Jefferson Phoenix, AZ 85003, with the following members present: Bill Gates, Chairman, District 3 (remote); Clint Hickman, Vice Chairman, District 4; Jack Sellers, Supervisor, District 1; Thomas Galvin, Supervisor, District 2; Steve Gallardo, Supervisor, District 5 (remote). INVOCATION - INVOCACIÓN Supervisor Sellers introduced Chaplain Mike Goodrich from the Arizona Fire and Medical Authority. Mr. Goodrich offered the invocation. 3. PLEDGE OF ALLEGIANCE - JURO FIDELIDAD A LA BANDERA Chaplain Mike Goodrich led the assemblage in the Pledge of Allegiance to the flag. Supervisor Sellers thanked Mr. Goodrich and stated the Arizona Fire and Medical Authority played a key role in the County during the pandemic. The organization helped our County through changes that were not understood. They provide services to most of the County that does not have municipal assistance for fire and medical services. Supervisor Sellers stated it was a great organization and thanked them for all they do. 4. PET SHOWCASE BY MARICOPA COUNTY ANIMAL CARE AND CONTROL - PRESENTACIÓN DE ANIMALES DOMESTICOS POR EL DEPARTAMENTO DE CONTROL Y CUIDADO DE ANIMALES Callie Best, Animal Care and Control, noted Pepper, the showcase pet, was no longer at the shelter and she introduced Sir Charles, a pit mix, who is partially deaf. He has been at the shelter since February. She stated he rides well in a car, loves water, and kids. For more information about pet adoption call 602-506-PETS or visit pets.maricopa.gov. Acting Chairman Hickman asked if there were any announcements or corrections to the agenda. The Clerk stated item #9 under Statutory Hearings will be continued to the August 17, 2022, meeting as requested by the department. She stated there is a correction to the title of item #79 to change 210287-S to 220287-S. The Clerk stated there were three items being taken out of order and being heard at the beginning of the meeting because they all require a unanimous vote. Those items were #26, #106, and #107. Acting Chairman Hickman thanked Sheriff Paul Penzone and Assessor Eddie Cook for their attendance at this meeting. TRANSFER OF OWNERSHIP OF RETIRING K-9 - HERO Approve the transfer of ownership of retiring K-9, Hero, #K139, to Detective Larry Edwards #S1866. Hero is an 8-year-old Belgian Malinois. In recent months Hero has been showing excessive panting and a decrease in both stamina and focus impairing his ability to function in his mission of finding wanted subjects. A recent diagnosis from the veterinarian recommended Hero be retired soon due to inability to cool down and exercise intolerance. Detective Edwards will accept full care and financial responsibility for Hero upon adoption and will be asked to sign the Canine Release and Indemnification. THIS ITEM REQUIRES A UNANIMOUS VOTE OF THE BOARD. UTILITY EASEMENT FOR APS TAKE CHARGE EV CHARGING STATION PROGRAM Approve and execute a Utility Easement by and between Maricopa County and Arizona Public Service Company (APS) for the installation, operating and maintenance of a charging station associated with APS’ Take Charge electric vehicle (EV) charging program. The station is located within the County-owned Jackson Street Garage at 601 W Jackson Street, Phoenix. This item affects Supervisory District 5. THIS ACTION REQUIRES UNANIMOUS CONSENT OF THE BOARD. SALT RIVER PROJECT AGRICULTURE IMPROVEMENT AND POWER DISTRICT POWER DISTRIBUTION EASEMENT Approve and execute a non-exclusive power distribution easement, without a public auction pursuant to A.R.S. 11-251 (9), to Salt River Project Agricultural Improvement and Power District (SRP) in, upon, over, under, through and across the County’s property identified as Lot 6 of Baseline Commerce Center Amended (Book 254, Page 37). This easement is required for electric service to the new East Valley Animal Care and Control building, located at 1920 South Lewis Street Mesa, Arizona. This easement will grant SRP the right to construct, reconstruct, replace, repair, operate, and maintain electrical lines for the transmission and distribution of electricity. No entitlement is inferred by this review. 2. All development and engineering design shall be in conformance with Section 1205 of the Maricopa County Zoning Ordinance and current engineering policies, standards and best practices at the time of application for construction. 3. Any site development must include a grading and drainage plan prepared by a licensed civil engineer in accordance with Drainage Review Requirements for Precise Plans (Planning Phase) and the Engineered Plan Submittal Requirements (Building Phase). 4. A Traffic Impact Study to address traffic impacts and roadway improvements required to support the proposed development must be submitted with the Plan of Development application(s) or other future entitlement applications. Applicant to contact the Town of Gilbert to coordinate any offsite improvements within their jurisdiction along Germann Road. 6. The subject premise is NOT located within the County’s Urbanized Area. A Storm Water Pollution Prevention Permit (SWPPP) is not required for the development of this site. e. Prior to the initial precise plan of development approval, the applicant shall provide the Maricopa County Planning and Development Department with an executed pre-annexation service agreement with the Town of Gilbert that identifies the detail for when the proposed project will be annexed and the provision of water and sewer service. In lieu of pre- annexation service agreement the developer must provide a ‘will serve’ letter from the certificated water and sewer provider(s). f. Approval of a Plan of Development will be required prior to approval and issuance of construction permits to develop and establish use of the site. Prior to issuance of any building permit, written confirmation will be required from the emergency fire protection jurisdiction having authority that the facility has been designed in accordance with their regulations and requirements, and that emergency fire protection service will be provided to the facility. Prior to issuance of the certificate of occupancy, local fire protection jurisdiction review and approval will be required. g. Noncompliance with any Maricopa County Regulation shall be grounds for initiating a revocation of this Zone Change as set forth in the Maricopa County Zoning Ordinance. Formal Meeting Minutes 06/22/2022 Page 6 of 81 h. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval allows the property to enjoy uses in excess of those permitted by the zoning existing on the date of application, subject to conditions. In the event of the failure to comply with any condition, the property shall revert to the zoning that existed on the date of application. It is, therefore, stipulated and agreed that either revocation due to the failure to comply with any conditions, does not reduce any rights that existed on the date of application to use, divide, sell or possess the property and that there would be no diminution in value of the property from the value it held on the date of application due to such revocation of the Zone Change. The Zone Change enhances the value of the property above its value as of the date the Zone Change is granted and reverting to the prior zoning results in the same value of the property as if the Zone Change had never been granted. (C-44-22-219-X-00) Acting Chairman Hickman asked the Clerk if there were any registered speakers or comments for this item. The Clerk said there was one registered speaker, Kyle Mieras, Director of Development Services, Town of Gilbert, online wishing to speak in opposition of item #6. This item was removed from the Planning and Zoning Consent Agenda to the Regular Agenda. Mr. Mieras thanked the Board for the opportunity to express the Town’s opposition to this item. He said the Town’s General Plan identified this site as appropriate for offices in the future given its mid-block location and access challenges. He said this zoning change is not compatible with the General Plan. Mr. Mieras stated the Town of Gilbert’s position of annexation and rezoning would be more appropriate. He said the Town is concerned about potential billboards being constructed on this site if rezoned. Mr. Mieras requested this application be denied but if the Board decided to approve this application and move forward, he asked that billboards not be an allowable use on this site. Supervisor Sellers stated he understood the Town’s concerns about billboards being constructed on this site if it were to be rezoned. He said this case requesting to rezone from Rural-43 to Commercial makes sense. Supervisor Sellers stated he understood there was no public opposition to this zoning change and the Planning Commission unanimously voted to approve this request. (AZ 196486) (Supervisorial District 1) (C-06-22-678-X- 00) Acting Chairman Hickman asked the Clerk if there were any registered speakers or comments for this item. The Clerk said there were none. SRP PETITION FOR ESTABLISHMENT OF UNDERGROUND CONVERSION SERVICE AREA: EXETER BOULEVARD 64TH ST - 66TH ST CONVERSION DISTRICT - CONTINUED FROM JUNE 8, 2022 Pursuant to A.R.S. §40-344, convene the scheduled public hearing, to solicit comments and consider the establishment of an underground conversion service area petition filed by Salt River Project Agricultural Improvement and Power District (SRP). Upon Board approval, authorize the Chairman to sign the Resolution. (Supervisory District No 2). (C-06-22-669-X- 01) Acting Chairman Hickman asked the Clerk if there were any registered speakers or comments for this item. The Clerk said there were registered speakers both in favor and in opposition. The Clerk said there were 10 in favor of the item and three in opposition. Supervisor Galvin stated he recommended each side be allowed six minutes to speak. Jennifer Pokorski, Assistant County Manager, presented the slide below and stated that Arizona Revised Statutes allows for this conversion to be done. Ms. Pokorski noted the slide depicted 73% of the property owners are in favor of this conversion. The statute tasks the Board of Supervisors to determine four things: That the requirement for the establishment of an underground conversion service area has been satisfied. Formal Meeting Minutes 06/22/2022 Page 8 of 81 That owners of no more than 40% of real property or no more than 40% of the owners of real property have not objected to the formation of the underground conversion service area. That the cost of conversion is reflected in the joint report that SRP developed and is economically and technically feasible. The underground conversion service area is a reasonable compact area of reasonable size. Ms. Pokorski informed the Board that all criteria has been met for moving forward and the statute states the Board “shall then direct the public service corporations or public agencies owning overhead electric or communication facilities, as defined in section A.R.S. § 40-341, within the underground conversion service area to convert such facilities to underground in accordance with standard underground practices.” Dave Sinovic, resident, appeared in person to speak in opposition to this item. He provided handouts to the Board and stated he wanted to be excluded from this area because he does not get power from this connection. He is concerned about the possible damages that might be made to his landscape and fencing. He noted the texts he received from Mr. Simon who offered to pay the costs for the conversion and explained why he declined the offers. Mr. Sinovic referred to the statute that gives the Supervisors the ability to exclude his parcel. Jason Morris, representing the applicant, spoke in favor of this item. He noted this was not a common request and said there is an opportunity to form this service area. He said the statute governing this endeavor is neighborhood driven. Mr. Morris stated the petition requirements were met and there are people who did not sign but there was not a need for more signatures. Mr. Morris stated Mr. Sinovic was a beneficiary under the statute and consideration has been given to Mr. Sinovic’s concerns. Adam Livingston, resident, spoke in opposition. He stated his property values would plummet and he was not even a part of the district. He felt ignored and excluded and yet the impact to his property value would be great. He said if Mr. Sinovic was excluded from the service area, everyone would win. Karen Magnoni, resident, spoke online in favor of the underground conversion service area. She said it will benefit the area aesthetically and from a safety standpoint it would be better if these powerlines were buried. She said during monsoon season, there is always a concern these aerial lines will come down. Anthony Skikos resident, spoke in opposition of the project and echoed Mr. Livingston’s comments. He had just learned of the possible negative impact this project could have on his property values from Mr. Sinovic. He stated these decisions need to be made when all neighbors are informed and can speak to the issue. Maggie and Greg Glassman, residents, were registered to speak in favor of this project online and did not respond when called upon to speak. Jim Earnhardt, resident, spoke in favor of the item online stating he would love to have an unobstructed view of Camelback Mountain. Bryna Hanson, resident, registered to speak online, but did not respond when called upon to speak. Supervisor Galvin thanked everyone who came to speak on this item. He stated he understood everyone’s concerns, but the Arizona Revised Statutes directs the Board Formal Meeting Minutes 06/22/2022 Page 9 of 81 of Supervisors to form an underground conversion service area if all criteria is met. He spoke to those in the audience representing SRP and urged them to speak with those who are not included in the service area but will be adversely affected. Supervisor Galvin stated all the statutes have been met and the Board must follow the statutes. Supervisor Galvin made the motion to approve the Resolution establishing the Exeter Boulevard 64th Street to 66th Street Conversion District, seconded by Supervisor Jack Sellers Ayes: Bill Gates, Clint Hickman, Jack Sellers, Thomas Galvin, Steve Gallardo Air Quality Statutory Hearings ~ The Clerk noted at the start of the meeting, item 9 would be continued to the August 17, 2022, formal meeting as requested by the department ~ 9. AQ-2021-002-RULE 270 (PERFORMANCE TESTS) Convene a public hearing, as required by Arizona Revised Statutes (A.R.S.) § 49-479(b), to solicit comments on the proposed revision of Maricopa County Air Pollution Control Regulation, Rule 270 (Performance Tests). Following the public hearing, the Board is requested to adopt the proposed revisions to the rule. Rule 270 establishes performance testing requirements for owners and operators of permitted sources that are required to conduct performance tests. This rule was last revised in 1993. The Maricopa County Air Quality Department is proposing to revise Rule 270 to update, clarify, and enhance the rule. IMPROVEMENT DISTRICT: PETITION FOR MOUNTAIN ROAD AND IVANHOE STREET PAVING Convene a hearing for the petition to organize the Mountain Road and Ivanhoe Street Paving Improvement District, located in the vicinity of Mountain Road and Ivanhoe Street. The District is for paving. Supervisory District No. 2 (C-64-22-263-X-01) Acting Chairman Hickman asked the Clerk if there were any registered speakers or comments for this item. The Clerk said there were a few comments in opposition and two registered speaker slips asking to speak in opposition. She said there were three registered speakers in favor of this item. Mark Snyder, resident, spoke in favor and stated he built his home in 2005 and in 2010 three of the four roads in this area were paved. The Transportation Department stated that Ivanhoe was not a County maintained road at that time. He asked why Ivanhoe is now considered a County maintained road and why this Improvement District is being formed, which will cost the property owners $8,000 to $10,000 per acre. He stated he investigated this proposed district and was told the cost was determined by the amount Formal Meeting Minutes 06/22/2022 Page 10 of 81 of road frontage each parcel had. He asked why the other three roads were paved at no cost to the property owner, but those on Ivanhoe are having to pay. Jennifer Toth, Director of the Transportation Department, reviewed A.R.S Title 48 governing special taxing districts. She said an Improvement District is initiated by property owners, and explained the process was followed. She noted the slide below depicting the area involved. Ms. Toth stated in response to why the other streets were paved and Ivanhoe was not was possibly because Ivanhoe was in a different subdivision. Abrielle Gleeson, resident, spoke in opposition online and said she wanted to have all parcels in the area included, not just the small number included. She asked that the assessment levied be by home and not by parcel size as shown on the slide. Jordan Carder and Logan Cooper with Carder Development did not want to speak but wanted to register in favor of the item. James McFarland, resident, spoke in opposition online stating he owns two acres and would like the assessment to be levied by home and not by acreage. He asked the Board to deny approval of this item and include all residents on Ivanhoe. Mr. McFarland stated the proposed assessments do not include the drainage component of the project. He said there is also a City of Mesa water line that runs alongside Ivanhoe that will need to be relocated. He is concerned that because of the tax assessments, property owners will have to sell because they cannot afford to pay the taxes. Supervisor Galvin thanked the speakers and said their input was very helpful. He stated he had wanted the petitioner to speak, but they were not present. Supervisor Galvin asked the developer to continue to work with the property owners involved. He wanted this item continued to the August 31, 2022, meeting. The term of service will be effective as of July 1, 2022, through June 30, 2024. REPLACEMENT OF FLEET VEHICLES AND EXEMPTION FROM MARKINGS Approve the acquisition of five vehicles as permanent additions to the fleet using funds from the County Attorney (D190) Racketeering Influenced Corrupt Organization (RICO) fund (213) to replace two of the one-time addition of vehicles on C-19-11-035-V-00, two permanent vehicles on C-19-09-037, and one permanent vehicle on C-19-12-055-V-00 (C- 19-16-039-M-00). The cost of the replacements to be paid from RICO funds shall not exceed $225,000 for the five vehicles. The net impact on the County Attorney fleet is zero. The purchase of the vehicles is deemed critical due to excessive mileage and/or the age of the vehicles making it cost-prohibitive to acquire replacement parts with which to maintain the vehicles. Pursuant to A.R.S. 38-538-03 and §28-2511(A), approve the issuance of non-governmental license plates and exemptions from county markings for five undercover vehicles. These five vehicles will replace five vehicles that are used for law enforcement investigative purposes. A detailed cross-referenced list of vehicle identification numbers is kept on file with the Clerk of the Board of Supervisors and retained in accordance with LAPR approved retention schedule. These are permanent additions to the fleet that will be disposed of according to forfeiture regulations and the General Fund will not be used to replace these vehicles. As this action involves the replacement of existing vehicles in the fleet, expenditures for the operation and maintenance of the vehicles will continue to be absorbed by the County Attorney's general fund budget with zero net impact. As the vehicles being replaced were purchased with County Attorney (D190) RICO Forfeited Asset Fund (213) monies as a permanent addition to the fleet, the new vehicles will also be permanently part of the fleet. This program requires a hard cash match of 25%, or $269,130. The total award is $1,076,521. These funds are for the enhancement of drug, gang, and violent crime prosecution. The Maricopa County Attorney's Office's composite indirect cost rate for FY23 is 22.35%, or $240,602.44. The recoverable indirect cost of administering this grant is $0; the non-recoverable indirect cost is $240,602.44. Nonrecoverable indirect costs will be covered by the departmental general fund budget. The 25% match requirement will be covered by the departmental general fund. The grant is competitive and reoccurring and does not require on-going cash contributions after the grant period end date. This funding directly supports the mandated function of prosecution of criminal cases. The terms of this agreement become effective upon approval of the Board of Supervisors and shall continue from July 1, 2022, until June 30, 2023, unless otherwise extended. Phoenix Children’s Hospital maintains and is willing to provide professional healthcare providers, staff, and personnel with knowledge and expertise in the medical evaluation and examination in cases of child sexual abuse and sexual abuse, forensic interviews, and records review in cases of suspected child physical abuse with the understanding that their evaluation may include consultation and courtroom testimony as it pertains to such cases. The Maricopa County Attorney’s Office (MCAO) will reimburse Phoenix Children’s Hospital at rates outlined in “Attachment B: Compensation and Reimbursement” for services under this agreement. This amendment will reimburse overtime costs for one additional deputy assigned to the Phoenix Task Force, up to $19,370. The term of this agreement is unchanged, October 1, 2021 through September 30, 2022. The grant award is reoccurring and has been awarded to the Sheriff's Office since 1998. A cash or in-kind match is not applicable. There is no future or ongoing contribution required following termination of the grant period. The Sheriff’s indirect cost rate is 14.74% for a total of $2,855.14 none of which is recoverable per item 7 of the Agreement. Program objectives, which target individuals that have served in the military and non-military first responders, are: Reduction in trauma, depression, stress, and anxiety; Increase in stress resiliency; Improvement in executive functioning (working memory, planning, flexibility, organization, initiation, inhibitory control, self-monitoring, attention, and emotional regulation); and Improvement in quality of life (physical health, social relationships, environment, general outlook, psychological health and overall quality of life). AGREEMENT FOR APS PEAK SOLUTIONS - ELECTRICAL DEMAND RESPONSE PROGRAM Approve and execute Agreement to participate in a peak energy load reduction program with Arizona Public Service and their vendor CPower to reduce consumption during peak use periods. Participation in the program will help avoid service interruptions or blackouts, reduce the need to build new power capacity and sources, and will generate billing savings with reduced consumption. As part of this agreement, nine (9) County facilities will participate in the program. The program is active from June 1, 2022 to September 30, 2022 from 4:00PM- 9:00PM. Program is limited to a maximum of 18 total events with no more than 3 consecutive days in a row. There is no cost to participate and participation can end at any time without penalty. During an activation, the program provides a rebate of $40 KW and $0.09 kWh for energy use below benchmark levels. Agreement is an annual term with County option to renew. IGA WITH THE ARIZONA HEALTH CARE COST CONTAINMENT SYSTEM FOR BEHAVIORAL HEALTH SERVICES TO THE SERIOUSLY MENTALLY ILL AND REMANDED JUVENILES Formal Meeting Minutes 06/22/2022 Page 24 of 81 Approve an Intergovernmental Agreement (IGA) between Maricopa County (the County) and the Arizona Health Care Cost Containment System (AHCCCS) which in effect extends the existing arrangement for the County's funding of behavioral health services for a term of one year from July 1, 2022 to June 30, 2023. County funding for services to the seriously mentally ill (SMI) under this IGA will be $70,906,688 for FY 2022-23. This increases the level of County funding based on an adjustment for inflation for services to the seriously mentally ill by $3,376,509, over the funding paid under the previous IGA in FY 2021-22. The FY 2022-23 IGA also includes funding for non-SMI services in the amount of $3,366,705 and substance abuse services in the amount of $1,489,871 for the one-year term which is equal to the FY 2021-22 level. The IGA will be in effect upon signature of the last party and shall remain in effect until June 30, 2023. The IGA may be amended, further extended or terminated pursuant to the IGA provisions, including a 90-day termination without cause provision. Total County funding for behavioral health services in FY 2022-23 under the IGA will be $75,763,264 for a one-year term. The purpose of this Contract is to provide FY 2023 nonprofit economic development funding to the PHX East Valley Partnership for the purposes of economic development support focused on marketing the PHX East Valley of Maricopa County to generate positive exposure and qualified business/industry prospects. This contract is effective from July 1, 2022 through June 30, 2023. The PHX East Valley Partnership is a regional coalition of community, business, educational, non-profit and government leaders whose goal is to provide leadership and support in specific areas that will help improve the overall business climate and quality of life in the region. Authorize appropriate departmental representatives to co-sign lease documents pertaining to their respective departments. All capital lease documents are subject to County Attorney approval. The Office of Budget and Finance will facilitate the reimbursement from capital leases during fiscal year 2023. Expenditures associated with equipment purchases will be bundled for capital lease financing at which time the interest rate(s) will be bid and repayment terms and amounts for principal and interest will be known. Capital lease(s) maturity will be thirteen months. Capital lease financing will be facilitated by the County’s master personal property lease contract as approved by the Board of Supervisors on December 1, 2020. There is a need for the County to enter capital leases for equipment purchases. Purchased equipment will be financed by the master personal property lease contract for County capital purchases. The Declaration of Official Intent will satisfy the 60-day reimbursement period for reimbursement of original expenditures, as required by Treasury Regulation §1.150-2(d)(1) (1993). Capital outlay expenditures from capital lease proceeds and the corresponding debt service payments for principal and interest are not subject to the County Expenditure Limitation Report (ELR). Capital leases will extend the debt service payments into the subsequent fiscal year (FY 2023-24). AGREEMENTS FOR STUDENT NURSE PRACTICE READINESS PROGRAM Maricopa County has contracted with Robin Schaeffer Consulting, LLC. to increase the practice readiness of New Graduate Nurses (NGNs) by creating and implementing a Maricopa County Student Nurse Practice Readiness Program (Program) for senior nursing students. This Program will enhance partnerships between education and practice using nursing faculties and specially trained practice-based nurse preceptors. The goal of entering into partnerships will allow for senior nurses to increase their practice readiness, yielding more confident and practice-prepared nurses who can transition to the workplace more efficiently. The Program model will include covering costs associated with employers hiring preceptors, nursing education faculties, and stipends for nursing students. In order to assist with the successful implementation of the Program, approval of the following agreement templates or substantially similar and the following actions is requested: 1. Affiliation Agreement with Nursing Education Programs for student capstone experience oversight for student nurses that are within six weeks of graduation. Funding for these Agreements shall not exceed $20,000. 2. Senior Nursing Student Placement Acknowledgment Form for 55 senior nurses to receive Stipends for participation in the Program. Funding for the Stipends shall not exceed $27,500. 3. Work Experience Agreement with Healthcare employers to place senior nurses to transition to the workplace. Funding for these Agreements shall not exceed $129,000. It is anticipated that 5 employers will enter into an Agreement. Employers will also receive $135,500 to pay Preceptors to provide oversight, liaison and troubleshoot work experience with NGNs. a. Psychiatric Crisis Center has been identified as a potential employer. Also request approval for the following: 1. A Work Experience Agreement with Maricopa County Correctional Health Services as a potential employer and will receive $27,000 for hiring NGNs and a not to exceed amount of $33,000 ($2,200 x 15 Preceptors) to provide oversight of NGNs. Formal Meeting Minutes 06/22/2022 Page 73 of 81 The Clerk informed the Acting Chairman there were 13 comments received via email concerning Animal Care and Control and one comment regarding Maricopa County salaries and staffing in jails. These have all been shared with the District offices. Andrea Cummings, Legal Counsel, read the rules to be followed during public comment. Lisa Donaldson, resident, spoke concerning Animal Care and Control (MCACC). She provided a handout and stated she wanted to discuss over-the-counter surrenders. She expressed her concerns with the change of process now in effect. The change will require an appointment to be made to surrender animals and she said this is a problem. Ms. Donaldson said appointments to surrender animals are now two to three days out and this will become an even worse problem during the Fourth of July. She asked the Supervisors to consider changing this new policy. John Hornewer, resident, and Rio Verde Domestic Water Improvement District (DWID) proponent, spoke concerning the Rio Verde water issue. He talked about the need for a dedicated water source for the Rio Verde Foothills community and the establishment of a DWID would provide that. He said water rights are not in place when water is provided by a municipal water entity. He explained his interpretation of water rights and how they belonged to a specific area. He asked that the Rio Verde Domestic Water Improvement District be put back on an agenda and approved. Doreen Hornewer, resident, and Rio Verde proponent said she was part of a water hauling business that supplies water to the Rio Verde area residents. Many are asking for water security from her business and she must inform them there is no assurance at this time. John Shafer, resident, and Rio Verde proponent did not come forward to speak. Liz Schafer, resident, and Rio Verde DWID proponent reiterated what John Hornewer, the previous speaker, stated. She said it was alarming that it has been 16 months since the item has been placed on an agenda. She stated it was continued on February 17, 2021, and has not been heard since that time. She is requesting the matter be placed back on an agenda and heard. She claimed the solution is the domestic water improvement district. She said this is a community driven statute and it is a right of the property owners. She said this matter needed to be brought to a resolution. DeeDee Patton, resident, stated she wanted to speak about change in MCACC. She stated change has caused conditions at MCACC to worsen. She said MCACC is now being run by a dictator who wants no emotion displayed in the shelter which is impossible when animals are being euthanized. She stated change for the better is needed and she does not understand why the Board does not listen to all the animal advocates that offer ideas for change. Amber Murray, resident, commented on the number of animals impounded by MCACC daily. She said MCACC has decided to move away from designated impound duties to a managed intake system. She said this will leave an average of 70 animals a week to the care of the public or on the streets because the County lacks the space to house them. She said it has been many years since the shelters have been expanded. Lisa Prunty-Del Rio, resident, stated her objections to the changes made to the intake policy at MCACC. The East Shelter accepts only five appointments a day and the West Shelter only accepts 20 dogs a day. She gave a scenario of someone who found a dog Formal Meeting Minutes 06/22/2022 Page 74 of 81 needing to be impounded and the issues faced by that person due to the change to the MCACC intake policy. Supervisors'/County Manager's summary of current events - Resumen de temas de actualidad de los Supervisores/Administrador del Condado Chairman Gates thanked Acting Chairman Hickman for filling in for him. He noted the Human Services Facility Grand Opening in the east valley he attended with Supervisors’ Galvin and Sellers. Chairman Gates and Supervisor Sellers attended an Air Quality event at the Phoenix Zoo. He said it was a great event to raise awareness. He was joined by Supervisor Galvin and County Attorney Rachel Mitchell at Eggstacy for the County Coffee hosted by District 3. He said there was a great crowd, and they were able to answer a lot of questions. Chairman Gates commented on the testimony given by Speaker of the Arizona House of Representatives, Rusty Bowers, before the January 6th committee hearing and stated what at a great man he is. He said he was proud of the integrity of Representative Bowers and the Board of Supervisors. Acting Chairman Hickman acknowledged Pam Gates, Chairman Gates’ wife, and the award she was receiving today. He congratulated them both. Joy Rich introduced the Mandela Washington Fellows present at the meeting today. She said they are part of a U.S. Department of State program who come to Arizona every year. There were 24 individuals from 19 countries present to learn about what the Board of Supervisors does and what others across the state do. Ms. Rich welcomed them and thanked them for attending. Acting Chairman Hickman invited someone from the group to speak and two speakers came forward, one being Nwabisa Modiba from the National Audit Office in South Africa. Ms. Modiba noted it was very useful for her to be there and spoke about the importance of hearing about the duties of the Board of Supervisors. Next, Laone Michelle Bame, a Medical Laboratory Scientist by profession, from a small African country, Botswana, came forward. Ms. Bame appreciated observing all levels of government here. On behalf of the group, she thanked the team and everyone who has opened doors for the group. She said they have a lot to take back home to help them become a first world Africa. Chairman Gates commented that he and his family have had a new daughter for the past three years from Uganda. She studied here in Maricopa County and had just graduated from Shadow Mountain High School, and she will be attending Grand Canyon University in the fall. Supervisor Sellers echoed all the comments made by Chairman Gates about Representative Rusty Bowers. He commented on the grand opening of the Human Services Facility in the east valley and all the services being offered in the one location. Supervisor Sellers noted the Air Quality kiosk at the Phoenix Zoo stating it was an excellent educational source. He stated he attended a ribbon cutting for the Grand Opening of the Bank of Taiwan in Chandler. He attended a reception at the Arizona Commerce Authority that hosted 20 companies from Taiwan. He noted the City of Phoenix has a sister city relationship in Taiwan that has gone on for 43 years. Supervisor Galvin welcomed the Mandela Washington Fellows and he encouraged them to watch the testimony given by our representative, Rusty Bowers in Washington, Formal Meeting Minutes 06/22/2022 Page 75 of 81 D.C. He said it was a great example of what service is about and what taking an oath is about. Supervisor Galvin met with the CEO of the Fountain Hills Chamber of Commerce, Betsy Lavoie. He noted this is the sixth largest Chamber of Commerce in the state. He also noted the events he attended with his colleagues such as the opening of the Human Services Facility and the breakfast which also included Rachel Mitchell. Acting Chairman Hickman explained why the Board was able to move through such an extensive agenda in such a reasonable amount of time. He noted the amount of background work done by the Supervisors’ staff and then all the departments’ staff. He also noted the testimony given by Representative Rusty Bowers and urged people to watch it. He thanked Representative Bowers and the Georgia Secretary of State, Brad Raffensperger, and others for their testimony before the January 6th Committee. Acting Chairman Hickman shared what he observed of Rusty Bowers for the entire year and how Mr. Bowers took the time to learn about the election process. The City will operate and maintain the completed Project. This Amendment No. 1 shall become effective when executed by all parties. Due to a major utility conflict, the design team was directed by the City to shift the design and avoid relocation of the utility conflict.
