners has disregarded the conditions of approval with each event.
•
Events held until 11p.m. to 1 a.m. with singing, music and amplified system.
•
Fireworks, pyrotechnics utilized at the site along with spotlights that shine skyward.
26.
Attached with the staff report includes e-mails received in opposition, and demonstration of uses
expanding to adjacent parcels. Staff notes the neighbors also have numerous documentation of
audio and video evidence to present the Commission and Board. Since the staff report is a printed
word document, Planning staff has advised the neighbors to create a webpage or utilize a web
source to upload audio and video evidence to include as part of their concerns. As of the writing
of the staff report, the neighbors are currently working on getting a page developed for the public
and the Commission to review additional evidence. Shown on the next pages includes a sample
of photographic evidence submitted.

Staff Analysis:
27.
Staff recommends repeal of this SUP due to non-compliance with conditions, operation of the
facility without the obtaining the required permits in a final status prior to holding events, noise
complaints from the public, increase in the number of violations calls submitted to Code
Compliance for zoning and MCSO for noise disturbances. The Hearing Officer with Code
Compliance Division directed staff to take this case back to public hearing. This venue has
expanded the original proposed use beyond the established conditions for a small event venue.
The owners have not complied with site improvement requirements by obtaining the required
permits for paving, parking, ADA spaces, on-site retention basin, fencing prior to operation of the
facility, they were notified multiple times but continue to use the facility without obtaining permits.
Staff notes three permits were issued in late December for grading and the restroom facility, but
there are other permits required in conjunction with facility prior to operation.
28.
The neighbors have expressed that the owners have not been good neighbors in considering the
impact of the outdoor venue uses with the residents and the rural character of the community.
The facility is disruptive to the community as evidence was discovered by staff and submitted by

the public, research of social media posts demonstrate that the owners have disregarded the
conditions of approval which has resulted in an increase in complaints received for increased
traffic, vehicles speeding along dirt roads, excessive dust, noise with amplified music and live
bands (not allowed per Board condition), operating beyond the 10:00 end time (evidence in MCSO
reports). The facility is a detriment to the existing rural character of the community, the neighbors
are working to get this case back in front of the Commission and Board to reclaim the area as
rural/residential without this use that is a public nuisance. The owners have ignored the
established Board conditions that limited event size, number of events, amplified
music/speakers, hours of operation, and permitting requirements.
29.
Neighbors submitted evidence demonstrating that there is utilization of adjacent parcels not
subject to the SUP with an increased number of attendees and additional dust being generated
with potential of rodeo events. The expansion of use is not allowed per MCZO without obtaining
the property entitlement with an SUP with allowance of public input on expansion of uses from
the Rural-43 zoning. Upon check of County records, there has been no Code Violations generated
on the parcels 500-93-018 (under ownership by Ellingson Family Trust) and 500-93-015
(ownership listed as Yaritz Pina-Merry and Miguel Cazarez).
30. * Staff notes this use is impacting MCSO with an increased amount of disturbance calls to the site.
MCSO District 2 located in Avondale is responsible for covering this area of the County. A call to
the venue from this station to is approximately 12.3 miles. Analysis of the MCSO public records
for loud disturbance calls, events have been held on Fridays, Saturdays, Sundays, Monday,
Tuesday, Wednesday and Thursdays. There are 34 loud disturbance calls from 1/1/19 –
12/30/22. Upon coordination with MCSO, the facility has operated after the 2200 hours (10:00
p.m.) in violation of the Noise Ordinance, but no citations issued by MCSO. A neighbor obtain a
report from MCSO for calls between 11/26/22 to 3/26/23, this includes 12 calls noted as loud
neighbors disturbing, no citations issued by MCSO.
31.
Neighbors are claiming there are intoxicated patrons leaving the site, however there is no liquor
license issued for the venue. The original SUP did not include refence to catering or liquor, the
approved site plan shows the location of two food trucks. Staff note that if food service is being
provided a food service permit with MCESD is required. If liquor is being served at the facility, then
a Special Event Liquor License is required to be submitted with the Clerk of the Board. Upon
research with the Clerk of the Board there is no license issued for the facility.
32.
There are valid concerns raised from the neighbors, and staff believes this use illegally expands
beyond a small event venue as originally proposed. Staff also notes that the majority of structures
were existing prior to the SUP approval, thus there was not significant improvements completed
dependent upon the SUP should it be revoked. The three permits for grading and restroom facility
were only recently issued, but as of the writing of this report have not received inspections. Staff
believes this use is no longer appropriate at this location and recommends the Commission
motion for the Board to initialize and recommend the Board process revocation of the SUP.
33.
Based upon the violation, direction from the Hearing Officer, non-compliance with SUP conditions,
violation of noise and amplified music, traffic, noise, and dust resulting in a use that exceeds the
scope and intensity of the ‘small outdoor venue’ use as originally proposed. This has resulted in
a direct impact to the lifestyle and rural ambiance of the community. Staff opposes this use
continuing on the property and recommends the Commission motion for the Board of Supervisors
to revoke the SUP.

34.
A limitation to 30 events per year, should have been further evaluated by staff with the original
SUP to establish when these events could be scheduled. For example only to occur on
Friday/Saturday weekends with a limitation on the number per month. Granted this is an outdoor
venue, the neighbors have indicated uses during the summer months is quiet. Staff believes 30
per year is excessive and should have been limited two events per a month only be allowed on a
Friday and Saturday so as not to disrupt the neighbors. The outdoor use would be limited to the
months of September through June. This would better line up with a true operation of small venue.
An outdoor venue on weekdays is inappropriate. Based on comments from neighbors, the owner
has demonstrated disregard for the community. Further, the Facility has operated in disregard to
the Board established condition by allowing events to include amplified music/bands/speakers.
The Board specifically set a condition prohibiting amplified music or speakers. The original SUP
requested 20 years, the Board approved the request for 10 years to afford opportunity for the
property owner to demonstrate the small event venue would be a good neighbor and fit for the
neighborhood, but at this stage with non-compliance of conditions, unpermitted construction,
violation of conditions, numerous public complaints to Planning, Code Compliance and MCSO,
staff believes the use is no longer appropriate.
35. * The legal firm representing the owners has requested additional continuance of the case. Staff
notes the letter expresses interest in a 6 months or longer continuance due to the owners of the
facility attempting to limit the number of events and have 4 events scheduled within the next two
months; 2 scheduled for April and 2 for May (dates not provided). The letter states they will be
shutting down for the summer months to focus on completing the necessary improvements that
the firm has established for them. The letter states since the January 26th hearing, they have been
working the owners to develop a plan to rectify the violation and SUP requirements. The letter
addresses the following changes:
1. Driveway ingress/egress to eastern parking lot wil not work due to irrigation & utility ditches.
(Requires modification to the site plan)
2. Existing driveway already established that could be used for access. (Requires modification
to the site plan)
3. The 6’ (h) screen wall was constructed and has two gate openings on east side of wall.
(Permits are required for the wall along with changes to the site plan ).
4. Permits issued for B202111203 & B202110499 which need to be modified to address
changes to access drive and change in location to retention basin (Requires modification to
the site plan).
5. Parking area would be reconfigured for gate openings and update circulation plan,
adjustments in the wall location, adjustments in parking and ADA spaces.
6. Asphalt material for parking was already installed, but would need to include
emulsified/binding material.
7. Permanent restroom facilities are needed for the property, need for new septic system has
caused delays.
8. Pole Barn & ramada building are permitted as residential structures and not part of SUP.
9. New material to upgrade Pioneer St. & 169th Ave., chip seal note was added to original SUP
site plan without the owner’s knowledge. The owners submitted permit with Air Quality but
not Planning and Development for the upgrades to the road segments. Determined the
condition is not realistic requiring changes to roadways.
10. Status report condition to be filed each year, plan to file as soon as they gather data from
client on operations and conditions of approval.
The letter states there is work that needs to be done to focus on the violation, updated plan
to rework parking, access, roadway material for dust and air quality. Permits were issued but

has run into issues at inspection stage due to not matching site conditions. Advised to secure
engineer to work with team.
36. * Staff recommends the SUP be revoked due to repeated and continuing non-compliance with the
SUP conditions, and growing neighborhood opposition due to the impacts of such non-
compliance. Staff has notified the legal firm that we would be supportive of a continuance
contingent upon the operation fully ceasing and desisting hosting events unless and until it is in
full compliance with the SUP conditions governing the site (as originally approved or as may be
subsequently amended by the Board of Supervisors). Staff cannot condone events being held on
site that do not comply with the SUP conditions of approval.
Recommendation:
37.
For the reasons outlined in this report, staff recommends the Commission motion to recommend
Revocation of the Z2019024 SUP to the Board.

charges in Case No. V202102065. Respondents Yaritza Pin-Merry and Miguel Cazarez are the owners of
the subject property. Following complaints alleging violation(s) of Maricopa County ordinances, the
Department conducted an inspection of the subject property on November 22, 2021. Based on the
inspection, violation(s) involving failure to meet stipulations of approval for Case No. Z2019024 were
confirmed. The Department issued a Notice and Order to Comply to Respondents on November 24, 2021.
Subsequent Department investigation revealed that the noted violation(s) had not been corrected. A

statements from the compl. per the RO the permit is til 2230. i did advised the RO the compl stated the music was at a
reasonable level and to please keep it at the same level for the remainder of the gathering. the RO agreed.

Taken in a backyard after having to cancel a family cookout and leaving to go out to dinner
instead. I sat in my back yard frustrated and crying after this ruined our plans. I was defeated
and started recording out of anger.
BTW we have not had one family gathering outside in 3 years due to this venue.
We never know when they are going to have a party and we never know when to plan around
them. And there is no way to have a gathering during this amount of noise. You have to yell
over the top of it to hear one another.
I usually make my recordings when I am angry and fed up.
If you look at the location of event record from the sheriff's office you can correlate this date
and see how many times they came out, on this day they came out four times.

Sitting on my couch trying to watch the news with a door open for fresh air, I got so angry I
turned off the TV and started recording and this is how loud it was.
I had had guests over earlier and we could hear it through the glass in the door and they
couldn't believe the volume and ask if this is frequent and sadly I answered yes, many times a
month!
We couldn't even stand outside at their truck and talk in my driveway!!!

These photographs are taken from a front porch to a house on 169 Ave. The easement that this venue
has chosen to use for its entry is a small irrigation road intended for light traffic just to the homes in this
neighborhood. School buses are prohibited to use these irrigation roads and the infrastructure of this
road can not handle the thousands of cars and large catering trucks this road has to withstand.
They had been operating for the whole year of 2019 (WITHOUT AN SUP)
I just couldn't take the dust anymore and I had asphalt millings installed on my section of the road from
Lower Buckeye Rd to my mailbox at 2915 S.169 Ave. From March 2020 until October 2022, even though
the road was extremely worn and abused, the milling created ABSOLUTELY a dust free environment
which made the traffic mildly tolerable and it was satisfactory except for the speeding. VERY FEW OF
THEIR PATRONS DRIVE AT A SAFE RATE OF SPEED TO GET TO THE VENUE, most speed except
for the stretch Limousines and a few expensive cars. Even the horse trailers going to their events
speed.
HOWEVER, in October 2022, without asking my permission, Cazarez Small Event Venue brought a very
LARGE grader (WITHOUT A PERMIT) onto the road on my land and started tearing up my
asphalt millings, they were destroyed and buried under a 6" layer of strange petroleum based
dirt product. I told them to stop and vacate my property and leave it alone and told them they didn't have
my permission to touch it. I confirmed with Jeff Bruining that they had no permits to do this work. They
continued and I didn't know what to do. So I started taking photos.
This product that they dumped products a dark black dust and causes sinus congestion with the passing
of a single car at any rate of speed over 10 MPH. They also severely damaged a Burrowing Owl habit
that never recovered and we lost all of those owls.
Had a permit been correctly used and abided by there would have been a road study, permission would
have been requested and the 2 residents affected on this road would have been notified, the owls would
have been protected and we'd have a dust free road now! I have now lost $1500 worth of materials
under this dusty petroleum dirt gravel product and these photos show the results.
Cars are driving by causing dust on the way to the Cazarez Small Event Venue.
(Dust is extremely difficult to photograph, it must be caught in the sunlight just right.)
All photos and dust videos are taken on Cazarez Small Event Venue day when their traffic is coming and
going.
The dust migrates across our whole property and spreads out across the field working its way to Cotton
Lane when this venue is under way.
Cazarez Small Event Venue has no respect for the residents whatsoever.
I own a major part of this entry near Lower Buckeye Road and receive the brunt of the abuse due to
angry drunk patrons leaving this venue's parties burning out onto Lower Buckeye Rd from 169 Ave. They
needed water trucks and traffic control. They used a water truck 1 single time at 6:30 pm on a day when
they started a horse event at noon. 6.5 hours later after we were already dusted out, they then took a
water truck down the road, it was far too late and many of the big horse rigs were gone.

This is a photo of the parcel that is diagonal to my property. It also shows the horse trailers (at least 20 or
more) and the dust stirred up from this dry lot.

Had this been part of the venue SUP, we would have been notified of the SUP hearings back in 2020.
Joel Watson, listed on the signage as contact for the hearings in 2019/2020 assured me that Maricopa
County would never pass this because there was "too much opposition". Telling me he received
much opposition from the neighbors. I told him I wanted to be notified anyway even though I was more
than 300 ft from the SUP. I was not given notification. I called him at least 10 times begging for
notification and asking for updates. He never acquiesced.
So far this parcel has been used twice, the latest usage was on November 20, 2022.

A permit wasn't pulled to work on the road 169th Ave. This unauthorized construction and tearing up of the road damaged my property (the road) and an owl nest that I protected on my
land.

Look at this sign on 169 Ave at Lower Buckeye road as you head south and enter 169 Ave
(This sign is 20' from the nest, the nest was demolished).

This is what happens when you don't follow rules and regulations of the SUP.

These owls are permanently gone and we never saw what happened to the offspring.
I did attempt to dig them out hours later when I realized they were buried, but my shovel broke and I walked off crying.
I am very frustrated and sad. I screamed and yelled at Miguel, using many foul words and told him to stay off my property.
He stood there with a grin on his face and I told them to stop messing up my portion of the road and that they had no right and could have at least knocked on my door.
They kept working, blocking the road, making dust and damaging and turning up my asphalt millings which are now all gone! You can't even imagine my frustration. I
didn't know what to do, I just kept calling Jeff Bruining in the complaint department.
This is negligent on the part of the Cazarez Small Event Venue for not getting the proper permits.

Regarding parts of 169 Ave, a small privately owned irrigation road. I own 169 Ave from Lower Buckeye
Rd, South to the first home at 2915 S. 169 Ave. I found that late 2018 through 2019 the traffic increased
and many parties were held at 16740 W. Pioneer St., the Cazarez event venue. They started parties
before they had a permit. The traffic caused much dust and damaged the road severely. I couldn't
maintain it anymore, the holes in the road kept getting deeper and worse and became difficult to
manage.
The dust became so severe I put my house up for sale at the front of my property, and I moved into the
mobile home at 2915 S.169 Ave so that I could finalize the sale of my house at the front of the property, I
then planned to sell my mobile home. I didn't want to move, but we had not had a family gathering in our
backyard for a year due to the sheer volume of their parties on many weekends. Because the dust was
so severe for us at 2915 S.169 Ave, we decided to have asphalt millings added to the road portion of our
property. It was WONDERFUL! NO MORE DUST! It was a miracle!
The party goers sped by faster than ever but they didn't "dust us out"! We were content. We still had to
grit our teeth and deal with the music drowning out the TV in our living room on Friday and Saturday
nights, but at least we knew our health and breathing would be better.
Then Covid hit in March of 2020, the sale of our house fell through. So we moved back to our front house
and moved our Mother into the 2915 S. 169 Ave address. Other than the hundreds of speeding cars and
terribly loud music, for the most part we could sit on the porch and at least watch the sunsets to the
West.
Here is the picture of the finished road a year after it was completed.
I only have one nice photo of the road, (we were fixing a gate in this photo), but you can see the nice road
behind the tractor all the way down the side of our property:

WHY TOUCH THIS ROAD??? IT WAS JUST FINE.
But then Maricopa County gave this venue deadlines to meet, part of that was to chip seal 169 Ave.
(WHICH WAS NEVER DONE)
This would have required a permit which would have notified the property owners.
This did not happen and in the first week of October 2022, to try to beat the October 10, 2022 deadline
the Cazarez Event Venue took a big machine and WITHOUT ASKING ME, tore up my road and drive!!!!
I called Jeff Bruining and complained several times that day, he told me they had no permit and I
confronted the people involved and told them to cease and desist. They persisted, I told them they had
no permission to be on my land and told them to get off, they didn't. This is what they did without permits:
(causing dust, road blockages and damage to what was a dust free road)
THEY TORE UP THE ROAD NOW IT IS DUSTIER THAN EVER AND NOW IT'S WASHBOARDING AND
NOW IT'S ALSO GETTING POTHOLES AND NOT DRAINING CORRECTLY!!!
MARICOPA COUNTY KNEW HE WASN'T FOLLOWING RULES, SO THEN THEY TELL HIM TO WORK
ON 169 AVE, KNOWING HE DOESN'T FOLLOW PERMITS AND RULES?!
It is time to do what is right and stop this madness. We would like this SUP revoked. He has proven to
be too disruptive to an otherwise quiet neighborhood.
They are now causing harm to the neighborhood, both with traffic, noise abuse,
abuse of the roads, angry drunk people leaving from the venue and speeding
recklessly down these small roads. People coming and going from this venue have
landed in the irrigation ditches with their cars and now they have damaged the road
beyond repair. I had $1600 worth of wonderful asphalt millings down on this road and
now they have covered it with a product with petroleum based hydrocarbons. It is
now extremely dusty with a dark powder dust. When you wipe your finger across a dusty
table, it is a dark black dust, not tan or dirt brown.

We live in the South part of the Canyon Trails Goodyear neighborhood and constantly hear very loud
music past 10 pm and often past midnight from the Cazarez venue. They have no regard for people
living near them.
We have contacted the sheriff’s office previously to have them turn the music and activities down.
There also has been more crime in the area which is devastating for our community.

Good morning Rachel,
I recently received your contact information from a flyer that was left at my door. It's my
understanding there will be a Planning & Zoning Hearing on January 26, 2023 regarding the
matter of approving an ongoing SUP for this venue, located at 16740 W Pioneer St. Goodyear,
AZ 85338.
I reside at a neighboring property & have serious concerns regarding this matter. The MCSO
has been contacted & responded numerous times about the noise. Not only by us, but others in
the area as well. I'm sure there is a dispatch call log that can be obtained regarding complaints
at the venue address. In addition to the noise, the issues with the traffic attending the events is
a concern. This area is a county island and even though people may be instructed to use a
different route to get to the venue, we have noticed an increase in traffic on event days
on 165th Avenue.
The property owners living along the East side of 165th Avenue actually own the roadway and

I certainly do not wish to ruin anyone's livelihood, as I often make every attempt to patronize
local businesses to support them. However, there MUST be consideration of this venue owner
to adhere to the SUP guidelines, which have not been adhered to previously.

Here are some of my concerns
Permit
In 2019 not stop parties at 16740 w. Pioneer st.Then in approximately March 2020 sign was posted in front yard of same address
that SUP has been applied for.Contact Joel Watson on the sign.When contacted he stated this will never pass so much opposition
to it from neighbors.Probably since it’s a neighborhood,not wedding/party venue.Never heard another word from him or anyone
else.Also if you look at page 5 of the original permit request a picture is shown as one house in the far distance.Incorrect houses
all the way around this place.All of the sudden he has permit with no notification to anyone.
NOISE
He put some 6 foot walls up,but it does not help.The music blares anytime from 1pm to 1am.I have 23 videos of this that I am
still in process of trying to send to you.I am only including the ones that are beyond loud.They had at least 15 additional parties
that could be heard,just not super loud.When I say blares means it shakes my house,and even with doors and windows closed.I
live roughly 250 yards away. I still hear it.Not sure why a neighborhood has to deal with this every weekend.I was shown a Police
log that shows they were there 36 times in 1 year for noise complaints.I was also TOLD could be hearsay that when people call
without address only that there is loud party going on it is not listed under that address.Many horses,cows,livestock that the
excessive loud noise can not be good for them.No one in the neighborhood can any longer leave windows open or enjoy their
patio due to the noise.Those of us who get up for work early also deal with this on Fri.,Sat.,Sun.,and Tuesday nights.
DUST
The road becomes dusty very quick,and with an additional 100-200cars,delivery trucks,and vans coming and going to 16740 W.
Pioneer st. numerous times per weekend/month the road dusts up quick.In approximately September 2022 Cazarez put down on
the road some type of crushed millings from 169thave. And Lower Buckeye rd. from the west to 16740 W. Pioneer st.Sorry I
don’t know exact date since I never thought we would have a chance to be heard on this issue.The road is actually worse now
and we are breathing this in.Can not be very healthy.He also neglected to tell the county that half the vehicles that attend the
parties come from the east of his place so we all also get dusted out.Can not open doors or be out side when these parties are
going on due to health concern with dust.One weekend after 3 in row days/nights of parties the road was so bad that he or
someone sprayed it down with a water truck 11/21/22.Helped some what,but now the whole neighborhood gets to have their
cars washed to remove mud.Waste of money for us and waste of water for living in desert.
SAFETY
I have two children that work nights and are afraid to drive home passed 16740 W. Pioneer st.Due to people zooming spinning
tires out of the Venue.People wandering the streets,and some (big scary guy)they tell ,I believe he is security standing in the
street.They drive the long way around.No reason for this in their own neighborhood. Street after these parties has beer bottle
broken/unbroken trash strewn up and down the street coincidentialy after these parties.We have had numerous times where
groups of people are arguing and carrying on late night out in front of our house.Vehicles doing fishtails and donuts in the street
coming and going to the party.Our area has 0 fire hydrants.When 16740 W. Pioneer st. has large fires at their parties we have no
way from preventing it from spreading and burning down the neighborhood.Yes it might seem like I am over doing this one but
look all the trees on the property and dry pastures in neighborhood.
FINAL
Police -now tell you to call non-emergency # since they do many more important emergencies than this.He is wasting emergency
services.They turn the music down till police leave then it goes back up.
Fire- don’t want my neighborhood burnt down
Health-Valley Fever is major issue in Az.,and I’m sure the excessive dust is not helping neighbors avoid that and other health
issues.
Noise-The noise is ridiculous and no one in the area can any longer enjoy outside activities.
Safety-Many strangers,possibly drinking walking,driving,running through the neighborhood.
Disclosure-I have considered selling to get away from this nonsense,but I believe you need to sign Disclosure about railroads,or
dumps,or planes,etc.I think constant noise and health issue from this guy would prevent me from doing so.
In closing this is a great neighborhood that I’ve been part of 20+ years,NOT A WEDDING CHAPEL,PARTY VENUE,ETC. BUSINESS in
a residential are.

Dear Ms. Applegate,
I understand you are the contact person regarding this event venue located at 16740 W Pioneer Street,
Goodyear, AZ 85338. . My name is Emily, a Maricopa County resident in an unincorporated area within
Goodyear. Our property is located a few parcels east of said event venue. We moved here in 2007. I've
never had any issues living in this area when it comes to noise. It's always been a very quiet area.
However, last year (2022) or possibly mid to late 2021 (when the pandemic started easing up), we've
started noticing party noises from the above mentioned location. Initially we thought it was just a one-off
family party/gathering, until we noticed the more frequent and more louder it became and realized it was
already a business. Previously, when our doors/windows were closed, we can hear faint music/voice and
only hear it very loud when we open our doors/windows (so we just keep our doors/windows shut), then
later on even with our doors and windows closed, we can definitely hear the loud music/voice of
someone hosting -- it was no longer a faint sound. I would wait patiently until 10pm has passed and then
call MCSO (if the music/noise has not died down by then) to report the noise disturbance. I've placed
calls on numerous occasions. I didn't not realize that they have a SUP that was passed in December of
2010. As someone living in this area, I didn't see any signs or received any notifications when they were
going through the process so I was unaware of their SUP.
We keep to ourselves and don't usually talk to our neighbors, but the noise has prompted us to ask
questions to some of our neighbors. That is how i got the information about the SUP, and the upcoming
hearing. As a neighbor, I would like to oppose this SUP. These people have no regard to our
neighborhood with the noise they are creating. We also experienced a damage to our property, our
mailbox, which got turned 180 and so we had to replace. Of course I did not see how it happened, but I
can only surmise it is related to these events because sometimes, vehicles would drive fast on our dirt
roads (to / from the event place). Neighbors who live here usually drive slow on the unpaved roads so as
not to stir up dust. So either a vehicle hit it by accident or someone physically was out to destroy our
mailbox which i doubt). Anyway, I like to make it known that this SUP should be revoked. From what I
see, they have violated the terms of the SUP numerous times.

p.s. from time to time, there are some people from surrounding areas with ATVs that come to our
neighborhood to use their ATVs (and stir up dust), thinking our neighborhood is their personal
playground since we don't have paved roads and there's a few vacant lots. Who do i contact to maybe

Good evening,
I understand you are the point of contact in reference to this special use permit. I wanted to add the
following information for your staff report. I live on 165th Avenue just north of Pioneer. I understand
many of my neighbors are upset over this venue being able to operate due to many issues to include
roadway usage, traffic, and noise.
I can tell you when they have an event going on, I can hear the music on my property and I’m about
½ mile away. If I’m in my house with the doors/windows shut I can’t hear it but if I leave one open I
can hear the music. We have gotten accustomed to leaving everything shut as a result.
While the noise is a concern, our main concern is the roadway traffic. Anyone going to the venue
from Phoenix takes one of three roadways (169th Avenue , 165th Avenue, or Sarival Avenue) south
from Lower Buckeye. While Sarival Avenue can handle the traffic (Its paved), 165th is not. 165th is a
dirt road that is not maintained by Maricopa County. Our roadway has seen an increase in traffic and
the roadway has deteriorated as a result.
Every time a vehicle speeds down the roadway a dust cloud is kicked up, this is another reason my
doors and windows are always shut. While I’m sure not all traffic down 165th is event related, most
of the neighbors that live here have common courteously to go 10 MPH or less down the roads due
to the massive dust clouds that are kicked up when speeding. However, party attendees that don’t
live in the community don’t have that same courteously.
I saw in the original approval they were required to install chip seal from in front of their property
west to 169th Avenue and then north to Lower Buckeye. If they are going to be able to continue to
operate, I would like to request this also be done east of their property to 165th Avenue and then
north to Lower Buckeye Road to help with the dust, and road deterioration.
As far as the sound, I think a maximum volume should be enforced, I don’t believe music should be
loud enough to be heard ½ mile away.

I would like to request the non-renewal of special use permit Z2019024 for the reasons listed below.
Amplified Music. Amplified music has been heard from the location during daytime events and has continued past
the 10:00 PM noise allowance.
Road condition. The condition of the roads, both 169th Ave and Poineer St. were not brought to specifications as
defined in permit Z2019024 item 14. The road has deteriorated and is full of washboard, deep holes and grading for
water shedding problems.
Pyrotechnics. There have been large Arial pyrotechnics seen from vicinity of event locations.
I live in the Canyon Trails subdivision located on the north side of Lower Buckeye Rd. I am
Able to hear the amplified loud speakers at my residence. I frequently travel on 169th Ave using non motorized
transportation.

Dear Ms. Applegate, we would like to have this e-mail submitted as a very real concern for the above referenced
SUP to be allowed to continue.
We are aware of the conditions of the guidelines to have such a permit and have been dealing with ninety-nine
percent of said guidelines being ignored and broken each and every time there is an “event”.
There is no regard for the hours to discontinue at 10:00 pm and it goes until at least 11:00pm to 1:00am each time.
The singing, music and verbal addresses are always on an amplified system.
We have seen no sign of pavement or chip seal having been done also.
When we have been unable to sleep at the late hours of the amplified proceedings we and several of our neighbors
have called and reported the noise to the Sheriff’s Dept. and they have been told that they
have a permit for all the noise and the fireworks.The spotlights that shine skyward cannot possibly be allowed since
we are in a neighborhood situation? Can they??
Please let us know if there is anything more we can do to put a stop to these disturbances.

is a hearing on revoking the zoning permissions.

effect. If he has shown the blatant disregard when it wasn't properly zoned, God help us all
when he has the permissions to do so or what he may think is the permission to do so.

Hello
I am writing this email with the hope of having my concerns addressed regarding
the disturbance of the peace coming from 16740 w. Pioneer st.
I live about 3/4 of a mile to the north of said location and I can hear their amplified
music and the PA system from my home. The disturbance usually occurs on Fridays
and Saturday evenings and into the night. There have been many occurrences
where the brass (tuba, trumpet) music has been so disturbing that I have to shut my
doors and window in order to have some peace and quiet. The music is so loud that
I can still hear it even with all the windows and doors shut tight. I live in a residential
area with several of immediate neighbors being affected by this disturbing noise. I
have the right as a citizen to be able to enjoy the nice Arizona weather without
having to listening to such terrible noise. I moved into a residential zone so that I
wouldn’t have to hear loud and annoying noise. Please hear the voices of peace
loving citizens and move this venue to a commercially zoned location.

The purpose of this memo is to request a continuance of regular agenda item # 2, scheduled for
the January 26, 2023 P&Z hearing. This is for the Cazarez Small Event Venue Special Use Permit
(the “SUP”) – case # Z2019024. We propose a continuance for sixty (60) days to allow our firm
additional time to review and address the concerns by Maricopa County Planning &
Development staff that lead to the consideration for revocation of the existing approved SUP.
Brenda and Miguel Cazarez (the “Owner’s”) have recently retained our services to represent
them moving forward.
Due to the nature of this uncommon staff proposal to consider revocation of the SUP, the amount
of entitlement, permit, and site history, and requirements from the SUP conditions of approval,
we appreciate your consideration to allow us the opportunity for additional research and
analysis.
The Cazarez family is dedicated to resolving these issues by proposing solutions to meet SUP
requirements and to be a good neighbor to the surrounding community, while providing a great
venue experience for patrons of their event business. Allowing us extra time to assist in these
endeavors is crucial to developing resolutions for this SUP that was approved for an event venue
by the BOS on January 13, 2021, when the COVID-19 pandemic made it difficult for the event
industry to operate. Especially a family business like the Cazarez event site with many required
property improvements conditioned as part of the SUP approval.

The purpose of this memo is to provide you and Maricopa County P&D staff with an update to
the subject SUP (Z2019024) on APN’s 500-93-011 & 500-93-013. The proposed SUP revocation was
continued at the January 26, 2023 P&Z hearing until April 6, 2023. Since the January hearing, we
have been working with our clients, Brenda and Miguel Cazarez to identify and develop a plan
to rectify the violation (V202102065) and address the existing SUP requirements.
Through site visits and client discussions, we have been able to advise on next steps and have
provided these updates to detail our understanding of the current issues and thought process
moving forward. It is unfortunate that the original SUP submittals did not have informed
guidance on our client’s part. Their engineer at the time did not conduct appropriate site visits
and did not know the nature of the property and the surroundings. However, they constructed a
plan that would not work for the event venue regardless of site knowledge, or lack thereof.
Nevertheless, we are prepared to remedy the current situation and work with County staff to
ensure that the Cazarez Event Site can meet the needs of the owner’s while providing an updated
layout and standards for the SUP.
Site Access, Parking, and Screening
•
The approved driveway for ingress/egress to the parking lot on the eastern parcel (APN
500-93-011) from Pioneer Street will not work for the event site due to large irrigation and
utilities ditch (part of easement for same uses) along the easement roadway.
•
There is already an existing driveway located on the eastern boundary of the site, which
can be utilized for vehicular access to and from the property.
•
The min. 6’ (h) screen wall has been constructed, which has two gate openings on the east
side of the wall to allow traffic to enter and exit from the site. We are working with the
client to submit/complete permits for this wall.
•
Our client has pulled grading permits (B202111203 & B202110499), which have been
issued, but the plan needs to be reworked to accommodate the revised access drive. Also,

there was a retention area approved at the southeast corner of the site, which is not ideal
and can be placed further from the site entrance to accommodate more parking adjacent
to the venue and push required drainage to unused areas of the site.
•
Parking area would need to be reconfigured to allow for gate openings and provide an
updated circulation plan for the site. This would also include the existing wall location,
which is set off from the parcel boundaries, which reduces the footprint of the venue area,
provides more buffers from adjacent properties, and would allow reassessment of the
parking requirements and needs. Handicap parking would be added to meet ADA
requirements.
•
Asphalt material for parking area has been laid out, but would need to include
emulsified/binding material to ensure limited breakdown over time.
Buildings/Structures
•
Although portable restrooms were approved as an option with the SUP site plan, building
review is requiring permanent restroom facilities for the property. Our client has issued
permits for these (B202213824 & B202110499), but has been another unforeseen setback
for their operation. The need for new septic systems has caused further delays in this
requirement.
•
The existing pole barn and ramada buildings are permitted structures under permit #’s
B201303116 & B201303117.
•
Other structures that are not included as part of the event site are labeled as “not a part of
the SUP”. Thus, are not operational under this entitlement.
Roadways
•
The Cazarez have attempted to apply new material to upgrade Pioneer St. and 169th Ave.
to meet SUP condition e.6. They mention that their engineer added the “chip seal” details
to their final site plan without their knowledge. Their understanding of this condition was
to get approved through the Maricopa County Air Quality Department, so they filed a
dust control permit without also submitting through Maricopa County Planning and
Development Department.
•
This roadway SUP condition is not a realistic requirement given that the mentioned
roadways are easements and would require each property along the way to sign-off on
permits. Some neighbors have complained of the attempted work as they do not want
changes to the roadway adjacent to their residences.

Status Report
•
We are aware of the required status report (condition ‘d’ of SUP) to be filed every year
since the entitlement was granted. We plan to file this soon as we gather data from our
client regarding any operations to address each current status of condition of approval.
Summary/Next Steps
As detailed within this memo, there is still a good amount of work to do. We are focused on
addressing the violation, but this would require an updated plan to rework parking, access, and
roadway material requirements to ensure that dust and air quality are not an issue. Permits have
been issued, but have run into issues at the inspection stage due to plans not matching site
conditions. We are advising our client to secure an experienced engineer for their services to work
with our team and the client with the goal to create a site layout that will work for everyone.
When the SUP was approved, COVID-19 was in full force, which has made required site
improvements more difficult without having venue income. We are confident that we can make
major progress moving forward, but this will take time. We respectfully request a continuance of
6-months or longer to the SUP revocation at the April 6, 2023 hearing. This will afford time to
complete permits and propose an amended site layout that is logical. We appreciate your

Bill/Ray: Case Z2019024 was continued from the 1/26/23 to the 4/6/23 P&Z. Staff is recommending
the SUP be revoked due to ongoing noncompliance with the conditions of SUP approval and growing
neighborhood opposition. The 1/26 staff report is attached. It will be updated for the 4/6 hearing
but based on the same points. Please prepare for the P&Z hearing based upon the points outlined in
staff’s report. You may request a further continuance from the P&Z at the hearing. Staff will agree
to a continuance but only if contingent upon the operation fully ceasing and desisting from holding
events unless and until it is in full compliance with the conditions of the SUP as originally approved
or as may be subsequently modified. We cannot agree to nor condone events being held on site that
do not comply with the conditions of SUP approval that govern the site. Darren

We apologize for the tardy response, our client has been trying to limit the amount of events coming
up. From our discussions, they will only have 4 events in the next two months – 2 in late April and 2
in early May. They plan on shutting down for the upcoming summer months to focus on completing
the tasks that we have laid out for them. We are happy to discuss the next P&Z hearing further and
appreciate your considerations for the continuance.
