The applicant is seeking a Special Use Permit (SUP) for an interim 
commercial use to accommodate an existing non-conforming 
recreational vehicle and boat storage facility in the Rural-43 zoning 
district. The subject site is comprised of approximately 2.5 acres 
and the applicant is requesting the SUP on 1.5 acres of the subject 
site. The site is located approximately 207’ east of the SEC of 
Gilbert Rd. and Water Tank Rd. in the Gilbert area. 
 
 
 
The site is already developed with 34 parking spaces in place. This 
SUP would rectify an open violation case (V202200812) on the site 
for operating a commercial business in the rural/residential zoning 
district without proper zoning entitlements.  
 
 
 
Staff has received 15 letters of support and 4 letters of oppositions, 
2 which were submitted anonymous and 2 from the adjacent 
neighbors directly to the west and east of the site. Concerns that 
were highlighted in the letters of opposition center around the 
proximity of the facility to the neighboring properties, privacy, and 
security.  
 
 
 
Staff has also received comments from the Town of Gilbert stating 
they do not support this SUP as the use is not an appropriate 
commercial use for the surrounding residential properties to the 
east, south, and north.

Recommendation: 
On 12/7/23, the Commission voted 4-2 to adopt a motion 
recommending the Board of Supervisors approve Z2022162 
subject to conditions ‘a’ – ‘n’:  
 
 
a. 
Development of the site shall be in substantial conformance with the site plan entitled 
“Special Use Permit Case No. Z2022162 25 E Water Tank Rd. Gilbert 85296“, consisting 
of one full-size sheet, stamped received May 3, 2023, except as modified by the following 
conditions. Staff may determine slight refinements to remain in substantial conformance 
with the approved site plan. Minor and major amendments to the site plan will be 
determined in accordance with Chapter 3 of the Maricopa County Zoning Ordinance. 
 
b. 
Development of the site shall be in substantial conformance with the narrative report 
entitled “Narrative Report for Special Use Permit for RV, Vehicle, and Boat Storage Facility”, 
consisting of five pages, stamped received May 3, 2023, except as modified by the 
following conditions. 
 
c. 
The following Planning Engineering conditions shall apply: 
 
1. Engineering review of planning and/or zoning cases is for conceptual design only. 
All development and engineering design shall be in conformance with Section 
1205 of the Maricopa County Zoning Ordinance; Drainage Policies and Standards; 
Floodplain Regulations for Maricopa County; MCDOT Roadway Design Manual; 
and current engineering policies, standards, and best practices at the time of 
application for construction. 
 
2. Based on the conceptual design nature of the information submitted, changes to 
the site layout may be necessitated by the final engineering design of the site’s 
drainage infrastructure. 
 
3. Detailed grading and drainage (site infrastructure) plans must be submitted with 
the application for building permits.  
 
4. Water Tank Road is within the jurisdiction of the Town of Gilbert.  The applicant 
will be responsible for coordinating with Gilbert to review any traffic impact, right-
of-way dedication, permitting or roadway improvement requirements. 
 
5. The retention basins with the equalizer pipe will have the same water surface 
elevations. 
 
6. The building permit will not be approved until the Stormwater Pollution Prevention 
(SWPP) Permit through Maricopa County Planning and Development is approved. 
 
d. 
The applicant shall complete any required construction permits for the appropriate 
occupancy within one (1) year of approval of this special use permit and prior to 
establishing the use and/or occupying the buildings.  
 
e. 
The applicant shall provide a solid 6’ CMU wall on the east, south, and west property lines 
and shall provide a 3’ landscape buffer on the east and west property lines where RVs are 
stored with 15-gallon xerophytic trees planted no greater than 20’ apart on center.

f. 
RV storage spaces shall be prohibited north of the rear plane of pool barrier, and the 
maximum number of RV storage spaces shall not exceed 34. 
 
g. 
The hours of operation shall be limited from 8 am to 6 pm. 
 
h. 
This special use permit is valid for a period of Five (5) years and shall expire on January 
24, 2029, or upon the termination of the use for a period of 90 or more days, whichever 
occurs first. All site improvements associated with the special use permit shall be 
removed within 90 days of such expiration or termination of use.  
 
i. 
There shall be no lighting associated with the RV storage facility. 
 
j. 
There shall be no shade canopies within the RV storage facility. 
 
k. 
There shall be a maximum of three (3) non-resident employees. 
 
l. 
Noncompliance with any Maricopa County regulation shall be grounds for initiating 
revocation of this Special Use Permit as set forth in the Maricopa County Zoning 
Ordinance.  
 
m. 
The property owner/s and their successors waive claim for diminution in value if the 
County takes action to rescind approval due to noncompliance with conditions. 
 
n. 
The granting of this change in use of the property has been at the request of the applicant, 
with the consent of the landowner.  The granting of this approval allows the property to 
enjoy uses in excess of those permitted by the zoning existing on the date of application, 
subject to conditions.  In the event of the failure to comply with any condition, and at the 
time of expiration of the special use permit, the property shall revert to the zoning that 
existed on the date of application.  It is, therefore, stipulated and agreed that either 
revocation due to the failure to comply with any conditions, or the expiration of the special 
use permit, does not reduce any rights that existed on the date of application to use, divide, 
sell or possess the property and that there would be no diminution in value of the property 
from the value it held on the date of application due to such revocation or expiration of 
the special use permit.  The special use permit enhances the value of the property above 
its value as of the date the special use permit is granted and reverting to the prior zoning 
results in the same value of the property as if the special use permit had never been

Project Summary: 
 
1. 
The applicant is requesting a special use permit (SUP) for an interim commercial use to 
accommodate an existing non-conforming recreational vehicle and boat storage facility in the 
Rural-43 zoning district. The subject site is comprised of approximately 2.5 acres and the 
applicant is requesting the SUP on 1.5 acres of the subject site. The site is located approximately 
207’ east of the SEC of Gilbert Rd and Water Tank Rd. in the Gilbert area.  
 
2. 
The applicant states in their narrative that the site has been operating as a vehicle storage facility 
for decades. The subject site currently has an open violation case, V202200812 for operating a 
commercial business in the Rural/Residential zoning district without the proper zoning 
entitlement. This SUP would rectify the violation on the site.  
 
3. 
The site is currently developed with a single-family residence, but the applicant is not including 
his residence within the SUP request. The site also includes a 3,952 square foot storage structure, 
37 parking spaces in the rear portion of the site, and a 6’ CMU wall on the south, east, and west 
boundary lines of the site. The applicant is proposing on paving and striping the subject site in 
order to be in compliance to MCZO regulations (MCZO Article 1102.7.9 & 1102.7.11).

The site can be accessed along the ingress/egress on Water Tank Road which is maintained by 
the Town of Gilbert. The property owner resides on the site but access to customers is on a self-
serve basis daily between the hours of 6 am and 10 pm. The vehicle storage area may be 
accessed by a gate located on the east portion of the site. The facility does not provide any 
dumping of wastewater or trash, it only serves for storage. The applicant states in their narrative 
that customers park their vehicles for approximately 3-4 months at a time. The facility serves the 
surrounding neighborhood for clients that cannot store their recreational vehicles and boats at 
their own home due to HOA restrictions.

Historic aerials show the property has been used as a recreational vehicle and boat storage 
approximately since 2009. On April 20, 2022, the code compliance division received a complaint 
and opened a code violation for operating a commercial business in the rural/residential zoning 
district (V202200812). The violation was verified by the site inspection on April 25, 2022. A code 
compliance hearing was scheduled for December 6, 2022 but was cancelled due to the applicant 
submitting the SUP application on August 19, 2022. The applicant does have a new hearing 
scheduled for November 21, 2023.

Area (0-1 d.u./ac).

Plan for Our Future 2020 Gilbert General Plan (adopted February 4, 2020): The Town of Gilbert 
designates the subject site as Neighborhood Commercial (NC) which supports basic services for 
the immediate area such as small-scale uses under 25,000 square feet per use or standalone 
buildings with limited traffic, noise, and sound impacts. This proposed SUP for a commercial 
vehicle storage facility Is not compatible with this land use designation as it exceeds 25,000 
square feet and would have an impact on traffic along Water Tank Road as the site only provides 
one access point. 
 
Public Participation Summary:

The applicant complied with the Maricopa County citizen review process with the required posting 
of the site and notification by first class mail to adjacent property owners within 300 feet of the 
subject site and area interested parties. Signs were posted on the site in accordance with 
applicable regulations. Staff received a public participation results report in accordance with 
County requirements and according to the report the applicant was in communication with 
neighbors who are supportive of the SUP. The applicant provided 14 letters of support that state 
the vehicle storage facility is needed in the neighborhood.  Most of the letters of support provided 
were from customers who currently or previously have used the existing vehicle storage facility.

Staff received 4 letters of opposition, 2 which were submitted anonymous and 2 from both 
neighbors directly to the west and east of the subject site. Concerns that were highlighted in the 
letters of opposition center around the proximity the facility to the neighboring properties, privacy, 
and security. The neighbor directly to the west is a Montessori Pre-School, who expressed 
concerns regarding the safety of the children. It was mentioned in the letter of opposition the 
fence that divides the property has been broken down due to RV’s parking too close and backing 
into the fence. The children’s playground is directly near the site.

Outstanding Concerns from Reviewing Agencies: 
 
13. 
Staff did receive a letter from the Town of Gilbert stating they do not support this request as this 
use does not serve the daily needs of abutting neighbors and does not provide adequate buffer 
to the residential properties to the east and south. The Town of Gilbert prefers annexation of the 
site and for it to be developed in conformance with the Town’s adopted general plan and the 
provision of their land development code. 
 
Staff Analysis: 
 
14. 
Staff recognizes that the general area surrounding the subject site is developed with single-family 
residential uses, and therefor staff is of the opinion that annexation and development in Gilbert is 
the preferred alternative. Annexation is encouraged, as highlighted in the Vision 2030 
Comprehensive Plan Policy “Urban Solutions for Urban Development.’ Staff recognizes this 
proposal is inconsistent with the Comprehensive Plan Policy as the applicant has stated they 
have no future plans to annex into the town of Gilbert. The subject site is within the Town of 
Gilbert municipal planning area which identifies the land as neighborhood commercial, therefore 
the proposed use for a vehicle storage is not supported by the town as it would negatively impact 
to the surrounding suburban area.  
 
15. 
Staff finds the use is not appropriate for the surrounding area as it is surrounded by single-family 
residential homes. A commercial vehicle storage for 34 recreational vehicles (boats, RV’s, etc.) is 
too intense of a commercial use at this location. Staff also finds that the site only provides one 
ingress/egress along Water Tank Road which is a safety concern. If the site cannot be accessed 
through the provided gate, these large recreational vehicles would be required to back into Water 
Tank Road which would be a safety issue and would have a negative impact on the flow of traffic 
in the residential neighborhood. The existing development along Water Tank Road is all single-
family residences except for the site located on the SEC of Gilbert Road and Water Tank Road 
which is a pre-school. 
 
16. 
The use interferes with the enjoyment of the neighboring properties which impacts the area’s 
public health, safety, welfare, and convenience. Staff received opposition from the neighborhood 
residents, more specifically the two (2) adjacent neighbors to the west and east, and the Town of 
Gilbert stating valid concerns which prompted staff’s recommendation that this SUP request be 
denied. 
 
Recommendation: 
 
17. 
For the reasons outline in this report, staff recommends the Commission adopt a motion that the 
Board of Supervisors deny Z2022162. 
 
18. 
However, if the Commission chooses to adopt a motion to recommend approval, staff offers the 
following conditions ‘a’ – ‘n’ for Commission consideration:  
 
a. 
Development of the site shall be in substantial conformance with the site plan entitled

Purpose of Request 
This request is for the issuance of a Special Use Permit that will allow RV, vehicle, 
and boat storage on my 2.5-acre property located in Maricopa County (parcel 
# 304-23-020J). The principal address of this parcel is 25 E. Water Tank Rd., 
Gilbert, AZ 85296. 1.5 acres of the property will be utilized for the Special Use 
Permit. My single-family residential home on the property is not part of this 
Special Use Permit. For the parking spaces, please see the Parking Table under 
the Description of Proposal section. The property is currently developed per the 
site plan and there will be no changes.  
 
Description of Proposal 
RV, vehicle, and boat storage will be operated on 1.5 acres of the 2.5-acre 
property. There will not be any signage for the proposed use on the property. 
The number and dimensions of the parking spaces are as follows:

70% of the parking spaces are paved, causing no dust, and the remaining 
spaces are covered with rock and granite. Low speeds on the property are 
enforced for safety and to prevent dust. There has never been a complaint 
regarding dust from any of the neighbors or the county since I’ve lived here. 
The facility is accessed by customers on a self-serve basis and the gate is kept 
closed but unlocked between the hours of 6 AM to 10 PM, Monday – Sunday.

The gate is locked from 10 PM to 6 AM, and access during that time is available 
by appointment only. Owner lives on the property and there are security 
cameras installed throughout the property. The entire back portion of the 
property is surrounded by a 6’ tall fence of masonry block that provides privacy 
and security. This back portion is accessible by a gate. The RV parking area 
under this Special Use Permit is behind this fence and gate. This facility does not 
provide any dumping of wastewater or trash; it is for storage only. 
 
Relationship to Surrounding Properties 
This facility offers convenient parking for motorhomes, travel trailers, boats, and 
other related vehicles for local clients who are unable to store their recreational 
vehicles and boats at their homes in nearby subdivisions because most of those 
types of communities have restrictions on parking recreational-type vehicles. 
Most of our customers store their vehicles for 3-4 months or more, at a time, 
giving low traffic to the neighborhood. This facility is located on a dead-end 
street and is surrounded by a 6’ block fence. The fence and the many large 
trees on the property provide a buffer between this property and the neighbors’ 
properties to the east, south, and west. Due to the low traffic, fence and tree 
buffer, there is little to no noise impact to the surrounding properties. There is an 
abundance of ambient light from the existing street lights on Water Tank Rd. and 
Gilbert Rd. provides adequate lighting at this time so I have no plans to install 
any on-site lighting. I encourage my customers to drop off and pick up their 
vehicles during the daytime, but if it becomes necessary in the future, I may 
install one or two lights as needed. There will not be any business signage on the 
property. From the street, this property looks like a well-maintained residential 
home and doesn’t look like a business. I have received numerous letters from my 
neighbors in support of this Special Use Permit because of the benefit this 
business will provide to the community.

Location and Accessibility 
The subject site entrance is accessed on Water Tank Road, approximately 500’ 
east of Gilbert Road. This property has a 46’ entrance with 25’ visibility triangle on 
both sides. There is low traffic impact since most of my customers leave their 
vehicles and RVs for long periods of time and rarely move their items off the 
property. This property is directly adjacent to, and west of, two commercial 
properties that currently utilize Water Tank Road for commercial purposes. Under 
the Town of Gilbert’s General Plan, this parcel is identified as Neighborhood 
Commercial.  
The Town presented 4 concerns: 
1. Limited length of time for the SUP. 
2. Ensure residential properties to the east and south are adequately 
buffered. 
3. Provide adequate site planning and access to eliminate impacts on 
Water Tank Road. 
4. Provision of no on-site lighting – reducing impact to neighbors. 
These concerns have all been addressed with the Town and within this narrative 
report. The Town of Gilbert’s position is a preference for the property to be 
annexed and developed in conformance with the Town’s adopted General 
Plan (Neighborhood Commercial). In other words, they will not agree with a 
Special Use Permit if I don’t annex to the Town of Gilbert. I have no plans to 
annex to the Town of Gilbert. 
 
Circulation System 
Access to this site is by one driveway located on Water Tank Road. Clients will 
enter through a secure gate to the main area. Parking spaces are laid out with 
numbers. The facility has enough space for a turn-around area in the middle of

the property. The exit will be at the same gate in the driveway that is used to 
enter the facility.

Good morning.  Thank you for the e-mail and providing us the opportunity to provide comments on this application.   
 
This parcel is a county island located within the Planning Area of the Town of Gilbert.  The Town’s General Plan identifies 
this parcel as Neighborhood Commercial.  The emphasis of this zone is on uses that serve the daily needs of abutting 
neighbors.  Uses permitted in this district tend to be limited to small-scale and with limited traffic, noise and sound 
impacts.  A vehicle storage use would not be an allowed use in this general plan category or zoning district. 
 
Gilbert’s concerns would include: 
              Limited length of time for the Special Use Permit in order to gauge and reduce negative impacts that may arise 
from the request. 
              Ensure residential properties to the east and south are adequately buffered.             
              Provide adequate site planning and access to eliminate impacts on Water Tank Road. 
              Provision of no on-site lighting – reducing impact to neighbors.
