Project Summary:

This application proposes to change the current zoning of Rural-43 to C-2 CUPD for future 
commercial use on a parcel of land (APN 502-68-001B) located at the northeast corner 
of Thomas Rd. & 195th Ave. in the Buckeye area. This proposal does not include a plan of 
development nor have a proposed use. The parcel is vacant and undeveloped. It 
borders vacant land in all directions with the exception of a church to the north. The 
property was purchased in 2014 and has not had any other development proposals over 
the past five years.

City of Buckeye General Plan – Imagine Buckeye 2040 (Approved June 7, 2022): The 
subject property is within the City of Buckeye’s planning area with a future use 
designation of ‘Rural Lands’ which proposes a density of 1 dwelling unit per acre.  
 
 
Public Participation Summary:

The applicant sent neighborhood notification letters to all parcels within 300’ of the 
subject parcel. The site has had 2 notification signs posted since 12/21/2022 and was 
updated with current public hearing information on 2/08/2023. To date, staff has not 
received any public support or opposition.  
 
Outstanding Concerns from Reviewing Agencies:

The City of Buckeye has provided comment and does not support the application as 
proposed. As the parcel is located within the City of Buckeye’s municipal planning 
area, the city “strongly supports annexation of the site into the City prior to 
development so that it can develop in accordance with Buckeye requirements.” 
Furthermore, the city has expressed, “In accordance with the Buckeye General Plan 
designation applied to the property, if development is to occur in the County against 
the City’s recommendation, the City would request zoning be limited to C-1 rather 
than C-2 as proposed. The City is opposed to development of the site with uses that 
involve any outdoor storage, such as RV storage, which the City understands would be 
permitted upon rezoning to C-2 in the county. Those types of uses would be 
inconsistent with the existing and future residential character of this street.” Buckeye 
has also indicated they are in the process of annexing 195th Ave. and once 
completed, the applicant will be required to develop any ROW improvements to the 
City of Buckeye roadway standards.  
 
Staff Analysis:

The subject parcel is located at the intersection of two future principal arterial roads that 
both consist of a section line edge. Traditionally section line roads are utilized for arterial 
throughfares with higher traffic volumes. The C-2 zoning designation plainly states ‘This 
zoning district is designed for application at major street intersections’, which both 
Thomas Rd. and 195th Ave. qualify for thus staff finds the location to be suitable for the 
proposed C-2 zone.

The City of Buckeye has objected to the higher intensity C-2 zoning and would prefer to 
see C-1 zoning with the reasoning that they do not want outdoor storage uses in a 
traditional neighborhood or rural setting. Buckeye has offered annexation and sewer 
services in exchange for the lower C-1 zone.  
 
11. 
The applicant has chosen to forego limitations on specific uses, only limiting the 
development to “uses on the site shall only be those acceptable to the Maricopa County 
Environmental Services Department (MCESD) that can be accommodated by septic 
systems.” The applicant is choosing to assert their private property rights and refrain from 
annexation and sewer use with the City of Buckeye to seek the proposed rezoning 
request.

Staff views the proposal for C-2 zoning as appropriate at an arterial intersection. Further 
there will be demand for community commercial nodes due to the dynamic residential 
growth of the surrounding area. Staff recognizes Buckeye’s concerns of potential outdoor 
storage issues and notes that outdoor storage uses are not entitled with C-2 zoning. The 
parcel is buffered from the adjacent rural residential by the church complex to the north 
and the large open parcel to the east.

The City of Buckeye expressed other concerns as well, including roadway infrastructure 
cost sharing. It is staff’s understanding that the adjacent rights-of-way are proposed for 
annexation into the City. Once that occurs the access permission onto the arterials will 
be the City’s charge as will required street improvement adjacent to the site and any off-
site improvements that may become necessary due to traffic generated by ultimate site 
development. Those improvements will be determined and required at time of 
subsequent POD and commercial construction permitting.  
 
14. 
Although staff considers a community commercial node appropriate for this site, the 
Commission may determine a neighborhood commercial node more appropriate 
and/or the zoning to be conceptual and speculative thus premature. In such instance 
the commission may consider Conditional Zoning approval in accordance with MCZO, 
Art. 304.6 to place a deadline on POD approval and commercial construction permitting.  
 
Recommendation: 
 
15. 
 For the reasons outlined in this report, staff recommends approval of Z2022206 subject to 
the following conditions ‘a’ - ‘g’: 
 
a. 
Development of the site shall be in substantial conformance with the Zoning Exhibit 
entitled “Z2022206 zoning exhibit“, consisting of 1 full-size sheet, except as modified 
by the following conditions; 
 
b. 
The CUPD overlay is applied to restrict the use of the site. Until such time as the site 
is served by sewer, uses on the site shall only be those acceptable to the Maricopa 
County 
Environmental 
Services 
Department 
(MCESD) 
that 
can 
be 
accommodated by septic systems. A public water system shall be required prior 
to establishment of any use that requires potable water. 
 
c. 
Administrative approval of a POD will be required prior to approval and issuance 
of construction permits to develop and establish use of the site. Prior to issuance

of a building permit, written confirmation will be required from the emergency fire 
protection jurisdiction having authority that the facility has been designed in 
accordance with their regulations and requirements, and that emergency fire 
protection service will be provided to the facility. Prior to issuance of the certificate 
of occupancy, local fire protection jurisdiction review and approval will be 
required. 
 
d. 
The following PND Engineering comments: 
 
1. 
Without the submittal of a precise plan of development, no development 
approval is implied by this review, including, but not limited to drainage 
design, access and roadway alignments. These items will be addressed as 
development plans progress and are submitted to the County for further 
review and/or entitlement. 
 
2. 
Any development must ensure that historic drainage patterns are 
maintained at the up and downstream limits of development. 
 
3. 
A traffic impact study must be submitted with any future entitlement 
application (i.e. plan of development). 
 
4. 
Right-of-Way dedication to provide a half-width of 65-feet along 195th Ave 
and Thomas Road will be required as part of any future POD. 
 
5. 
All development and engineering design shall be in conformance with 
Section 1205 of the Maricopa County Zoning Ordinance; Drainage Policies 
and Standards; Floodplain Regulations for Maricopa County; MCDOT 
Roadway Design Manual; and current engineering policies, standards and 
best practices at the time of application for construction. 
 
e. 
The granting of this change in use of the property has been at the request of the 
applicant, with the consent of the landowner.  The granting of this approval allows 
the property to enjoy uses in excess of those permitted by the zoning existing on 
the date of application, subject to conditions.  In the event of the failure to comply 
with any condition, the property shall revert to the zoning that existed on the date 
of application.  It is, therefore, stipulated and agreed that either revocation due 
to the failure to comply with any conditions, does not reduce any rights that 
existed on the date of application to use, divide, sell or possess the property and 
that there would be no diminution in value of the property from the value it held 
on the date of application due to such revocation of the Zone Change.  The Zone 
Change enhances the value of the property above its value as of the date the 
Zone Change is granted and reverting to the prior zoning results in the same value 
of the property as if the Zone Change had never been granted. 
 
f. 
Noncompliance with any Maricopa County Regulation shall be grounds for 
initiating a revocation of this Zone Change as set forth in the Maricopa County 
Zoning Ordinance.

g. 
The property owner/s and their successors waive claim for diminution in value if 
the County takes action to rescind approval due to noncompliance with 
conditions.

A request for a Rezone from RU-43 to C-2 to allow 
Commercial uses 
Approximately 4.13 acres located at the northeast corner of Thomas Road and 195th Avenue 
Buckeye, Arizona
A. 
Property Location 
The subject property (the “Property”) is a 4.13-acre parcel located at the northeast corner of Thomas Road 
and 195th Avenue in unincorporated Maricopa County but is within the Town of Buckeye planning area. 
The Property is also identified as Maricopa County Assessor Parcel No. 502-68-001B.  See Exhibit 1 – 
Aerial Map.  The Property is approximately one mile north of the Interstate 10 and located at a major 
arterial intersection. See Exhibit 2 – Vicinity Map.  The Property is surrounded by a mixture of residentially 
zoned property within Maricopa County and the Town of Buckeye. See Exhibit 3 – Zoning Map. 
The Property is zoned RU-43 and is currently undeveloped land. The Property is located near the 
intersection of two major roadways (Thomas Road and 195th Avenue), which makes the Property well 
positioned for commercial uses. In addition, the current Buckeye General Plan Rural Land Use map 
designation allows C-1 commercial uses.   
B. 
Rezone Proposal 
This request is to rezone the Property from Rural 43 to C-2 to allow development of commercial uses and 
with the addition of a CUPD overlay. The CUPD overlay will be limited to those specific uses that have 
sufficient infrastructure (water and sewer) capacity, such as uses that can be served through a septic 
system. Large water/sewer uses must have the appropriate infrastructure to manage the capacity, as 
approved by the Maricopa County Environmental Services Department. 
The applicant proposes a commercial development at the intersection which makes sense given its 
frontage along two arterial roads and its proximity near the I-10 freeway. There is no plan of development 
proposed at this time; however, the development will be completed under the C-2 district standards. 
C. 
Relationship to Surrounding Properties 
The Property is ideally located for commercial uses that can serve residential neighborhoods located to the 
southwest and northwest of the site. Commercial uses along two major roadways (Thomas Road and 195th 
Avenue) will provide a prime location for these uses. Residential is not likely on these parcels with frontage 
onto these roadways. In addition, there is a church located to the north of the Property that is not a 
residential use.

Across Thomas Road, there is an undeveloped Property and to the west, across 195th Avenue is also an 
undeveloped Property. In addition, to the east of the Property is also an undeveloped parcel. These 
surrounding vacant parcels will not be negatively impacted by the proposed commercial uses.  We believe 
it is possible the development of this parcel may contribute to the revitalization of the surrounding parcels.  
D. 
Vision 2030 Comprehensive Plan Analysis 
The proposal is consistent with the goals and policies of the Maricopa County Vision 2030 Comprehensive 
Plan. 
Land Use Goal #1: Achieve balanced and efficient development patterns. 
The proposed project will place appropriate zoning district that has its frontage along two arterial roads 
and its proximity near the I-10 freeway. The commercial use will serve neighborhood and residential 
properties in the vicinity that currently do not have commercial options nearby. In addition, the Property 
has been undeveloped, and a new commercial development will help to balance the land uses in the area 
at this major roadway intersection. 
Land Use Policy #7: Maricopa County supports coordinating land use and infrastructure planning 
with state agencies, counties, and municipalities. 
The Applicant has met with the Town of Buckeye and will continue to coordinate infrastructure between 
Maricopa County and the Town of Buckeye as needed.  
Land Use Policy #17: Maricopa County supports balanced land use patterns that include various 
residential, retail, non-retail employment, and public and civic land uses. 
As stated above, the proposed commercial development of the Property is appropriate and 
complementary to the surrounding land use patterns and uses. The potential future commercial uses will 
provide retail and potential employment opportunities nearby which are compatible with residential uses. 
Transportation Policy #9: Maricopa County supports balanced and efficient land use patterns that 
reduce the number and length of vehicle trips. 
The easternmost parcel on the Property will provide employment opportunities and other commercial or 
service services to the local community, thus reducing the number and length of trips that residents in the 
area would travel for employment or services to areas further away. 
E. 
Accessibility and Circulation System (On and Off-Site) 
The proposed development will have two points of access for circulation per fire department requirements. 
Access will be provided on 195th Ave and/or Thomas Road.

Since the rezone is to commercial uses, facilities such as parks, schools or libraries are not needed.

Conclusion

As noted, this parcel has been in a holding pattern waiting to attract a future proposal.  The current 
RU-43 zoning was never intended to be the long-term use of the site, but was simply a holding pattern 
until market conditions reach this western area. The rezoning to C-2 is appropriate at the intersection of 
two major roadways and will help reinvigorate this area. In addition, commercial uses can help serve 
the adjacent residential as residents travel to and from Interstate 10. The proposed commercial uses will 
be a benefit to the vicinity.

Thomas Rd. & 195th Ave. Commercial  planning case(s). Please note the following MCESD 
requirements for site development: 
Subdivision and Infrastructure –  
An Approval to Construct application is required and must be submitted to MCESD’s Subdivision 
& Infrastructure Program for water, reclaimed water and/or wastewater system infrastructure. 
A will serve letter issued by the Utility is required and must be submitted to MCESD’s Subdivision 
& Infrastructure Program if the site/development will be provided with water and/or reclaimed 
water by a Utility.  A capacity assurance letter issued by the Utility is required to MCESD’s 
Subdivision & Infrastructure Program if the site/development wastewater service is being provided 
by a Utility. 
A will serve letter is required and must indicate approval from local municipality to discharge 
onsite wastewater to municipal sewerage system.

We’ve had a chance to consult with our City Engineer. Please add the following to the City’s comments on this case 
(Note #3 replaces the earlier comment #3, clarifying that the City will not provide sewer service to the site if developed 
in the County) 
 
3. Sewer will not be provided to the project if developed in the county, unless they annex and submit site 
plan/development docs through the city.   
4. City is annexing Jackrabbit Trail so any and all access needs to be processed through city including the TIA.  
5. Contribution to the Thomas Road signal will also be required.

1. The narrative does not indicate why they are choosing to proceed with rezoning in the county rather than 
annexation into Buckeye and rezoning in our jurisdiction. Unless there is an inability to annex due to statutory 
requirements (the City is not presently aware of any such inability), the City strongly recommends that the 
applicant annex into the City, rezone as needed, and developed in accordance with City design requirements.  
2. IF the applicant proceeds to rezone in the County in spite of the City’s objection, the City would request zoning 
be limited to C‐1 to ensure uses that develop are appropriate for the residential character of the area. Uses the 
City would not support on the site would be those that involve outdoor storage including vehicle parking (e.g. RV 
storage, etc.).

3. The narrative states that City will provide sewer service per a will serve letter. I did not see the letter attached to 
the submittal, and would request that letter be provided to confirm. It is not Buckeye’s general policy to provide 
services to properties developing in the County (though there are certain exceptions and perhaps this could be
