Council Districts: all Purpose and Recommendation The purpose of this report is to request Council approval of a Right of Way Occupancy License (License) for Vero Fiber Networks, LLC (Vero Fiber Networks) for an initial five- year term, with one automatic five-year renewal, provided the licensee is not in default. Staff recommend that the Council authorize the City Manager to execute this License on behalf of the City. Background & Discussion Vero Fiber Networks has applied for a License to work within the City’s rights-of-way and easements to install, operate, and maintain an underground dark fiber optic cable communications network to support business connectivity. Alternatives City Council could consider different licensing language. Furthermore, City Council could choose not to authorize this license. Fiscal Impact The City has received a $4,000 license application fee, which covers the City’s cost for processing the license. There will be an annual ROW Underground Conduit Fee of $1.89 per lineal foot of the City’s rights-of-way occupied for a dark fiber network, with a CPI escalator applied each year.
