RESOLUTION FCD 2022R002 Page 1 of 3 When Recorded Return to: Contracts Branch Flood Control DISTRICT of Maricopa County 2801 West Durango Street Phoenix, AZ 85009 RESOLUTION - FCD 2022R002 Pecos Road Drainage Improvements Agenda: _________________ WHEREAS, The Flood Control District of Maricopa County (DISTRICT) was established in accordance with provisions of Arizona Revised Statutes Title 48, Chapter 21, which authorizes the Board of Directors of the Flood Control District of Maricopa County (BOARD) to acquire by eminent domain, purchase, donation, dedication, exchange or other lawful means rights-of-way to construct, operate and maintain flood control works and storm drainage facilities within or without the DISTRICT for the benefit of the DISTRICT, to contract and join with the State of Arizona, the United States or any other flood control district or floodplain board, municipality, political subdivision, governmental agency, irrigation or agricultural improvement district, association, corporation or individual in acquiring, constructing, maintaining and operating flood control works, and regulating floodplains; and, WHEREAS, the proposed improvements as shown in Exhibit A are located within the City of Mesa and within Pinal County; and, WHEREAS, the area is subject to frequent flooding; and, WHEREAS, the area was the subject of the East Mesa Area Drainage Master Study/Plan (ADMS/P) and subsequent updates; and, WHEREAS, the area was the subject of a Design Concept Report (DCR) completed in 2015 that refined the concepts from the update; and, WHEREAS, the DCR provided solutions to mitigate the flood hazards in the area (the PROJECT), as depicted by Exhibit A; and, WHEREAS, the present on-going Queen Creek/East Mesa ADMS/P Update may identify different and/or additional features that may become part of the PROJECT. NOW, THEREFORE, BE IT RESOLVED that the Director of the DISTRICT is authorized and directed to include funds for the PROJECT implementation in the DISTRICT’s current and future Five-Year Capital Improvement Programs, subject to the ratification and approval of this BOARD; and, BE IT FURTHER RESOLVED that the Director of the DISTRICT is authorized and directed to negotiate and prepare intergovernmental agreements and/or agreements with identified cost-share partners, other municipalities, agencies and others, as appropriate, for cost sharing, rights-of-way acquisition, design, RESOLUTION FCD 2022R002 Page 2 of 3 construction, construction management and future operation and maintenance of the PROJECT, subject to the ratification and approval of this BOARD; and, BE IT FURTHER RESOLVED that the Director of the DISTRICT is authorized and directed to negotiate with appropriate owners and agencies to obtain the necessary Rights-of-Way, Property and/or Easements and all other land rights: and to retain counsel to initiate and prosecute actions and proceedings in the manner required by law to condemn any and Rights-of-Entry, Property, and/or Easements required for the implementation of the PROJECT that cannot be obtained by donation or purchase in the following locations: Township 1S, Range 7E, Sections 33, 34, 35, and 36; Township 2S, Range 7E, Sections 01, 02, 03, 04, and 12; Township 1S, Range 8E, Section 31; Township 2S, Range 8E, Section 06 and 07; and, BE IT FURTHER RESOLVED that the Director of the DISTRICT is authorized and directed to advertise, select, negotiate and award contracts for engineering and construction services and sign other documents on behalf of the DISTRICT as necessary for implementation of the PROJECT, subject to the ratification and approval of this BOARD.
