The Maricopa County Environmental Services Department (MCESD) has received 
documentation for a FAA Pvt Airpark SUP renewal.   
 
Based on the submitted documentation, water and sewer will not be provided.  
APN # 506-27-062F. 
 
Based on the above, MCESD raised no objections to the Planning & Development 
Department in in Accela Automation on February 27, 2020 and can allow the project 
to proceed at this time subject to the following stipulations:

None  
 
It should be noted that this document does not approve the referenced project.  
Comments are provided only as advisory to Maricopa County Planning and 
Development Department to assist staff to prepare a staff report.  Other Maricopa 
County agencies may have additional requirements. Final review and approval will be 
made through Planning and Development Department procedures. Applicant may 
need to submit separate applications to the Maricopa County Environmental Services 
Department for approval of proposed facilities regulated by the Department.  Review 
of any such application will be based on regulations in force at the time of application.

Thank you for the opportunity to provide comments on the Special Use Permit Renewal for Eagletail Airstrip.  The site is 
in close proximity to VR242 and is highlighted in AP1B and the low level maps that are provided by Intel to our pilots.  On

the intel map, the airstrip has an avoidance circle of 3NM and 1500 feet AGL.  It is located on 7.5 acres between 
Broadway Rd and Southern Ave in Harquahala Valley in Maricopa County, AZ.  The application is to renew the special use 
permit for another 20 yrs.  The site is located 42 miles outside the Luke AFB 1988 JLUS 65 LDN, “high noise or accident 
potential zone” as identified by A.R.S. § 28‐8461 and is within the “territory in the vicinity of a military airport” also 
defined by A.R.S. § 28‐8461.     
  
As described, this special use permit will not negatively impact the flying operations at Luke AFB.  Since the site will be 
located within the “territory in the vicinity of a military airport,” it will be subjected to approximately 170 over flights per 
day.   We also recommend a strong notification program on the part of the applicant to inform any potential tenants 
about Luke AFB operations.

These are the DRAFT Conditions, which are the conditions from the Z99-87 SUP. We will probably
change a few things, particularly the highlighted language. The SUP is likely to be perpetual (where
a 20 year life is identified below), we may or may not require the 5 year reports and we will
probably update the code citations (the code sections cited are out of date). But, these are
generally what we’ll be including. I will follow up with you if you would like to see the final
conditions. FYI – we noticed Luke AFB and they identified no impact to their flight operations.
 
 
a.            Development shall comply with the site plan, entitled "Site Plan
of Eagletail Airstrip,”, consisting of 1 sheet, dated January 3, 2000
and stamped received January 14, 2000 except as modified by the
following stipulations.
 
b.            Development shall comply with the provisions in the narrative
report entitled "Eagletail Airstrip, Maricopa County, Arizona Special
Use Permit Narrative Report", consisting of 7 pages, dated January
28, 2000 stamped received February 3, 2000 except as modified by
the following stipulations.

c.            The applicant shall submit a written report outlining the status
of the development at the end of five years from the date of
approval by the Board of Supervisors.  The status report shall be
reviewed by staff to determine whether the special use is
compatible with the surrounding area.
 
d.                      This Special Use Permit shall expire August 19, 2040 or upon
termination of the use, whichever occurs first. All of the
improvements shall be removed within 90 days of such termination
or expiration.
e.            All outdoor lighting shall conform to Section 2318 of the
Maricopa County Zoning Ordinance.
 
f.             Major changes to this Special Use Permit must be processed as
a revised application with approval by the Board of Supervisors
upon recommendation of the Commission.  The Department of
Planning and Development may administratively approve minor
changes.
 
g.            No person shall operate, maintain, use or allow the use of any
area larger than 5,000 square feet for the parking, storage, servicing
or dispatching of motor vehicles without first implementing
reasonably available control measures to effectively prevent or
minimize fugitive dust.
 
h.            After zoning approval, but prior to issuance of any building
permits or the issuance of a drainage clearance, the developer or
his representatives must contact the Flood Control Permitting Office.
 
i.              Non-compliance with the regulations administered by the
Maricopa County Environmental Services Department, Maricopa
County Department of Transportation or the Maricopa County Flood
Control District may be grounds for initiating a revocation of this
Special Use Permit as set forth in Section 2806 of the Zoning
Ordinance.
 
j.              The number of flights per month shall be unlimited.

NARRATIVE 
The following narrative is a detailed summary of the identified incident. An Axon Body Worn Camera (BWC) system was 
used during the incident in accordance with established policy. The recording will be preserved in accordance with policy 
and may be available upon direct official request. The following narrative is not meant to account for every single 
comment, statement or action. It is a summarization of the incident. It does contain all pertinent facts and evidence to 
account for any probable cause in an arrest or criminal charge. Any breaks in the video and the reason for such breaks are 
noted in the face sheet of this report. Refer to the full preserved recording of the incident for complete details. 
On Thursday 06/11/2020 I was on-duty and acting in my official capacity as a Deputy Sheriff for the Maricopa County 
Sheriff's Office (MCSO). I was dressed in an identifiable uniform and driving a fully marked patrol vehicle - 321863. I was 
on this date performing patrol functions for the District Two area. 
At about 0847 hours Deputy Ledesma #S1694/A231 and I were dispatched to a call for service regarding an assault. The 
complainant was identified as JESUS AGUIRRE-ARAUJO - V1. The initial call information provided by Jesus was that he 
was working in the area of 539th Avenue and Sunland Road, crop dusting from a small airstrip in the Harquahala Valley 
area of Tonopah. While working in this area Jesus told the MCSO Call-Taker that there were two men who parked a truck 
in the middle of the runway, which prevented his plane from taking off. Jesus said he approached the men and asked what 
they were doing. Both men were alleged to be yelling and cursing at Jesus. At one point Jesus said he was grabbed by 
his arm, causing marks and an injury. The two men had now left the area. 
This call for service originally came in to the MCSO at about 0802 hours. At about 0814 hours Jesus called MCSO again 
to report that one of the men had returned on a motorcycle like vehicle with a rifle, but was not acting in a threatening 
manner with the weapon. This time the subject was apparently telling Jesus and two crop dusting pilots that were present 
that they all needed to leave the area, but Jesus claimed he had a permit to be on the airstrip. 
Both men had once again now left the area. As an additional note, Jesus claimed that one of the men had also made a 
comment about "killing" the man who owned or used to own the airstrip, but would not do so because it was illegal. 
At about or around 0920 hours Jesus left the airstrip at my request and met with myself and Deputy Ledesma at the

NARRATIVE, 
'Rio Valley Market', located at 315 S 515th Avenue. The market was just a short distance from the identified airstrip. Upon 
meeting with Jesus, he provided the following condensed and summarized information about this incident. 
Jesus works for a company called 'Tri-Rotor AG Services' based out of Somerton Arizona. It should be noted that Jesus 
was dressed in a shirt bearing a 'Tri-Rotor' business logo and had arrived at the market driving a fuel truck registered to 
'Tri-Roter'. Jesus said that 'Tri-Rotor' had acquired a permit to use airstrip for the landing and launching of planes 
performing crop dusting in the area. There were apparently two other crop dusting planes at the airstrip and their pilots. 
Both of the pilots were said to be possible witnesses in this incident. They were identified as STANLEY BOLING - W1 and 
BENJAMIN CARDON - W2. 
Jesus and the noted pilots started work at the airstrip this morning at about or around 0630 hours. At about or around 0700 
hours the alleged trouble started. 
While on the airstrip Jesus said that two men drove up and used their vehicle to block the runway, intentionally parking the 
vehicle on the runway to prevent the landing and launching of the crop dusting planes. The vehicle was described as a 
white colored Dodge Ram pick-up truck. 
About this same time the men began yelling and cursing at Jesus about him and the pilots using the airstrip. The men 
alleged that Jesus and the pilots had no right to be on the airstrip, as it was private property. One of the men then began 
demanding to see the name tag on Jesus' shirt, shouting 
11Let me see your Goddamn name tag! I want to see your fucking 
name tag." At the moment this was occurring, Jesus said he felt he was under no legal obligation to show the man his 
name tag. While he did not outright refuse, Jesus described that he ignored the man and turned away from him. The man 
that had made the demanding comments to see Jesus' name tag then reached out and grabbed Jesus about his upper left 
arm/shoulder area. The man then forcefully turned Jesus around to face him. With one hand on Jesus and a flip-style cell 
phone in his other hand the man appeared to be trying to take a picture of Jesus' name tag. 
The action of the one man grabbing Jesus and turning him around lasted only several seconds, after which time the man 
let go of Jesus. The other man who was present did not touch Jesus. There were no other assaults that took place, nor 
were there any criminal threats made. 
The man that grabbed Jesus was identified through investigation as STEPHEN (CHARLIE) KOOISTRA - SP1. Jesus said 
he knew the man as 'Charlie' from other interactions while working in the area in the past. The other man with Charlie was 
identified through investigation as LYLE SPARGO - W3. 
Jesus said both men lived at the far west end of the airstrip. Lyle was said to live on the south side of the airstrip, while 
Charlie lived on the north side. 
It was clarified by Jesus that it was Charlie who after the assault left the area and returned a short time later on a yellow 
colored quad-ATV (All Terrain Vehicle). When he returned there was a rifle laying on the front of the quad. Jesus said 
Charlie never touched the rifle and made no threats with it; it was just present on the quad. 
According to Jesus when Charlie returned on the quad he spoke to Benjamin, telling him that he never should have 
touched Jesus in the manner that he did. Around this same time Lyle was apparently heard making a statement to the 
effect of:

Jesus later voluntarily showed me the area where Charlie had touched him, his upper left arm/shoulder. Upon seeing the 
exposed skin on Jesus' arm in this area there were clear indications of what appeared to be minor bruising and minor 
abrasions. The injuries were located on the front inside area of Jesus' left upper arm and extended down to about the 
middle of his bicep. The injuries were well distinguished and appeared in totality to have been incurred recently. 
Digital photos of the injury were taken using the Axon Capture Application on my county issued cell phone and later 
uploaded to Evidence.com. Jesus had also taken some photos of the injury prior to my arrival using his personal cell 
phone. At my request Jesus emailed those photos to me at my county email address. I later downloaded those photos

and placed them into Sheriffs Office Property as evidence. Copies of all of the photos have been attached to this report as 
PDF documents for reference. 
Jesus stated he felt he had been assaulted and wanted to aid in prosecution. A Victim's Rights Form was completed and 
later provided to him. 
This was about the extent of the information Jesus had to provide about this incident. 
After speaking with Jesus, I contacted a subject identified as MICHAEL TRAGARZ - IL 1. Jesus said Michael was the 
manager of the airstrip and provided me with his phone number - 602 625 0243. 
Upon speaking with Michael on the phone, he too identified himself as the manager of the airstrip. According to Michael 
the airstrip had been sold to 'Tri-Rotor' and declared they had a lawful right to use the airstrip for their crop dusting 
operations in the area. Michael went on to identify a civil land dispute over the airstrip and said that the matter was also 
being reported to the Federal Aviation Authority as a violation of Federal Law. 
Not much more relevant information to this incident was conveyed. 
At about 1014 hours Deputy Ledesma and I arrived at the identified airstrip, having been led here by Jesus. The airstrip 
was a maintained dirt airstrip running east to west. The total length of the airstrip was about 5k feet, or nearly one mile. 
The east most end of the airstrip sat a signed corner showing 539th Avenue and Sunland Road. However, the intersection 
failed to clearly identify itself on any of the mapping systems available to me at this time. A Global Positioning Satellite 
(GPS) coordinate for the east most end of the airstrip was obtained to be approximately (33.395568, -113.215213). 
When we arrived at the airstrip I observed two yellow colored prop driven crop dusting planes parked on the east end. The 
pilots, Benjamin and Stan, were also present. Deputy Ledesma assisted in the investigation by conducting interviews with 
Benjamin and Stan. Refer to his supplement for complete details concerning the information he received. It should be 
noted that Deputy Ledesma did advise me following his interviews that one of the pilots had witnessed Jesus being 
assaulted by Charlie and provided a statement corroborating Jesus' depiction of the event. 
At about 1025 hours I contacted Lyle at his home on the west end of the airstrip, 54651 W Sunland Road. My contact with 
Lyle on this date was established to be consensual. Lyle voluntarily stood on the front porch of his home while talking to 
me, just a few feet from the main/front door of his home. Also present was his wife, who was not identified and not indexed 
for this report. 
After explaining the reason for my visit and asking Lyle about the incident, he proceeded to corroborate the fact that Jesus 
had been assaulted. 
Lyle talked about a civil land ownership dispute that was apparently at the center of the entire incident. Lyle stated he 
owned part of the airstrip, Charlie owned another part of the airstrip and Michael Tragarz owned another part along with a 
few other property owners in the area. Michael had allegedly sold his portion of the airstrip to 'Tri-Rotor'. but Lyle and 
Charlie believed this was an illegal sale. Lyle and Charlie allegedly had attorneys already looking into the matter and they 
were trying to work towards a resolution through civil litigation. 
This morning Lyle noticed the yellow colored crop dusting planes launching and landing on the airstrip. He called Charlie to 
tell him about it and the two of them then went down to the east end of the airstrip. Once at the east end of the airstrip Lyle 
said he and Charlie spoke to Jesus about the fact that he and the pilots were not allowed to be present on the airstrip. 
According to Lyle they could not be present because a Special Use Permit (a civil document) had expired.

It was about this point when Charlie began trying to take a picture of Jesus' name tag with his personal cell phone. From 
what Lyle said he witnessed, Charlie merely touched Jesus about his upper left arm in an effort to tum him around so that 
he could get a picture of his name tag. Lyle said the touch he witnessed Charlie give Jesus was simply a light touch to tum 
him around. As soon as Charlie touched Jesus, Jesus immediately jerked away. 
According to Lyle there was no way that Charlie could have injured Jesus through the action. When confronted with the 
fact that Jesus had an injury in that same area, Lyle suggested it must have been an injury that one of the pilots gave 
Jesus in order to get Charlie in trouble. 
Lyle was also asked about the statement being made to the effect of 'treating Mexicans like a dog'. Lyle denied that 
Charlie or him ever made such a statement. Later he said that Charlie may have said something similar about Michael 
Tragarz, but not about Jesus or Hispanic individuals in general. 
Lyle was also asked about the alleged statement from the initial call notes regarding someone 'wanting to kill someone 
else'. Lyle freely admitted to making this statement. However, he described that it was made in jest in the context of 
speaking with Charlie about how they could go about stopping what they perceived to be an illegal use of the airstrip. 
As the contact went on Lyle added information about how Michael Tragarz did sell 'Tri-Rotor' about 2.5 acres of land in the 
area, but none of it included the airstrip. Lyle said Michael set up an association of some sort with other area land owners, 
which Charlie and him did not join. This has apparently been part of the on-going civil land dispute involving the airstrip. 
This was about the extent of the information Lyle provided on this date. 
After speaking with Lyle, I drove to the north side of the airstrip where Charlie lived, 5205 S 547th Avenue. My contact with 
Charlie was established to be consensual. We spoke under a covered patio area on his property within several feet from 
his main/front door. Deputy Ledesma was present for this interview. During the interview Charlie stood unrestrained by 
any means. 
Concerning the alleged assault incident Charlie freely stated he went down to the east end of the airstrip with Lyle to tell 
Jesus and the two pilots they could not use the airstrip, because they had no lawful right to be present on it. During this 
confrontation Charlie said he wanted to take a photo of Jesus' name tag on his shirt to document who was present at the 
airstrip. Jesus apparently turned away from Charlie and in response Charlie did reach out and touch Jesus. Charlie said 
his intent was merely to tum Jesus around so that he could get a photo of his name tag. He never intended to hurt him 
and was surprised to learn that Jesus had an injury because of it. 
Charlie mitigated the entire incident, describing it as a casual conversation that he was trying to make with Jesus. Charlie 
said he told Jesus that he 'got it'. telling Jesus that he was just a ''worker dog" and that there were bigger parties involved 
over the land dispute. Although, Charlie did also state: "I pushed him around ... I made a mistake." 
At this point in the investigation the lingering civil dispute seemed to be of little relevance to the assault matter. No 
significant amount of time was spent discussing the civil matter with Charlie and no further significant information about it 
was provided by him. 
This concluded my interview with Charlie on this date. 
In summary conclusion to this incident there is probable cause for a criminal charge as it relates to misdemeanor assault. 
The listed victim did have an identified minor injury that appeared to have been incurred recently. The victim also identified 
his assailant and the incident was witnessed by at least two others. When contacted the listed suspect freely admitted to 
touching the victim and also stated he had made a "mistake."

air strip at 539th Avenue / Sunland Avenue Tonopah, Arizona 85354. 
CALL 
Jesus said he was working on the air strip, when a man named Charlie approached him and demanded to take a picture of 
his shirt. Charlie wanted to get the name on his shirt and the company logo. Charlie then assaulted Jesus by grabbing his 
arm and leaving a mark. Jesus said he will be waiting for deputies at the Rio Valley market at 315 S. 315th Avenue in 
Tonopah. 
Deputy Palmer and I responded to the Rio Valley market. 
ON SCENE 
When we arrived the Rio valley market, Deputy Palmer spoke with Jesus. Refer to Deputy Palmer's initial report for Jesus 
and Charlie's statements. 
After Jesus gave Deputy Palmer his statement, we followed him to the air strip. When we arrived at the air strip, Jesus said 
their were two crop dusting pilots than witnessed the assault. I spoke to both pilots and Deputy Palmer went to speak with 
Charlie. 
The first pilot was identified as Stanley Jackson Boling. Stanley stated the following: 
Stanley said he was in his crop dusting airplane, when he observed a man named Lyle driving up their location. When Lyle 
arrived, he went straight to Jesus and it appeared Lyle was yelling at Jesus. A few seconds later, Lyle started talking to 
Jesus and he wasn't yelling at him anymore. 
Stanley then got out of the airplane at this time. 
About five minutes later, Charlie arrived on scene and blocked the runway with his vehicle. Charlie got out of his vehicle 
and approached Jesus. Charlie immediately approached Jesus and attempted to grab his arm, but Jesus pulled away. 
Charlie reached in again and finally grabbed Jesus' upper left arm. As Jesus was trying to pull away from Charlie, Charlie 
pulled Jesus' upper left arm towards him and took a picture of his shirt. Stanley said Charlie was trying to take a picture of 
the Jesus' name tag and the company log on his shirt. 
Stanley said he wasn't standing to far from Jesus and Charlie, when Charlie walked up to him. Charlie then told Stanley:

"I fucked up ..... .l deal with Mexicans all the time and I'm not going to let them tell me what to do". 
At this time, Charlie and Lyle talked for a bit and left the area. There were not further altercations between, Jesus and 
Charlie. Stanley said there is some sort of dispute over the airport strip, but he doesn't know much about it. Stanley said 
they were allowed to be on the strip today and were allowed to land and depart from the strip. Stanley knows Charlie and 
Lyle, because he has talked to them in the past, when he landed at the strip. 
Stanley didn't have anything else to say. 
I spoke with the second pilot and he was identified as Benjamin Phillip Cardon. Benjamin was about to land, when Charlie 
assaulted Jesus, so he did not witness Charlie grab Jesus. When Benjamin landed, Charlie approached him and told him 
"he fucked up". Charlie then told Benjamin: 
"I'm not used to working with these fucking Mexicans, not going to let them tell me what to do". 
Charlie and Lyle then left the area and drove towards their homes at the end of the strip (west-end). Benjamin said Lyle 
and Charlie did not come back once they left the area. Benjamin told me there are lawyers involved over the airstrip, but it 
doesn't really concern him, because his company just tells him where to go. Benjamin knows Charlie and Lyle, because he 
has talked to them, when he's landed at the strip. 
Lyle didn't anything else to say.

Reason for the Appeal of
the Subject Case
Commissioners were advised by County Attorney to disregard
any objection to the application and focus only on whether the
general character of the zoning district had changed such that an
SUP for a private airstrip would no longer be appropriate.
The Narrative report is inaccurate in its description of the

property and the current wishes of the property owners, the
documentation is inaccurate with wrong definitions of affected
areas and the MCZO clearly requires all owners to authorize
affected areas outside the restrictive easement. The applicants
are all non-resident land promoters and the parties in opposition
are all residents. The opponents feel we should be given a full
airing of our opposition without the dismissive bias from the
County Attorney. All parties to a Special Use Permit should have
a say in whether their property can be encumbered to satisfy the
desires of other property owners. Eagletail Airstrip is/was a
residential airstrip. It is hard to imagine how non-residents should
have more say than residents.
