The applicant seeks a Special Use Permit (SUP) for an interim 
industrial use (auto repair business). A family member of the 
proprietor occupies the residence which is why the interim 
industrial SUP is requested versus the home cottage industry 
SUP.  It is expected that the proprietor will occupy the 
residence within the next ten years and switch the SUP to a 
home cottage industry.  While the County land use 
designation is Rural (0-1 d.u./acre), the Special Use Permit 
allows businesses such as auto repair businesses when 
appropriately scaled.  The City of Goodyear neighborhood 
land use designation allows for a variety of housing types and 
commercial uses at appropriate intensities; however, their 
ordinance allows such businesses as a use permit under 
certain conditions that this proposal does not meet.  The City 
of Goodyear did not comment on the request and the City 
of Buckeye had no comments. Luke Air Force Base stated that 
the proposal will not have an impact on flying operations in 
or around the base.  ADOT ROW Project Management 
indicated that the project is not anticipated to have an 
impact on the construction of the Loop 303 to SR-30 freeway 
project.  There are eighteen (18) individuals in support of the 
proposal and four (4) individuals in opposition. Concerns 
included noise, fumes and several civil matters between an 
aggrieved neighbor and the proprietor.  A supermajority vote 
of the Board has not been triggered for SUP approval as most 
neighboring properties within 300’ support the proposed SUP.

Recommendation: 
On 12/8/22, the Commission voted 6-2 to recommend 
approval of Z2022086 subject to conditions ‘a’ – ‘j’: 
 
a. 
Development of the site shall comply with the Legal Description entitled “Legal 
Description”, consisting of 2 pages, dated November 17, 2022, and stamped 
received November 18, 2022, except as modified by the following conditions. 
 
b. 
Development of the site shall be in substantial conformance with the Site Plan 
entitled, “Site Plan” consisting of one full-size sheet dated November 22, 2022, and 
stamped received November 22, 2022, except as modified by the following 
conditions. Staff may determine slight refinements to remain in substantial 
conformance with the approved site plan.  Minor and major amendments to the 
site plan will be determined in accordance with Chapter 3 of the Maricopa 
County Zoning Ordinance. 
 
c. 
Development of the site shall be in substantial conformance with the Narrative 
Report entitled, “Narrative Report”, consisting of four pages, dated November 8, 
2022, and stamped received November 8, 2022, except as modified by the 
following conditions. 
 
d. 
The following Planning Engineering conditions shall apply:  
 
1. 
Engineering review of planning and/or zoning cases is for conceptual 
design only. All development and engineering design shall be in 
conformance with Section 1205 of the Maricopa County Zoning 
Ordinance; Drainage Policies and Standards; Floodplain Regulations for 
Maricopa County; MCDOT Roadway Design Manual; and current 
engineering policies, standards and best practices at the time of 
application for construction. 
 
2. 
MCDOT is requiring the dedication of additional ROW so that there is a total 
of 55’ R/W from the centerline to the property line. Dedication of the ROW 
must be completed within 6 month of BOS approval or prior to issuance of 
any building/construction permits, whichever comes first. The ROW 
dedication takes time and approval from the Board of Supervisors. The 
dedication is not required for approval of this Zoning case, but it is required 
before the Building permit can be issued. See the MCDOT webpage

Detailed Grading and Drainage (Infrastructure) Plans must be submitted 
with the application for the Building Permits. 
 
e. 
The following SUP standards shall apply:

Parking - 8 parking spaces including 2 required ADA spaces / Vehicles shall 
only be stored within these dedicated spaces or within a fully enclosed space. 
 
All other development standards per Rural 43 zoning shall apply.

All outdoor lighting shall be shielded and directed downward and otherwise in 
accordance with Section 1112 of the Maricopa County Zoning Ordinance. 
 
g. 
The special use permit shall expire 6 years from the date of BOS approval or upon 
termination of the use for a period of 90 or more days, whichever occurs first. All 
site improvements associated with the special use permit shall be removed within 
90 days of such expiration or termination of use – unless otherwise permitted in the 
Rural-43 zoning district.   
 
h. 
Noncompliance with any Maricopa County Regulation shall be grounds for 
initiating a revocation of this Special Use Permit as set forth in the Maricopa County 
Zoning Ordinance.  
 
i. 
The property owner/s and their successors waive claim for diminution in value if 
the County takes action to rescind approval due to noncompliance with 
conditions.  
 
j. 
The granting of this change in use of the property has been at the request of the 
applicant, with the consent of the landowner.  The granting of this approval allows 
the property to enjoy uses in excess of those permitted by the zoning existing on 
the date of application, subject to conditions.  In the event of the failure to comply 
with any condition, and at the time of expiration of the Special Use Permit, the 
property shall revert to the zoning that existed on the date of application.  It is, 
therefore, stipulated and agreed that either revocation due to the failure to 
comply with any conditions, or the expiration of the Special Use Permit, does not 
reduce any rights that existed on the date of application to use, divide, sell or 
possess the property and that there would be no diminution in value of the 
property from the value it held on the date of application due to such revocation 
or expiration of the Special Use Permit.  The Special Use Permit enhances the value 
of the property above its value as of the date the Special Use Permit is granted 
and reverting to the prior zoning results in the same value of the property as if the 
Special Use Permit had never been granted.

Project Summary: 
 
1. 
Marco and Danielle Malanche are requesting a SUP for the use of their property as a 
auto repair business as an interim industrial use.  The subject property is located in the 
Goodyear area in unincorporated Maricopa County, and is designated as Large Lot 
Residential (1-2 d.u./acre) in the White Tank/Grand Avenue Area Plan.  The City of 
Goodyear General Plan designates the subject property’s land use as Neighborhood. 
Neighborhoods include a wide range of densities (0-12+ d.u./acre dependent upon 
satisfaction of land use plan development standards) and housing products, public and 
community facilities such as schools and places of worship, and commercial uses at 
appropriate intensities and locations. 
 
2. 
The subject property is approximately 2.3 acres and zoned Rural-43.  The request for this 
SUP is a response to the applicant receiving a violation for use of the property as an illegal 
commercial business (V202100700), along with unpermitted animal encasement 
structures, in a rural zoning district.  Use of a property for an auto repair business requires 
either C-2 zoning or alternatively a SUP.  Code compliance dismissed the violation for the 
illegal business as the applicant discontinued the business use within the timeframe prior 
to compliance inspection and communicated to staff that their intent is to seek a SUP to 
operate the business.  Following the first complaint, the applicant erected a wall around 
the property.  Staff received several additional complaints after the applicant submitted 
the SUP; however, enforcement officers closed the complaints after being unable to 
determine whether the operation continued.   
 
3. 
The auto repair business will serve individuals who bring their personal automobiles (cars 
and trucks) for service and repair.  Per the applicant’s narrative, there will be no more 
than six (6) customer vehicles on site on a daily basis.  Cars will be stored until repair is 
complete and the customer picks up the vehicle.  Motor oil will be stored in a drum that 
is stored inside of the garage with the contents being replaced by a service provider as 
needed.  Any coolant will be disposed of and removed from the site on a daily basis.  
There will be no repair of construction or commercial grade vehicles.  There will be two 
employees of the business, the applicant and his wife, who do not reside on the property.  
A family member of the applicant does reside on the property.  The proposed hours of 
operation are 8:00 a.m. to 5:00 p.m. Monday through Saturday.  Repair will be conducted 
entirely within the garage. Access is available to the site from Lower Buckeye Rd. Vehicles 
will enter through an entry-only access point from Lower Buckeye Rd. and exit through 
an exit-only access point back to Lower Buckeye Rd.

Structures on the subject property include a residence, garage and storage shed along 
with animal pens.  The lot coverage for the site is approx. 7.9% or approx. 7,910 sq. ft. and 
requires 32 parking spaces including 2 ADA spaces if utilizing the residence and storage 
shed for the business.  The applicant’s site plan proposes 12 total parking spaces for the 
site (2 existing garage spaces for the residence and 8 defined spaces for the business 
including 2 ADA).  The structures conform to height, lot coverage and setback 
requirements.   There is no sign proposed at this time and any outdoor lighting shall be 
shielded, directed downward and in conformance with Section 1112 of the Maricopa 
County Zoning Ordinance.  The perimeter of the property and use will be screened with 
a minimum 6’ screen wall.  All buildings are permitted in the Rural-43 zoning district for or 
accessory to a single-family residence or agricultural use. The business activity will occupy 
only the garage/shop building and adjacent parking.

5. 
Staff notes that the location of the existing screen wall is a subject of dispute between 
neighboring owners.  Staff considers this dispute over the location of the wall to be a civil 
matter that has no bearing on the requirements for the building permit.  A screen wall will 
be required along or within the owner’s property boundaries if the SUP is approved and 
inspected after building permit issuance in accordance with regulations and procedures. 
If upon inspection, the wall location is found to be outside of the applicant’s property 
boundaries, the wall will be required to be relocated in the appropriate location.

White Tank Grand Avenue Area Plan (Adopted: 2000): The White Tank Grand Avenue 
Area Plan identifies this site as Large Lot Residential (1-2 d.u./acre).  The Large Lot 
Residential category denotes areas where single family residential development is 
desirable and urban services (sewer, water, law enforcement, fire protection, schools, 
parks, etc.) may only be partially available or be required as an improvement district. 
Suitability is determined on the basis of location, access, existing land use patterns, and 
natural or man-made constraints. Densities greater than 2.0 per dwelling unit may be 
permitted in new development, but only if areas of lower densities offset the increase 
such that an average of no more than 2.0 dwelling units per acre is maintained. A 
community sewer and water system will be required for developments above 1.0 
dwelling units per acre and may be required for those below 1.0 dwelling unit per acre 
depending upon pre-existing conditions.

Public Participation Summary:

The applicant complied with the Maricopa County Citizen Review Process with the 
required posting of the site and notification by first class mail to adjacent property owners 
and HOA’s within 300’ of the subject parcel and notification to interested parties.  Two 
signs were posted on site in accordance with applicable regulations.  A Public 
Participation Results Report was submitted to Staff in accordance with County 
requirements and noted verbal support of the proposal from neighbors.

Staff received a petition signed by ten (10) individuals in support from the applicant. 
Separately, Staff received five (5) letters of support.  All appear to be neighbors within or 
just outside of the 300’ support/opposition buffer and expressed support for a 
neighborhood repair business.  Four (4) individuals are opposed to the site with three (3) 
having signed a petition and the fourth having sent letters to Staff. Concerns included a 
civil matter relating to the location of a wall, potential traffic impacts, privacy, noise, dust 
and other environmental impacts.  One individual opposed to the site is requesting that 
the SUP be limited to two (2) years and that separate screening be installed by the 
applicant than the existing screening the individual opposed stated that they personally 
installed.  This individual also submitted a police report regarding harassment to the 
public record.  The officer’s notes indicate that both parties should seek an order against 
harassment from one another.

Staff received a no comment letter from the City of Buckeye. Luke Air Force Base (LAFB) 
indicated that the proposal will not have an impact on flying operations in or around the 
base.  ADOT ROW Project Management indicated that the proposal is in the vicinity of 
the Loop 303 to SR-30 freeway project and that the project is not anticipated to have an 
impact on the construction of the freeway.

Staff Analysis:

Staff supports the SUP request for an interim industrial auto repair business.  While the land 
use proposed is not necessarily consistent with a large lot residential land use, an auto 
repair business when appropriately scaled can function as a business that brings a benefit 
to the area while not causing a great impact to the neighborhood.  The Goodyear 
neighborhood land use designation notes that the neighborhood classification is mixed 
designation that allows for a variety of housing types and commercial uses at 
appropriate intensities; however, the general plan does not speak to auto-repair 
businesses.  The City of Goodyear allows such businesses in its ordinance as a use permit 
so long as the business is conducted entirely within the principal residence, occupies no 
more than 25% of living area, maintains a business license and does not generate noxious 
fumes, noise, odors, etc. otherwise auto-repair is permitted in the City’s neighborhood 
commercial zoning district.  This proposed business would not meet its ordinance 
requirements, but does fulfill an economic development goal in the Goodyear General 
Plan regarding the nurturing of locally-based employment.

Staff finds the requests to alter development standards for parking reasonable. Limited 
parking is appropriate for a interim industrial use expected to eventually become a 
cottage industry helping maintain the residential character of the area. All required ADA 
spaces will be developed while setting an appropriate amount of regular spaces for 
customers.  Further commercialization of the exterior of the site beyond the few customer 
parking spaces will be detrimental to maintaining a residential setting for this property 
and maintaining the rural character of the area. 
 
19. 
With that said, Staff has concerns with the relationship of the applicant and a neighbor 
opposed to the development.  A particular neighbor is highly aggrieved and their 
concerns related to noise and peaceful enjoyment of their home warrant consideration.  
With that noted, the applicant generated a great deal of support from immediate 
surrounding property owners.  Lastly, it’s important to note that the applicant does not 
live on the property as the proprietor of the business as required by the zoning ordinance.  
Rather, another family member lives in the residence in their stead while the owner’s 
principal residence is located in a subdivision in Goodyear. The proprietors do plan to be 
living on the property within 10 years time. As such this cannot be a Cottage Industry SUP 
which requires the proprietor to live on site, but rather is processed as an Interim Industrial 
Use SUP which the ordinance limits to a maximum of 10 years.  Staff is recommending that 
the SUP timeframe be six (6) years so that current and future impacts can be assessed 
near the end of the six (6) year period and so that the applicant can switch the SUP to a 
home-cottage industry which allows more than the maximum of 10 years allowed with 
an interim industrial SUP.  Ultimately, Staff is recommending approval based upon the 
scale of the proposed use and the quality of the support. 
 
Recommendation:

For the reasons outlined in this report, staff recommends the Commission motion for 
Approval of case Z2022086, subject to conditions ‘a’ – ‘j’:

possess the property and that there would be no diminution in value of the 
property from the value it held on the date of application due to such revocation 
or expiration of the Special Use Permit.  The Special Use Permit enhances the value 
of the property above its value as of the date the Special Use Permit is granted 
and reverting to the prior zoning results in the same value of the property as if the

Purpose of Request:  The request is for a SPECIAL Use Permit (SUP) for Marco’s Auto Repair, LLC to provide 
on-site general auto repair for customers.   
 
Description of Proposal:   
1. Business Operations:  On-site general auto repair and maintenance. 
2. Days/Hours:  Monday thru Saturday 8 a.m. to 5 p.m. 
3. Employees:  Two, owners, Marco and Danielle Malanche 
4. Description/Location of Building:  The three-bay detached garage is already on-site behind the main 
residence at 16555 West Lower Buckeye Road, Goodyear, 85338.  The only addition being made to the 
property will be paved and/or concrete entrance, exit, and parking spaces around the detached garage.  
No sign will be used/placed on the property.  The parcel has a block wall fence around the entire 
perimeter of the property for privacy of owners and neighbors. 
5. The number of customers on the premises shall not exceed 6 vehicles parked on the exterior of the 
garage, in designated paved parking spots. This is just one vehicle more than the Chapter 5-Rural 
Zoning allowance.  Customer’s will drop off their vehicle and leave the premises.   
6. Site lighting included a flood light on the front (north) side of the detached garage and a flood light on 
the back (south)side of the detached garage.  Flood lights will not be utilized on the property after  
11 p.m. per the Dark Sky Ordinance.  Lighting shall be shielded and directed downward.  All site lighting 
will comply with Section 1120 of the MCZO. 
7. The goal of the project is to maintain the current Rural-43 zoning appearance without looking like a 
commercial industry.  The exterior landscape would stay the same with large trees, gate grass area, 
and surrounding desert landscaping along the perimeter property line border.   
 
Relationship to Surrounding Properties:  The surrounding properties (north, south, east and west) are 
zoned Rural-43 (Rural Zoning District), primary use as residential homes and various farming properties. 
 
8. In the City of Goodyear 2025 General Plan there are three goals identified:  Physical Growth & 
Development; Community & Cultural Development; and Economic Development.  According to the City 
of Goodyear 2025 General Plan and land use map, the proposed development (Marco’s Auto Repair, 
llc) is identified as a “neighborhood” and as stated above, the goal of the project is to maintain the 
current neighborhood/Rural-43 zoning appearance without looking like a commercial industry.  The 
exterior landscape would stay the same with large trees, gated grass area, and surrounding desert 
landscaping along the perimeter property line border.  Marco’s Auto Repair, llc will assist the City of 
Goodyear Physical Growth & Development by supporting the arterial roadway along Lower Buckeye 
Road and dedicating additional property to Maricopa County.  Additionally supporting the Community 
& Cultural Development goal by preserving our “neighborhood” street appeal as well as revitalizing the 
overall appearance of the property.  The goal is to provide all neighbors/community with low-cost 
general auto repair services.  Various neighbors have asked owners for auto repair concerns/needs for 
their personal vehicles, having a small public garage will build community relationships and allow for 
low-cost general auto repair that is not currently available.  Finally, the proposed development will 
support the City of Goodyear’s Economic Development goal by nurturing locally based employment.   
 
No current code violation cases against the property.  Previous code violations from the anonymous 
complainant have been investigated, closed and no further action needed.   
 
Operation hours of the business will be from 8 a.m. to 5 p.m., any noise created by the business will be 
during operation hours only.  Deliveries and/or tow trucks will not occur outside of operation hours.  The 
air guns (tools) used have a sound decibel (db) of 95 or less, which would be 5 db over a standard power 
lawn mower used in a residential area.

Location and Accessibility:  The three-bay detached garage is already on-site behind the main residence at 
16555 West Lower Buckeye Road, Goodyear, 85338.  The only addition being made to the property will be 
paved and/or concrete entrance, exit, and parking spaces around the detached garage.  There is one 
designated entrance and separate exit for the property that will be indicated with small sign stating 
“ENTER ONLY” and “EXIT ONLY”.  There is one ADA accessible parking spot.   
 
Circulation System:  Entrance to the property will be dedicated to the “East” driveway (one way only), 
vehicles will travel south, through RV gate and park vehicle in identified/designated parking spots.  
Vehicles can loop through the property, by traveling westward (just north of the detached garage) and 
through the designated exit, through the west RV gate, and proceed to the west exit onto Lower Buckeye 
Road. 
 
Development Schedule:  Upon County approval, pavement and/or concrete driveway, entrance, exit, and 
parking areas will be constructed.  No other changes needed.  Estimated date of development completion 
is within 7 months of County Board of Supervisor approval.

know our vote doesn’t count however we are very much in support of their Auto Repair Shop. They

We received the notice regarding the Auto Repair shop.  We do not live
there, you do.  If you wind up having a vote in this, you have a vote from

Just got out of the hospital.  My artificial heart valve failed and I needed
to get it replaced.  Now rehab and trying to get going again.  It will really
slow me down a bunch.
