Project Summary: 
 
1. 
The applicant, Jay Irvin on behalf of Butler Design Group, is requesting a Military 
Compatibility Permit (MCP) with a Plan of Development (POD) to build an approximately 
2.3 million sq. ft speculative warehouse development on 138.4 acres located northeast 
of Luke Air Force Base (LAFB). The warehouse complex will consist of up to three buildings: 
buildings A&B on the northern half of the parcel, which depending on a potential tenant 
may be combined into one building totaling a little over 1.1 million sq. ft, and building C 
on the southern half of the parcel totaling 1.278 million sq. ft. These buildings will 
cumulatively have 485 trailer spaces and accesses to the site will be provided from both 
Northern Ave. and Litchfield Rd. No specific occupants have been identified for the 
complex at the time of this report, but the applicant believes the granting of the subject 
entitlement and subsequent building permits will be critical to attracting potential 
tenants. The applicant has indicated that depending on the tenant, they may wish to 
combine buildings A&B into one larger structure through infilling the space between 
those buildings. This would have to be accomplished through a separate UCCD/MCP 
application. 
 
2. 
The site is within the City of Glendale’s municipal planning area.  The Glendale General 
Plan designates the property as Luke Compatible, which is applied to lands surrounding 
LAFB. Similarly, the county’s area plan designates the general area for Military 
Compatible land uses. This designation coincides with the Military Airbase and Ancillary 
Military Facility Overlay Zoning District (MAAMF) delineated by the 1988 Air Installation 
Compatible Use Zone (AICUZ) 80, 75, and 70 LDN noise contours. A portion of the lot on 
the northwest corner is within the clear zone meant to prevent development that would 
encroach on LAFB’s runways. Projects located within the MAAMF must first obtain a Use 
Compatibility and Consistency Determination (UCCD) prior to being able to apply for a 
Military Compatibility Permit (MCP).  LAFB determined that this proposed warehouse use 
is consistent and compatible with the high noise or accident potential zone per 
UC2022011. 
 
3. 
The earliest available aerial photography of the site from 1949 indicates it as farmland 
directly bordering LAFB to the southwest. Beginning in or around 2007, the overall site 
began to be formally developed as a plant nursery with several dozen greenhouse 
structures being erected. Additionally, a separate parcel on the north of the site, 501-52-
003A, was developed with a cell tower which appears to remain in use and is not part of 
the subject entitlement. The applicant filed and was approved for a UCCD from LAFB, 
UC2022011, in April of 2022. The applicant applied for the subject MCP with POD in 
September of 2022. Staff held a Technical Advisory Committee meeting with the 
applicant on October 4, 2022.

The subject site is zoned IND-2 MAAMF & AD-2 MAAMF. The AD-2 portion of the site is the 
extreme southwest corner that does not impact development. It will only contain 
retention. The existing standards for the IND-2 MAAMF zoning district and proposed

The applicant is requesting to vary the maximum height of the structure from 40’ to 55’ to 
accommodate taller internal racking heights. This height will also allow for a parapet to 
screen any visibility from site rooftops to on-base operations at LAFB.

The applicant is also requesting to vary parking requirements from 1 per 900 sq. ft of floor 
area for warehouse uses to 0.4 spaces for every 1,000 sq. ft of floor area arguing that the 
site would otherwise be overparked with far more spaces than active employees if built 
to County warehouse standards. Staff would note that the required ADA spaces are 
based off the original number of required parking spaces per Ordinance standards and 
are not based upon the varied parking. 
 
7. 
Variances of the front/rear setbacks are required for the areas of the site that are LDN 
80-84, 75-79, and 70-74, as these contour lines functionally serve as distinct zoning district 
boundary lines (as each noise contour is subject to different development standards 
within the MAAMF overlay zoning district).  Development must meet setbacks, as 
approved as part of the MCP, from the IND-2 & AD-2 zoning district boundary line and 
from the noise contour MAAMF zoning district boundary lines.

As no new residential construction is allowed near LAFB within the MAAMF overlay and 
the site itself is not near any existing residential construction, only 6’ solid wall screening is 
required for any outdoor industrial uses as site activities will not otherwise disturb nearby 
residents.

City of Glendale General Plan (Revised: 2016): This plan identifies the subject parcel as a 
Luke Compatible Land Use Area.  Luke Air Force Base must issue a Use Consistency and 
Compatibility Determination (UCCD) prior to a use being allowed in this area. 
 
Public Participation Summary: 
 
14. 
The applicant has complied with the Maricopa County Citizen Review Process with the 
required posting of the site and notification by first class mail to adjacent property owners 
and HOA’s within 300’ of the subject parcel and notification to interested parties.  Two 
signs were posted on site in accordance with applicable regulations.  A Public 
Participation Results Report was submitted to Staff in accordance with County 
requirements.

Staff received no letters in support or opposition to the request. 
 
16. 
LAFB sent staff comments stating that the request will not negatively impact flying 
operations at the base. As part of both the UCCD and MCP applications, LAFB staff 
included several potential mission risks and hazards: 
 
a. Retention ponds or other features that would attract wildlife – Birds pose an aircraft 
strike hazard and are incompatible with flying operations.   
b. Light interference – Buildings or structures that would produce light interference at 
night and or glint/glare during the day that would distract or interfere with pilot 
vision. 
c. Spectrum utilization and radio frequency interference – Buildings or structures that 
would cause a loss of radar coverage such that it interferes with spectrum 
utilization. Additionally, to avoid radio frequency interference, developers and or 
end users should not use radio equipment that would interfere with Luke’s 
frequency or operate on a military frequency. 
d. Displaced water resulting in flooding – Development that would displace water or 
storm runoff in such a manner that it overflows onto the base, particularly areas 
near our runway. Besides direct effect of flooding, it also creates an opportunity 
for the pooling of water, which could attract birds near our runway. 
e. Physical encroachment – Personnel standing on the top of the buildings could 
potentially surveille base activities. Cameras placed on top of building structures 
present a potential danger to military operations. When the time comes, Luke 
Security Forces personnel can provide a list of National Defense Authorization Act 
(NDAA) compliant security/surveillance equipment that would work best for our 
operations. 
f. Impairment of pilot’s visibility – Any production that would release substances into 
the air that would impair visibility or otherwise interfere with operating aircraft such 
as: steam, dust or smoke. These items create a negative impact and should be 
eliminated. 
 
17. 
Planning and Engineering staff have worked with the applicant on mitigating these issues 
in the design phase to mollify LAFB’s concerns. Such mitigations include parapets along 
the roofs of each warehouse structure to limit base observation, the usage of access 
codes to access the site instead of radios, orienting any potential illuminated signs away 
from the base, light mitigation to prevent light encroachment beyond parcel lines, and

drainage design that would limit fowl and other animals from becoming potential strike 
hazards for incoming and outgoing air traffic. 
 
 
Outstanding Concerns from Reviewing Agencies: 
 
18. 
Staff still has concerns regarding some aspects of the site design and narrative and is 
working with the applicant on addressing these concerns. To that end, staff is requesting 
to allow the applicant to submit a final site plan and narrative within thirty days of 
calendar approval by the Board of Supervisors. It must be noted that these changes are 
minor and will not affect the site layout or building design. 
 
Staff Analysis: 
 
19. 
Staff believes that the proposed industrial warehouse use is appropriate for the site. LAFB 
found that the proposed land use consistent and compatible with the High Noise and 
Accident Potential Zone of the base, and that the proposal would not negatively impact 
flying operations. As such, Maricopa County can make a similar determination of 
compatibility and consistency. Several industrial developments in both Maricopa County 
and Glendale jurisdictions have been constructed in recent years in the vicinity of LAFB 
that have had little to no impact on base operations or the remaining nearby residences 
and have otherwise provided thousands of jobs in the west Valley. 
 
Recommendation: 
 
20. 
Staff recommends the Commission adopt a motion recommending that the Board of 
Supervisors approve MCP2022007 subject to the following conditions ‘a’ – ‘m’: 
 
a. 
Development of the site shall be in substantial conformance with the Site Plan 
entitled “Luke Field”, consisting of 1 full-size sheet, dated 10/10/22, except as 
modified by the following conditions. Staff may determine slight refinements to 
remain in substantial conformance with the approved site plan.  Minor and major 
amendments to the site plan will be determined in accordance with Chapter 3 of 
the Maricopa County Zoning Ordinance. 
 
b. 
Development of the site shall be in substantial conformance with the Narrative 
Report entitled “Luke Field Project Narrative”, consisting of 3 pages, received 
11/10/22 except as modified by the following conditions. 
 
c. 
Major amendments to the site plan will require a new UCCD and MCP application 
to be filed prior to any permit approvals. The incorporation of any other parcels 
into this project will require a lot combination, new UCCD, and new MCP prior to 
any additional permit approvals. 
 
d. 
No permits can be approved until a lot combination of APN 501-52-005J and APN 
501-52-005H is complete.  
 
e. 
A revised site plan addressing all outstanding Planning concerns shall be submitted 
within 30 calendar days of approval of the Maricopa County Board of Supervisors.

f. 
The following Military Airport and Ancillary Military Facility Overlay Zoning District 
standards shall apply:  
 
i. Max. Building Height: 55’ 
ii. Parking spaces required: 0.4 per 1,000 square feet of floor area for 
warehouse. Accessible spaces shall be provided in accordance with 
ordinance and ADA requirements. 
iii. Front/Rear Setback between LDN 80-84 to LDN 75-79(minimum): 0’/0’

The following Planning Engineering condition(s) shall apply:  
 
i. Engineering review of planning and/or zoning cases is for conceptual 
design only. All development and engineering design shall be in 
conformance with Section 1205 of the Maricopa County Zoning 
Ordinance; Drainage Policies and Standards; Floodplain Regulations for 
Maricopa County; MCDOT Roadway Design Manual; and current 
engineering policies, standards and best practices at the time of 
application for construction. 
ii. Based on the conceptual design nature of the information submitted, 
changes to the site layout may be necessitated by the final engineering 
design of the site’s drainage infrastructure. 
iii. Detailed Grading and Drainage (Site Infrastructure) Plans must be 
submitted with the application for Building Permits 
iv. MCDOT ROW permits to be obtained during building permit phase. 
v. Upon TIS approval from the City of Glendale (COG) and Luke Air Force Base 
(LAFB), provide a copy of the authorization to MCDOT. 
vi. It is the developer’s responsibility to ensure annexation and right of way 
dedication to COG on Litchfield Road. 
vii. The future classification of Northern Avenue along the site frontage is 
recorded as Principal Arterial. MCDOT reduced the classification upon the 
first TIS review to the Urban Minor Arterial with no sidewalk. Half-street 
improvements shall be as per RDM Figure 5.9 
 
h. 
The following Maricopa County Environmental Services Department (MCESD) 
condition(s) shall apply:  
 
i. ATC for water and sewer improvements must be obtained prior to 
construction permit approval. 
 
i. 
Prior to issuance of a building permit, written confirmation will be required from the 
emergency fire protection jurisdiction having authority that the facility has been 
designed in accordance with their regulations and requirements, and that 
emergency fire protection service will be provided to the facility. Prior to issuance 
of the certificate of occupancy, local fire protection jurisdiction review and 
approval will be required.

j. 
Noncompliance with any Maricopa County Regulation shall be grounds for 
initiating a revocation of this Military Compatibility Permit as set forth in the 
Maricopa County Zoning Ordinance.  
 
k. 
All new buildings are subject to noise attenuation as per ARS § 28-8482(B).  
 
l. 
The property owner/s and their successors waive claim for diminution in value if 
the County takes action to rescind approval due to noncompliance with 
conditions.  
 
m. 
The granting of this change in use of the property has been at the request of the 
applicant, with the consent of the landowner.  The granting of this approval allows 
the property to enjoy uses in excess of those permitted by the zoning existing on 
the date of application, subject to conditions.  In the event of the failure to comply 
with any condition, the property shall revert to the zoning that existed on the date 
of application.  It is, therefore, stipulated and agreed that either revocation due 
to the failure to comply with any conditions, does not reduce any rights that 
existed on the date of application to use, divide, sell or possess the property and 
that there would be no diminution in value of the property from the value it held 
on the date of application due to such revocation of the MCP.  The MCP 
enhances the value of the property above its value as of the date the MCP is 
granted and reverting to the prior zoning results in the same value of the property

Purpose of Request: 
Obtain site plan approval and zoning variance approval in order to allow the submission of construction 
documents for permit review and approval. 
 
Description of Proposal: 
Luke Field is a three-building speculative development constructed in a single phase, consisting of approximately 
2,280,000 total s.f. of industrial warehouse / distribution, planned on a 137.6-acre site at the SWC of N. 
Litchfield Road and W. Northern Avenue.  Building A, which is 604,000 s.f. and Building B, which is 416,000 s.f., 
will be approximately 1,079,000 s.f. if combined. These two buildings are designed with the ability to be 
combined into one larger building in the future for market flexibility. Building C will be 1,260,000 s.f. All three 
buildings are cold dark gray shell spec. industrial buildings. Buildings A and B are designed with the ability to 
combine them into one larger building for the potential to attract larger national tenants. No specific tenant has 
been identified at this point but developing the design and obtaining entitlement and permits is critical to 
marketing the project.  All three buildings will have 40-feet clear heights with approximate buildings heights (top 
of parapets) at approximately 55-feet. 
 
The three industrial buildings are speculative in nature and hours of operation, number of employees and 
specific warehousing use will be determined once a tenant occupies the building.

Relationship to Surrounding Properties: 
The Luke Field industrial development is located at the SEC of Litchfield Road and Northern Avenue.  The Loop 
303 corridor has seen tremendous industrial development within the last 10 years along the Loop 303 corridor 
and explosive growth within the last five years.  These industrial / warehouse developments support local job 
growth, tax revenue and provide economic engines for both the greater Phoenix area and Arizona in general.  
Arizona is a top five destination nationally for industrial development.  Our neighbor to the East is Luke Air Force 
Base and to the West is a similar size industrial development by Clarion Partners.  To the North is a property 
owned by the City of Phoenix and to the South is housing for Luke Air Force Base.  This development is 
consistent in nature with surrounding growth and developments. 
 
Location, Accessibility and Site Circulation: 
Access to the project site will be from both Litchfield Road and Northern Avenue.  The project will have three 
main access points along Northern Avenue which will serve as the access points for trucks for Buildings A and B.   
Litchfield Road will have multiple access points for all three buildings.  The multiple access points along Litchfield 
Road are intended to separate car and truck traffic for safety purposes.  All access points along Litchfield Road 
and Northern Avenue are accessible to the fire department for fire access.  Two of the access points along 
Litchfield Road are designed to have a potential future guard house to create a secured yard and should be 
entitled with flexibility, dependent on specific future tenant needs. For all three buildings, a single row of trailer 
storage will be provided on the North and South sides of the dock areas of each building to create cross dock 
buildings with trailer storage on both sides each building. There are also potential future trailer storage areas 
located on the North side of buildings A and B and on the South side of building C. 
 
There is ample queuing for semi-trucks that is provided along with any required screen walls facing public right-
of-way’s and at other dock / trailer areas. Screen walls will be used along the perimeter of all dock areas for both 
security and screening.  All buildings will have a fire lane that encompasses the entire perimeter of all buildings, 
which will provide code required access and clearances for the fire department.  On-site storm water retention 
will be provided along the edges of the property in designated retention basins. 
 
Development Schedule: 
We are anticipating the start of construction in early Q1 of 2023 with an approximate construction schedule of 
14 months.  Construction is anticipated to be completed in Q2 of 2024.  All three buildings will be built in one 
single phase, no phasing is anticipated for this project based on current market conditions. 
 
Community Facilities and Services: 
There will be no community facilities provided for the public with-in the Luke Field industrial/warehouse 
development. 
 
Public Utilities and Services: 
Sewer service will be provided by Liberty.  LPC and our neighboring industrial development to the East, by 
Clarion Partners are working jointly to extend sewer to both industrial developments.  LPC and Clarion Partners 
are also working jointly with Valley Utilities to extend domestic water to both industrial developments.  Both 
developers have already started the sewer and water extension service agreements with both Liberty and 
Valley.  Rural Metro will be the servicing fire department for our development.  Refuse service will be by a 
private third-party vendor. 
 
Elevation Design: 
The design of the building elevations will provide flexibility to create primary tenant entries at either of the 
building corners facing Litchfield Road.  The prominent entries at the buildings will feature 24’ tall low ‘e’ glazing 
with a clean and simple steel canopy, using accent tilt panels at each entry which tie into a theme to create 
cohesiveness amongst all the buildings.  The higher volume of glass can adequately accommodate a second level

of office at the entry should a tenant desire. The perimeter of the warehouse will have clerestory windows along 
the perimeter which provide both natural light into the warehouse and an aesthetic and modern appeal to any 
potential user. A mix of cool grey color tones, along with a series of reveals and punched openings, will further 
break down the mass of the concrete tilt-up concrete, currently scheduled to be a 40’ clear height based on 
tenant-driven market standards.  Optional tenant entries may be added to the East corners of the buildings if 
future tenant leasing dictates.  All buildings will have a cohesive and aesthetically pleasing architectural design 
which provide an attractive visual along Northern Avenue, Litchfield Road and Northern Parkway.

building height will also allow us to screen the view from a maintenance worker standing on top of the 
roof.  The 55’-0” parapet height will screen any visibility from our roof top.  See the attached sight line

Justification:  Building appurtenances are not specifically identified for IND-2 zoning.  We are requesting 
building appurtenances for IND-2 be identified as silos, cooling towers, or similar

Article 1102.1.5 – Industrial, Wholesale and Manufacturing Uses: 
Required Parking 
One per 600 square feet of floor area, with 5% of parking spaces to be ADA 
accessible. 
Proposed Parking 
0.4 spaces for every 1,000 s.f. of space. and 2% of parking spaces to be ADA to 
match the 2010 ADA Standards for Accessible Design. 
 
Justification:  Current industrial developments are larger in size due to the requirement of more 
warehouse racking/storage space.  The size of the building does not have a direct correlation to parking 
space requirements.  Current e-commerce buildings will have a typical workforce of approximately 600 – 
800 employees.  This workforce is typically based up 2-3 *-hour shifts.  The average workforce is 0.5 
parking spaces per every 1,000 s.f. of warehouse space.  Our current site plan supports this 
development.  An “alternative” parking plan is being provided to show in the event additional parking is 
required on site beyond what we are providing, it can be accommodated.

Engineering Review has reviewed the second plan (Revised plans via email sent 
12.7.2022) and report routed for review on 12/7/2022, for the subject application and 
has no objections provided that any approvals include the following 
stipulations: 
 
The following general stipulations will apply: 
 
1. Engineering review of planning and/or zoning cases is for conceptual design 
only. All development and engineering design shall be in conformance with 
Section 1205 of the Maricopa County Zoning Ordinance; Drainage Policies and 
Standards; Floodplain Regulations for Maricopa County; MCDOT Roadway 
Design Manual; and current engineering policies, standards and best practices 
at the time of application for construction. 
 
2. Based on the conceptual design nature of the information submitted, changes 
to the site layout may be necessitated by the final engineering design of the 
site’s drainage infrastructure. 
 
3. Detailed Grading and Drainage (Site Infrastructure) Plans must be submitted 
with the application for Building Permits  
 
4. MCDOT ROW permits to be obtained during building permit phase.

facilities around SR 303, to be on conservative side, MCDOT requires the developer to use ITE land code 
130 (Industrial Park) for estimating the trip generation for the proposed development. Please
revise the TIS accordingly and resubmit.
The scope of study has been approved by Glendale. The building is designed as Warehouse and 
doesn't meet the description for Industrial Park, since there will be only one user for each building. If 
the analysis was updated, the recommendations for Northern Avenue would not be affected. 
MCDOT only has jurisdiction for Northern Avenue as part of the study area for the TIA. Northern 
Avenue will end at the east end of the site and will not connect to the east in the future. Therefore, 
the only improvements inlcude the half-street improvements and right-turn deceleration lanes at 
the site driveways. Increasing the land use or background growth rate will not affect the 
improvements for Northern Avenue.

Proposed access points on Northern Ave (A, B, C, and D) are conceptually acceptable to MCDOT. However, 
final determination will be made after the revised study is submitted to MCDOT addressing the comments 
in the current 1st review.

in future calculations.
The scope of study has been approved by Glendale. MCDOT only has jurisdiction over Northern

development. Northern Avenue will end at the east end of the site and will not connect to the east in 
the future. Therefore, the only improvements relevant to MCDOT inlcude the half-street

Include traffic signal warrant, turn lane, LOS, and Queuing analysis at all proposed site driveways on 
Northern Ave, this shall be to the standards in the MCDOT Roadway Design Manual (RDM).
LOS, turn lane, and queung analysis are already included in the report for the proposed site 
driveways on Northern Avenue. Signal warrant analyses are not necessary, since the ADT on 
Northern Avenue is only 1,192 vpd and the peak hour traffic existing the driveways is far below the 
thresholds. Northern Avenue ends at the east end of the site and will not continue east in the future.

Provide right-turn deceleration lanes on Northern Ave at all site driveways,
including Driveway A.
Right-turn deceleration lanes were recommended at the truck driveways on Northern Avenue. 
Northern Avenue will end at east end of the site and not continue east in the future. MCDOT's right-
turn criteria in the MCDOT Roadway Design Manual are not met for the installation of a right-turn 
deceleration lane at Driveway A. Driveway A will serve vehicle traffic only with a peak right-turn 
volume of 30 vph during the AM peak hour. However, less than 1,000 vpd are expected to use the 
driveway and less than 5,000 vpd are expected on Northern Avenue.

005-J, 501-52-003-A, 501-52-005-H).  The site proposes nine (9) driveways: 
five (5) new driveways on Litchfield Rd and four (4) full access driveways on 
Northern Ave.   
 
Per the TIS, the trip generation is based on the ITE LUC code 150 – 
Warehousing with 2,321,420 SF building area.  The proposed site is 
estimated to generate 3,970 total daily trips with 395 AM peak hour trips and 
417 PM peak hour trips.  
 
General Comments: 
  
As Litchfield Road is under the City of Glendale’s (COG) jurisdiction, submit 
TIS to COG for review and approval.   
 
Due to the proximity of Luke Air Force Base (LAFB), submit TIS to LAFB for 
review and approval. 
 
Following each agency approval, provide a copy of the authorization to 
MCDOT.  The review comments below are limited to roadways in the project 
vicinity under Maricopa County jurisdiction.

Considering the proposed industrial land use, large size development, and 
upcoming heavy industrial facilities around SR 303, to be on conservative

Proposed access points on Northern Ave (A, B, C, and D) are conceptually 
acceptable to MCDOT.  However, final determination will be made after the 
revised study is submitted to MCDOT addressing the comments in the current 
1st review. 
 
Due to the increasingly high development climate, MCDOT requires a 
minimum growth rate of 5% be used in future calculations.   
 
Include traffic signal warrant, turn lane, LOS, and Queuing analysis at all 
proposed site driveways on Northern Ave, this shall be to the standards in the 
MCDOT Roadway Design Manual (RDM). 
 
Provide right-turn deceleration lanes on Northern Ave at all site driveways, 
including Driveway A.   
 
Include and discuss sight distance at all proposed driveways in revised TIS, 
RDM 9.2.1. 
 
Half-street improvements along the site frontage of Northern Ave shall be to 
the Urban Minor Arterial section (RDM figure 5.9), w/o sidewalk.  
 
As part of half-street improvements, dedicate 55’ ROW to MCDOT along the

The Maricopa County Environmental Services Department (MCESD) has reviewed 
documents received from the Maricopa County Planning and Development 
Department for the above referenced project. This project is a commercial site plan 
review at APN # 501-52-005H. Water and sewer will be provided by Valley Utilities 
for water/ Liberty Utilities for sewer. MCESD has concerns, ATC for water and sewer 
improvements must be obtained prior to construction permit approval. 
 
Based on the above, MCESD raised no objection to this project to the Planning & 
Development Department in Accela Automation on September 9, 2022, 2022 and the 
project may proceed at this time subject to the following stipulations:

It should be noted that this document does not approve the referenced project.  
Comments are provided only as advisory to Maricopa County Planning and 
Development Department to assist staff to prepare a staff report.  Other Maricopa

Dear Mr. Landis 
Thank you for the opportunity to provide comments on the Military Compatibility Permit 
Application for the Luke Field Commercial Warehouse Complex Development.  The proposed project 
will consist of three speculative light industrial buildings with a completed height of approximately 56 
feet.  The 137-acre site is located at the southeast corner of Litchfield Rd and Northern Ave in 
unincorporated Maricopa County, AZ.  The parcel is located inside the Luke AFB 1988 JLUS 80, 75 and 
70 DNL “high noise or accident potential zone” as identified by A.R.S. §28-8461.  Additionally, there 
are 7.33 acres of the northwest corner that are located inside the LAFB Clear Zone and Accident 
Potential Zone 1, also identified by A.R.S. §28-8461.   
While we recognize that Arizona law may not have restrictions in line with our concerns in this 
particular area of development, we continually appreciate the opportunity to provide comments, 
acknowledging that we are not the approval authority.  Given the location of this development project, we 
have identified actual and/or potential mission risks and hazards should development encompass the 
following:   
a.
Retention ponds or other features that would attract wildlife – Birds pose an aircraft strike hazard 
and are incompatible with flying operations.
b.
Light interference – Buildings or structures that would produce light interference at night and or 
glint/glare during the day that would distract or interfere with pilot vision.
c.
Spectrum utilization and radio frequency interference – Buildings or structures that would cause a 
loss of RADAR coverage such that it interferes with spectrum utilization.  The area in which this 
development is proposed must contain an airspace analysis to ensure any buildings do not 
interfere with Luke's radar.  Additionally, to avoid radio frequency interference, developers and or 
end users should not use radio equipment that would interfere with Luke’s frequency or operate 
on a military frequency.
d.
Physical Encroachment – Personnel standing on the top of the buildings could potentially 
surveille base activities.  Cameras placed on top of building structures present a potential danger 
to military operations.  When the time comes, Luke Security Forces personnel can provide a list

of National Defense Authorization Act (NDAA) compliant security/surveillance equipment that 
would work best for our operations. 
e.
Impairment of pilot’s visibility – Any production that would release substances into the air that
would impair visibility or otherwise interfere with operating aircraft such as:  steam, dust or
smoke.  These items create a negative impact and should be eliminated.
f.
Foreign persons involvement – given the location and sensitive nature of Luke’s mission, we ask
that if the development involves transactions involving foreign investment or the leasing to
foreign persons, that Luke AFB be notified immediately in order to determine the effect of such
transactions on the national security of the United States.
There are perpetual and assignable easements purchased by the United States for the benefit of
Luke AFB located on the 7.33 acres of the northeast corner that Luke AFB must enforce (attached).  
Along with other language, the easement and rights granted consist of prohibiting future construction of 
buildings, structures or materials that infringe upon, extend into or above the Approach and/or 
Transitional Surface.  In short, the areas stated in each easement need to remain undeveloped so to protect 
the airfield surface areas of Luke AFB.  Based on the current conceptual site plan (attached), it is evident 
that the developer has eliminated all above grade development inside the clearance easement, “no build” 
area.    
Luke AFB follows A.R.S. § 28-8481 when evaluating compatible land use within the “territory in 
the vicinity of a military airport.  Subject to the results of an FAA Obstruction Evaluation/Airport 
Airspace Analysis (OE/AAA), this request, as described in the narrative, will not negatively impact the 
flying and base operations at Luke AFB.   
Since the development will be located within the “territory in the vicinity of a military airport,” it 
will be subjected to approximately 165 over flights a day.  In addition, a strong notification program on 
the part of the applicant is essential to inform potential occupants about Luke AFB operations.  We also 
recommend that the developer and/or future occupants be made aware that the proposed development is 
underneath Luke AFB’s flight traffic pattern, specifically low-level flights; therefore, there is an increased 
risk of accidents in that area as well as fuel dumping or jettison of external aircraft tanks.
