County Island Status: Yes (Buckeye) Additional Comments: The applicant is seeking a timeframe extension for an additional 25 years for a communications tower that has been in use since 1985. The site is located in a Rural-43 zoning designation within a Buckeye county island. The site is within the Maricopa County State Route 85 Area Plan with a plan designation of Industrial as well as being in the City of Buckeye General Plan as part of the Historic Downtown Activity Center. There are no outstanding concerns from reviewing agencies and no public comment has been made on this proposal. The City of Buckeye has provided no comment Commission Recommendation: On 12/8/22, the Commission voted 9-0 to recommend approval of Z2022174 subject to conditions ‘a’ – ‘o’: a. Development and use of the site shall be in substantial conformance with the Zoning Exhibit entitled “Buckeye 806972”, consisting of four (4) full-size sheets, stamped received November 6, 2008, except as modified by the following stipulations. b. Development and use of the site shall be in substantial conformance with the Narrative Report entitled “Special Use Permit MODIFICATION OF CONDITION January 25, 2023 Z2022174 Page 2 of 3 PROJECT NARRATIVE”, consisting of Six (6) pages, dated October 17, 2022, except as modified by the following stipulations. c. The following Drainage Review conditions shall apply: 1. All development and engineering design shall be in conformance with the Drainage Regulation and current engineering policies, standards and best practices at the time of application for construction." 2. Drainage review of planning and/or zoning cases is for conceptual design only and does not represent final design approval nor shall it entitle applicants to future designs that are not in conformance with the Drainage Regulation and design policies and standards. d. All transformers, back-flow prevention devices, utility boxes and all other utility related ground mounted equipment shall be painted to complement the development. e. All outdoor lighting shall conform to the Maricopa County Zoning Ordinance. f. Development and use of the site shall comply with requirements for fire protection measures as deemed necessary by the applicable fire department. Prior to issuance of zoning clearance or Final Plat approval, the applicant shall seek review and comment from the applicable fire protection agency, and shall provide written confirmation that the site will be developed in accordance with their requirements. g. Prior to zoning clearance or Final Plat approval, developer(s) and/or builder(s) shall establish emergency fire protection services, covering all real property contained within the project area during course of construction and shall obtain a ‘will serve’ letter substantiating coverage from the appropriate Fire Department servicing the site. h. The applicant or his successor shall obtain approval of any development plans from the Office of the Arizona State Fire Marshal prior to any construction. i. The maximum height of the Wireless Communication Facility shall be limited to 290’ as measured to the top of the whip antennas except as may be permitted as an Eligible Facilities Request colocation per federal rule. j. Development of the site shall be in conformance with all Federal and State requirements, including but not limited to, Federal Communications Commission (FCC), Federal Aviation Administration (FAA), National Environmental Policy Act (NEPA), and State Historical Preservation Office (SHPO). The applicant shall be responsible for obtaining all necessary approvals prior to construction, and shall be accountable to those agency requirements, and penalties. k. A Minor Amendment shall be required to co-locate future carriers. l. This Special Use Permit shall expire Twenty-Five (25) years from the date of approval by the Board of Supervisors, or upon expiration of the lease to the applicant, or January 25, 2023 Z2022174 Page 3 of 3 upon termination of the use, whichever occurs first. All site improvements shall be removed within 60 days of such termination or expiration. l. Amendments to the site plan and narrative report shall be processed as a revised application in accordance with Maricopa County Zoning Ordinance Article 304.9. m. Noncompliance with the conditions of approval will be treated as a violation in accordance with the Maricopa County Zoning Ordinance. Further, noncompliance of the conditions of approval may be grounds for the Planning and Zoning Commission to take action in accordance with Chapter 3 (Conditional Zoning). n. Non-compliance with the regulations administered by the Maricopa County Environmental Services Department, Maricopa County Department of Transportation, Drainage Review Division, Planning and Development Department, or the Flood Control District of Maricopa County may be grounds for initiating a revocation of this [Special Use Permit or Zone Change] as set forth in the Maricopa County Zoning Ordinance. o. Michael Campbell, Campbell A&Z, LLC., on behalf of Union Pacific Corporation (property owner), is requesting a 25-year time extension to a previously approved special use permit (SUP) for a wireless communications facility (Z85-49) located west of Miller Rd. and south of Baseline Rd in the Buckeye Area. The facility was first approved by the BOS in 1985 and has been subsequently extended two additional times, the first on February 2, 1998 (Z85-49A) for 10 additional years and December 17, 2008 (Z2007156) for an additional 15 years. 2. The approx. 1,200 sq. ft. SUP area contains one (1) 290’ lattice tower containing four (4) cellular antenna arrays, four (4) microwave dishes, two (2) miscellaneous antennas at 196’ and 236’, and a set of whip antennas at the top of the tower, in addition to associated ground equipment, related shelters, and a retention basin. (Note the main tower is actually 280’ in height, but a lightning rod and whip antennas drive the height to 290’.) Background 3. October 7, 1985: The Board of Supervisors (BOS) approved Z85-49, the original Special Use Permit, subject to stipulations. 4. March 4, 1988: Staff approved Z85-49a, a request for a Minor Amendment to relocate ground equipment due to the discovery of an underground fiber optics cable that bisected the site. 5. February 2, 1998: The BOS approved Z85-49A, a request for a Major Amendment to extend the expiration date for a period of 10 additional years, subject to stipulations. 6. June 6, 2000: Staff approved Z2000023, a request for a Minor Amendment pertaining to Nextel. 7. August 31, 2005: Staff approved Z2005023, a request for a Minor Amendment pertaining to T-Mobile. 8. January 19, 2007: Staff approved Z2006133, a request for a Minor Amendment pertaining to Verizon. 9. December 13, 2007: Dennis Chambers, on behalf of Southwest Wireless, submitted an application for a Temporary Use Permit under TU2007068 to allow a Cell on Wheels (COW). 10. December 20, 2007: Staff initiated Violation case V200702384 due to a COW being erected on the site without the proper entitlements or permits. This COW belonged to Cricket and was later legitimized by subsequent TUP and building permit activity. 11. December 28, 2007: Crown Castle submitted a request for a Time Extension / Major Amendment to the SUP under Z2007156, the subject case. Z2022174 Page 3 of 7 12. January 4, 2008: Staff approved TU2008001, a Temporary Use Permit to allow Cricket’s COW on the subject site. 13. February 2, 2008: The underlying SUP expired per stipulation ‘d’ of Z89-49A. 14. August 11, 2008: Staff approved Z2007109, a request for a Minor Amendment pertaining to Cricket Communications. 15. December 17, 2008: The BOS approved Z2007156, a request for a Time Extension / Major Amendment to the SUP for an additional 15 years, subject to stipulations. 16. December 2008 to Present: Eight separate commercial alteration permits have been applied for and approved allowing various cell site refurbishments and upgrades to site facilities and pole antennas. No other valid violations have occurred since the last granted time extension. Existing On-Site and Adjacent Zoning / Land Use: 17. State Route 85 Area Plan (Adopted 8/27/13): The State Route 85 Area Plan designates the site as Industrial. Although the Area Plan is silent on cell towers, staff considers the use to be consistent with the Industrial land use category. 20. Town of Buckeye General Plan: Buckeye’s General Plan, updated in 2008, designates the site as part of the Downtown Expansion Area, with an underlying land use designation of Historic Downtown Activity Center. Public Participation Summary: 21. The applicant complied with the Maricopa County Citizen Review Process with the required posting of the site and notification within 300’ of the subject parcels and to interested parties. To date, staff has not received any support or opposition. 22. The city of Buckeye has been notified of this application and had provided no comments. Outstanding Concerns from Reviewing Agencies: 23. N/A. Staff Analysis: 24. Much has changed in this area since the original approval of the tower in 1985. At that time the area was very rural with agricultural and industrial operations surrounding the railroad track areas. Since then, the area has slowly transitioned to a more suburban zone with single-family and multifamily residential nearby to the north and slowly moving in from the south. The City of Buckeye has changed the General Plan designation of the area since the last renewal from Business Park to Historic Downtown Activity Center. The City of Buckeye intends to use the area as a new governmental operations center to which they have already begun collecting area properties for a future municipal use. 24. The project has failed to complete the required status updates per stipulation ‘M’ at year 5 and 15. Though with the diligence and frequency of updating and modernizing the site through applying for building permits, the applicant and users have demonstrated continued site diligence and maintenance and have shown to be good stewards to the SUP and its intended purposes. Z2022174 Page 6 of 7 25. The existing tower has been in constant use for over 37 years offering cellular and radio communications. While the height may seem out of place with similar facilities, the tower still offers vital communications for the area. The City of Buckeye has provided no comment for this extension proposal. Recommendation: 25. Staff recommends the Commission adopt a motion recommending that the Board of Supervisors approve Z2022174 subject to the following conditions ‘a’ – ‘o’: a.
