Chairman Gates opened the meeting and asked the Clerk to call the roll.
1.
ROLL CALL - LISTA
The Board of Supervisors of Maricopa County, Phoenix, Arizona, convened in Formal Session at 
9:30 AM on Wednesday, October 19, 2022, in the Supervisors' Auditorium, 205 W. Jefferson 
Phoenix, AZ 85003, with the following members present:  Bill Gates, Chairman, District 3; Clint 
Hickman, Vice Chairman, District 4; Jack Sellers, Supervisor, District 1;  Thomas Galvin, 
Supervisor, District 2;  Steve Gallardo, Supervisor, District 5. Also present: Juanita Garza, Clerk; 
Joy Rich, County Manager; Andrea Cummings, Legal Counsel; Kelly Gardiner, Minutes 
Coordinator; Mia Vargas, Minutes Coordinator.

INVOCATION - INVOCACIÓN
Supervisor Galvin introduced Brian Murray. Mr. Murray offered the invocation. 
3.
PLEDGE OF ALLEGIANCE - JURO FIDELIDAD A LA BANDERA
Mr. Murray led the assemblage of the Pledge of Allegiance to the flag. Supervisor 
Galvin stated Mr. Murray is a good and dear friend. Mr. Murray had a 21 year old 
daughter who was a murder victim from a domestic violence situation. Supervisor 
Galvin expressed his condolences and wants to see justice for all victims.  Mr. Murray 
thanked Supervisor Galvin and Dan Gardner, Deputy Administrator for District 2, for the 
opportunity to speak. He spoke briefly about domestic violence and his daughter’s 
tragedy. Mr. Murray also encouraged everyone to reach out to anyone who is 
experiencing domestic violence.  Chairman Gates thanked Mr. Murray and expressed 
his deepest sympathies.

PET SHOWCASE BY MARICOPA COUNTY ANIMAL CARE AND CONTROL - 
PRESENTACIÓN DE ANIMALES DOMESTICOS POR EL DEPARTAMENTO DE 
CONTROL Y CUIDADO DE ANIMALES
Kim Powell with Maricopa County Animal Care and Control introduced Brut, 98 pounds 
of love who is currently in foster care.  He is a couch potato, knows how to sit and 
shake. For adoption information visit Pets.maricopa.gov.
Chairman Gates asked the Clerk if there were any announcements or corrections to 
the agenda. The Clerk said there were a few: Item 17, The Ville- Apartment Townhomes 
applicant has requested for continuance to the November 16, 2022 meeting; Item 18 
has been withdrawn; Item 95, Easement, Right-of-Way, and Relocation Assistant 
Documents, “B” as listed on the agenda is being removed and will not be considered in 
the vote.

Juanita Garza, Clerk of the Board, read the proclamation. A copy of the proclamation 
is on file with the Clerk of the Board's Office and retained in accordance with LAPR 
retention guidelines.
Motion to approve by Supervisor Steve Gallardo, seconded by Supervisor Thomas 
Galvin
Supervisor Gallardo thanked Chairman Gates and Supervisor Galvin for their 
comments. He also thanked Mr. Murray and expressed his condolences. He talked 
about the importance of the Proclamation and reaching out to people who are in tough 
situations.  Supervisor Gallardo stated that he has been holding County events each 
year to bring awareness to domestic violence. This year a luncheon has been organized 
with the help of his staff to invite employees to have an open, informal but educational 
discussion on domestic violence. Supervisor Gallardo commented on the different kinds 
of domestic violence issues that people are facing.  Supervisor Gallardo also mentioned 
that many municipalities are lighting their building purple to show support. He thanked 
Chairman Gates and Supervisor Galvin for supporting this Proclamation. 
Chairman Gates thanked Supervisor Gallardo for his comments. He gave credit to 
Supervisor Gallardo and his staff for leading the Board on this issue. Chairman Gates 
stated he would like to have more awareness on mental health also.  He echoed 
Supervisor Galvin’s comments and thanked him for having his guest share his 
message. 
Supervisor Gallardo mentioned they are also reaching out to the schools to bring more  
awareness to domestic violence.

SUPERIOR TANKS

Request: A Special Use Permit (SUP) for a cottage industry to accommodate the 
manufacture of water tanks for water carrying vehicles in the Rural-43 zoning district
Site Location:  A ¼ mile north of the northwest corner of El Mirage Rd. and Southern Ave. in 
the Avondale area
Commission Recommendation:  On 9/22/22, the Commission voted 8-0, to recommend 
approval of Z2021076 subject to conditions ‘a’ – ‘h’:
a. Development of the site shall be in substantial conformance with the Site Plan entitled 
“Special Use Permit Request for Superior Tank and Fabrication“, consisting of two full-size

sheets, dated March 21, 2022, and stamped received March 22, 2022, except as modified 
by the following conditions. Staff may determine slight refinements to remain in substantial 
conformance with the approved site plan.  Minor and major amendments to the site plan will 
be determined in accordance with Chapter 3 of the Maricopa County Zoning Ordinance.
b. Development of the site shall be in substantial conformance with the Narrative Report 
entitled “Superior Tank and Fabrication”, consisting of four pages, dated March 13, 2022, 
and stamped received March 22, 2022, except as modified by the following conditions.
c. The following Planning Engineering comments shall apply:
1. The regulatory flood elevation for new structures shall be two feet above the base flood 
elevation for building and floodplain use permitting purposes.
2. New fencing within the floodplain shall be designed such that it will not result in an adverse 
drainage or flood impact to the site or surrounding properties.
3. Retention basins must drain within 36 hours.
4. The owner shall dedicate right-of-way along the site’s El Mirage Rd. frontage to provide a 
total half-width of 65 feet prior to issuance of any building permits; or within six months of 
SUP approval, whichever occurs first.
5. Detailed Grading and Drainage (Site Development) Plans indicating that the site will drain 
to the retention basin(s) must be submitted with the application for Building Permits.
6. Engineering review of planning and/or zoning cases is for conceptual design only. All 
development and engineering design shall be in conformance with Section 1205 of the 
Maricopa County Zoning Ordinance; Drainage Policies and Standards; Floodplain 
Regulations for Maricopa County; MCDOT Roadway Design Manual; and current 
engineering policies, standards, and best practices at the time of application for; and 
issuance of construction permits.
d. The two temporary shade structures must be removed or permitted within 12 months.  A 
status report must be submitted in 12 months showing that the shade structures have been 
removed or permitted on the site. 
e. The site shall use an alternative surface material on driveways, parking areas, and 
loading/unloading areas to address dust pollution in place of paved surfaces, except for any 
ADA accessible parking space(s). 
f. This special use permit is valid for a period of ten years and shall expire on October 19, 
2032, or upon termination of the use for a period of 90 or more days, whichever occurs first. 
All site improvements associated with the special use permit shall be removed within 90 days 
of such expiration or termination of use. 
 
g. Noncompliance with any Maricopa County Regulation shall be grounds for initiating a 
revocation of this Special Use Permit as set forth in the Maricopa County Zoning Ordinance. 
h. The granting of this change in use of the property has been at the request of the applicant, 
with the consent of the landowner.  The granting of this approval allows the property to enjoy 
uses in excess of those permitted by the zoning existing on the date of application, subject 
to conditions.  In the event of the failure to comply with any condition, and at the time of 
expiration of the Special Use Permit, the property shall revert to the zoning that existed on 
the date of application.  It is, therefore, stipulated and agreed that either revocation due to

the failure to comply with any conditions, or the expiration of the Special Use Permit, does 
not reduce any rights that existed on the date of application to use, divide, sell or possess 
the property and that there would be no diminution in value of the property from the value it 
held on the date of application due to such revocation or expiration of the Special Use Permit. 
The Special Use Permit enhances the value of the property above its value as of the date 
the Special Use Permit is granted and reverting to the prior zoning results in the same value 
of the property as if the Special Use Permit had never been granted.

Chairman Gates asked the Clerk if there were any registered speakers or comments 
received for agenda items 6 through 12. The Clerk said two speaker forms for item 7 
were received from Brian Vaccaro and Rodney Jarvis available to speak in favor only if 
necessary. One speaker form for item 12 was received from George Pasquel, the 
applicant, who was available to speak only if necessary.

Commission Recommendation:  On 9/22/22, the Commission voted 8-0, to recommend 
approval of Z2021131 subject to conditions ‘a’ – ‘k’: 
a. Development of the site shall be in substantial conformance with the Zoning Exhibit 
entitled “Zone Change with Overlay R-5 & C-3 to C-3 CUPD Z2021131 8815 E. Apache 
Trail”, consisting of 1 full-size sheet, dated June 30, 2022 and stamped received August 12, 
2022, except as modified by the following conditions. Staff may determine slight refinements 
to remain in substantial conformance with the approved site plan.  Minor and major 
amendments to the site plan will be determined in accordance with Chapter 3 of the Maricopa 
County Zoning Ordinance.
b. Development of the site shall be in substantial conformance with the Narrative Report 
entitled “8815 E. Apache Trail”, consisting of 11 pages, dated revised September 8, 2022 
and stamped received September 8, 2022 except as modified by the following conditions.
c. A Plan of Development is approved subject to site plan entitled “Zone Change with Overlay 
R-5 & C-3 to C-3 CUPD Z2021131 8815 E. Apache Trail” consisting of 11 full-size sheets, 
dated June 30, 2022, and stamped received August 12, 2022. The Plan of Development may 
be amended administratively under separate application as long as the amendment complies 
with the established CUPD development standards as approved by the Board of 
Supervisors. Staff may determine slight refinements to remain in substantial conformance

with the approved site plan.  Minor and major amendments to the site plan will be determined 
in accordance with Chapter 3 of the Maricopa County Zoning Ordinance.
d. The following Planning Engineering conditions shall apply: 
1. The submitted plan of development includes a previously unpermitted structure built over 
previously impervious surface. No additional development approval is implied by this review, 
including, but not limited to drainage design, access, and roadway alignments. 
2. Any future development must ensure that historic drainage patterns are maintained at the 
up and downstream limits of development. 
3. All development and engineering design shall be in conformance with Section 1205 of the 
Maricopa County Zoning Ordinance; Drainage Policies and Standards; Floodplain 
Regulations for Maricopa County; MCDOT Roadway Design Manual; and current 
engineering policies, standards, and best practices at the time of application for construction. 
e. The following Maricopa County Environmental Services Department (MCESD) condition 
shall apply: 
1. Approval to Construct (ATC) and Notice of Intent to Discharge (NOID) must be obtain prior 
to construction permit approval. 
f. The following C-3 CUPD standards shall apply: 
1. Front, rear, side and street-side setbacks: 0’ 
2. Maximum side yard lot coverage and setback: 100% and 0’
3. Maximum number of standard parking spaces: 11 
4. Fencing: 6’ fencing with opaque screening 
5. Elimination of the sight visibility triangles at the north property line (both sides of the 
ingress/egress) and Apache Trail right-of-way. 
6. One freestanding pole sign to be setback 0’ from east property line with height of 12’, non-
illuminated double-faced sign with 24 sq. ft.  
7. Paving waived – utilization of existing decomposed granite for the property. 
g. The owner shall submit as-built permits for all unpermitted construction which includes the 
existing 1,200 mechanic shop (northern region of site), existing canopy 720 sq. ft (northern 
region of site), completion of B202005586 for the existing mechanic shop (southern region 
of site), on-site parking improvements and fencing by obtaining final inspections by the 
extended Compliance Agreement deadline date – June 30, 2023. 
h. The C-3 CUPD overlay is applied to restrict the use of the site to automobile repair until 
such time as the site is served by sewer.
i. Noncompliance with any Maricopa County Regulation shall be grounds for initiating a 
revocation of this Zone Change as set forth in the Maricopa County Zoning Ordinance. 
j. The property owner/s and their successors waive claim for diminution in value if the County 
takes action to rescind approval due to noncompliance with conditions. 
k. The granting of this change in use of the property has been at the request of the applicant, 
with the consent of the landowner.  The granting of this approval allows the property to enjoy 
uses in excess of those permitted by the zoning existing on the date of application, subject 
to conditions.  In the event of the failure to comply with any condition, the property shall revert 
to the zoning that existed on the date of application.  It is, therefore, stipulated and agreed

Site Location:  Generally located at the SWC of Campbell Ave. & 355th Ave.
Commission Recommendation:  On 9/22/22, the Commission voted 8-0, to recommend 
approval of Z2021137 subject to conditions ‘a’ – ‘j’: 
a. Development of the site shall be in substantial conformance with the Zoning Exhibit 
entitled “Zoning Exhibit“, consisting of 1 page, dated July 2, 2022, and stamped received 
September 6, 2022, except as modified by the following conditions.
b. Development of the site shall be in substantial conformance with the Narrative Report 
entitled “Narrative Report Envirotech Group”, consisting of 6 pages, dated revised 
September 13, 2022, and stamped received September 13, 2022 except as modified by the 
following conditions.
c. Administrative approval of a Plan of Development will be required prior to approval and 
issuance of construction permits to develop and establish use of the site. Prior to issuance 
of any building permit, written confirmation will be required from the emergency fire protection 
jurisdiction having authority that the facility has been designed in accordance with their 
regulations and requirements, and that emergency fire protection service will be provided to 
the facility. Prior to issuance of the certificate of occupancy, local fire protection jurisdiction 
review and approval will be required.
d. The following Planning Engineering conditions shall apply:
 
1. Without the submittal of a precise Plan of Development, no development approval is 
inferred by this review, including, but not limited to drainage design, access, and roadway 
alignments. These items will be addressed as development plans progress and are 
submitted to the County for further review and/or entitlement.
2. A Plan of Development shall be required for any future development should the zone 
change application be approved (i.e. building expansion). Any development must ensure that 
historic drainage patterns are maintained at the up and downstream limits of development;

provide for storm water retention of new development area(s); and will require an engineered 
grading and drainage plan.
3. A traffic impact study must be submitted with any future entitlement application(s) (i.e. plan 
of development), unless otherwise waived by MCDOT.
4. Dedication of right-of-way for the arterial (65’) alignment fronting the site (355th Avenue) 
may be required as part of future entitlement application(s).
5. All development and engineering design shall be in conformance with Section 1205 of the 
Maricopa County Zoning Ordinance; Drainage Policies and Standards; Floodplain 
Regulations for Maricopa County; MCDOT Roadway Design Manual; and current 
engineering policies, standards, and best practices at the time of application for construction.
e. The following IND-2 IUPD Zoning District standards shall apply: 
1. Parking – A minimum of 10 regular parking stalls shall be developed including 1 ADA 
space to accommodate employees and 1 space per 900 sq. ft. of floor area shall be required 
thereafter
2. Uses Permitted – Manufacturing or assembly of electrical appliances, electronic 
instruments and devices, optical goods, precision instruments, radios and phonographs, 
including the manufacture of small parts only, such as coils, condensers, transformers and 
crystal holders; accessory buildings and uses customarily incidental to the above uses; 
commercial storage of mobile homes, manufactured homes, travel trailers, recreation 
vehicles, boats and aircraft; construction equipment, including sales, service, rental and 
storage, and one single-family dwelling or caretaker residence.  Until such time as the site is 
served by sewer and water, of the uses permitted, the uses on site shall only be those 
acceptable to the Maricopa County Environmental Services Department (MCESD) that can 
be accommodated by septic and well. A public water system and public sewer system shall 
be required prior to establishment of any non-residential use that requires potable water.
f. No more than ten (10) individuals other than the owner are permitted to be employed on 
the site.
g. Zoning approval is conditional per Maricopa County Zoning Ordinance, Article 304.6, and 
ARS § 11-814 for five (5) years for the initial phase and an additional five (5) years for each 
subsequent phase, within which time a Plan of Development and initial construction permit 
must be obtained. 
h. Noncompliance with any Maricopa County Regulation shall be grounds for initiating a 
revocation of this zone change as set forth in the Maricopa County Zoning Ordinance.

Freeway in the Mesa area
Commission Recommendation:  On 9/22/22, the Commission voted 8-0, to recommend 
approval of Z2021163 subject to conditions ‘a’ – ‘h’: 
a. Development of the site shall be in substantial conformance with the Site Plan entitled 
“SR24 Storage”, consisting of 1 full-size sheets, dated June 7, 2022, and stamped received 
June 20, 2022, except as modified by the following conditions. Staff may determine slight 
refinements to remain in substantial conformance with the approved site plan.  Minor and 
major amendments to the site plan will be determined in accordance with Chapter 3 of the 
Maricopa County Zoning Ordinance.
b. Development of the site shall be in substantial conformance with the Narrative Report 
entitled “Special Use Permit (SUP) Project Narrative for SR24 RV & Boat Storage”, 
consisting of 8 pages, dated revised July 14, 2022 and stamped received July 14, 2022, 
except as modified by the following conditions.
c. Development of the site shall be in substantial conformance with the Sign Package entitled 
“Sign Package SR24 RV Boat Storage”, consisting of 5 pages, dated July 11, 2022 and 
stamped received July 14, 2022, except as modified by the following conditions.
d. This special use permit is valid for a period of (10 years) and shall expire on August 31, 
2032, or upon termination of the use for a period of 90 or more days, whichever occurs first. 
All site improvements associated with the special use permit shall be removed within 90 days 
of such expiration or termination of use.  
e. The following Planning Engineering conditions shall apply: 
1. At the time of application for building permit, verification of (no) offsite flow must be 
provided.

2. At the time of application for building permit, there must be details on the plans for the 
grates over the manholes. The MAG Standard Details do not have grates for manhole 
covers.
3. The applicant should be aware that 222nd St. is MCDOT operated and maintained. Any 
work in the MCDOT right-of-way will require a MCDOT right-of-way permit. 
4. The applicant should be aware that Fry Road/SR24 is ADOT operated and maintained. 
Any work in the ADOT right-of-way will require a ADOT right-of-way permit. 
5. Engineering review of planning and/or zoning cases is for conceptual design only. All 
development and engineering design shall be in conformance with Section 1205 of the 
Maricopa County Zoning Ordinance; Drainage Policies and Standards; Floodplain 
Regulations for Maricopa County; MCDOT Roadway Design Manual; and current 
engineering policies, standards, and best practices at the time of application for construction.
6. Based on the conceptual design nature of the information submitted, changes to the site 
layout may be necessitated by the final engineering design of the site’s drainage 
infrastructure.
7. Design conforming to Maricopa County Drainage Policies and Standards DPS 6.10.9. 
Item required, but not limited to:
a. Certification from system manufacturer for a minimum 75-year service life.
b. Maintenance Plan.
c. Geotechnical Report (soil borings indicating depth to groundwater) and corrosivity (soil 
pH) testing for metal (CMP,CAP) systems.
d. Soil percolation testing in accordance with DPS 6.10.12.
e. Construction details of all system components.
f. Calculations for the required 100-year, 2 hour storm volume.
g. Basin drain down time calculations. Design rate for drywells shall be 0.1 cfs/drywell. As-

3. Minimum standard parking space widths of 9½’ and depths of 20’. However, parking 
spaces may overhang two feet into a landscape strip or pedestrian walkway, but any parking 
spaces that protrude over a pedestrian walkway shall maintain at least a four-foot-wide 
clearance to allow for pedestrian access. 
e. Prior to a precise plan of development or final plat approval, the applicant shall provide 
the Maricopa County Planning and Development Department with an executed pre-
annexation service agreement with the City of Peoria that identifies the detail for when the 
proposed project will be annexed and the provision of water and sewer service.  In lieu of 
pre-annexation service agreement the developer must provide a ‘will serve’ letter from the 
certificated water and sewer provider.
f. Noncompliance with any Maricopa County Regulation shall be grounds for initiating a 
revocation of this Zone Change as set forth in the Maricopa County Zoning Ordinance.

The grant award is non-recurring and a cash or in-kind match is not applicable. Indirect cost

CASE DNA 2
Approve the application, agreement, and acceptance of $500,000 in grant funding from the 
Office of Justice Programs (OJP), 2022 BJA FY22 Prosecuting Cold Cases Using DNA, in 
the amount not-to-exceed $500,000.00 for the purpose of investigating and bringing cold 
case violent crimes forward for prosecution and closure. 
The grant award begins on October 1, 2022 and ends on September 30, 2025. 
Authorize the Chairman to sign all documents related to these grant funds, as applicable. 
The Maricopa County Attorney’s office (MCAO) indirect rate for FY23 is 22.35%. Total grant 
indirect costs are estimated to be $91,336.33 and the department will not be recovering 
indirect costs off this grant. MCAO will absorb the indirect costs of the grant award totaling 
$91,336.33 within their general budget. 
The grant award is non-reoccurring. This funding does not have a required match 
component. This grant provides critical overtime funding for our homicide investigations 
team, funding for a full-time cold case analyst to assist in cold case homicide investigations, 
investigative travel funding, and additional DNA testing if required. This is the second award 
for MCAO from this OJP funding initiative.

ADMINISTRATION FOR THE DEA TASK FORCE FFY 2023
Approve the Task Force Agreement and acceptance of any available reimbursement funding 
up to $19,840.75 from the US Department of Justice, Drug Enforcement Administration. 
The term of this agreement is October 1, 2022, through September 30, 2026. 
Authorize the Chairman to sign all documents related to these funds, as applicable. The 
agreement allows a 0% rate for indirect costs, or $0 which may be incurred by the County 
Attorney's Office or Maricopa County for the administration of this grant. 
The Maricopa County Attorney's Office's composite indirect cost rate for FY23 is 22.35%, or 
$4,434.41. The recoverable indirect cost of administering this grant is $0; the non-
recoverable indirect cost is $4,434.41. Grant revenues are not local revenues for the purpose 
of the constitutional expenditure limitation, and therefore, expenditure of the funds is not

The agreement does not require on-going cash contributions after the period end date. This 
agreement is recurring, non-competitive and does not require a match. This funding indirectly 
supports the overall mandated function of prosecution of criminal cases. 
Approval of this agreement allows for reimbursement of overtime paid to the Maricopa 
County Attorney’s Office detective assigned to the DEA Task Force. The purpose of the 
agreement is to enhance disruption of the illicit drug traffic in Maricopa County and the State 
of Arizona by immobilizing targeted trafficking violators and organizations. 
The County Attorney has cooperated with the DEA since 1998. While the agreement allows 
for the reimbursement of overtime, it is contingent upon the availability of funds. The County 
Attorney is prepared to absorb the costs of any overtime related to this agreement.

DEPARTMENT OF HOMELAND SECURITY – PROJECT #210209-01
Approve Modification #1 and Amendment #1 to the Subgrantee Agreement from the Arizona 
Department of Homeland Security, Project #210209-01. The amendment extends the 
expiration date of the Agreement from September 30, 2022, until September 30, 2023. The 
modification is due to a change in the intelligence sharing vendor. All other terms and 
conditions are the same. This funding award is recurring and there is no match requirement. 
It was competitively bid. The purpose for which it is being used it is not a mandated function. 
This Amendment and Modification extends the amount of time to utilize the funds for 
integration costs of other regional agencies and expand the use of the new LInX application, 
thereby making it a more powerful tool. This extension will allow MCSO to complete all work 
by 9/30/2023. The original award amount of $80,000 was approved on October 20, 2021 (C-

MOU WITH USDA FOR US FOREST SERVICE LAW ENFORCEMENT OFFICER’S 
DEPUTIZATION
Approve a Memorandum of Understanding (MOU) between the United States Department 
of Agriculture (USDA), Forest Service, and the Maricopa County Sheriff’s Department for the 
deputization of US Forest Service Law Enforcement Officer’s by the Maricopa County 
Sheriff’s Office and to establish a continuous general framework for law enforcement 
procedures and relationships. This is a non-financial MOU and is effective as of the last 
signature date written on the MOU and for five years thereafter. This MOU can be unilaterally 
terminated in whole, or in part by either side, in writing, at any time before the expiration 
date.

of 6 – 8 weeks. This is a non-financial agreement.  Its term is retroactive to May 1, 2022 and

second alarm system and would remain in the Tactical Operations Unit (TOU) to be used as

installed and annual operating expense for this vehicle is expected to be $5,000. These costs

Approve the one-time additions to the fleet of two (2) new 25’ Safe Boats with an estimated 
value of $248,603 each to be assigned to Saguaro Lake and Lake Pleasant. These boats 
will help to ensure the MCSO Lakes Division is operational with the safest and most efficient 
equipment to patrol, and provide the service needed to oversee the lakes.   These boats are 
purchased primarily with Arizona Boating Law Enforcement Safety Fund (AZBLESF) funding 
provided as a result of ARS  §5-383 and accepted by the Board in MCSO agenda items (C-
50-22-234-X-00) and (C-50-21-035-X-00). These boats will be retired at the end of their 
useful lives with no funding from the General Fund for replacement.

Department and Maricopa County (Permittee) for aircraft storage spaces DV STHG-46-07 
and Space No. DV STHG-46-09 located at the Phoenix Deer Valley Airport, 702 W. Deer 
Valley Road, Phoenix, AZ. The Permits are in effect until canceled by either party. The 
Permits may be canceled by the Director of Aviation Services or a designee, without cause, 
upon thirty (30) days’ written notice or immediately for violation of law or provision of the 
Permits or to protect public health or safety and may be canceled by the Permittee upon five 
(5) calendar days’ written notice. The Permit rent fee is $240.58 per month per hangar plus

KENNEL PERMIT FOR COOK’S CAVS AND LABS
The Board of Supervisors approved a fee schedule effective June 1, 2018. Pursuant to 
A.R.S. §11-1009, any person operating a kennel shall obtain a permit issued by the Board 
of Supervisors for the county where the kennel is located (except if each individual dog is 
licensed). Animal Control has received the application and the actual cost of recovery permit 
fee ($350) for each kennel, and each kennel has passed an inspection by Animal Control. A 
person who fails to obtain a kennel permit under this section is subject to a penalty of twenty-
five dollars ($25) in addition to the annual fee. Kennel permits aid in assuring dogs in kennels 
are properly vaccinated for rabies. The Department has not received any complaints and 
MCACC recommends this kennel permit be approved. Revenue Funds have been deposited.

BEHALF OF MESA COMMUNITY COLLEGE
Approve a new agreement with Maricopa County Community College District on behalf of 
Mesa Community College and Maricopa County through the Maricopa County Animal Care 
and Control (MCACC), in which Mesa Community College of Veterinary Medicine, as part of 
their educational modules, will house select animals provided by MCACC prior to adoption 
for the purpose of providing medically necessary veterinary services such as dental 
procedures, spay and neuter, and grooming. Veterinary care will be done in accordance with 
veterinary standards of practice set by the American Veterinary Medical Association. Term

ACCEPT GRANT FUNDS FROM ARIZONA STATE DEPARTMENT OF HOMELAND 
SECURITY FOR RENEWAL OF EMERGENCY PLANS SOFTWARE
Approve the acceptance of grant funds from Arizona State Department of Homeland 
Security, (FFY22 SHSGP), in the not-to-exceed amount of $68,000 for the 
MaricopaRegionPrepares.com subscription renewal. This is a Continuity of Operations 
Planning (COOP) software package for all jurisdictions within Maricopa County. The grant 
period for this grant is October 1, 2022 through September 30, 2023. The Maricopa County 
Department of Finance has calculated the Department of Emergency Management's 
composite indirect cost rate at 28.82% or $19,597.60. The Department will not be recovering 
indirect costs off of this grant. The amount of unrecoverable indirect cost is $19,597.60. 
Emergency Management will absorb these indirect costs within their general budget.
The grant award is non-recurring, the department has to apply every year however, we have 
received the grant for the past five years. The department does not have an in-kind match 
requirement for this grant. The grant award is not a mandated function, but it is a department 
strategic goal to have all county departments with a viable Continuity of Operations Plan 
(COOP). The grant is awarded through the Arizona State Homeland Security Department-
State Homeland Security Grant Program (SHSGP), which is a competitive grant program. 
Maricopa County jurisdictions compete for projects based off the State grant initiatives. 
Maricopa County has spear headed the grant for the Emergency Operations Plans 
(EOP)/COOP software project for all county departments and jurisdictions within Maricopa 
County. Each year Maricopa County applies for the recurring cost of the software 
maintenance and training funds. Maricopa County does not have to fund any additional costs 
for the program.
The grant is intended to renew the MaricopaRegionPrepares.com subscription. This 
software tool benefits Maricopa County in developing Emergency Operations Planning 
(EOP), Continuity of Operations Planning (COOP), Continuity of Government (COG) 
Planning for local government. The Department was awarded a grant for the software in 
2015, we are applying for a grant to cover the cost associated with the maintenance of the 
system.
Funding for this agreement is provided by a grant from the State of Arizona Department of 
Homeland Security in the amount not to exceed $68,000. Additionally, in accordance with 
A.R.S.42-17106(B), authorize the following amendments to the FY 2023 Emergency 
Management (D150), Emergency Management Fund (215) Operating (OPER) Budget:
a) Increase the revenue and expenditure authority for Emergency Management (D150) 
Emergency
Management Fund (215) Operating (OPER) by $68,000.
Grant revenues are not local revenues for the purpose of the constitutional expenditure 
limitation, and therefore expenditure of the funds is not prohibited by the budget law. The

Per the Budget and Accountability Policy, the Budget Office will reconcile and request the 
necessary budget adjustments for spending variances in the prior year forecasts each year 
by the end of October.

EXPAND THE COUNTY’S EMPLOYEE DISCOUNT PROGRAM
Authorize and approve the:
• Expansion of the County’s Employee Discount Program to include The Employee Network 
as an employee discount program vendor.
• Update of the name of one of the County’s current employee discount program vendors, 
from Benefairs to Arizona Corporate Events.
• End of the County’s relationship with the Employee Services Management Association 
(ESMA) as the local chapter no longer exists.
In 2000, the Board of Supervisors approved an agenda item authorizing the County to use 
Employee Services Management Association (ESMA) as an employee discount program 
vendor. In 2019, the Board of Supervisors approved an agenda item to expand the County’s 
Employee Discount Program to include Benefairs (now known as Arizona Corporate Events), 
a group of vendors that separated from the ESMA’s local Phoenix chapter.
By expanding the County’s Employee Discount Program to include Arizona Corporate 
Events and The Employee Network, County employees will continue to have access to 
hundreds of local and national discounts. Arizona Corporate Events and The Employee 
Network do not charge the County fees.

AMENDMENT TO THE COMPETITION IMPRACTICABLE AGREEMENT WITH 
COMMUNITY LEGAL SERVICES
Approve Amendment No. 1 to the Competition Impracticable Agreement (“Agreement”) 
between Community Legal Services., a Community-Based non-profit law firm (“Contractor”) 
and Maricopa County (“County”) administered by its Human Services Department.
The purpose of the Amendment is to address the following:
A. Revise paragraph 3.0 (Contractor Responsibilities), to add additional Contractor 
responsibilities, which will address a referral process, advocacy services, and efforts to 
vacate eviction judgements on behalf of clients.

ARIZONA DEPARTMENT OF HEALTH SERVICES LICENSING
Request approval of the following:
1. Authorize the Human Services Department Director to submit formal notification to the 
Arizona Department of Health Services Child Care Facility Licensing, identifying the County 
individual authorized to submit for new and annual renewal Child Care Facility Licensing.
2. Authorize the Department Director to submit formal notification to the state when staff 
changes occur or if the authorized individual representing Maricopa County changes.
Maricopa County Human Services Department, Early Education Division - Head Start 
program operates several community-based Child Care facilities where Head Start services 
are provided to children ages zero-to-five. State Licensing and renewals are required for 
each facility. Maricopa County Human Services Department will designate the authorized 
individual to submit Child Care Licensing applications to AZDHS via the state’s Licensing 
portal.
By approving these requests, Maricopa County Head Start program will maintain compliance 
with Arizona regulatory requirements for Child Care Facilities.

In accordance with County Policy A2508, accept the donation report from the Human 
Services Department. 
The Human Services Department, Workforce Development Division Arizona@Work 
Maricopa County held a Hiring Event with Peckham, Inc., on Thursday, September 8, 2022, 
at the West Valley One-Stop Career Center to assist them in filling vacant positions.
Peckham provided $20 Café food vouchers to the individuals that attended the hiring event, 
located in the facility. After the event, Peckham provide 19 leftover $20 food vouchers to the 
program to distribute to program participants. 
The estimated value of the donation from Peckham to the Arizona@Work – Maricopa County 
is $380.
Voucher restrictions: Only valid at West Valley Career Center Café till 9/30/2022. No cash 
value.

Approve Amendment No. 5 to the Agreement between Diocesan Council for the Society of 
Saint Vincent de Paul (Contractor) and Maricopa County (County), administered by its 
Human Services Department. The purpose of the Agreement is for the Contractor to provide 
services to individuals experiencing homelessness. 
The purpose of the Amendment is to address the following items:
A. Correct Amendment No. 4 which referenced Amendment No. 3 funding source as 
Assistance Listing Number (ALN) 81.135 American Rescue Plan Act (ARPA) to correctly 
reflect the funding source to Coronavirus State And Local Fiscal Recovery Funds ALN 
21.027.
B. Extend the Agreement term from June 30, 2023, through January 31, 2025.
C. Contractor shall continue to provide shelter services to homeless individuals at the St. 
Vincent de Paul 2739 E. Washington Street location to include meals, laundry and clothing 
services, support case conferencing efforts and connecting individuals to needed services 
and housing.
D. The County shall provide Contractor with $4,678,948 for services to homeless individuals 
from November 1, 2022, through January 31, 2025. The Contractor’s monthly expenditure 
amounts shall not exceed $173,294. Funding for this Amendment No. 5 shall be provided 
under Coronavirus State And Local Fiscal Recovery Funds ALN 21.027.
E. By this Amendment, the total funding amount provided by the County through January 31, 
2025, is $7,676,306.

IGA WITH THE CITY OF GLENDALE FOR EMERGENCY RENTAL ASSISTANCE
Approve a financial Intergovernmental Agreement between the City of Glendale 
(“Subrecipient”) and Maricopa County, administered by its Human Services Department. 
Through this Agreement the Subrecipient will provide Emergency Rental Assistance to 
residents in the City of Glendale, impacted by the COVID-19 pandemic. The County shall 
provide the Subrecipient with $3,693,000 to provide rental and utility assistance services. 
Also request authorization for the Chairman to sign Administrative Change Orders as 
outlined in Section 5.0 Administrative Change Orders:
5.1 The Chairman of the Board of Supervisors is authorized upon the recommendation of 
the Human Services Department Director and Legal Counsel to make changes within the 
general scope of the Agreement on behalf of the County through Administrative Change 
Orders. The Subrecipient’s City Manager, or his designee, is authorized to approve and sign 
Administrative Change Orders on behalf of Subrecipient. Administrative Change shall be 
approved by both Parties and fully executed by the Chairman of the Board of Supervisors 
and Subrecipient. Administrative Change Orders may address any of the following areas:
5.1.1 Modifications to the project timeline if the last day of the project timeline is within the 
Agreement term;
5.1.2 Modifications to Budget line items if the Agreement Amount remains unchanged;
5.1.3 Modifications required by federal, state, or County regulations, ordinances, or policies; 
and
5.1.4 Modifications to Administrative requirements such as changes in reporting periods, 
frequency of reports, or report formats required by the U.S. Department of Treasury or local 
regulations, policies, or requirements.
The Agreement term shall be retroactive to October 1, 2022, through February 15, 2023. 
The funding for this Agreement is provided by the Assistance Listing Number (ALN) 21.023

AMENDMENT TO IGA WITH ARIZONA DEPARTMENT OF HEALTH SERVICES
Approve Amendment number 1 for Intergovernmental Agreement (IGA) for contract number 
CTR056454 between Arizona Department of Health Services (ADHS) and Maricopa County 
by and through its Department of Public Health (MCDPH) to provide continued funding for 
the Congenital Syphilis Intervention Project. The revised budget period of this contract has 
been extended to August 1, 2022 through August 1, 2023.  
Effective upon signature by both parties, it is mutually agreed that the IGA referenced in this 
amendment is amended as follows:
1. Pursuant to the Terms and Conditions, Provision Six (6), Contract Changes, 6.1., 
Amendments, Purchase orders and Change orders, the termination date is extended to 
August 1, 2023.
The purpose of this project is to expand access to services to promote healthy pregnancies 
and prevent congenital syphilis. The term of the contract is 5 years, ending August 1, 2026. 
The award was non-competitive and there is no cash or in-kind match required. This is not 
a mandated service but provides a benefit to the community through the promotion of healthy

pregnancies and the prevention of congenital syphilis. If discontinued, ongoing cash 
contributions should not be required. 
The Department of Public Health indirect rate for FY23 is 17.24%.  Full indirect costs were 
estimated at $44,114.64, all of which were recoverable.  Departmental indirect rates were 
reestablished at the beginning of each fiscal year and the future indirect rates will be collected 
at the corresponding rates. All program costs are allocated to the grant so there will not be 
additional burden on the department’s operating budget. 
The CFDA number is 93.323.
Grant revenues are not local revenues for the purpose of the constitutional expenditure 
limitation, and therefore, expenditure of the funds is not prohibited by the budget law. 
Approval of this action does not alter the budget constraining the expenditure of local 
revenues duly adopted by the Board pursuant to A.R.S. §42-17105.

continuing TRB stakeholder, MCDOT will have affiliation with, and access to, the National 
Academies and TRB.

research needed to deploy AV and shared mobility services.  Such partnership will bring 
together stakeholders on an ongoing basis to promote policy to best meet long-term goals, 
including safety, reducing congestion, enhancing accessibility, increasing sustainability and

AND HUMAN SERVICES FOR FY2022 FOR THE EARLY HEAD START PROGRAM 
GRANT
Approve the submittal of a Carryover funds application in the amount of $1,336,721 to the 
U.S. Department of Health and Human Services (DHHS)/Administration for Children and 
Families (ACF), Office of Head Start (OHS), Grant No. 09CH012079 for Fiscal Year 2022. 
The Maricopa County Head Start program must submit an Application for Federal Assistance 
Standard Form SF-424 requesting the Carryover funds.
The Carryover funds will be used to facilitate improvements such as adding 
equipment/playground structures and information technology supplies and upgrades, at 
several center-based Head Start sites to include the completion of facility maintenance and 
repairs and allowable expenses related to post-pandemic recovery and to meet full 
enrollment expectations. 
Maricopa County is the recipient of Grant No. 09CH012079 from OHS for the administration 
of Head Start and Early Head Start service delivery. The Grant project period began July 1, 
2021 and is through June 30, 2026. 
If OHS approves the request for the Carryover funds, the Human Services Department will 
request formal approval for the receipt of the funds at a future meeting.

RESCIND RESEARCH CORE SERVICES AGREEMENT WITH VANDERBILT 
UNIVERSITY MEDICAL CENTER TO PROVIDE ANALYTICAL RESEARCH MATERIALS 
AND APPROVE THE REVISED AGREEMENT
Rescind approval of the previously submitted Research Core Services Agreement with 
Vanderbilt University Medical Center (VUMC) which was approved on August 17, 2022, 
under C-86-23-010-X-00  to provide analytical research materials to Maricopa County by and 
through its Department of Public Health due to changes later being requested by VUMC.

In addition, approve the updated Research Core Services Agreement between Vanderbilt 
University Medical Center (VUMC) and Maricopa County by and through its Department of 
Public Health (MCDPH). The term of the Agreement shall be for twelve (12) months 
beginning on September 9, 2022, and ending September 8, 2023, unless terminated early 
due to the mutually agreed upon completion of project or as stipulated in Exhibit A of the 
Agreement. 
   
The total amount of the agreement shall be in an amount not to exceed $100,000 and it is 
anticipated that this amount will cover an initial six (6) REDCap Projects for a total of twelve 
(12) months each. The Office of Enterprise Technology (OET) shall serve as the designated 
Administrator of this service contract and may choose to utilize it for other County 
departments as may be needed during the term of the agreement. Due to the VUMC’s 
qualifying designation as a “Public Educational or Public Health Institution” it has been 
determined by the delegated Procurement Officer that Section MC1-1003 of the Maricopa 
County Procurement Code applies to this expenditure.  
The purpose of this agreement is to utilize VUMC’s RedCap Software for research activity to 
validate scientific hypothesis of mutual academic interest. Test materials will be provided to 
Core Lab by MCDPH as detailed in Exhibit A - Scope of Work. This includes projects to serve 
public safety, public health, flood control, education, and parks with tools for surveillance 
initiatives and scientific projects. Pricing for individual projects shall be based on an 
estimated number of units and the associated unit cost combined with a cost-recovery rate 
in effect at the time the services are provided. Proposed service quotes shall be received 
and reviewed by Maricopa County’s Office of Enterprise Technology (OET) who shall also 
oversee the performance of each individual project.

Chairman Gates asked the Clerk if there was anything to report regarding public 
comment email responses. The Clerk said there was one email comment regarding 
MCACC and that email had been shared with the Board offices. She said there was 
one request to speak from Blue Crowley.
Blue Crowley, resident, commented on documents to the legislature and had questions 
regarding the MAG projects. He also had concerns about the money that is going out 
to Prop 400.

Supervisors'/County Manager's summary of current events - Resumen de temas de

Supervisor Sellers talked about representing Maricopa County at the County 
Supervisors Association Legislative Summit and attended Arizona State Sister Cities 
Board meeting. He also talked about the importance in getting Prop 400 passed. 
Supervisor Gallardo talked about the upcoming Domestic Violence Awareness 
Luncheon and noted there would be guest speakers. He commented about the Phoenix 
Gay Pride festival he attended last weekend and said despite lots of rain, it was a big 
event and well attended. Supervisor Gallardo also noted the County Recorder’s office 
was there registering voters.  
Chairman Gates talked about the rain in Moon Valley, reporting six inches of rain. He 
thanked Flood Control District for the work they do. 
Supervisor Galvin thanked Mr. Murray again for coming to the Board meeting. He said 
the County has resources for anyone who needs help. Supervisor Galvin made brief 
comments regarding the elections and said reporters from all over the world are 
watching Arizona.
Supervisor Hickman reflected on Mr. Murray’s testimony. He talked about female 
inmates who work at Hickman Farms and their stories, saying that some of the inmates 
are incarcerated due to domestic violence. Many said they would like to break the cycle 
of abuse for their families before the crime is committed. 
Chairman Gates talked about the regular press conferences being held with County 
Recorder Stephen Richer and media each Wednesday. He also announced his 
November Coffee Chat at Eggstacy in Scottsdale on November 1, 2022 at 8:00 A.M. 
Chairman Gates said that Recorder Richer and Sheriff Penzone would be in 
attendance.

ACQUISITION OF A DRAINAGE BASIN LOCATED IN UNINCORPORATED MARICOPA 
COUNTY AT 62ND STREET AND UNIVERSITY DRIVE, MESA
Pursuant to A.R.S. § 48-3603(C)(5) and § 42-18303 (E), approve making an offer to the 
Maricopa County Board of Supervisors  to purchase  a tax deeded parcel know as Assessor’s 
Parcel Number 141-63-884 and authorize the Chairman to sign and execute all documents 
related to this action. The  parcel is adjacent to the University Drive Basin that is owned and 
operated by the Flood Control District as approved by Board Resolution 1992R002. The 
parcel of approximately 1.26 acres will be integrated into the adjacent 9.23-acre University 
Drive Basin project for District operations and maintenance.

PROJECT IN GILA BEND
Ratify the execution by the Chairman of Amendment No. 1 to FCD 2022A008 between the 
Flood Control District of Maricopa County (DISTRICT) and the United States Department of 
Agriculture, Natural Resources Conservation Service (NRCS) and accept $1,288,177.44, an

DISTRICT for repair of portions of the Scott Avenue Wash in the Town of Gila Bend.

Emergency Watershed Protection Program provides for technical and financial assistance 
to a local sponsor for the restoration of flood control facilities damaged due to flooding.

IGA WITH UNITED STATES GEOLOGICAL SURVEY FOR WATER MONITORING FOR 
THE LOWER GILA RIVER
Approve Intergovernmental Agreement (IGA) FCD 2022A015, between the United States 
Geological Survey [Agreement #23ZFJFA00079400 (USGS)] and the Flood Control District 
of Maricopa County (District), for the period of October 1, 2022 to September 30, 2027, for 
collection of stream flow data on local watersheds throughout Maricopa County. The total 
cost of the IGA is $375,000 over five years. The District’s costs under this agreement will be 
$75,000 annually, with the USGS actively pursuing cooperative matching funds from the 
Urban Waters Federal Partnership, but this match is not guaranteed. If this project is 
selected, the proposal can be modified to either add more work that could be beneficial to 
the project or lessen the amount that FCDMC contributes. Payments from the District are to 
be made quarterly. 
The agreement covers costs associated with the maintenance, collection, and publication of 
collection of water-level and salinity information at five surface-water and six groundwater 
monitoring sites on the Lower Gila River. This agreement will allow data to adequately be 
analyzed for statistical trends spatially and temporally, and to better capture a range of flow 
regimes in the system, it is recommended to continue monitoring for at least five years.  This 
effort will provide information critical to ongoing non-structural flood control efforts in these 
watercourse areas. The information generated by the USGS’s ongoing work is vital to the 
safety of Maricopa County residents, and to the continual flood mitigation efforts performed 
by the District.

IMPROVEMENTS
Approve Intergovernmental Agreement (IGA) FCD 2022A011 for the Design, Rights-of-Way 
Acquisitions, Utility Relocations, Construction, Construction Management, and Operation 
and Maintenance of Mockingbird Lane Drainage Improvement Project (PROJECT) between 
the Town of Paradise Valley (TOWN) and the Flood Control District of Maricopa County 
(DISTRICT). 
This Agreement shall become effective as of the date it has been executed by all PROJECT 
PARTNERS and shall expire ten years from that date, or upon PROJECT completion, 
whichever occurs first.

The Lower Indian Bend Wash watershed extends from Shea Boulevard to the north, Middle 
Indian Bend Wash to the east, Salt River to the south, and 56th Street to the west.
The PROJECT starts from 56th Street along Mockingbird Lane to Invergordon Road then 
heads north along Invergordon Road to outfall into Indian Bend Wash. The PROJECT 
includes storm drains, inlets, lateral pipes, and outfall pipes.
This Agenda Item impacts Supervisorial District 3.

IGA WITH THE UNITED STATES GEOLOGICAL SURVEY FOR WATER RESOURCES 
INVESTIGATIONS
Approve Intergovernmental Agreement (IGA) FCD 2022A016 between the United States 
Geological Survey [Agreement #23ZFJFA00079410 (USGS)] and the Flood Control District 
of Maricopa County (District), for the period of October 1, 2022, to September 30, 2023, for 
collection of stream flow data on local watersheds throughout Maricopa County. The total 
cost of the IGA is $340,650. The District’s costs under this agreement will be $205,700, with 
the USGS contributing the remaining $134,950. Payments from the District are to be made 
quarterly. 
The agreement covers costs associated with the maintenance, collection, and publication of 
stream flow data and river reach characteristics at seven continuous stream flow monitoring 
stations and 14 peak flow monitoring sites throughout Maricopa County. This agreement 
further will develop and evaluate long term flood histories on watercourses in Maricopa 
County, and provide information critical to the determination of the risk of flooding in these 
watercourses. The information generated by the USGS’s ongoing work is vital to the safety 
of Maricopa County residents, and to the continuing hydrologic studies performed by the 
District.

RESOLUTION FOR GENERAL POLICIES CONCERNING THE FINANCIAL 
MANAGEMENT OF THE FLOOD CONTROL DISTRICT OF MARICOPA COUNTY
Adopt Resolution FCD 2022R003, General Policies Concerning the Financial Management 
of the Flood Control District of Maricopa County, consolidating and affirming the District’s 
fiscal policies, rescinding and replacing prior policy statements, Resolution FCD 2010R008, 
2015R005, 2009R003, 2009R003A, 2009R003B and 2009R003C.
Resolution FCD 2022R003 provides consolidated guidance for management of District 
capital and operating funds by rescinding and replacing past resolutions related to the same 
topic. The capital budget and program shall include four categories: Primary Capital 
Improvement Program, Small Project Assistance Program, Major Maintenance and Flood-
prone Properties Acquisition. The operating budget shall address requirements related to 
flood hazard identification, maintenance, regulation, education and necessary administrative 
support. The Director of the District shall ensure annual proposed operating and capital

budgets are prepared to balance flood hazard mitigation needs, fiscal responsibility, 
sustainability and efficient operation.
