ORDINANCE NO. 5790
AN ORDINANCE EXTENDING AND INCREASING THE CORPORATE
LIMITS OF THE CITY OF MESA, MARICOPA COUNTY, ARIZONA,
PURSUANT TO ARIZONA REVISED STATUTES TITLE 9, CHAPTER
4, ARTICLE 7, AND AMENDMENTS THERETO, BY ANNEXING
THERETO CERTAIN COUNTY RIGHT-OF-WAY ADJACENT TO THE
EXISTING CITY LIMITS OF THE CITY OF MESA.
WHEREAS, Arizona Revised Statute ("A.R.S.") § 9-471 (0) provides for transferring
county right-of-way or roadway to an adjacent city by mutual consent of the governing
bodies of the county and city if the county right-of-way being transferred is adjacent to
the receiving city and if the governing bodies of the city and county each approve the
proposed transfer at a public meeting of their governing bodies; and
WHEREAS, pursuant to A.R.S. § 9-471 (0), the City of Mesa ("City") desires to annex
into the City that certain Maricopa County right-of-way located adjacent to the City,
within the 3300 to 3600 blocks of South Val Vista Drive, legally described in Section 1
below and shown on the map attached to this Ordinance as Exhibit A ("Right-of-Way").
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF MESA MARICOPA COUNTY, ARIZONA, AS FOLLOWS;
Section 1:
Pursuant to A.R.S. § 9-471 (0), the Mesa City Council desires to
annex to the City of Mesa the county Right-of-Way located adjacent to the City of Mesa
depicted on the map attached hereto as Exhibit A and legally described below:
A PORTION OF RIGHT-OF-WAY LOCATED IN THE NORTHEAST
QUARTER SECTION 32, TOWNSHIP 02 NORTH, RANGE 06 EAST
OF THE GILA AND SALT RIVER MERIDIAN, MARICOPA COUNTY,
ARIZONA, AND BEING MORE PARTICULARLY DESCRIBED AS
FOLLOWS:
COMMENCING AT THE EAST QUARTER CORNER OF SAID
SECTION 32, BEING A FOUND CITY OF MESA BRASS CAP IN
HAND HOLE, FROM WHICH THE NORTHEAST QUARTER
CORNER OF SAID SECTION 32, BEING A FOUND BRASS CAP IN
HAND HOLE, BEARS NORTH 00 DEGREES 31 MINUTES 58
SECONDS EAST, 2640.93 FEET (BASIS OF BEARING);
THENCE ALONG THE EAST LINE OF THE NORTHEAST
QUARTER OF SAID SECTION 32, NORTH 00 DEGREES 31
MINUTES. 58 SECONDS EAST, 787.02 FEET;
THENCE DEPARTING SAID EAST LINE, NORTH 89 DEGREES 28
MINUTES 02 SECONDS WEST, 102.77 FEET TO THE POINT OF
BEGINNING;
THENCE SOUTH 63 DEGREES 27 MINUTES 41 SECONDS
WEST, 81.02 FEET, TO A NONTANGENT CURVE, CONCAVE
EASTERLY, WITH RADIUS THAT BEARS NORTH 72 DEGREES
12 MINUTES 05 SECONDS EAST, A DISTANCE OF 994.93 FEET;
THENCE ALONG SAID CURVE TO THE RIGHT, THROUGH
CENTRAL ANGLE OF 38 DEGREES 19 MINUTES 45 SECONDS,
AN ARC DISTANCE OF 665.58 FEET;
THENCE NORTH 20 DEGREES 31 MINUTES 50 SECONDS EAST,
95.07 FEET;
THENCE NORTH 15 DEGREES 07 MINUTES 05 SECONDS EAST,
169.75 FEET TO A TANGENT CURVE, CONCAVE WESTERLY,
WITH RADIUS OF 1,090.92 FEET;
THENCE ALONG SAID CURVE TO THE LEFT, THROUGH
CENTRAL ANGLE OF 14 DEGREES 35 MINUTES 07 SECONDS,
AN ARC DISTANCE OF 277.71 FEET;
THENCE ALONG A LINE PARALLEL WITH AND 55.00 FEET
WEST OF THE EAST LINE OF THE NORTHEAST QUARTER OF

CENTRAL ANGLE OF 19 DEGREES 59 MINUTES 52 SECONDS,
AN ARC DISTANCE OF 347.26 FEET;
THENCE SOUTH 20 DEGREES 31 MINUTES 50 SECONDS
WEST, 205.42 FEET TO THE BEGINNING OF A TANGENT
CURVE, CONCAVE EASTERLY, WITH RADIUS OF 914.93 FEET;
THENCE ALONG SAID CURVE TO THE LEFT, THROUGH
CENTRAL ANGLE OF 37 DEGREES 33 MINUTES 29 SECONDS,
AN ARC DISTANCE OF 599.75 FEET TO THE POINT OF
BEGINNING.
SAID PORTION OF RIGHT-OF-WAY CONTAINING 172,105
SQUARE FEET, OR 3.9510 ACRES, MORE OR LESS.
Section 2:
Upon the Maricopa County Board of Supervisors approving the
transfer of the Right-of-Way at a regular public meeting as set forth in A.R.S. § 9-
471 (0), the Right-of-Way is annexed to the City of Mesa and the current corporate
limits of the City of Mesa are increased to include the Right-of-Way.
Section 3:
The recitals above and the exhibit attached hereto are fully
incorporated into this Ordinance by reference.
Section 4:
The City Clerk is hereby authorized and directed to forward a
copy of this Ordinance to the Maricopa County Board of Supervisors.
PASSED AND ADOPTED by the City Council of the City of Mesa, Maricopa County,
Arizona, this 19th day of June, 2023.
