On 11/2/23, the Commission voted 5-0 to adopt a motion 
recommending the Board of Supervisors approve Z2022185 
subject to conditions ‘a’ – ‘g’:  
 
a. 
Development of the site shall be in substantial conformance with the site plan entitled 
“PH68137A Towercom Roeser“, consisting of 7 full-size sheets, dated September 27, 
2023, except as modified by the following conditions. Staff may determine slight 
refinements to remain in substantial conformance with the approved site plan.  Minor and 
major amendments to the site plan will be determined in accordance with Chapter 3 of 
the Maricopa County Zoning Ordinance. 
 
b. 
Development of the site shall be in substantial conformance with the narrative report 
entitled “Towercom TMobile”, consisting of 4 pages, dated, August 7, 2023, except as 
modified by the following conditions. 
 
c. 
This special use permit is valid for a period of 25 years and shall expire on December 6, 
2048 or upon termination of the use for a period of 90 or more days, whichever occurs 
first. All site improvements associated with the special use permit shall be removed within 
90 days of such expiration or termination of use.

d. 
The wireless communication tower shall retain the stealth properties as originally 
designed. Any damaged or missing fronds or branches shall be replaced within 60 days 
of such damage occurring.  
 
e. 
The following engineering condition shall apply: 
 
1. 
All development and engineering design shall be in conformance with Section 
1205 of the Maricopa County Zoning Ordinance; Drainage Policies and Standards; 
Floodplain Regulations for Maricopa County; MCDOT Roadway Design Manual; 
and current engineering policies, standards and best practices at the time of 
application for construction. 
 
f. 
Noncompliance with any Maricopa County Regulation shall be grounds for initiating a 
revocation of this special use permit as set forth in the Maricopa County Zoning 
Ordinance.  
 
g. 
The granting of this change in use of the property has been at the request of the applicant, 
with the consent of the landowner.  The granting of this approval allows the property to 
enjoy uses in excess of those permitted by the zoning existing on the date of application, 
subject to conditions.  In the event of the failure to comply with any condition, and at the 
time of expiration of the special use permit, the property shall revert to the zoning that 
existed on the date of application.  It is, therefore, stipulated and agreed that either 
revocation due to the failure to comply with any conditions, or the expiration of the special 
use permit, does not reduce any rights that existed on the date of application to use, divide, 
sell or possess the property and that there would be no diminution in value of the property 
from the value it held on the date of application due to such revocation or expiration of 
the special use permit.  The special use permit enhances the value of the property above 
its value as of the date the special use permit is granted and reverting to the prior zoning 
results in the same value of the property as if the special use permit had never been

Project Summary:  
 
1. 
The applicant is requesting a Special Use Permit (SUP) for an 80’ Wireless Communications 
Facility (WCF) and associated transmission equipment to be located on a Rural-43 zoned parcel 
in the Buckeye area. The request is located on parcel 504-41-006T and is situated at the northwest 
corner of Roeser & 239th Ave. The subject site is located on a  small county island that is 
comprised of approximately 10 acres over five residential lots, with the subject parcel accounting 
for approximately 4.9 acres of the county island.  
 
2. 
The request is for an 80’ communications pole and facility designed to be obscured with a faux-
tree ‘monotree’ covering chosen through direct talks with neighbors and the parcel owner. The 
SUP is specifically requested due to the location of the WCF on the parcel which does not meet 
by-right location setback standards of 160’ as the proposed location is 110’-9” from the northern 
and 20’-5” from the western parcel boundary.

Public Participation Summary:

The applicant posted the site and sent notification to all owners within 300’ of the proposed 
parcel. The applicant has been in direct contact with the immediate neighbor to the north, The 
Vargas Family,  who are currently in the process of completing their new home on the adjacent 
parcel. Discussions with the Vargas Family resulted in the applicant moving the WCF pole location 
100’ to the south away from their parcel as well as being involved in choosing the screening faux 
tree design.

Staff and the applicant have also been in contact with another neighboring landowner and their 
real estate market representative who are opposed to this proposed WCF. Their concerns are the 
unsightly nature of the tower, property value influence and direct health impacts a tower may 
bring.

The case was routed to all registered area of interest members within the parcel vicinity. The City 
of Buckeye responded with a comment letter stating they wish to see the tower developed with 
City of Buckeye WCF regulations due to neighboring jurisdiction and existing and planned single 
family home subdivisions to the East, South & West of the project. City of Buckeye regulations 
would limit the tower to 50’ and require setbacks of 50’ from each lot line. The City additionally 
commented they would prefer to utilize a palm style tree for screening for the tower.  
 
Staff Analysis:

Staff supports this request to add an additional communications tower in this area. The new 
tower will provide accessibility, additional technology connections, and help fill in gaps for 
emergency services network. Staff recognizes the efforts the applicant made to change the 
location, screening and faux tree design in directly communicating and working with neighbors.  
 
12. 
Staff recognizes the City of Buckeye’s design concerns to limit the tower to 50’ per the City design 
guidelines, however, due to the 2014 Infrastructure Order adopted to the FCC Spectrum Act of 
2012, tower operators have the right and ability to expand approved facilities up to 20’ or 10% of 
tower height (whichever’s grater). With the ability to expand and the applicants’ efforts in working 
with the neighbor on site and design, staff supports the 30’ expanded height to 80’ which also 
corresponds to County standards for approved tower height.  
 
Recommendation:

Staff recommends the Commission adopt a motion recommending that the Board of Supervisors 
approve Z2022185 subject to the following conditions ‘a’ – ‘g’:

Purpose of Request 
 
T-Mobile is committed to improving coverage and expanding network capacity to meet 
customer demand throughout Maricopa County. T-Mobile in cooperation with TowerCom is 
proposing a new Wireless Communication Facility (WCF) to be located at 23910 W Roeser Road, 
Buckeye.  
 
The proposed WCF will provide residents, visitors and businesses with improved high quality 
reliable wireless service for both personal & business, in addition to enhancing emergency 
services in the area. 
 
Details of Request 
 
T-Mobile is proposing a new 80’ WCF disguised as a “Tree” with an associated equipment 
compound enclosed by a masonry wall. The proposed site will be centrally located on the 
subject property. The site will also accommodate AT&T as detailed on the attached site 
plan/elevation, and possibly can accommodate additional carriers if necessary. 
 
 
 
 
 
 
 
Proposed Site Location

The proposed 600 sq/ft equipment compound will be enclosed by an 8’ Masonry wall and will 
have the following setbacks: 
 
From North Property Line: 100’-2” 
From South Property Line: 514’-11” 
From East Property Line: 293’-1” 
From West Property Line: 7’-7” 
 
SUP Request 
 
T-Mobile is requesting a Special Use Permit to allow an 80’ WCF structure height, and two 
antenna arrays at different levels with a diameter of 12’, and the following pole setbacks:

City of Buckeye Comments – I did respond to the City of Buckeye comments via email on 
1/13/23, and received a response from City planner Ken Galica on 1/17/23. 
 
The proposed site is designed to accommodate multiple carriers, in fact AT&T is ready and 
waiting to co-locate on the subject site. Ken did mention that they City of Buckeye would 
support a taller site if multiple carriers, so the 80’ is justifiable and typically allowed in RU-43 
elsewhere in the County.  
 
With regards to the type of site, we have been working with the adjacent neighbors and the 
consensus is that the proposed Broadleaf is the preferred method of stealthing. The City of 
Buckeye has preferred typical Monopole type sites in the past, but subject property ownership 
and adjacent neighbors prefer the proposed Broadleaf Treet over any other option.  
 
The most recent wireless technology requires more radio equipment to be mounted closer to 
the antennas up on the actual pole/structure. So a Broadleaf Tree can better conceal this type 
of equipment configuration as opposed to a MonoPalm. The Broadleaf Tree branches will not 
only better conceal the antennas/radios, but will hold up better overtime from a UV 
perspective, and therefore maintain the aesthetics of the site long term. A Broadleaf Tree with 
the proper branch density/color can be far more aesthetically pleasing and durable over the 
best quality MonoPalm.

The proposed site maybe visited once a month for routine maintenance, or the event of a 
breakdown, so the proposed use will not impact traffic in the area and will comply with all local, 
state and federal laws & regulations.

I would like to express my opposition to the requested Special Use Permit for a new Wireless 
Communication Facility at 23910 W Roeser Road, Buckeye AZ 85326.  
 
This unsightly tower will be placed extremely close to our lot and also directly next door to a family 
home being built. It is also extremely close to a housing development and schools. Not only is this 
very unsightly, it will negatively affect the house prices of properties in the vicinity, but also exposure 
to microwaves from cell phone towers can interfere with your body's own EMFs, causing a variety of 
potential health problems, including, headaches, memory loss, cardiovascular stress, low sperm 
count, birth defects and cancer.

Dear Andrew- 
 
I represent the LOA Group  & Ben Harvey owners of 504-41-006V, a residential 
zoned 1 acre parcel of vacant land that is currently on the market for sale.  This 
parcel is approximately 170 feet north of the proposed 80 foot cell tower.  The LOA 
Group is opposed to the placement of the cell tower and are concerned that they 
will not be able to sell their lot. Not only are the towers unsightly, they could pose a 
health risk from RF radiation. These are valid concerns for a potential buyer 
wanting to live in this location. 
 
Barbara Jane Hunt of 23910 W. Roeser Road, owner of 504-41-006 , a 5 acre parcel, 
sold the 4 adjacent north 1 acre parcels to various buyers in 2006 including the 
parcel owned by the LOA Group.  The only use for the four parcels are for single 
family homes. These parcels are on a county island along with Hunt's parcel and 
surrounded properties in the  City of Buckeye.  
 
 
The parcel on the north boundary of Hunts property where the cell tower is 
proposed to go is owned by Mr. VARGAS is currently under construction for his

new home. that cell tower will be within 9 feet of the VARGAS home and 170 feet of 
the LOA Group parcel.  There is another new home being constructed on the 4th 
parcel by Mr. Zepeda.

A solution for this issue would be to move the proposed  cell tower 600 feet SOUTH to the 
southwest corner of Barbara Jane Hunt's property where the tower would be facing Roeser 
Road. 
 
The City of Buckeye also recommended that the tower be 50 feet and not 80 feet and the 
minimum set back from any property line be at least the height of the tower to be 
constructed.  Please ask the applicant to consider moving the tower 600 feet to the southwest 
corner of the Hunt property.

Good morning, Andrew:  
 
Given that the proposed cell tower is located in a small county island with Buckeye jurisdiction on all sides, we do kindly 
request that the tower meet the City’s design requirements.  
 
For context, a residential subdivision, Montana Vista II, is in the final stages of review just west of the site (Zoning and 
Preliminary Plat approved, Final Plat in review – see attached), and we have an existing single‐family community to the 
east, so it is even more important that we make sure the tower will be scaled properly at this location.  
 
The design standards that the City would request be applied to this location are: 
 
Limit height to 50 feet 
 
Setback from west and north property lines should be at least the height of the proposed tower (a 50’ tower 
would be setback at least 50’ from both of those property lines).  
 
A stealth design should be provided – with palms provided on the property, a date palm design would be 
appropriate here.
