The Board of Supervisors of Maricopa County, Phoenix, Arizona, convened in Formal Session at
9:30 AM on Wednesday, April 12, 2023, in the Supervisors' Auditorium 205 W. Jefferson Phoenix,
AZ 85003, with the following members present: Clint Hickman, Chairman, District 4; Jack Sellers,
Vice Chairman, District 1; Thomas Galvin, Supervisor, District 2 (entered late); Bill Gates,
Supervisor, District 3; Steve Gallardo, Supervisor, District 5 (entered late). Also present: Juanita

Kim Powell with Maricopa County Animal Care and Control introduced Chanel, a five-
year-old that has been at the shelter for about a month. Chanel is beefy, strong, and
loves belly rubs. Chanel also attended a PetSmart training and knows all commands.

Chairman Hickman recognized the new County Manager, Jen Pokorski. He also
commented on the women in leadership who represent Maricopa County.
Chairman Hickman asked the Clerk if there were any announcements or corrections to
the agenda. The Clerk said item #14; Appointment of Constable for the Agua Fria
Justice Precinct is being postponed. Item #53 as noted on the agenda has been
withdrawn. Item #64 Chief Deputy County Attorney Appointment reference to the A.R.S.
§11-419 (C) should be A.R.S. §11-419 (D).

d. Upon build-out of public sewer services to site the CUPD uses may be revisited via a
stipulation modification pending approval of the Board of Supervisors.
e. The CUPD overlay is applied to restrict the use of the site. Until such time as the site is
served by sewer, uses on the site shall only be those acceptable to the Maricopa County
Environmental Services Department (MCESD) that can be accommodated by septic
systems.
f. Development of the site shall conform with design standards laid forth in the El Rio Scenic
Corridor.
g. The following PND Engineering conditions shall apply:
1. Without the submittal of a precise plan of development, no development approval is
inferred by this review, including , but not limited to drainage design, access and roadway
alignments. These items will be addressed as development plans progress and are
submitted to the County for further review and/or entitlement.
2. Any development must ensure that historic drainage patterns are maintained at the up
and downstream limits of development.
3. A traffic impact study must be submitted with any future entitlement application (i.e. plan
of development) to identify the need for any offsite road/right-of-way improvements.

h. The granting of this change in use of the property has been at the request of the applicant,
with the consent of the landowner. The granting of this approval allows the property to enjoy
uses in excess of those permitted by the zoning existing on the date of application, subject
to conditions. In the event of the failure to comply with any condition, the property shall revert
to the zoning that existed on the date of application. It is, therefore, stipulated and agreed
that either revocation due to the failure to comply with any conditions, does not reduce any
rights that existed on the date of application to use, divide, sell or possess the property and
that there would be no diminution in value of the property from the value it held on the date

recommending the Board of Supervisors approve Z2021132 subject to conditions ‘a’ – ‘j’:
a. Development of the site shall be in substantial conformance with the Site Plan entitled
“Sprague Site Plan Special Use Permit Z2021132 For Light Trucks and Storage “, consisting
of 1 full-size sheet, dated 12/22/2022, and stamped received 01/04/2023, except as modified
by the following conditions. Staff may determine slight refinements to remain in substantial
conformance with the approved site plan. Minor and major amendments to the site plan will
be determined in accordance with Chapter 3 of the Maricopa County Zoning Ordinance.
b. Development of the site shall be in substantial conformance with the Narrative Report

e. All transformers, back-flow prevention devices, utility boxes and all other utility related
ground mounted equipment shall be painted to complement the development and shall be
screened with landscape material where possible. All HVAC units shall be ground-mounted
or screened with a continuous parapet for commercial projects.
f. The following Engineering conditions apply:
1. Prior to any issuance of any permits for construction/grading on the site, the
Owner/Applicant must apply for and obtain a Drainage Waiver to allow for a reduced storm
water retention volume for the site. The minimum retention shall be the grater of the pre vs
post or first flush volume of runoff.

2. Prior to issuance of building permits, the owner/applicant must provide an erosion setback
analysis conforming to ADWR State Standards (SSA 5-96) or Section 11.9 of the FCDMC
Design Manual – Volume 2.
3. Detailed grading and drainage plans must be submitted with building permit application(s).
4. Engineering review of planning cases such as this is conceptual in nature. All development
and engineering design shall be in conformance with Section 1205 of the Maricopa County
Zoning Ordinance; Drainage Policies and Standards; Floodplain Regulations for Maricopa
County; MCDOT Roadway Design Manual; and current engineering policies, standards and
best practices at the time of application for construction.
5. ADOT reserves the right to review any future plans, additions and/or changes to this
development in regards to any impact they may have on the State Highway System.
6. ADOT would like to remind the developer there is ADOT Right of Way in the area and they
must not encroach upon it without a permit. No work shall begin on ADOT right of way until
said permit is obtained.
7. ADOT would like to review any impacts that may arise regarding ADOT facilities such as
utility tie ins, drainage, fencing along right of way, traffic control if necessary, or landscape
encroachment within ADOT R/W during construction, along with any other potential impact

g. This special use permit is valid for a period of ten (10) years and shall expire on April 12,
2033, or upon termination of the use for a period of 90 or more days, whichever occurs first.
All site improvements associated with the special use permit shall be removed within 90 days
of such expiration or termination of use.
h. Prior to issuance of a building permit, written confirmation will be required from the
emergency fire protection jurisdiction having authority that the facility has been designed in
accordance with their regulations and requirements, and that emergency fire protection
service will be provided to the facility. Prior to issuance of the certificate of occupancy, local
fire protection jurisdiction review and approval will be required.
i. Noncompliance with any Maricopa County Regulation shall be grounds for initiating a
revocation of this Special Use Permit as set forth in the Maricopa County Zoning Ordinance.
j. The granting of this change in use of the property has been at the request of the applicant,
with the consent of the landowner. The granting of this approval allows the property to enjoy
uses in excess of those permitted by the zoning existing on the date of application, subject
to conditions. In the event of the failure to comply with any condition, and at the time of
expiration of the Special Use Permit, the property shall revert to the zoning that existed on
the date of application. It is, therefore, stipulated and agreed that either revocation due to
the failure to comply with any conditions, or the expiration of the Special Use Permit, does

into the Maricopa County highway system and will also authorize the maintenance and
acquisition of the necessary rights-of-way through donation, purchase, or condemnation.

COMMUNITY SOLUTIONS FUNDING
Authorize the Community Solutions Funding request for Stand Up Expo 2023 in the amount
of $2,400, with an expected start and end date of May 6, 2023.
The Maricopa County Mental Health Task Force has partnered with Valleywise Behavior
Health and other stakeholders to offer the “Stand Up Expo 2023". The purpose of this event
is to educate, inspire, and empower in the areas of behavioral health advocacy, services,
wellness, the justice system and more. This event brings the community and service
providers together to gain awareness and increase connections to behavioral health
resources. The Board of Supervisors’ Community Solutions Funding (CSF) is primarily
intended to cover the cost of initiatives that carry the potential of advancing Maricopa
County’s Strategic Goals and provide a clear public benefit for Maricopa County residents.
The Associated Maricopa County Strategic Goal is: Safe Communities.
Also, pursuant to A.R.S. 42-17106(B), authorize the following appropriation adjustments to
the FY 2023 budget:
1. Decrease the expenditure authority in the Non Departmental (D470) General Fund (100)
Non Recurring (NRNP) budget in the line “Community Solutions Funding” (4711) by $2,400.
2. Increase the expenditure authority in the Non Departmental (D470) General Fund (100)

CRIMINAL JUSTICE COMMISSION
Accept additional grant funds from the Arizona Criminal Justice Commission (ACJC) in the
amount of $275,000.00 for FY23 Victim Compensation claims.
The funds are $275,000.00 in ARPA (Federal Funding) CFDA #21.027.
The addition of the supplemental funding brings the total amount of the FY23 grant award
to $2,556,593.00.
The supplemental funding is limited for use in paying Victim Compensation claims and
cannot be used for indirect costs.
The Arizona Criminal Justice Commission Grant Number VC-23-oo8 commenced on July 1,
2022, and terminates on June 30, 2023.
ACJC Victim Compensation Grant funding is recurring.
The Maricopa County Attorney's Office's composite indirect cost rate for FY23 is 22.35% or
$61,462.50 for the additional funding.
The recoverable indirect cost of administering this grant is $0; the non-recoverable indirect
cost is $61,462.50. Non-recoverable indirect costs will be covered by the departmental
general fund budget. There is no requirement for matching funds. The original grant was
competitive and does not require ongoing cash contributions after the grant period's end
date. Grant revenues are not “local revenues” for the purpose of the constitutional
expenditure limitation, and therefore expenditure of the funds is not prohibited by budget law.
This funding directly supports the overall mandated function of providing victim services.

The Maricopa County Correctional Health Services (CHS) enhances community safety by

INCREASE EQUIPMENT SERVICES REVENUE AND EXPENDITURE BUDGET FY 2023
In accordance with A.R.S. 42‐17106(B), authorize the following appropriation adjustments to
the FY
2023 Equipment Services budget:
1. Increase the FY 2023 expenditure and revenue budgets for the Equipment Services
(D740)
Equipment Services Fund (654) Operating (OPER) by $3,730,706.
2. Offsetting expenditure and revenue adjustments in the Eliminations (D980) Eliminations
Fund (900)
Operating (OPER) in the amount of $3,730,706.
This appropriation adjustment is needed to increase the Equipment Services budget to
account for
increased costs related to vehicle fuel and parts. Budgeted amounts for FY23 did not
account for the sustained increase in prices related to fuel and parts due to the current global
economic situation. A detailed financial impact that shows the increases is attached to this
submission.
This action will have a net zero impact on the overall County budget.

INDIVIDUALS
Approve financial Intergovernmental Agreement between the City of Glendale and Maricopa
County administered by its Human Services Department.
The purpose of the Agreement is to expand heat relief services to people experiencing
homelessness, and also serve other vulnerable populations at risk of suffering from heat-
related illness or death in the greater Glendale area. The Subrecipient shall provide heat
relief respite centers – 7 days per week 12:00 PM to 8 PM during the months of May 1, 2023,
through October 31, 2023. An estimated minimum of 90 individuals per day are anticipated
to receive services.
The County shall provide the Subrecipient with $771,000 in American Rescue Plan Act,
Coronavirus State and Local Fiscal Recovery (ARPA) Funds under the Assistance Listing
Number 21.027.
The Agreement is effective beginning April 1, 2023, through December 31, 2023.
Also request authorization for the Chairman to approve and execute Administrative Change

Approve financial Intergovernmental Agreement (IGA) between the City of Surprise
(Subrecipient) and Maricopa County administered by its Human Services Department.
The purpose of the Agreement is to expand shelter infrastructure for homeless individuals in
the northwest area of Maricopa County. The Subrecipient shall expand homeless shelter
availability by:
Rehabilitating seven (7) residential units to be utilized as short-term non-congregate shelter
for women and families. It is anticipated 150 unduplicated persons shall receive temporary
shelter per year at this location; and Acquiring and rehabilitating existing multi-family housing
units for short-term shelter. It is anticipated 48 individuals will receive temporary shelter per
year at this location.
The County shall provide Subrecipient with $2,580,000 in American Rescue Plan Act
Coronavirus State and Local Fiscal Recovery (ARPA) Funds under the Assistance Listing
Number 21.027.

AMENDMENT TO IGA WITH ARIZONA DEPARTMENT OF ECONOMIC SECURITY FOR
REFUGEE SCREENING MEDICAL ASSISTANCE PROGRAM
Approve the release order for funding increase from the Arizona Department of Economic
Security (AZDES), Refugee Resettlement Program for Coordination-Refugee Preventive
Health Sreening, to Intergovernmental Agreement (IGA) Dl18-002141 between AZDES and
Maricopa County by and through its Department of Public Health. The funding is increased
to the not-to-exceed amount of $402,412.93 for the budget period of October 1, 2022 through
September 30,2023. The IGA term is September 01, 2017 through September 30, 2023.
The grant award is reoccurring and has been awarded to the department since 1983. There
is no cash or in-kind match requirement nor is there currently a requirement for continued
contributions should the grant end. The grant award is not a mandated function but provides
a benefit to the citizens by coordinating medical exams for refugees settling in Arizona. The
grant award is competitively bid.
Maricopa County Department of Public Health’s indirect rate for FY23 is 17.24%. This grant
allows for full indirect, therefore, the estimated amount of $59,174.33 is fully recoverable.
Departmental indirect rates are re-established at the beginning of each fiscal year and the
future indirect rates will be collected at the corresponding rates. There is no cost to the
County’s operating budget.
Grant revenues are not local revenues for the purpose of the constitutional expenditure
limitation, and therefore expenditure of the revenues is not prohibited by the budget law. This
Amendment does not alter the budget constraining expenditures of local revenues duly
adopted by the Board pursuant to A.R.S. §42-17105. The overall grant budget will be
adjusted as necessary to accommodate this grant through a future reconciliation. Funding
for this Agreement is provided by a Grant from ADES and will not affect the County’s general
fund.

OF UNIVERSITY OF ARIZONA
Approve Amendment 3 to Intergovernmental Agreement (IGA) between Arizona Board of
Regents for and on behalf of University of Arizona (U of A) and Maricopa County by and
through its Department of Public Health (MCDPH). The agreement provides funding for U of
A Mel and Enid Zuckerman College of Public Health (MEZCOPH) to include a mobile
vaccination clinic which will provide vaccination services for individuals in hard-to-reach
populations.
I. The above-named Intergovernmental Agreement (IGA) is hereby amended as specified
below:
A. Cover Page, Agreement Amount is changed from $250,000 to $806,364.
The additional $556,364 is to be used for a new Scope of Work (Exhibit B) beginning on

THE CDC FOUNDATION
Approve the retroactive Business Associate Agreement (BAA) and Memorandum of
Agreement (MOA) with The CDC Foundation and Maricopa County by and through its
Department of Public Health (MCDPH), Clinical Services. This is a non-financial Agreement,
and this Agreement begins on September 6, 2022, and shall terminate on July 31, 2023.
This agreement may be renewed annually unless terminated by either party, by providing
thirty (30) day written notice of termination to the other party.
These agreements are retroactively effective on September 6, 2022
The purpose of this Agreement is to comply with the requirements of the Health Insurance
Portability and Accountability Act of 1996 (42 USC §1320d et seq.) (“HIPAA”), the Health
Information Technology for Economic and Clinical Health Act (“HITECH”) of the American
Recovery and Reinvestment Act of 2009 (ARRA), which made changes to various provisions

the not-to-exceed amount of $115,808 which is for the budget period January 01, 2023
through December 31, 2023. The IGA term is January 01, 2022 to December 31, 2026.
This grant award is reoccurring and has been awarded to the department in previous years.
It is non-competitive and there is no cash or in-kind match required. The grant award is a
mandated function; should it be discontinued, on-going contributions may be required.

reimbursement but a maximum of 15% of salaries and employee related expenses. The

$2,255.74 is not recoverable; and, if necessary will be absorbed by the departments
operating budget.

RELOCATION OF THE GAS PIPELINE
Approve The Agreement for Construction with El Paso Natural Gas Company, LLC, a Kinder
Morgan Company (EPNG-KM). The Agreement is between EPNG-KM and Maricopa County
for the relocation of the gas pipeline facilities in conflict with the MCDOT Roadway
Improvement Project TT0600, Northern Ave.: 99th Avenue to Agua Fria. The estimated cost
to design and relocate the 16-inch high-pressure natural gas line is $2,294,945.00. Funds
are budgeted in Transportation System Management (TMAN) project, Sub-Project TT0600
Northern Ave.: 99th Avenue to Agua Fria.
Flood Control is in involved in the determined easement relocation adjustment. EPNG-KM
has confirmed prior rights, therefore MCDOT is responsible for all costs related to the design,
construction, and relocation of these facilities. Approval of this agreement will allow

Approve the Deactivation Agreement for the removal of the SRP above ground Irrigation
Structure that is in direct conflict with the MCDOT Transportation Improvement Project,
TT0712: 51st Ave. and Olney Ave.
SRP Land and Water services has provided the County with a means to work in partnership
to eliminate an above ground irrigation structure. The structure needs to be removed so the
parcel being developed on the southwest corner can complete design and construction, as

IGA WITH CITY OF MESA FOR THE PERMITTING AND ANNEXATION OF POWER
ROAD
Approve the Intergovernmental Agreement between Maricopa County and the City of Mesa
for the permitting and annexation of improvements to Power Road from Baseline Road to
Guadalupe Road.
The City of Mesa is currently constructing Monterey Park which is adjacent to Power Road.
In 2006, Maricopa County and the City entered into a separate Intergovernmental Agreement
for Improvements to the roadway (C-64-07-210-0-00). As part of that Agreement, the City
was required to annex the improvements.
As a result of the annexation not being completed, the City is required to obtain permits to
work within the County’s right-of-way to construct the necessary driveway access points to
Monterey Park. The City will begin the annexation process upon the Board of Supervisors’
approval of this Agreement.
Either Party may terminate this Agreement at any time before the expiration date by

The City is requesting assistance in the procurement of traffic signal parts and equipment for

Mr. Crowley, resident, commented on the transit, light rail, and Prop 400. He addressed
the lack of connections from the light rail to the bus stops. Mr. Crowley commented on
the money being spent on staff rather than addressing the issues of congestion,
volume, and pollution.

Supervisors'/County Manager's summary of current events - Resumen de temas de

Jen Pokorski, County Manager, briefly stated it was National Animal Control Officer
Appreciation week. She recognized the nearly 30 officers in the field every day
protecting public health, and helping stray animals. Ms. Pokorski thanked the officers
for their service.
Supervisor Gallardo stated he appreciated Mr. Crowley’s comments. He noted the
Board, Valley Metro, cities, and counties need to help people waiting at the bus stops
stay safe from the heat. He talked about an event coming up this weekend called
Founder’s Day-Whoopee Daze Festival in the City of Tolleson. It is a day to celebrate
the City of Tolleson, and it includes a variety of activities. He mentioned county
employees working on summer events to assist people who need services in the hot
summer. Supervisor Gallardo said he would be attending the State of the City, where
Kate Gallegos, Mayor of Phoenix, would give her address. He is looking forward to all
the festivities and events of the summer. Chairman Hickman and Supervisor Gallardo
commented on car show events.
Supervisor Gates welcomed Ms. Pokorski into her new position as County Manager.
He attended the Farm Breakfast in District 3 at Arizona Wholesale and stated it was a
great turn out. He mentioned Representative Judy Schwiebert, and Representative Tim
Dunn were present as well as City of Phoenix Councilwomen Ann O’Brien, and Debra
Stark. Supervisor Gates said he would be attending the State of the City to hear Mayor
Kate Gallegos speak. He would also be attending the inauguration for City of Phoenix
Councilmembers Jim Waring, Laura Pastor, Kevin Robinson, and Kesha Hodge
Washington. Finally, he commented on the report from former Arizona Supreme Court
Chief Justice Ruth McGregor and is grateful for the time she and her team spent on the
review of the printer issues from the General Election in November. Supervisor Gates
highlighted that all ballots were counted, suggestions were given on issues with the
printers, and there was no evidence of any tampering of the machines. He noted the
Board has made a commitment to assure the same issues do not occur in the future.
Supervisor Galvin congratulated Ms. Pokorski and looking forward to work with her. He
briefly talked about his attendance at the Governor’s Prayer Breakfast where he was
asked to lead the Pledge of Allegiance to the flag. He mentioned it was a diverse event
with people from different faiths, non-partisan, and a wide variety on the political
spectrum.
Supervisor Sellers welcomed Ms. Pokorski. He said in the last week, he has been
involved in all things transit. He attended a conference in the City of Mesa where the
annual Transit Conference was held and said it was a very informative organization. He
also talked about the East Valley Partnership Critical Infrastructure Committee. A
presentation was given by a person from Valley Metro that included what would be in
the Prop 400 Extension Plan. Supervisor Sellers noted it was an extremely
comprehensive, complete report. He said he encouraged the organization to share that

information to demonstrate their plan going forward, and make the system better
connected. Supervisor Sellers also noted Arizona State Transportation Board member,
Jenn Daniels, presented updates on major projects and funding issues. He attended
a meeting last week about the Arizona water crisis and a solution for a sustainable
future. He stated it was an excellent panel that included The Kyl Center, the Director
from the City of Chandler, Central Arizona Project (CAP), and the Arizona Department
of Water Resources. The people on the panel discussed planning. Supervisor Sellers
commented on improving the storage on the Rio Verde River.
Chairman Hickman commented on his trip to Spur Cross Ranch Conservation Area. He
described the scenery of the desert settings and remarked on its beauty. He mentioned
Maricopa County’s recent purchase of 30 acres, adding to the Conservation Area in the
Town of Cave Creek. Chairman Hickman accepted an invitation from KTAR, and was
asked about Justice Ruth McGregor’s report. Chairman Hickman said he spoke for the
County and county employees as a reflection in the report. He said there is work to do
and suggestions were made on the report. He commented on election workers,
commentary, threats, and machines. He appreciated the Board for staying strong.

under this contract.
The contract time extension is necessary for this on-call contract with SAECO to be able to
provide the required Quality Assurance Management and Materials Testing for the projects
that the District is constructing within FY23 through FY24. Extra funds are required to cover
