ORDINANCE C-06-23-431-X-01 WHEREAS, A.R.S. § 9-471.02 and 9-471.03 provide a method for deannexation of land from a municipality to a county; and WHEREAS, pursuant to A.R.S. § 9-471.03(C), the City of Mesa passed and adopted Ordinance No. 5741 declaring the deannexation of the territory described as follows: A portion of the northwest quarter of Section 24, Township 1 North, Range 7 East, of Gila and Salt River Base and Meridian, Maricopa County, Arizona. WHEREAS, it is the desire of Maricopa County to receive the certain deannexed territory now within the corporate limits of the City of Mesa and WHEREAS, the territory proposed to be severed and returned to Maricopa County meets the conditions outlined in A.R.S. § 9-471.03, and WHEREAS, Maricopa County Department of Transportation conducted an analysis of the impact of the Deannexation as follows: The existing roadway is owned/operated/maintained by MCDOT. The southeast corner of Signal Butte Rd and Mercury Dr is currently in development as a residential subdivision requiring roadway improvements. These improvement require the deannexation of 15 feet along Signal Butte Rd to accommodate an arterial roadway and 25 feet along both Mercury Dr and Boston Street to accommodate local roadways. This annexation will ensure the roadway is fully within unincorporated Maricopa County and reduce conflict of liability. The roadway improvements are a necessary improvement to the traveling public. WHEREAS, after such notice as was appropriate and legally required, the Maricopa County Board of Supervisors scheduled a hearing on the matter on January 25, 2023; and WHEREAS, it was determined at such hearing that requirements pursuant to A.R.S. § 9-471.03 (C, D and E) have been satisfied; and WHEREAS, it is the determination of the Board of Supervisors that the public interest is served by the deannexation; and WHEREAS, no protests were filed before the Board of Supervisors, NOW, THEREFORE, BE IT ORDAINED by the Board of Supervisors of Maricopa County, Arizona, that the territory earlier described in City of Mesa Ordinance No. 5741 is hereby declared to be returned to Maricopa County contingent on the remaining requirements of A.R.S. § 9-471.03 including the final public hearing scheduled for February 8, 2023.
