The applicant is seeking a Special Use Permit for 5.94 acres in the
Rural-43 zoning district to allow a group care facility for an
educational institution. The site is currently developed as five (5)
single-family residential homes within six (6) parcels. This SUP
would allow the Grove Bible Church educational institution located
north to the subject site, to provide housing to students and interns
of the church. This SUP is not proposing any new structures but
using the existing residential homes with a total of 23 sleeping
rooms to accommodate approximately 6-10 students/interns per
residence. There is no known opposition and no outstanding
concern from county review agencies.

On 11/2/23, the Commission voted 5-0 to adopt a motion
recommending the Board of Supervisors approve Z2022222
subject to conditions ‘a’ – ‘k’:
a.
Development of the site shall be in substantial conformance with the Site Plan entitled
“The Grove Bible Church Special Use Permit Z2022222“, consisting of two full-size sheet,
dated August 1, 2023, and stamped received September 26, 2023, except as modified by
the following conditions. Staff may determine slight refinements to remain in substantial
conformance with the approved site plan. Minor and major amendments to the site plan
will be determined in accordance with Chapter 3 of the Maricopa County Zoning
Ordinance.

b.
Development of the site shall be in substantial conformance with the Narrative Report
entitled “Narrative Report The Grove Church”, consisting of sixteen pages, stamped
received September 26, 2023, except as modified by the following conditions.
c.
The following Planning Engineering conditions shall apply:
1.
Without the submittal of a precise plan of development (showing future
development), no development approval is implied by this review, including, but
not limited to drainage design, access and roadway alignments. These items will
be addressed as development plans progress and are submitted to the County for
further review and/or entitlement.
2.
Any development must ensure that historic drainage patterns are maintained at
the up and downstream limits of development.
3.
Since Queen Creek Road is within the jurisdiction of the City of Chandler, the
applicant is responsible for coordinating with the City to review any traffic impact,
right-of-way dedication, permitting or roadway improvement requirements for any
future entitlement application (i.e. plan of development.
4.
Storage of materials, walls/fence, parking, wells, septic systems and storm water
retention are prohibited in the (future) right-of-way.
5.
The subject site is located within the County’s Urbanized Area. If the site
disturbance is more than one (1) acre then a Storm Water Pollution Prevention
Permit (SWPPP) is required. If the site disturbance is less than one (1) acre, then
a SWPPP from the County (PND) is not required. This does NOT preclude the
requirement to obtain a Construction General Permit (CGP) Notice of Intent to
Discharge (NOI) from the State (ADEQ), as may be required.
6.
All development and engineering design shall be in conformance with Section
1205 of the Maricopa County Zoning Ordinance; Drainage Policies and Standards;
Floodplain Regulations for Maricopa County; MCDOT Roadway Design Manual;
and current engineering policies, standards and best practices at the time of
application for construction.
d.
The applicant shall consolidate all six (6) parcels within 180 days of approval of this
special use permit and prior to zoning clearance for any construction permitting.
e.
The applicant shall complete any required construction permits for the appropriate
occupancy within one (1) year of approval of this special use permit and prior to
establishing the use and/or occupying the buildings.
f.
This special use permit is valid for a period of ten (10) years and shall expire on December
6, 2033, or upon the termination of the use for a period of 90 or more days, whichever
occurs first. All site improvements associated with the special use permit shall be
removed within 90 days of such expiration or termination of use.
g.
All outdoor lighting shall be in conformance with the provisions of Section 1112 of the
Zoning Ordinance and shall be placed so as to reflect light away from any adjoining rural
or residential zoning district.

h.
Prior to occupying the existing residence or any portion thereof for any use associated
with the special use permit, the applicant shall obtain a building permit to retrofit the
existing residence to meet current commercial building code requirements as applicable
and shall obtain a certificate of occupancy for the retrofitted building prior to occupancy.
i.
Noncompliance with any Maricopa County Regulation shall be grounds for initiating
revocation of this Special Use Permit as set forth in the Maricopa County Zoning
Ordinance.
j.
The property owner/s and their successors waive claim for diminution in value if the
County takes action to rescind approval due to noncompliance with conditions.
k.
The granting of this change in use of the property has been at the request of the applicant,
with the consent of the landowner. The granting of this approval allows the property to
enjoy uses in excess of those permitted by the zoning existing on the date of application,
subject to conditions. In the event of the failure to comply with any condition, and at the
time of expiration of the Special Use Permit, the property shall revert to the zoning that
existed on the date of application. It is, therefore, stipulated and agreed that either
revocation due to the failure to comply with any conditions, or the expiration of the Special
Use Permit, does not reduce any rights that existed on the date of application to use,
divide, sell or possess the property and that there would be no diminution in value of the
property from the value it held on the date of application due to such revocation or
expiration of the Special Use Permit. The Special Use Permit enhances the value of the
property above its value as of the date the Special Use Permit is granted and reverting to
the prior zoning results in the same value of the property as if the Special Use Permit had
never been granted.

Project Summary:
1.
The applicant is requesting a special use permit (SUP) for a group care facility for an educational
institution in the Rural-43 zoning district. The subject site is comprised of approximately 5.94
acres and is located approximately 419 feet east of the NEC of Gilbert Road and Queen Creek
Road in the Chandler area. The site is currently developed with single-family residential homes
and is comprised of 6 parcels. The subject site currently has an open violation case, V202101720
for operating a commercial business in the Rural/Residential zoning district without the proper
entitlement. This SUP would rectify the violation on the site.
2.
The Grove Bible Church located north of the subject site (APN 304-56-010G) currently operates a
religious educational institution within the City of Chandler jurisdiction and is proposing on using
the subject site within unincorporated Maricopa County to house students and church interns.
The applicant is currently not proposing any new structures on the site, but to use the existing 5
residential homes with a total of 23 sleeping rooms to accommodate approximately 6 to 10
students/interns per residence, depending on the number of bedrooms per residence. The group
care facility will be in use approximately eight to nine months per year (September through April).
3.
The project currently does not meet the required setbacks for the Rural-43 zoning district in the
front yard, west side yard, and rear yard. The applicant is requesting within this SUP to allow the
existing structures to remain as is, with a front yard setback of 23’ where 40’ is required, a west
side yard setback of 28’ where 30’ is required, and a rear yard setback of 27’ where 40’ is required.
This is due to poor lot splitting practice and unregulated land division so that lot lines were created
without regard to existing structures. Variances are required whether or not the subject parcels
are consolidated. Staff recommends consolidation due to existing buildings not only failing to
meet minimum setbacks but actually straddling lot lines

The project does not include screening to the north, east, and portion of the west since it is under
the same ownership, The Grove Bible Church. An 8’ masonry wall serves as screening only on the
southwest property line, which is adjacent to a gas station, QuikTrip, and a 6’ CMU wall with
wrought iron along the front of the subject site.
5.
The site will be accessed along the ingress/egress on Queen Creek Road which leads to a 24’
wide paved driveway with ancillary paved drives to each residential home. The applicant
discusses in their narrative that they don’t expect all the students or interns to have a car, but they
are proposing 24 parking spaces on the subject site with a parking agreement with the Grove
Bible Church site to the north to provide additional parking. The parking agreement has been
obtained. There are various walkways that connect the church site to the subject site.

designates the subject site as Neighborhoods with supports a range of residential densities and
a variety of non-residential uses such as commercial and institutional.
Public Participation Summary:

The applicant complied with the Maricopa County Citizen Review Process with the required
posting of the site and notification by first class mail to adjacent property owners within 300 feet
of the subject site and area interested parties. Signs were posted on the site in accordance with
applicable regulations. Staff received a public participation results report in accordance with
County requirements. To date, staff has not received any letters of support or opposition
concerning this zone change request from surrounding property owners.
Outstanding Concerns from Reviewing Agencies:

Staff did receive a letter from the City of Chandler as the applicant was initially proposing to
rezone the subject site for multi-family. The City of Chandler did not support a zone change unless
annexation occurred on site. When the City of Chandler was provided a project update regarding
the SUP request instead of a rezone, they did not provide any comments or concerns regarding
the SUP.
Staff Analysis:

The subject site is within the City of Chandler’s Municipal Planning Area which identifies the land
as Neighborhoods in the Chandler General Plan 2016. The proposed use of a group care facility

for an educational institution would facilitate the use desired by the City of Chandler. However,
without additional input from Chandler regarding the SUP staff cannot be certain.
14.
Staff recognizes that because the general area surrounding the subject site is developed with
single-family residential uses, staff is of the opinion that annexation and development in Chandler
is the preferred alternative. Annexation is encouraged, as highlighted in the Vision 2030
Comprehensive Plan Policy “Urban Solutions for Urban Development”. Staff recognizes that the
applicant discusses in their narrative that annexation is in the future plans for the subject site
when new development occurs, and the financial resources are available to process an
annexation.
15.
Staff supports this SUP request as the proposed use of the site, with recommended conditions,
due to the general compatibility with the surrounding residential land uses within the City of
Chandler. Staff recommends the SUP be valid for 10 (ten) years due to the an open violation on
the site (V202101720).
Recommendation:

Staff recommends the Commission adopt a motion recommending that the Board of Supervisors
approve Z2022222 subject to the following conditions ‘a’ – ‘k’:

4. NARRATIVE REPORT:
A. THE GROVE church

B. Purpose of Request
The Grove Church owns a 6 acre parcel in Maricopa County, with 5 exisiting homes, the
church is requesting a Special Use Permit in order for the homes to be used as Group Care
Facility for Educational Institution.
Currently the church is unable to financlly bear the cost of Annexing into the City of Chandler
and Rezoning: The cost of converting the 5 homes to sewer, sewer install and hook-up fees,
water meter hook up fees, and install, are estimated to be nearly half a million dollars.
In the future, in approximaly seven to ten years, when the church has rasied the capital to
develop the land, the church will at that time annex this proepety into the City of Chandler
and rezone.
For these reasons The Grove Bible Church is requesting a Special Use Permit to use these 5
homes as Group Care Facility for its educational institution.
C. Description of proposal
The site, approximately 6 acres (+/-), with 5 existing houses, needs a Special Use Permit in order
to accommodate the boarding of students at its education institution. The Grove church,
owner of the parcels, operates a religious institution on its premises and will use this site, in part,
for the boarding of these students and church intern students.
The 6 acre parcel (+/-) will accommodate approximately 50 residents, however, with future
development on the parcel, that number may or will increase. Each house will accommodate
approximately six to ten residents depending on number of bedrooms in the home.
The Group Care Facility will be in use approximately eight to nine months per year, September
through April.
Parking: The site contains 5 single family homes. The total number of sleeping rooms amongst
the 5 homes is 23. AS 1.5 parking spaces are required per sleeping room, the site must have or
have access to 35 parking spaces. A Parking Easement Agreement has been executed by
The Grove that allows the owner, tenants, and occupants of the site to park in and utilize the
350 parking spaces (including handicap parking spaces
sits
adjacent to the site. There are walkways that will allow students occupying the homes on the
site to walk from the church property and church parking lots to the site. Significant portions of
parking lot sits within three (300) feet of the subject property.
D. Relationship to Surrounding Properties
The use of this property fits well with the existing surrounding uses, which is residential
neighborhoods and gas station (with whom the property shares its west wall). These five homes
have been a part of this Chandler neighborhood for more than 30 years; where on this
property the Pratt family occupied these five homes with dozens of family members.
Also, in the immediate vicinity, directly to to the south and west are Legacy Traditional School,
Vertex Education, and Lincoln Preparatory Academy; as well as a Circle K, Quick Trip, Dutch
Bros Coffee, What-a-Burger, and Salad-to-Go.
This 6 acre parcel is contiguous to 30 acres also owned by The Grove church, therefore, no
screening wall or fence is necessary. The 6 acre parcel is bordered by The Grove to the north,
east and west. Quick Trip is the one external neighbor to the southwest
screen wall already divides the property.
E. Location and Accessibility
The site is located on a major arterially roadway (six lanes), Queen Creek Road, near the N.W.
corner of Gilbert Road.
The site is accessed from Queen Creek Road via an existing paved and curbed entrance that
leads into the property. This entrance has been in use for more than 30 years.
Eastbound traffic has an existing medium break and decel-lane to allow traffic to turn left into
the property. Westbound traffic has right-turn access to the property.
F. Circulation
The site currently has a main, paved driveway accessible from Queen Creek Road, with
ancillary paved drives to each residential home.
The City of Chandler is responsible for maintaining the ROW. And the city is responsible for
basin at the S.W. corner of the property. This ROW maintenance agreement was established
when the City of Chandler widened Queen Creek Road to six lanes in 2009.
The City of Chandler has no comments regarding traffic or ROW since no development of the
property is being proposed at this time, and because the City of Chandler agreed to maintain
the ROW when it widened the roadway in 2009.
G. Development Schedule
When the Special Use Permit is granted, The Grove church will apply for permits from the
County to remodel the interiors of some of the existing structures. No other site development is
currently planned.
H. Community Facilities and Services
This site is located in the Chandler Unified School District. Nearby is the Tumbleweed Park. The
Grove church is adjacent and offers worship services and counseling services.

Per the Safe Drinking Water Act, any water system that supplies more than 25 people or 15 service

A Minor Plan Review application must be submitted for any existing system(s) if being utilized and

Wastewater program.
An Onsite Application for Abandonment must be submitted for any onsite wastewater treatment
(septic) system(s) that are to be abandoned. Then following the abandonment, a Certification of
Closure/Abandonment must be submitted immediately after the work is completed.
