The Board of Supervisors of Maricopa County, Phoenix, Arizona, convened in Formal Session at
9:30 AM on Wednesday, June 14, 2023, in the Supervisors' Auditorium, 205 W. Jefferson Phoenix,
AZ 85003, with the following members present: Clint Hickman, Chairman, District 4; Jack Sellers,
Vice Chairman, District 1; Thomas Galvin, Supervisor, District 2; Bill Gates, Supervisor, District 3;
Steve Gallardo, Supervisor, District 5 (entered meeting late). Also present: Juanita Garza, Clerk;
Jen Pokorski, County Manager; Betsy Pregulman, Legal Counsel; Mia Vargas, Minutes
Coordinator.

INVOCATION - INVOCACIÓN
Vice Chairman Sellers introduced Pastor David Wade of Mount Calvary Baptist Church.
Vice Chairman Sellers said he and Supervisor Gates met Pastor Wade at a reception
for Senator Mark Kelly and were impressed with Pastor Wade’s involvement in the
community. Pastor Wade created the Mount Calvary Community Development
Corporation, a 501(c)(3) to serve church members and the community and noted under
Pastor Wade’s leadership, the church has experienced spiritual, financial, and
congregational growth. Vice Chairman Sellers listed a variety of organizations in the
community that Pastor Wade has served on. Finally, Vice Chairman Sellers thanked
Paster Wade for attending the meeting and offering the invocation.

PLEDGE OF ALLEGIANCE - JURO FIDELIDAD A LA BANDERA
Pastor Wade led the Pledge of Allegiance to the flag.
Chairman Hickman thanked Pastor Wade for coming to the meeting and for his
involvement in the community.

PET SHOWCASE BY MARICOPA COUNTY ANIMAL CARE AND CONTROL -
PRESENTACIÓN DE ANIMALES DOMESTICOS POR EL DEPARTAMENTO DE
CONTROL Y CUIDADO DE ANIMALES
Kim Powell with Maricopa County Animal Care and Control introduced Rover, a one-
year-old dog who has been at the shelter for about a week. Rover is well behaved,
calm, and looks like he has had training because he knows how to touch, sit, and walks
well on a leash. Ms. Powell said he is neutered so his adoption fee is waived. For more
information, please visit Pets@maricopa.gov.
Chairman Hickman asked the Clerk if there were any announcements or corrections to
the agenda. The Clerk said item 11 has been withdrawn.

to conditions. Failure to comply with conditions after a reasonable opportunity to bring the
property into compliance may result in the initiation of revocation at a public hearing. It is,

emergency fire protection jurisdiction having authority that the facility has been designed in
accordance with their regulations and requirements, and that emergency fire protection
service will be provided to the facility. Prior to issuance of the certificate of occupancy, local
fire protection jurisdiction review and approval will be required.
d. The following Planning Engineering conditions shall apply:
1. In accordance with DPSM 6.10.6.3 provide a minimum top width of 8’ for the existing
channel berm that fronts your parcel
2. Please submit plans to the Marvella HOA. Following approval provide copy of
authorization of the plans to County
3. Due to proximity submit a TIS for review and APPROVAL from City of El Mirage. Following
the agency’s approval provide a copy of authorization.
4. A MCDOT Right of Way Permit will be needed during the building permit phase. All work
within the ROW will require permit fees along with an Assurance Bond in the amount of the
work being performed in the ROW (roadway improvements, utilities, storm drain, signing and
striping, landscaping ext)
5. As part of half street improvements, maintain/provide ROW dedication to MCDOT along
site frontage of Northern Parkway Eastbound Frontage.
i. Identification of utilities or underground facilities within or adjacent to the required right-of-
way that may have prior rights and/or require relocation.
6. Signal timing Modification shall be completed by the developer at opening year with
coordination from MCDOT Traffic Design.
i. MCDOT has a current TIP project (TT0347 Northern Parkway) adjacent to this site.
Coordination of potential impact to this project must be communicated to Ben Markert,

recommending the Board of Supervisors approve Z2023008 subject to conditions ‘a’ – ‘g’:
a. Development of the site shall be in substantial conformance with the Site Plan entitled
“BUSHNELL“, consisting of 7 full-size sheets, dated March 15, 2023 and stamped received
March 22, 2023, except as modified by the following conditions. Staff may determine slight
refinements to remain in substantial conformance with the approved site plan. Minor and
major amendments to the site plan will be determined in accordance with Chapter 3 of the
Maricopa County Zoning Ordinance.
b. Development of the site shall be in substantial conformance with the Narrative Report
entitled “DW Tower, LLC. Site”, consisting of 5 pages, dated March 20, 2023, stamped
received March 22, 2023, except as modified by the following conditions.
c. The following Planning Engineering conditions shall apply:
1. Provide the required retention volume for the 100 year, 2 hour storm event with one (1)
foot of freeboard for the SUP area.
2. Provide a runoff coefficient based on Table 6.3 of the Maricopa County Drainage Policies
and Standards. Use 0.95 for commercial/industrial areas and 0.5 for retention basin areas.

Route 87.

emergency fire protection jurisdiction having authority that the facility has been designed in
accordance with their regulations and requirements, and that emergency fire protection
service will be provided to the facility.
f. Noncompliance with any Maricopa County Regulation shall be grounds for initiating a
revocation of this Special Use Permit as set forth in the Maricopa County Zoning Ordinance.
g. The granting of this change in use of the property has been at the request of the applicant,
with the consent of the landowner. The granting of this approval allows the property to enjoy
uses in excess of those permitted by the zoning existing on the date of application, subject

the Commission recommended conditions ‘a’ – ‘g’ but with revised condition ‘a’ to read:

Under A.R.S. § 42-11102(C), the Arizona State Retirement System (ASRS) may elect to
have the taxes on its income producing properties based upon their full cash value as
determined by this Office ("voluntary contributions") or pursuant to A.R.S. § 42-6201 et seq.,
it may provide for a government property lease tax ("GPLET"). The ASRS has timely notified

COMMUNITY SOLUTIONS FUNDING PROPOSAL
Authorize the Community Solutions Funding Proposal request for the Gila Bend Unified
School District, Softball Field improvements in the amount of $1,325,000 with an expected
start date of June 19, 2023, and an expected completion date of November 3, 2023.
The property was previously used as a softball field, but most recently was used to store
construction debris. This project will include reconstructing the field, repairing existing chain
link fencing, repairing the irrigation system, installing new dugouts and bleachers and
installing lights and a scoreboard. The softball field will be available for use to the students
of the Gila Bend Unified School District and the Gila Bend community. The Board of
Supervisors’ Community Solutions Funding (CSF) is primarily intended to cover the cost of
initiatives that carry the potential of advancing Maricopa County’s Strategic Goals and
provide a clear public benefit for Maricopa County residents. The associated Maricopa
County Strategic Goal is: Safe Communities.
Also, pursuant to A.R.S. 42-17106(B), authorize the following appropriation adjustments to
the final FY 2024 budget:
1. Decrease the expenditure authority in the Non Departmental (D470) General Fund (100)
Non Recurring (NRNP) budget in the line “Community Solutions Funding” (4711) by
$1,325,000.
2. Increase the expenditure authority in the Non Departmental (D470) General Fund (100)
Non Recurring (NRNP) budget in the line “D5 – Community Solutions Funding” (4765) by
$1,325,000.
These actions will have a net zero impact on the County-wide budget and do not alter the
budget constraining the expenditure of local revenues duly adopted by the Board pursuant
to A.R.S. 42-17105.

Supervisor Gallardo commented on items 19 and 20. He said the softball field has been
a project that has been a long time coming. He thanked the Maricopa County staff for
working with the Gila Bend Unified School District. Supervisor Gallardo said that almost
two years ago, Gila Bend was devasted by flooding. He and Gila Bend have been
working on infrastructure projects with Flood Control. The School District and the Red
Cross shelter were hit hard. He noted the County has been in communication with Gila
Bend to provide services for the community and a property targeted for restoration was
the softball field. Supervisor Gallardo said the County has partnered with Gila Bend on
an agreement to help with funding for the community. He thanked the County Manager,
Jen Pokorski, for moving forward on the agreement with Gila Bend and asked for the
Board’s support. Supervisor Gallardo said there will be a ribbon cutting ceremony in a
few months

IGA WITH GILA BEND UNIFIED SCHOOL DISTRICT
Approve and execute an Intergovernmental Agreement (IGA) between Maricopa County and
Gila Bend Unified School District for improving a softball field. Gila Bend owns certain real
property which is located at the SW corner of Logan Ave. and Richards St. that is used as a
softball field and the property is in a state of disrepair. Gila Bend desires that improvements
be made to the property for the public to use and enjoy. Maricopa County desires to use a
portion of Community Solutions Funding (CSF) for improvements to the Property. The

ACCEPT GRANT FUNDING FROM THE ARIZONA CRIMINAL JUSTICE COMMISSION
Approve the application and acceptance of grant funds from the Arizona Criminal Justice
Commission (ACJC) through the FY 2023-2024 Drug, Gang, and Violent Crime Program in
the amount of $807,390.75, which includes: $807,390.75 in Federal funds under CFDA
16.738 and $0 in State funds. This program requires a cash match of 25%, or $269,130.25.
The total award is $1,076,521. These funds are for the enhancement of drug, gang, and
violent crime prosecution. This grant agreement, ACJC number DC-24-027, commences on
July 1, 2023, and will terminate on June 30, 2024.
Authorize the Chairman to sign all documents related to these grant funds, as applicable.
The grant funds, $807,390.75, may not be expended for any indirect costs which may be
incurred by the Maricopa County Attorney's Office or Maricopa County for the administration
of this grant (Agreement Page 8, Paragraph 35). The grant allows a 0% rate for indirect costs
or $0 that may be incurred by the County Attorney's Office or Maricopa County for the
administration of this grant. The Maricopa County Attorney's Office's composite indirect cost
rate for FY24 is 20.20%, or $217,457.24. The recoverable indirect cost of administering this
grant is $0; the non-recoverable indirect cost is $217,457.24. Nonrecoverable indirect costs
will be covered by the departmental general fund budget.
The 25% match requirement will be covered by the departmental general fund. The grant is
competitive and reoccurring and does not require ongoing cash contributions after the grant
period's end date. This funding directly supports the mandated function of prosecution of
criminal cases.
Grant revenues are not "local revenues" for the purpose of the constitutional expenditure
limitation, and therefore budget law does not prohibit the expenditure of these funds.

MARICOPA COUNTY ATTORNEY'S OFFICE INTERN STIPEND PROGRAM
Approve the creation of an intern stipend program for the Maricopa County Attorney's Office.
The Maricopa County Attorney’s Office (MCAO) accepts law student interns who have
completed their first two semesters of study. Those in their second (2L) and third (3L) years
of study may become a Certified Limited Practice Student by seeking certification through
Arizona Supreme Court’s Rule 39(c) program. The certification allows the students to appear
in court for hearings, or to conduct trials, under the supervision of a supervising DCA. Interns
have the opportunity to work on different types of cases depending on their assigned bureau,
including general trial cases, juvenile cases, justice court misdemeanors, and specialized
prosecutions. MCAO attracts students from throughout the nation because it is the third-
largest prosecution agency in the nation. Additionally, many Arizona residents attend law
school out of state and prefer to return to Arizona following graduation. The stipend program
is designed to entice the best law school applicants to apply to MCAO. The stipend program
will apply only during the summer, which is when students can participate full-time and get
the most out of their internship by seeing the life of a prosecutor at MCAO and getting
exposed to MCAO’s culture and values.

Contractor are collectively referred to here as the “Parties” and individually as a “Party.”
The services Education Evolving provides are essential for successful implementation of the
Maricopa County Teacher Powered School Network a collaboration between the Maricopa
County School Superintendent, Empower Schools and Teacher-Powered Schools.
This item accompanies and is essential to four IGA's and one agreement with local school
districts and a local charter school to implement the Teacher Powered School Network.

SIMULATORS (50SIMULTR) – FY24
Approve acceptance of funding appropriation of up to $330,000 from the Office of the State
Treasurer to purchase V-300 LE decision making and firearms training simulators. The
anticipated term of this funding is July 1, 2023 through June 30, 2024. This is the first time
this funding has been awarded to the Sheriff’s Office and it will not be re-occurring. This
funding is formulaic and non-competitive. There is no match requirement, or future or
ongoing contributions required when the funding period ends.The projected use for these

Accept reimbursement funding in the amount of up to $10,000 from City of Phoenix, PD
Internet Crimes Against Children Task Force, for which Maricopa County Sheriff's Office
(MCSO) is an affiliate authorized in IGA 157605--0, AKA C-50-22-139-X-00, approved in an
action taken by the Board of Supervisors (BOS) on April 6, 2022. The BOS action taken
authorized acceptance of funding in the amount of up to $20,000.
The Sheriff’s Office indirect cost rate for FY23 is 12.3%. The indirect cost basis is $10,000.
Unrecoverable indirect costs associated with this Agreement are estimated to be $1,230.
These unrecoverable indirect costs will be absorbed by the General Fund.
This funding is competitive and does not require a match. The funding is recurring and has
been awarded to the Sheriff’s Office for over five years. The agreement does not require
future or on-going cash contributions after the grant period ends. This funding is not for a
specific mandate but supports the Sheriff’s Office overall public safety mandate.
The funding notification letter from City of Phoenix is attached to this item. This amount is

Approve the application and acceptance of grant funds from the Administrative Office of the
Courts (AOC) in the amount not-to-exceed $276,844 for the purpose of Family Counseling.
The grant award will begin on July 1, 2023 and ends on June 30, 2024. The JPD department
was awarded $271,986 in FY23. Authorize the Chairman to sign all documents related to
these grant funds, as applicable. The Juvenile Probation Department indirect rate for FY23
is 23.07%. Total grant indirect costs are estimated to be $63,868 and are not recoverable.
The grant does require a cash equivalent match of $69,211.
The grant award is reoccurring and has been awarded to the department for over ten years.
The department has an in-kind match requirement of $69,211 during the grant award period.
The grant award is a mandated function and provides a benefit to the citizens by providing
family counseling services to support juveniles and intended to support their success upon
release with the goal of providing behavioral change. The grant award is competitively bid

PLAN FOR EXISTING MUNICIPAL SOLID WASTE LANDFILLS
Approve the Memorandum of Agreement for the Delegation of Authority of the Federal Plan
for Existing Municipal Solid Waste (MSW) Landfills between the Maricopa County Air Quality
Department (MCAQD) and the United States Environmental Protection Agency (EPA).
The EPA encourages states that do not have approved 111(d) plans to request delegation
of authority of the Federal Plan so they can have primary responsibility for implementing the
2016 municipal solid waste landfill emission guidelines until a 111(d) plan is approved.
Following Board approval in September of 2022, MCAQD submitted a delegation of authority
request to implement the Federal Plan for Existing MSW Landfills to the EPA. The EPA
drafted a Memorandum of Agreement incorporating the delegation of authority requirements
and it must be signed by the Chairman of the Maricopa County Board of Supervisors. The
Federal Plan and corresponding delegation of authority will no longer apply upon the
effective date of the approved 111(d) plan for Maricopa County.

been deemed eligible for the New Hope program. Maricopa County will provide a rabies
vaccination, dog license tag, and new owner transfer fee within the first year of transfer for
each dog three months of age or older at no cost to the Contractor. The cost for these
services is $52 for each animal transferred in FY 2022 and thereafter. Animal Care and
Control estimates ten (10) New Hope transfers annually, for a total of $520.00 per year, over
the term of the agreement. The term of this agreement shall commence upon approval and
execution by the Board and will expire on June 14, 2026.

REMANDED JUVENILES
Approve an Intergovernmental Agreement (IGA) between Maricopa County (the County) and
the Arizona Health Care Cost Containment System (AHCCCS) which in effect extends the
existing arrangement for the County's funding of behavioral health services for a term of one
year from July 1, 2023 to June 30, 2024.
County funding for services to the seriously mentally ill (SMI) under this IGA will be
$74,452,022 for FY 2023-24. This increases the level of County funding based on an
adjustment for inflation for services to the seriously mentally ill by $3,545,334, over the
funding paid under the previous IGA in FY 2022-23. The FY 2023-24 IGA also includes
funding for non-SMI services in the amount of $3,366,705 and substance abuse services in
the amount of $1,489,871 for the one-year term which is equal to the FY 2022-23 level. The
IGA will be in effect upon signature of the last party and shall remain in effect until June 30,
2024. The IGA may be amended, further extended or terminated pursuant to the IGA
provisions, including a 90-day termination without cause provision. Total County funding for
behavioral health services in FY 2023-24 under the IGA will be $79,308,598 for a one-year
term.

Approve a non-financial Affiliation Agreement between Widener University Center for Social
Work Education and Maricopa County, administered by its Human Services Department.
The purpose of the Agreement is to provide social work field training for BSW and/or MSW
students from Widener University Center for Social Work Education. The training will provide
students with education and training in service delivery to low-income, elderly and disabled
individuals served by the Human Services Department.
The Agreement shall be effective upon approval and signature by both Parties and shall be
one year from the date first entered and thereafter from year to year unless terminated by
either party.
Notice of termination by either party must be in writing at least 60 days prior to the termination
date.

IGA WITH ARIZONA DEPARTMENT OF ECONOMIC SECURITY FOR WORKFORCE
INNOVATION AND OPPORTUNITY ACT ACTIVITIES
Approve a financial Intergovernmental Agreement (Agreement) with Arizona Department of
Economic Security (DES) and Maricopa County, administered by its Human Services
Department The purpose of the Agreement is for the County to administer Workforce
Innovation and Opportunity Act Title I (WIOA) program activities in Maricopa County,
excluding the City of Phoenix.
DES shall provide the County with Program Year 2023/Fiscal Year 2024 (PY2023/FY2024)
funding in an amount-not-to-exceed $16,479,365. The period of funding availability for Adult
(AD), Dislocated Worker (DW) and Rapid Response (RR) activities is July 1 through June
30. Funding for Youth (YT) activities is April 1 through June 30. The Agreement term is July
1, 2023, though June 30, 2028 and shall be effective on date of last signature.
Funding for WIOA Title I Assistance Listing Number (ALN) #17.258 (Adult $4,968,475), ALN
#17.278 (Dislocated Worker $6,188,968), and ALN #17.259 (Youth $5,321,922) is
authorized by a U.S. Department of Labor for each Program Year.
Maricopa County, exclusive of the City of Phoenix, is a designated Local Workforce
Development Area (LWDA) under the federal WIOA. As a designated LWDA, services are
administered by the Maricopa County Human Services Department Workforce Development
Division ARIZONA@WORK - Maricopa County. WIOA services include career and training
opportunities, to job seekers, youth, and employers to meet the needs of workforce
development in the local area. DES contracts with the County on an annual reoccurring, non-
competitive basis.

NAVIGATION SERVICES
Approve financial Amendment No. 8 to the Agreement (Agreement) between Community
Bridges, Inc. (Subrecipient) and Maricopa County (County) administered by its Human
Services Department. The purpose of the Agreement is for the Subrecipient to provide
Navigation services for individuals experiencing homelessness in Maricopa County. The
Subrecipient and the County shall be referred to as the Parties.
The purpose of the Amendment No. 8 is to address the following:
A. Extend the Termination Date from June 30, 2023, through June 30, 2024.
B. Add that the County shall provide the Subrecipient with an additional $400,000 in County
General Funds Fiscal Year 2024 funding (Outreach Budget) for the Outreach Scope of Work
activities. Funding availability period is from July 1, 2023, through June 30, 2024.
C. Upon approval of this Amendment No. 8, the Agreement funding total amount is
$1,587,944.29 and shall consist of the following fund sources:
1. $553,000 – CDBG
2. $1,030,078.82 – General Funds
3. $4,865.47 – Non-Federal Grant Funds

Approve and execute Amendment No. 6 to Lease Agreement (L-7457) between Maricopa
County (County) and 800 West Galveston, LLC., for County’s use of leased classroom and
playground space located at 800 West Galveston St, Chandler AZ 85225 to provide Head
Start Services.
The purpose of the Amendment is to:
1. extend the Lease retroactively, through May 31, 2033 (Term) Upon County’s receipt of a
Certificate of Occupancy issued by the City of Chandler, a Fire Marshal’s non-violation
inspection certificate, and acceptance of the Tenant Improvements, the parties will execute
the Memorandum of Rate Increase, in substantially the same format as Exhibit “C” of the
Fifth Amendment, the Premises will increase to 3,154 square feet of exclusive use and 2,289
square feet of non-exclusive use, and the monthly rental rate shall increase to five thousand
three hundred ninety-five dollars and 25/100 ($5,395.25) and the monthly utility
reimbursement rate shall increase to six hundred eight five ($685.00) dollars for the duration

1. Amendment No. 6 to the Intergovernmental Agreement “Agreement” with Regional Public
Transportation Authority (RPTA/Valley Metro) and Maricopa County (County) administered
by its Human Services Department. The purpose of the Agreement is for RPTA to provide
transportation services to eligible Americans with Disabilities Act (ADA) Maricopa County
residents that reside in unincorporated areas of the County. The County provides funds to
RPTA for transportation services. RPTA and the County shall be referred to as the “Parties.”
2. The purpose of Amendment No. 6 is to address the following:
A. Amend the term of the Agreement from June 30, 2023, through June 30, 2024.
B. Replace the first paragraph of Attachment A (Annual Service Agreement) at page 16 of
the Master Agreement, as was amended by Amendments One, Two, Three, Four and Five
which addresses obligations of the Parties for fiscal year 2023 and 2024.

income households. The County provided the City with U.S. Department of Housing and

The purpose of Amendment No. 4 is to address the following:
A. Clarify the extension term for Amendment No. 2 to the Agreement. The Agreement term
is extended from September 30, 2021, through September 30, 2023.
B. Clarify the extension term for Amendment No. 3 to the Agreement. The Agreement term
is extended from September 30, 2022, through September 30, 2024.

RENEWAL OF MARICOPA COUNTY HOME CONSORTIUM 3 YEAR-
INTERGOVERNMENTAL AGREEMENT
Approve the automatic renewal of the Maricopa County HOME Consortium 3-Year
Intergovernmental Agreement (“Agreement”) with geographically contiguous municipalities
consisting of the cities and town of: Avondale, Chandler, Gilbert, Glendale, Peoria,
Scottsdale, Surprise, Tempe, and County of Maricopa (collectively, the “Consortium” or the
“Maricopa HOME Consortium” or the “Parties”; and individually, “Consortium Member” or
“Party”) for the U.S. Department of Housing and Urban Development (HUD) HOME
Investment Partnerships Programs (“HOME”).
The Agreement, fully executed on May 28, 2020, designates Maricopa County as the lead
agency for the Consortium, and to assume responsibility for ensuring that the Consortium’s
HOME Program is carried out in compliance with HUD rules, regulations, and requirements,
including requirements concerning a comprehensive housing affordability strategy. The
executed Agreement is attached for reference.
The Agreement requires renewal on a 3-year basis. Each of the above listed municipalities
has approved the automatic renewal of the Agreement, through their individual Councils.
Renewal of the Agreement provides full legal authority for the Consortium to continue to
undertake or assist in undertaking housing assistance activities for the HOME Program. The
Agreement term shall begin on July 1, 2023, through June 30, 2026, for Federal Fiscal Years
2024-2026.
Maricopa County Human Services Department oversees the HUD HOME Program and must
provide HUD with information that the Agreement automatic renewal has full approval of all
the Parties. The Department must also submit an opinion letter from the Maricopa County
Civil Services Division’s, Deputy County Attorney assigned to the Human Services
Department regarding the County’s compliance with the National Affordable Housing Act and
HUD rules, regulations, and requirements of the HOME Program, implementing the 3-Year
Consortium Agreement.
The Agreement is non-financial and will not impact the County General Funds. Supervisor

QUALIFIED HEALTH CENTERS (FQHC) FOR COVID RESPONSE AND RESILIENT
COMMUNITIES (CCR)
Approve Amendment 1 by and through the Maricopa County Department of Public Health
(MCDPH) and Valle De Sol, Inc. for Federally Qualified Health Centers (FQHC) for COVID
response and resilient communities (CCR) to further allow the Contractor to assist MCDPH
in our efforts to increase awareness in detection and prevention of COVID-19 for the
residents of Maricopa County.
I. The above-named contract is hereby amended as specified below:
A. Contract Expiration date shall be updated to December 31, 2023.
B. Term and Conditions shall be updated to include:

NEGOTIATED INDIRECT COST RATE AGREEMENT (NICRA) STAFF POSITIONS
Approve a Federal Memorandum of Agreement (MOA) between the CDC Foundation and
Maricopa County by and through its Department of Public Health (MCDPH), Division of
Epidemiology and Informatics for negotiated indirect cost rate agreement (NICRA) staff
positions. The term of the Agreement shall be July 01, 2023 through June 30, 2024, with a
not-to-exceed amount of $188,755.59.
The CDC Foundation will be responsible for providing the following direct positions: Federal
Budget Analyst, Federal Grants Manager, HR Generalist, Program Manager, Senior
Program Manager, Emergency Response Senior Portfolio Manager and Epidemiologist(s).
This Federal Memorandum of Agreement is the result of a Competition Impracticable
Procurement because MCDPH has not been successful in recruiting or hiring the stated
positions to full capacity since the beginning of the pandemic (either hiring as a county
employee or through traditional staff agency contracts). The CDC Foundation is the only
known and trusted organization to successfully recruit and hire approximately 2,500 public
health workers to bridge gaps in the public health workforce across the country.
The Competition Impracticable Procurement is in accordance with Maricopa County
Procurement Code MC-351 “Competition Impracticable” exceeding the $100,000 threshold.
The legal advertising requirement was met with an ad in the newspaper for two (2)
consecutive weeks beginning on May 04, 2023.

IGA WITH ARIZONA DEPARTMENT OF HEALTH SERVICES FOR IMMIGRANT
EMERGENCY CARE AND TESTING
Approve a new fixed price Intergovernmental Agreement (IGA), Contract No. CTR065586,
Immigrant Emergency Care and Testing (IECT) between Arizona Department of Health
Services (ADHS) and Maricopa County by and through its Department of Public Health
(MCDPH), Office of Preparedness Response (OPR). The purpose of this IGA is to leverage
partnerships between ADHS and the other various Arizona Counties to provide emergency
care, infectious disease(s) testing, expending access and quality of emergency health care
for immigrants.
OPR will work with ADHS to provide emergent health care for the immigrant, which provide
key insight on best practices for collecting quality data to analyze and identify sources of
infection and outbreaks, and to characterize the impact of disease, to target prevention
strategies, and to utilize related departmental community resources.
The budget period is December 1, 2022, through November 30, 2023, for a not-to-exceed
amount of $1,355,000.04. The IGA Term is December 1, 2022, through November 30, 2027.
This is year 1 of the 5-year IGA. There is no cash or in-kind match required nor should
ongoing cash contributions be necessary when it ends. The grant award is not a mandated
function but provides a benefit to the citizens through the investigation of infectious disease
cases and the performance of surveillance activities which will provide insight into best
practices in data collection and analysis. The grant award was not competitive.
The Department of Public Health’s Indirect Rate for FY23 is 17.24% Indirect costs are
estimated at $199,251.11 all of which is recoverable. Departmental indirect rates are
reestablished at the beginning of each fiscal year and the future indirect rates will be collected
at the corresponding rates.
Grant revenues are not local revenues for the purpose of the constitutional expenditure
limitation, and therefore expenditure of the revenues is not prohibited by the budget law. This
Amendment does not alter the budget constraining expenditures of local revenues duly
adopted by the Board pursuant to A.R.S. §42-17105. The overall grant budget will be
adjusted as necessary to accommodate this grant through a future reconciliation. Funding
for this Agreement is provided by a Grant from ADHS and will not affect the County’s general

Party may terminate this Agreement at any time prior to the expiration date by furnishing the
other Party with a thirty (30) day written notice.
The purpose of this Intergovernmental Agreement is to identify and define the Parties’
respective roles in the application of Town standards on development-related roadways in
County jurisdiction under certain circumstances. The need for this Agreement was identified
by a task force of the Department of Transportation manager, other County departments,
and private sector development interests to reduce regulation and streamline government
processes.
There are instances, where a development site is in the Town’s jurisdiction and adjacent
roadways to be constructed by the developer, are in the County’s jurisdiction, and the Town
is planning to annex the development area and its roadways. In such cases, it may be
reasonable to allow the roadways within the county jurisdiction to be designed and

STREETLIGHTS ON 51ST AVENUE FROM SAINT JOHNS ROAD TO KOMATKE LANE
AND 83RD, 87TH, AND 91ST AVENUES FROM BASELINE ROAD TO DOBBINS ROAD
Approve the Intergovernmental Agreement between Maricopa County and the Gila River
Indian Community for the installation of streetlights on 51st Avenue from Saint Johns Road
to Komatke Lane and 83rd, 87th, and 91st Avenues from Baseline road to Dobbins Road.
Under this Intergovernmental Agreement, the Gila River Indian Community will act as the
lead agency for all aspects of the design and installation of the street lighting.
Gila River Indian Community has proposed to install street lighting in the Community to
improve safety for pedestrian traffic. The proposed improvements will be installed within the
County right-of-way.
The terms of the agreement are in effect as of the Board of Supervisors’ approval and shall
remain in full force and effect until all stipulations have been satisfied, except that it may be
amended upon written agreement by all parties. Supervisory District No. 5

Blue Crowley, resident, came forward to speak on item 101. Mr. Crowley briefly talked
about one of the oldest communities in the state of Arizona, Komatke, and the public
transportation in that area.

of Supervisors designating Alana Lewicki as Superintendent of Streets.
2. Adopt a resolution designating Gant Yasanayake as Superintendent of Streets.
Alana Lewicki, who served as the Superintendent of Streets, is to be replaced by the
appointment of Gant Yasanayake. Gant Yasanayake has accepted the position of
Superintendent of Streets.
The Office of Superintendent of Streets is located within the County Department of
Transportation.

WATER DELIVERY DISTRICT IMPACT STATEMENT
1. Pursuant to A.R.S. § 48-261 and § 48-263, set a hearing date to receive the impact
statement for the proposed Woodland Terrace Irrigation Water Delivery District. The hearing
date is set for Wednesday, June 28, 2023, at 9:30 a.m., 205 W. Jefferson, Phoenix, AZ
85003.
2. Pursuant to A.R.S. § 48-261(C), approve a bond in the amount of $250 to be filed with
the Board by the persons proposing the district to cover cost incurred by the County.
The Clerk of the Board of Supervisors shall post a notice of the hearing in at least three
conspicuous public places in the area of the proposed district and shall publish a notice twice
in a daily newspaper at least ten days before the hearing. A notice of hearing will be sent to
each property owner within the proposed district boundaries.
At the hearing on June 28, 2023, the Board will hear those who appear for and against the
proposed district and shall determine whether the district will promote public health, comfort,
convenience, necessity, or welfare. If the Board of Supervisors determines that the public
health, comfort, convenience, necessity, or welfare will be promoted, it shall approve the
impact statement and authorize the persons proposing the district to circulate petitions within
the following proposed boundaries of the district:

Supervisors'/County Manager's summary of current events - Resumen de temas de

Supervisor Gates acknowledged that today was Flag Day and he appreciated that every
Board meeting starts with the Pledge of Allegiance. He said he attended a session last
week in Washington D.C., Issue One’s, Faces of Democracy, a campaign that gives
election workers from around the country an opportunity to come together and discuss
the challenges they face during elections. Supervisor Gates said he visited the
Department of Justice to discuss the importance of having protection for election
workers and election officials. He noted he met with several members from Congress
to talk about the importance of funding for elections across the Country. He also met
with members of the Arizona Congress including Senator Mark Kelly, Representative
Juan Ciscomani, and Representative David Schweikert. He thanked them for taking
time to discuss important issues.
Supervisor Galvin said he attended a ribbon cutting last Friday for a new Amazon
warehouse facility in Mesa that has 1.2 million square feet. He said the Mayor of Mesa,
John Giles, and Arizona House of Representatives, Neal Carter were present too.
Supervisor Galvin said the Amazon facility will add 1,300 jobs and contributes to the
economic development in District 2 which is appreciated. Supervisor Galvin
congratulated the City of Mesa for their 2023 All American City Award. It is a National
Civic League Award given each year to 10 municipalities or counties that are impacting
the lives of their residents. Supervisor Galvin said this year’s theme was “Creating,
Thriving Communities through Youth Engagement”. The 2023 award recognizes
communities that are working to improve the health and wellbeing of young people.
Supervisor Gallardo thanked Maricopa County departments for their help in planning
the Water Days program. He said the City of Phoenix has partnered with the County to
have the events throughout parks in District 5. Supervisor Gallardo said he was looking
for ideas to connect communities with services provided by the County and the City of
Phoenix. He wanted to connect families who are facing economic challenges with
services. In the Water Days Events, firefighters got involved with the communities by
providing water for the kids to cool down. He thanked all the partnerships who helped
provide services through these events. Supervisor Gallardo said these events had a
good turnout in the communities and he would like to see bigger crowds. Supervisor
Gallardo talked about being involved in the first Community Summer Program that
engaged kids during the summer in a positive way. He said 500 kids were enrolled in

the basketball and volleyball programs, keeping the kids engaged during the hot
summer days. He hopes to expand programs to engage the community during the
summer months.
Vice Chairman Sellers said he attended the Chandler Community Awards dinner where
the many leaders in Chandler were celebrated. He also attended an event by the
Chandler Chamber called Maricopa Matters. Vice Chairman Sellers said he was
honored to share the stage with Sheriff, Paul Penzone, County Attorney, Rachel
Mitchel, Recorder, Stephen Richer, and Assessor, Eddie Cook. He noted he was
pleased that his hometown got an overview of the different departments in the County.
Vice Chairman Sellers also attended a program put on by Arizona Department of
Transportation (ADOT) and the Maricopa Association of Governments (MAG) called
“Don’t Trash Arizona”. He said it is a reminder to the public of the damage and harm
that can be caused by unsecure loads on the roads. Vice Chairman Sellers said he
attended the Intel Community Advisory Panel meeting, where they presented their
Annual Economic Impact Statement. He said there is an $8.6 billion impact in Arizona.
He noted discussions were regarding the water issues and water recycling efforts. Vice
Chairman Sellers said at the end of 2022, Intel was net positive for water in Arizona
and received an Alliance for Stewardship Platinum Certification. Finally, he said Intel is
a great organization to have in the community and employs 12,000 people.
Chairman Hickman thanked Supervisor Galvin for his efforts in bringing awareness of
safety to the lakes. He said the Sheriff and Supervisor Galvin did a fantastic job
representing the County. He talked about the public not being prepared at the lakes,
which can cause tragedies like drownings. Chairman Hickman said he attended a
meeting in the West Valley with mayors and managers in the City of Buckeye, and part
of the discussion was the extension of Proposition 400. He said the discussion included
buses, light rail, roads, and highways. He thanked the mayors and their staff for bringing
the vision that our roads and transportation systems are an economic driver. He noted
the traffic issues that the County is currently facing will continue without federal funding
to assist the County with transportation needs.
Supervisor Gallardo acknowledged the celebration of Juneteenth across the County
and across the Country. He said it is a celebratory day and part of our history.
Chairman Hickman briefly noted the County’s multicultural community.

IGA WITH MARICOPA COUNTY
Approve and execute the Intergovernmental Agreement between the Flood Control District
of Maricopa County (DISTRICT) and Maricopa County (COUNTY), administered through its
Parks and Recreation Department (MCPRD) (IGA), to allow the DISTRICT unfettered access
to any Maricopa County Parks, upon proper notice to the administration of said park, for the
purpose of collecting seeds to be used to germinate native plant materials in tall pots, in
exchange for the DISTRICT providing native plant materials propagated in tall pots to
MCPRD on an as needed and as available basis.
The IGA shall become effective as of the date it has been executed by all parties. Term of
the IGA is five (5) years with three (3) additional five (5) year automatic renewals unless
either party provides notice not to renew. This Agenda Item impacts all Supervisory Districts.

FY 2023 BUDGET APPROPRIATION ADJUSTMENT FOR STADIUM DISTRICT
Approve appropriation adjustments increasing the FY 2023 Stadium District revenue and
expenditure authority for the (D680) Cactus League Operations Fund (F250) Operating
(OPER) budget by $2,500,000.
This action will adjust the Stadium District budget to reflect the receipt of Car Rental
Surcharge Revenues from the State of Arizona Treasurer in compliance with A.R.S. §48-
4234 Paragraph G directing the State Treasurer to remit to the District Treasurer the net Car
Rental Surcharge Revenues collected during the preceding month. The increase in
expenditure authority will allow for the disbursement of Car Rental Surcharge Revenues to
the Arizona Sports and Tourism Authority (Authority) in accordance with the Agreement
between the District and Authority dated October 22, 2003. The Office of Budget and Finance
will facilitate the monthly wire transfers.
District revenues are not local revenues for the purpose of the constitutional expenditure
limitation and therefore expenditures of these revenues are not subject to the constitutional
expenditure limitation. The approval of this action requested does not alter the budget
constraining the expenditure of local revenues duly adopted by the Board pursuant to A.R.S.
§42-17105.
