The applicant is seeking a Special Use Permit for 1.38 acres in the 
C-2 zoning district to allow a pet cemetery. The current site is 
developed with a 3,385-sf commercial structure that would be used 
as an administrative office building for “Advanced Planning 
Services”, to support the pet cemetery on the site and the existing 
funeral chapel on the parcel adjacent to the north, also owned and 
operated by the applicant (Camino Del Sol). The development 
would also include a new 2,400 sf structure to serve as a new 
crematorium, storage, and vehicular storage. The north portion of 
the site would be used as the pet cemetery, which would include 6 
vertical niches with a height of 15 feet. 
 
The funeral home administrative office is an allowed use by right in 
the C-2 zoning district, this SUP would allow for the pet cemetery to 
be placed on the site. There is no known opposition and no 
outstanding concerns from county review agencies.

a. 
Development of the site shall be in substantial conformance with the Site Plan entitled 
“Camino Del Sol - Pet Cemetery - Special Use Permit Request (Z2023078)“, consisting of 
one full-size sheet, dated July 23, 2023, and stamped received August 29, 2023, except as 
modified by the following conditions. Staff may determine slight refinements to remain in 
substantial conformance with the approved site plan. Minor and major amendments to 
the site plan will be determined in accordance with Chapter 3 of the Maricopa County 
Zoning Ordinance. 
 
b. 
Development of the site shall be in substantial conformance with the narrative report 
entitled “Special Use Permit for Camino Del Sol Pet Cemetery Case Z2023078”, consisting 
of sixteen pages, dated August 24, 2023 and stamped received August 29, 2023, except 
as modified by the following conditions. 
 
c. 
The following Planning Engineering conditions shall apply: 
 
1. 
Engineering review of planning and/or zoning cases is for conceptual design only. 
All development and engineering design shall be in conformance with Section 
1205 of the Maricopa County Zoning Ordinance; Drainage Policies and Standards; 
Floodplain Regulations for Maricopa County; MCDOT Roadway Design Manual; 
and current engineering policies, standards and best practices at the time of 
application for construction. 
 
2. 
Based on the conceptual design nature of the information submitted, changes to 
the site layout may be necessitated by the final engineering design of the site’s 
drainage infrastructure. 
 
3. 
Detailed Grading and Drainage (Site Infrastructure) Plans must be submitted with 
the application for Building Permits. All grading that has occurred onsite shall be 
reflected in the submitted Grading and Drainage Plans. All wall details to be 
provided with building permit submittal. 
 
d. 
This special use permit is valid for a period of twenty (20) years and shall expire on 
December 6, 2043. 
 
e. 
Any outdoor lighting shall be in conformance with the provisions of Section 1112 of the 
Maricopa County Zoning Ordinance and shall be placed so as to reflect light away from 
any adjoining rural or residential zoning district. 
 
f. 
Noncompliance with any Maricopa County regulation shall be grounds for initiating 
revocation of this special use permit as set forth in the Maricopa County Zoning 
Ordinance.  
 
g. 
The property owner/s and their successors waive claim for diminution in value if the 
County takes action to rescind approval due to noncompliance with conditions. 
 
h. 
The granting of this change in use of the property has been at the request of the applicant, 
with the consent of the landowner.  The granting of this approval allows the property to 
enjoy uses in excess of those permitted by the zoning existing on the date of application, 
subject to conditions.  In the event of the failure to comply with any condition, and at the 
time of expiration of the special use permit, the property shall revert to the zoning that 
existed on the date of application.  It is, therefore, stipulated and agreed that either 
revocation due to the failure to comply with any conditions, or the expiration of the special

use permit, does not reduce any rights that existed on the date of application to use, divide, 
sell or possess the property and that there would be no diminution in value of the property 
from the value it held on the date of application due to such revocation or expiration of 
the special use permit.  The special use permit enhances the value of the property above 
its value as of the date the special use permit is granted and reverting to the prior zoning 
results in the same value of the property as if the special use permit had never been

Project Summary: 
 
1. 
The applicant is requesting a special use permit (SUP) to allow for a pet cemetery. The subject 
property is zoned C-2, comprises approximately 1.38 acres and is currently developed with a 
vacant commercial structure. Camino Del Sol has currently acquired the subject property with the 
intent to have a pet cemetery with an office for administrative planning services as an ancillary 
facility for the property to the north where they currently have a funeral chapel and cremation 
center. All neighboring properties are zoned C-2. 
 
2. 
The development will consist of using the existing 3,385-sf commercial structure as an 
administrative office building for “Advanced Planning Services” to support the pet cemetery on 
site and the funeral chapel on the parcel to the north. The applicant is not proposing any new 
improvements to this existing structure. The development will also include a 2,400-sf structure to 
serve as a new crematorium, storage, and vehicular storage for two (2) services vehicles used by 
employees. The new crematorium would support the pet cemetery, which is proposed to be 
located just north of the structure, utilizing 2,800 sf of the subject site. The pet cemetery would 
include six (6) vertical niches that would be approximately 15’ in height within a 4’ x 6’ area.

Access to the pet cemetery will be directed near the northeast corner of the administrative office, 
through a defined sidewalk. An ADA ramp will lead guest along a 5’ wide path to the niches and 
seating areas. The area will be landscaped with canopy tress and hedges to provide shade and 
privacy within the seating areas. The landscape is proposed to enhance solitude from street 
traffic on Camino Del Sol and the adjacent parking area.

The site would use the existing access driveways on 138th Ave. and Camino Del Sol. The 
applicant is proposing 25 parking spaces with 5% being dedicated for ADA. The applicants 
estimates that the pet cemetery will generate approximately 4-5 visits per day, or 20 visits per 
month as the facility will not have any group ceremonies.

Staff notes that the proposed pet cemetery is appropriate for this location. The funeral home 
administrative office is an allowed use by-right in the C-2 zoning district (MCZO Section 804.2.19), 
so the SUP would allow for the pet cemetery to be placed on the site. Staff supports this SUP 
request as the proposed development of the site would not have any negative impacts to the area, 
as a similar use is located just north of site, also operated by Camino Del Sol Funeral Chapel.

1. Purpose of Request
On behalf of Darby Properties LLC (Property Owner), Gilmore Planning & Landscape 
Architecture (Applicant) respectfully submits for consideration this Application request for a
Special Use Permit (SUP) for a pet cemetery.  The property includes three parcels that are 
of equal size at just under 20,000sf and total 1.38 net acres (1.93 gross acres).  The 
property address is 13739 E. Camino Del Sol in Sun City West, Arizona.  Please refer to 
Exhibits 1 and 2 for the location of this subject property. The County Assessor identifies 
these three parcels as: 232-12-040, 041, and 042.  The east parcel, 232-12-040, will be the 
location of the new crematorium and pet cemetery and the site improvements associated 
with this SUP request. This east parcel is currently vacant.  
The existing building on the two west parcels is used by the Camino Del Sol Funeral Chapel 
& Cremation Center as an administrative office for Advanced Planning Services for their 
customers and guests, as well as support for this proposed Pet Cemetery.
The existing 
zoning on the three parcels is Intermediate Commercial C-2. The existing zoning will remain 
but would become C-2
SUP. Exhibit 3 is the Site Survey locating the existing building,
parking, and perimeter improvements, as well as the vacant parcel.  Site Photos have been 
included as a separate attachment with this application to provide perimeter views oriented 
to the street frontage and the vacant lot. 
Concurrent with this SUP Application is a separate lot combination application that has 
already been filed that will unite these three parcels into one.  This was a condition included 
with the Pre-App Comments issued for PA2023063, please, refer to Exhibit 10 for a copy of 
the lot combination plan. There are no modifications proposed for the existing administration 
building or the associated parking except for the service access drive to the new building.  
2. Description of Proposal
The SUP applies to the entire 1.4-acre property.  The Pet Cemetery will utilize approximately 
2,800sf within the vacant east parcel that is approximately 20,000sf in area.  The portion of 
the east parcel to be used for the pet cemetery area is approximately 40 x 70 .  The 
cremated remains will be interred within six (6) vertical niches (towers) that could be up to 
15 in height and typically 4 x 6 in area. Please refer to Exhibit 4 - Site Plan which includes 
an enlarged plan view of the defined Pet Cemetery, and Exhibit 5 for Photos of the typical 
niche towers, which are already in use at their existing funeral home immediately north.
Access to the pet cemetery will be directed to a defined crosswalk near the northeast corner 
of the existing office building.  An ADA accessible ramp will then lead guests along a 5 wide 
concrete sidewalk to the niche towers and seating areas.  A new landscape with canopy 
trees and hedges will provide shade and privacy for the seating areas. This landscape will
enhance the solitude from the street traffic (W. Camino Del Sol) and the adjacent parking.
The existing administrative office building is approximately 3,385sf and situated west of the 
pet cemetery.  It was originally constructed in 1982 as a commercial bank.  A public records 
request confirmed that the County does not retain any building permit records back to that 
date. This SUP Application does not propose any new improvements to that facility.

Located approximately 20 south of the pet cemetery, the Owner intends to construct a
2,400sf metal building, of which 600sf will be used for a new crematorium, approximately 
1,000sf is for storage, and the remaining 800sf will be for vehicular storage for parking two 
service vehicles used by employees. The new building will be designed using colors that 
complement the existing building.  It is not intended for any public use, but for the operations 
associated with the crematorium, garage and service access, and as a visual backdrop for 
the cemetery.
Please refer to Exhibit 6 for the Preliminary Architectural Site Plan and 
Building Elevations.
The construction of the new metal building will increase the total building area on-site to
5,785sf. Discounting the 800sf for vehicular storage leaves 4,985sf that will be the basis for
calculating the required parking.  At one space per 250sf, the required parking for the 
existing administrative planning office and the new metal building totals 20 spaces. Based 
on prior experience, the Owner/Operator is projecting that the Pet Cemetery will generate a
maximum of 4-5 visits per day, or 20 visits per month, which is extremely low, and these 
trips are sporadic and will not overlap. These Pet Cemetery users and guests will increase
the required parking from 20 to 25 spaces.
The reference to the Pet Cemetery being a 
public assembly use per Section 1102.1.2 is not fully relevant.  Other than individual 
benches associated with the niche towers, there are no facilities planned for any group 
ceremonies.  
The existing parking count is 29. The west side access into the new structure will remove 3 
parking stalls, but will include two vehicle spaces within the new building reducing the 
parking count by one space to a net provided parking count of 28. Those two indoor spaces 
are only available for service vehicles used by employees. Although the code requirement 
for the two buildings totals 20 spaces, with only three full time employees, available parking 
will not be an issue for the office, their guests and vendors. Of the 28 provided spaces, 8
parking spaces are available for the Pet Cemetery, but realistically many more will be
available which will easily satisfy the maximum projected daily guest visits of 4-5 per day.  
The days and times of operation are Monday through Friday, 8:00AM 
4:30PM.  The total 
number of employees is three, two full time within the existing administrative building, and 
one full time within the new crematorium building.  Accordingly, we believe there is ample 
parking for the Advanced Planning Office, employees, and guests to the pet cemetery.
The development of this vacant site will not require any off-site improvements.  Vehicular
and pedestrian access will come from the west utilizing the existing driveways and parking.  
Utilities are already available on-site, or may be extended from the two west parcels, or from 
service taps already in-place.
These services will be resolved with the Building Permit 
Application.  This SUP will transform a vacant site into a use that supports the existing 
funeral operations and as a resource for area residents.

3. Surrounding Land Uses and Potential Impacts
The location of this proposed Pet Cemetery is situated within an established and fully
developed Sun City West.  All of the immediate surrounding properties that share any 
visibility to this SUP site have been improved with commercial projects.  The south side of 
the property backs onto a 60 wide concrete drainage channel and service drive, with single
family homes beyond that also back onto this same drainage channel.

Context Plan that identifies these surrounding properties and their existing 
zoning.  These surrounding areas are described as follows:
North: The subject property fronts north onto W. Camino Del Sol that is fully improved with 
5 lanes of traffic within a 110 ROW. The property immediately north is the Camino Del Sol 
Funeral Chapel & Cremation Center under the same ownership and zoned C-2.
The 
existing Administrative Planning Services building is an ancillary facility for that primary
Funeral Chapel & Cremation Center. This SUP will permit the installation of a pet cemetery 
that utilizes above grade niche towers.  The cemetery portion represents approximately 
2,800sf of the east parcel.  The cemetery portion is centered within the parcel and will be 
enclosed with landscaping to create some sense of privacy for family/guests who choose to 
visit.
East:  The east side is defined by an existing multi-tenant commercial/office complex on less 
than one-half acre zoned C-2.  The west façade is situated on the common property line and 
has no windows, so the impact is less than minimal, except for a new landscape that will 
absorb the building mass and provide some shade on their west wall.  
South:  The entire south side is defined by an approximate 5-6 screen wall that parallels an 
existing 45 wide concrete lined drainage channel owned by the County Flood Control
District and zoned C-2. Along the south side of the drainage channel is a parallel 15 wide 
access drive also owned by the Flood Control District, zoned R-7.  The area further south is 
a single-family neighborhood zoned R1-7 within the Sun City West Unit 22 Subdivision. The
closest residential home has a rear side that totals approximately 112 from the south 
property line.  The separation provided by the opposing rear yard setbacks with 
landscaping, the drainage channel, and access drive provides an effective buffer to the 
neighborhood.
The pet cemetery will also be separated from the south by the new 
crematorium structure that further buffers the south side, increasing the separation by 
another 100 to approximately 210 .
West: The west side of the property aligns with 138th Ave that provides local access for the 
Sun City West Unit 22 subdivision.
On the west side of 138th Ave is a financial planning 
office, Raymond James, that is Zoned C-2. The west side of the cemetery will be screened
by a landscape hedge to separate the existing parking.

4. Access / Circulation
The primary vehicular access to the property will be oriented to W. Camino Del Sol.  There 
are five lanes of traffic, two each way and one common left.  Access onto the property is 
available from three existing driveways; two off W Camino Del Sol and a third driveway off 
138th Ave.  The west driveway off Camino Del Sol is for ingress, and the east driveway is for 
egress.
The new Crematorium and Pet Cemetery will share these driveways and the 
existing parking.  There will be a service drive leading to the west side of the Crematorium
that will remove 3 existing parking spaces.  However; the new crematorium will include two
new indoor parking spaces that will reduce the existing parking on-site from 29 to 28
spaces, 2 of which are designated as ADA. Although the required parking per the County 
Ordinance is 20 for the two buildings, there are only 3 full time employees, leaving 23
spaces available for guest and vendor parking. Please refer to Exhibit 4 - Site Plan that 
illustrates the location of the existing and proposed improvements.
A Traffic Statement has been prepared by Paul Guzek with Lee Engineering that reviews 
the area traffic and the minimal impact of this proposed Pet Cemetery.  That Statement is 
included as a separate report with this SUP Application.
5. Development Schedule
The major portion of this project will be developed in one phase.  The crematorium will be 
constructed along with the cemetery improvements that will include the pedestrian access
from the parking area on the north side and at least 2 of the niche towers along with seating.  
The entire landscape will be installed in one phase.  As the capacity of the niche towers are 
filled, additional niche towers will be installed per the plan layout.  The associated 
improvements for the additional niche towers are relatively minor, requiring the individual 
constriction of the towers, seating, minor hardscape for walks, and low-level groundcovers 
for the landscape.  The initial installation will allow easy extension for lighting, irrigation, and 
the extension of walkways and seating.

EPCOR requires a minimum 6
service, which is adequate for anticipated wastewater 
demand. A Preliminary Sewer Report has prepared and included as a separate report with 
this application.
Site Drainage: The existing planning center and associated site improvements surface drain 
south to a wall opening into a constructed Flood Control District drainage channel. The 
crematorium and associated improvements will include shallow surface retention basins 
sized for first flush (0.5 direct runoff). Runoff in excess of the first flush volume is designed 
to drain to the existing wall opening via surface swales and curb openings, maintaining the
historic discharge point. Please refer to Exhibit 9
