RESOLUTION NO. 12464 
 
A RESOLUTION OF THE COUNCIL OF THE CITY OF MESA, 
MARICOPA COUNTY, ARIZONA, APPROVING AND AUTHORIZING 
THE CITY MANAGER TO EXECUTE AN AMENDMENT TO THE 
COMMUNICATION LICENSE AGREEMENT FOR CROWN CASTLE, 
LLC.  
 
 
WHEREAS, the City entered into a Communication License Agreement with Crown 
Castle Fiber, LLC (“Licensee”) on February 10, 2020 (the “License”); and 
 
WHEREAS, the License established, among other provisions, a right-of-way use fee 
based upon the total lineal feet of fiber optic cables installed on City-owned property; and 
 
WHEREAS, the City and Licensee now desire to revise the fee structure to allow for 
the option to base the fee on a percentage of the annual gross revenue Licensee collects 
from its facilities located on City-owned property; and 
 
WHEREAS, the City and Licensee also desire to correct certain scrivener’s errors 
located within the License.  
 
NOW THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE CITY OF MESA, 
MARICOPA COUNTY, ARIZONA, AS FOLLOWS: 
 
Section 1: 
The Amendment to the Communication License Agreement issued to 
Crown Castle Fiber, LLC is hereby approved, and the City Manager or his designee is hereby 
authorized to execute the Amendment and any other documents required to implement 
the terms thereof. 
 
Section 2: 
Additionally, the City Clerk is authorized and directed to attest to the 
City Manager’s or his designee’s signature.
