Period of Availability for Expenditure of WIOA Title I Funds 
Pursuant to 20 CFR 683.110, funds allocated by a State to an LWDA under subpart- A sections 128(b) and 
133(b), funds that are not expended by an LWDA in the two-year period described in paragraph (b) (1) of 
section 128 (b) and 133(b) of the Workforce Innovation and Opportunity Act shall be returned to the State. 
Funds so returned are available for expenditure by State and local recipients and sub-recipients only during 
the third program year of availability. These funds may be distributed to LWDAs, which have fully expended 
their allocation of funds.  
 
This alert is for third year PY21/FY22 grant funds that were reverted to the state and is distributed to LWDAs 
that have fully expended their original PY20/FY21 WIOA allocation. These funds fall under the same rules 
and regulations and have the same allowability as original WIOA formula funds including a 10% 
administrative cap and must stay in the program they are granted under. Transferring funds from dislocated 
worker to adult may be allowable upon request in accordance with ADES Fiscal Policy Section 400.
