Project Summary: 
 
1. 
This application modification of the conditions of previous R-5 RUPD zoning approval. 
Case Z2021067 was approved by the Board on December 8, 2021 rezoning the parcel 
from Rural-43 to R-5 RUPD to accommodate multi-family residential development.  The R-
5 RUPD zoning is subject to conditions ‘a’ to ‘k’. This request is to modify condition ‘f’ which 
requires the abandonment of federal patent easements on the parcel prior to the 
issuance of building permits. Proposed language provides greater flexibility. 
 
Condition ‘f’ was originally stipulated as follows:

The existing Federal Patent Easements and west roadway easement (MCR# 2020-
708344) on the site shall be abandoned prior to submission of any building permits. 
 
This application proposes the following update to condition ‘f’:

The existing Federal Patent Easements and west roadway easement (MCR# 2020-
708344) on the site shall be abandoned prior to submission of any building permits. 
The proposed development is located in a Federal Patent Easement Area. 
Applicant will be required to go through Federal Patent Easement Abandonment 
Process prior to building permit approval. No encroachments allowed within the 
patent easements unless abandoned or otherwise approved by MCDOT Planning. 
 
This change in conditions does not alleviate the requirement to abandon the federal 
patent easements on the parcel. The applicant recognizes the need to follow the 
county’s federal patent easement abandonment process and is actively progressing 
through the required steps. This modification of condition is being requested due to the 
slow-moving nature of the federal patent easement removal process combined with 
scheduling issues, it has created an unfortunate scenario in which the easements will not 
be abandoned until sometime in mid-2023. The change in verbiage of condition ‘f’ will 
allow the applicant to obtain MCODT approval to enter level and grade the areas within 
the federal patent easement to the specifications in the grading and drainage plan that 
was approved with case Z2021067, prior to the finalization of the federal patent 
easement removal case approval. The applicant has already recorded new private 
easement for the neighboring landowner to access. The applicant has obtained 
abandonment support from the City of Peoria and APS regarding utilities on and though 
the parcel. All other previous conditions of approval will not be modified via this 
application.

White Tank/Grand Ave. Area Plan (adopted December 6, 2000): The area plan is a way 
to encourage planned community developments while preserving a variety of lifestyles 
and a high quality of life. The subject site is designated as Small Lot Residential (2 – 5 
du/ac), which identifies areas where increased residential density development is 
appropriate and urban services are available.

Plan Peoria 2040 General Plan: The Peoria General Plan designates the site as 
Park/Open denotes areas best suited for open space and recreation. 
 
Public Participation Summary:

The applicant sent out public notices to all property owners within 300’ of the subject 
property. The applicant also erected 2 notification signs on the subject parcel as well as 
an additional sign that was erected on a neighboring parcel that will be used as a future 
entrance to the subject parcel. There was no public or municipal response to any of the 
completed outreach efforts.

Staff Analysis:

This request to allow grading in the federal patent easements within the site prior to 
abandonment of the federal patent easement does not create any adverse conditions 
for neighboring landowners, the site itself or any of the other approved conditions of the 
R-5 RUPD zoning. The applicant has already created a new easement along the eastern 
boundary for neighboring access. Staff finds the application to be an attempt to resolve 
a self-created situation. As any grading within the federal patent easement will still need 
MCDOT approval, staff does not find any adverse issues with the request.

Recommendation: 
 
10. 
Staff recommends the Commission adopt a motion recommending that the Board of 
Supervisors approve Z2022188 subject to the following conditions ‘a’ – ‘k’: 
 
a. 
Development of the site shall be in substantial conformance with the Site 
Plan entitled “Villages at Pleasant River”, consisting of five full-size sheets, 
dated September 27, 2021, and stamped received September 30, 2021, 
except as modified by the following conditions. 
 
b. 
Development of the site shall be in substantial conformance with the 
Narrative Report entitled “Villages at Pleasant River”, consisting of ten 
pages, dated September 10, 2021, and stamped received September 13, 
2021, except as modified by the following conditions. 
 
c. 
The following Planning Engineering conditions shall apply: 
 
1. 
Engineering review of planning and/or zoning cases is for 
conceptual design only. All development and engineering design 
shall be in conformance with Section 1205 of the Maricopa County 
Zoning Ordinance; Drainage Policies and Standards; Floodplain 
Regulations for Maricopa County; MCDOT Roadway Design Manual; 
and current engineering policies, standards and best practices at 
the time of application for construction. 
 
2. 
Based on the conceptual design nature of the information 
submitted, changes to the site layout and/or a reduction in the 
number of building lots may be necessitated by the final engineering 
design of the drainage infrastructure. 
 
3.  
Detailed Grading and Drainage (Infrastructure) Plans with a Final 
Drainage Report must be submitted with the application for 
Building Permits. 
 
d. 
The access easement inside of the roadway easement along the east 
boundary of the site shall be surfaced with decomposed granite from the 
paved driveway to the north to the site’s southern boundary to minimize 
dust pollution. 
 
e. 
The existing five parcels of the site shall be combined into one parcel prior 
to submission of any building permits. 
 
f. 
The proposed development is located in a Federal Patent Easement Area.

A Plan of Development is approved subject to site plan entitled “Villages 
at Pleasant Village” consisting of five full-size sheets, dated September 27, 
2021, and stamped received September 30, 2021. The Plan of 
Development may be amended administratively under separate 
application as long as the amendment complies with the established 
RUPD development standards as approved by the Board of Supervisors. 
 
i. 
Noncompliance with any Maricopa County Regulation shall be grounds 
for initiating a revocation of this zone change as set forth in the Maricopa 
County Zoning Ordinance. 
 
j. 
The property owner/s and their successors waive claim for diminution in 
value if the County takes action to rescind approval due to 
noncompliance with conditions. 
 
k. 
The granting of this change in use of the property has been at the request 
of the applicant, with the consent of the landowner. The granting of this 
approval allows the property to enjoy uses in excess of those permitted 
by the zoning existing on the date of application, subject to conditions. 
In the event of the failure to comply with any condition, the property shall 
revert to the zoning that existed on the date of application. It is, therefore, 
stipulated and agreed that either revocation due to the failure to comply 
with any conditions, does not reduce any rights that existed on the date 
of application to use, divide, sell or possess the property and that there 
would be no diminution in value of the property from the value it held on 
the date of application due to such revocation of the Zone Change. The 
Zone Change enhances the value of the property above its value as of 
the date the Zone Change is granted and reverting to the prior zoning 
results in the same value of the property as if the Zone Change had never 
been granted.

On behalf of The Village at Pleasant River, LLC (“EMC”), who is the developer of the 
property located east of the southeast corner of 115th Avenue and Happy Valley Parkway 
(“Site”), we request a Zone Change Modification of Conditions on one stipulation from 
Z2021067 to facilitate the development of a multi-family community on this vacant site. 
 
The 24.69-acre Site is a proposed residential community known as Village at Pleasant 
River. Per the Board of Supervisors Zone Change Approval Letter dated December 8, 2021, the 
Village at Pleasant River was rezoned to R-5 RUPD, subject to Stipulations a-k. See Exhibit 1, 
Zone Change with Overlay Approval Letter dated December 8, 2021. EMC is requesting 
modification of Stipulation “f”. Specifically, EMC requests the following modification: 
f. The existing Federal Patent Easements and west roadway easement (MCR# 2020-708344) 
on the site shall be abandoned prior to submission of any building permits. The proposed 
development is located in a Federal Patent Easement Area. Applicant will be required to 
go through Federal Patent Easement Abandonment Process prior to building permit 
approval. No encroachments allowed within the patent easements unless abandoned or 
otherwise approved by MCDOT Planning.   
 
The pending patent easement abandonment is being processed under case number PAB-
01211. See Exhibit 2, Patent Easement Abandonment Applications. The pending patent 
easement abandonment currently has no Agency objections and would have likely been 
scheduled for October and December (2022) public hearings for abandonment; however, due to 
scheduling issues, the pending patent easement abandonments are unlikely to go to public 
hearings until January and March (2023), which will cause further construction delays.   
 
The easements to be abandoned are within the development boundary. Generally, they 
border the Site on the east, south, and west boundaries and also run through the Site. The Site is 
primarily bordered by vacant land. See Exhibit 3 for Patent Easement Locations. The 
easements are currently in place to provide access to neighboring properties. However, a 
replacement easement was recently conveyed and recorded that provides access to the 
neighboring properties. Further, access will not be negatively impacted by grading within the 
easement areas, rather Empire will improve these access areas with flatter grades.  The existing 
topography makes it nearly impossible for a vehicle to traverse and travel through the easement 
areas.      
 
Empire has worked with the City of Peoria and APS regarding their original objections to 
the patent easement abandonments and has obtained their support for the abandonments.  The 
Happy Valley access drive construction plans are currently in the final review stages with the 
City of Peoria (Peoria Project Ref No R220001). In addition, Empire is currently in the 
preliminary design stage with APS to provide electrical service to the entire property (APS job 
reference number is WA669238). 
 
Village at Pleasant River is an appropriate and already approved residential use for the 
Site that will provide much needed housing opportunities for families, working professionals, 
retirees, and more. The requested modification will facilitate the timely development of this 
community.

the Site Plan entitled “Villages at Pleasant River”, consisting of five 
full-size sheets, dated September 27, 2021, and stamped 
received September 30, 2021, except as modified by the 
following conditions.

Development of the site shall be in substantial conformance with 
the Narrative Report entitled “Villages at Pleasant River”, 
consisting of ten pages, dated September 10, 2021, and 
stamped received September 13, 2021, except as modified by 
the following conditions.

The following Planning Engineering conditions shall apply:

Engineering review of planning and/or zoning cases is for 
conceptual

east boundary of the site shall be surfaced with decomposed 
granite from the paved driveway to the north to the site’s 
southern boundary to minimize dust pollution.

The existing five parcels of the site shall be combined into one 
parcel prior to submission of any building permits.

The existing Federal Patent Easements and west roadway

prior to submission of any building permits.

The following R-5 RUPD development standards shall apply:

30, 2021. The Plan of Development may be amended 
administratively under separate application as long as the 
amendment complies with the established RUPD development 
standards as approved by the Board of Supervisors.

Noncompliance with any Maricopa County Regulation shall be 
grounds for initiating a revocation of this zone change as set forth 
in the Maricopa County Zoning Ordinance.  
 
j. 
The property owner/s and their successors waive claim for 
diminution in value if the County takes action to rescind approval 
due to noncompliance with conditions.  
 
k. 
The granting of this change in use of the property has been at 
the request of the applicant, with the consent of the landowner.  
The granting of this approval allows the property to enjoy uses in 
excess of those permitted by the zoning existing on the date of 
application, subject to conditions.  In the event of the failure to

comply with any condition, the property shall revert to the zoning 
that existed on the date of application.  It is, therefore, stipulated 
and agreed that either revocation due to the failure to comply 
with any conditions, does not reduce any rights that existed on 
the date of application to use, divide, sell or possess the property 
and that there would be no diminution in value of the property 
from the value it held on the date of application due to such 
revocation of the Zone Change.  The Zone Change enhances 
the value of the property above its value as of the date the Zone 
Change is granted and reverting to the prior zoning results in the 
same value of the property as if the Zone Change had never 
been granted.

To Whom It May Concern: 
We are the owner of parcels 201-21-049B and 201-21-057 as shown on the attached exhibit.  We are in 
the process of combining these two parcels into one and have submitted a lot combination for 
recordation and assignment of a new overall parcel number for the entire acreage that we now own.  
We are resubmitting two Patent Abandonment Applications for PAB-0171 and PAB-0211.  We had 
previously received Initial Determination feedback on each of these parcels; therefore, we are hoping 
that resubmitting under the original numbers will help to avoid confusion for the outside agencies who 
will again be reviewing this abandonment request. 
Our entire property is approved for zoning that allows us to build a gated multi-family residential 
development (draft site plan attached for reference).  As is typical in any gated community, the interior 
streets will be private.  Therefore, cut-through traffic from outside of the community cannot be 
accommodated.  Primary access to our property will come from the west and 115th Avenue through the 
future QuikTrip site within a public easement they have dedicated.  We have worked closely with the 
City of Peoria to obtain a secondary point of access near the NEC of our site for connection to Happy 
Valley Road.  We have included the landscape and street light plans which Peoria has approved along 
with the latest version of the civil engineering plans which are close to City approval. 
Prior coordination with your office through the Initial Determination processes included a proposed 
dedication of an access and utility easement along our eastern boundary.  This easement would have 
provided continuous connection for Parcel 201-21-057 to the arterial road.  Dedication of this easement 
for access and public utilities would have satisfied the original objections from both the City of Peoria 
and APS.  Now that we own Parcel 201-21-057 and have incorporated it into our site plan, it is our 
understanding that a public access and utility dedication will no longer be necessary.  However, please 
note that we will not be able to extend our site planning area east into the location where the public 
access was proposed for dedication due to constraints created by the adjacent river, wash, floodway, 
and required erosion hazard setbacks together with significant topography and shear drop offs into 
these waterways.  The eastern developed boundary/wall of our gated community will remain as 
originally proposed.

The Maricopa County Environmental Services Department (MCESD) has completed review for the  
Villages at Pleasant River planning case(s). Please note the following MCESD requirements for site 
development: 
Subdivision and Infrastructure –  
An Approval to Construct application is required and must be submitted to MCESD’s Subdivision 
& Infrastructure Program for water, reclaimed water and/or wastewater system infrastructure. 
 
A will serve letter issued by the Utility is required and must be submitted to MCESD’s Subdivision 
& Infrastructure Program if the site/development will be provided with water and/or reclaimed 
water by a Utility.  A capacity assurance letter issued by the Utility is required to MCESD’s 
Subdivision & Infrastructure Program if the site/development wastewater service is being provided 
by a Utility. 
An Approval of Sanitary Facilities (Subdivision) application is required to the MCESD’s 
Subdivision & Infrastructure Program for Subdivisions with Single Family Residences and for 
Condominiums/Town Homes.

Additional Notes –  
Environmental Services does not require these items for condition of approval of  Z2022188 , 
however these items must be addressed with the development of the site. Environmental Services

*It should be noted that this document does not approve the referenced project. Comments are 
provided for the benefit of the applicant for MCESD permit requirements and as an advisory to 
Maricopa County Planning and Development Department. Other Maricopa County agencies may 
have additional requirements. Final review and approval will be made through Planning and 
Development Department procedures. Applicant may need to submit separate applications to the 
Maricopa County Environmental Services Department for approval of proposed facilities regulated 
by the Department. Review of any such application will be based on current regulations at the time
